CDCLI HOUSING DEVELOPMENT FUND CORPORATION, a New York not for profit corporation with
offices located at 2100 Middle Country Road, Centeraach, New York 11720, party of the first part, and
BRIAN MCCLEERY and J.NME MCCLEERY, hie wife, residing at (no #) Meday Avenue, Mattituck,
New York 11952, party of the second part,
NOTE: This deed conveys property subject to Affordable Housing Restrictions of the Town of Southold
and County of Suffolk as set forth of record.
WITNESSETH, that the party of the first part, in consideration of Ten and 001100--($10.)--Dcllars, and
other good and valuable consideration paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at Mattituck, in the Town of
Southoid, County of Suffolk and State of New York, know as Lot 13 on a certain map entitled, "Map of
Cottages at Mattituok", filed in the Office of the Clerk of the County of Suffolk on January 30, 2007 as
Map No. 11491, bounded and described as follows:
BEGINNING at a point on the westerly side of Cottage Way distant 864.92 feet southerly as measured
along the westerly side of Cottage Way from the corner formed by the intersection of the westerly side
of Cottage Way and the southerly side of Sound Avenue (North Road);
THENCE Southerly along the westarty side of Cottage Way along an arc of a curve bearing to the left
having a radius of 100.00 feet a distance of 59.16 feet;
THENCE South 61 degrees 17 minutes 37 seconds West 137.56 feet;
THENCE North 20 degrees 19 minutes 00 seconds West 64.80 feet;
THENCE North 19 degrees 04 minutes 40 seconds West 12.82 feet;
THENCE North 70 degrees 28 minutes 04 seconds East 119.33 feet to the point or place of
BEGINNING.
BEING AND INTENDED TO BE part of the promises conveyed to the party of the first part by deed
dated February 8, 2007, recorded March 5, 2007 in Uber 12494 page 982.
SUBJECT to Declaration of Covenants and Restrictions between CDCLI Housing Development Fund
Corporation and Town of Southold dated 11117/06 and recorded on 11128/06 in Liber 12480 page 627.
SUBJECT to Declaration of covenants and Restrictions required by Southold Town Planning Board
dated 12/08106 recorded on 12/14/06 in Liber 12483, Page 291.
SUBJECT to conditions, covenants and other terms of deed from County of Suffolk to Town of Southold
dated February 8, 2007 and recorded March 3, 2007 in Liber 12494, Page 981.
EXCLUDING all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Uen Law, covenants that the party
of the first pad will receive the consideration for this conveyance and will hold the fight to receive such
consideration as a lrust fund to be applied first for the purpose of paying the cost of the improvement
and will apply the same first to the payment of the cost of the improvement before using any part of the
total of the same for any other purpose. The word 'party' shall be construed as if it road 'parties"
whenever the sense of this indenture so requires.
