THIS INDENTURE, made tim ~',g~d~of December, 2007
BETWEEN
CDCLI HOUSING DEVELOPMENT FUND CORPORATION, a New York not for profit corporation with
offices located at 2100 Middle Country Road, Centereach, New York 11720, party of the first part, and
CHRISTOPHER YOUSIK and KELLEY YOUSIK, his wife, residing GL 1375 Fourth Street, New
Suffolk, New York 11956, party of the second part,
NOTE: This deed conveys property subject to Affordable Housing Restrictions of the Town of Southeld
and County of Suffolk as sat forth of record.
WITNESSETH, that the party of the first part, in consideration of Ten and 001100-($10.)-Dollara, and
other good and valuable consideration paid by the party of the second part, does hereby grant and
releasa unto the party of the sacond part, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at Mattituck, in the Town of
southold, County of Suffolk and State of New York, known as Lot 21 on a certain map entitled, 'Map of
Cottages at Mattituck", filed in the Office of the Clerk of the County of Suffolk on January 30, 2007 as
Map Nc. 11491, bounded and described as follows:
BEGINNING at a point on the northwesterly side of Cottage Way distant 340.30 feel southerly as
measured along the northwesterly side of Cottage Way from the corner formed by the intersection of
the northwesterly side of Cottage Way and the southerly side of Sound Avenue (North Road);
THENCE Southerly along the northwesterly side of Cottage Way along an arc of a curve beadng to the
right having a radius of 100.00 feet a distance of 26.40 feet to a point;
THENCE Still southerly along the northwesterly side of Cottage Way along an arc of a curve bearing to
the left having a radius of 150.00 feet a distance of 55.27 feet;
THENCE South 69 degrees 52 minutes 20 seconds West 160.63 feet;
THENCE North 19 degrees 08 minutes 00 seconds West 60.01 I~eet;
THENCE North 69 degrees 52 minutes 20 seconds East 214.38 feet to the point or place of
BEGINNING.
BEING AND INTENDED TO BE part of the premises conveyed to the party of the first part by deed
dated February 8, 2007, recorded March 5, 2007 in Liber 12494 page 982.
SUBJECT to Declaration of Covenants and Restrictions between CDCLI Housing Development Fund
Corporation and Town of Southold dated 11117106 and recorded on 11128/06 in Liber 12480 page 627.
SUBJECT to Declaration of Covenants and Restrictions required by Soulhold Town Planning Board
dated 12/08/06 recorded on 12/14106 in Liber 12483, Page 291.
SUBJECT lo conditions, covenants and other terms of deed from County of Suffolk to Town of Southold
dated February 8, 2007 and recorded March 3, 2007 in Liber 12494, Page 981.
EXCLUDING all dght, title and interest, if any, of the party of the first part in and to any streets and
roads abuffing the above described promises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premisas.
TO HAVE AND TO HOLD the promises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered In any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purposa or paying the cost of the improvement
and will apply the same first to the payment of the cost of the improvement before using any part of the
total of the same for any other purpose. The word 'party" shall be construed as if it read 'parties'
whenever the sansa of this indenture so requires.
