WITNESSETH, that the pady of the first part, in consideration of Ten and 00/100--($10.)--Doilara, and
other good and valuable consideration paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at Mattltuck, in the Town of
Southold, County of Suffolk and State of New York, known aa Lot 12 on a cortain map entitled, "Map of
Cottages at Mattltuck", filed in the Office of the Clerk of the County of Suffolk on January 30, 2007 as
Map No. 11491, bounded and described as follows:
BEGINNING at a point on the southwesterly side of cottage Way distant 919.79 feet southerly as
measured along the southwesterly side of Cottage Way from the corner formed by the intersection of
the southwesterly side of cottage Way and the southerly side of Sound Avenue (North Road);
THENCE Southeasterly along the southwesterly side of Cottage Way along an arc of a curve bearing to
the left having a radius of 100.00 feet a distance of 53.75 feat;
THENCE Southeasterly still along the southwesterly side of Cottage Way along an arc of a curve
bearing to the right having a radius of 25.00 feat a distance of 13.63 feat;
THENCE South 51 degrees 50 minutes 56 seconds West 159.10 feet;
THENCE South 86 degrees 50 minutes 08 seconds West 36.30 feet;
THENCE North 20 degrees 19 minutes 00 seconds West 61.85 feet;
THENCE North 61 degrees 17 minutes 37 seconds East 137.56 feat to the point or place of

BEING AND INTENDED TO BE part of the premises conveyed to the party of the first part by deed
dated February 8, 2007, recorded March 5, 2007 in Liber 12494 page 982.
SUBJECT to Declaration of Covenants and Restrictions between CDCLI Housing Development Fund
Corporation and Town of Southoid dated 11/1710§ and recorded on 11128/06 in Liher 12480 page 627.
SUBJECT to Declaration of Covenants and Restrictions required by Southoid Town Planning Board
dated 12/08/06 recorded on 12/14/06 In Ubor 12483, Page 291.
SUBJECT to conditions, covenants and other terms of deed from County of Suffolk to Town of Southold
dated February 8, 2007 and recorded March 3, 2007 in Liber 12494, Page 981.
EXCLUDING all dght, title and interest, if any, of the party of the first part in and to any slreets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of Ihe second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the sa[el premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration ds a trust fund to be applied first for the purpose of paying the cost of the improvement
and will apply the same first to the payment of the cost of the improvement before using any part of the
total of the same for any other purpose. The word 'party" shall he construed as if it read 'parties'
whenever the sense of this indenture so requires.
