THIS INDENTURE, made the ~" dayof December, 2007
BETWEEN
CDCLI HOUSING DEVELOPMENT FUND CORPORATION, a New York not for profit corporation with
offices located at 2100 Middle Country Road, Centersach, New York 11720, party of the first part, and
BRADLEY S. MERILA end MARGARET S. MERII.A, his wife, residing at 1945 Main Road, Laurel,
New York 11948, party of the second part,
NOTE: This deed conveys property subject to Affordable Housing Restrictions of the Town of Southold
and County of Suffolk as set forth of record.
WITNESSETH, that the party of the first part, in consideration of Ten and 001100-($10.)--Doltsrs, and
other good and valuable consideration paid by the party of the second part, does hereby grant and
release unto the party of the second pad, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at Mattituck, in the Town of
Soulhold, County of Suffolk and State of New York, known as Lot 10 on a certain map entitled, "Map of
Cottages et Mattituck', filed in the Office of the Clerk of the county of Suffolk on January 30, 2007 as
Map No. 11491, bounded and described as follows:
BEGINNING at a point on the easterly side of cottage Way distant 1035.75 feet southerly as measured
along the easterly side of cottage Way from the comer formed by the intersection of the easterly side of
Cottage Way and the southerly side of Sound Avenue (Norlh Road);
THENCE North 70 degrees 41 minutes 34 seconds East 33.22 feet;
THENCE North 47 degrees 00 minutes 00 seconds East 112.30 feet;
THENCE North 43 degrees 00 minutes 00 seconds West 102.90 feet;
THENCE North 72 degrees 34 minutes 02 seconds East 152.45 feet to the westerly side of Factory
Avenue (Railroad Avenue);
THENCE South 17 degrees 21 minutes 10 seconds East along the westady side of Factory Avenue
(Railroad Avenue) 69.19 feet;
THENCE South 47 degrees O0 minutes 00 seconds West 212.06 feet;

THENCE Northerly along the easterly side of Cottage Way along an arc of a curve bearing to the left
having a radius of 50.00 feet a distance of 22.11 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE part of the premises conveyed to the party of the first part by deed
dated February 8, 2007, recorded Mamh 5, 2007 in Liber 12494 page 982.
SUBJECT to Declaration of Covenants and Restrictions between CDCLI Housing Development Fund
Corporation and Town of southold dated 11117~06 and recorded on 11128/06 in Liber 12480 page 627.
SUBJECT to Declaration of covenants and Restrictions required by southold Town Planning Board
dated 12/08106 recorded on 12114/06 in Uber 12483, Page 291.
SUBJECT to conditions, covenants and other terms of deed from County of Suffolk to Town of Southold
dated February 8, 2007 and recorded Mamh 3, 2007 in Liber 12494, Page 981.
EXCLUDING all righl, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants Ihat the party of the first part has not done or suffered anything
whereby the said premises heys been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement
and will apply the same first to the payment of the cost of the improvement before using any part of the
total of the same for any other purpose. The word "party" shall be construed as if it read 'parties"
whenever the sense of this indenture so requires.
