BOARD OF SOUTHOLD TOWN TRUSTEES
May 3, 1983
WORK SESSION
6:30 P.M. - The Board went over some of the responses received
from the Mattituck Creek survey.
REGULAR MEETING
7:30 P.M.
The regular meeting of the Board of Southold Town Trustees
was held on Tuesday, May 3, 1983 at the Town Hall, Main Road~
Southold, New York.
Present: President Paul Stoutenburgh
Vice-President Frank Kujawski

President Stoutenburgh called the meeting to order.
On motion made by Henry Smith seconded by Frank Kujawski and carried,
the minutes of the April 5; 1983 meeting were approved, with the
following correction:
On page 523, in resolution to approve the application of Virginia
Jones, the statement "Area immediately adjacent to float" be
amended to read "Privately owned area immediately adjacent to
float".
On motion made by Henry Smith seconded by John DiVello, and carried,
the mooring renewal permits for the month of June were approved.
On motion made by Henry Smith seconded by John Bednoski, and carried,
the date for the next Trustee meeting will be held on June 7, 1983,
at 7:30 P.M.
BENJAMIN KOWALCHUK
On motion made by Henry Smith seconded by John Bednoski it was
RESOLVED to approve the application of Benjamin Kowalchuck to
~onstruct a timber dock consisting of a 24'x4' fixed elevated cat-
walk a 12'x4' hinged ramp and a 16'x6' float secured by two posts,
in Richmond Creek, Peconic. Vote of Board: Ayes: Messrs. Smith,
Stoutenburgh, DiVello, Kujawski, Bednoski.

WETLAND APPLICATION ~133 - BENJAMIN KOWALCHUCK
On motion made by Henry Smith seconded by John Bednoski it was
RESOLVED to recommend to the Southold Town Board approval of
the Wetland Application #133 for Benjamin Kowalchuck, as per
application. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith,
Kujawski, DiVello, Bednoski
ROBERT WENDELL
On motion made by Frank Kujawski seconded by Henry Smith it was
RESOLVED to approve the application of Robert Wendell, to construct
120 lin. ft. of bulkhead, with two returns along the MHW line of
West Creek, Southold. Structure will be backfilled with 15c.y.
of sand obtained from an outside source. Vote of Board: Ayes:
Smith, Kujawski, DiVello, Bednoski- Opposed: Stoutenburgh
WETLAND APPLICATION #134 - ROBERT WENDELL
On motion made by Frank Kujawski seconded by Henry Smith it was
RESOLVED to recommend to the South01d Town Board approval of
the Wetland Application 4134 for Robert Wendell as per application.
Vote of Board: Ayes: Smith, Kujawski, DiVello, Bednoski. Opposed:
Stoutenburgh
WINDS WAY BUILDING CORP.
ON motion made by John Bednoski seconded by Henry Smith it was
RESOLVED to approve the application for the Winds Way Building
Corp., to construct a timber bulkhead 100' in length with a 20'
return along his property at Dawn Lagoon, Greenport. Vote of Board:
Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bedneski
WETLAND APPLICATION 4135 - WINDS WAY BUILDING CORP.
On motion made by John Bednoski seconded by Henry Smith it was
RESOLVED to recommend to the Southold Town Board approval of
the Wetland Application ~135 for Winds Way Building Corp., as per
application~ Vote of Board: Ayes: Stoutenburgh, Smith, Kujawski,
DiVello, Bednoski
JAMES BITSES
On motion made by Henry Smith seconded by Frank Kujawski it was
RESOLVED to approve the application for James Bitses to construct
a bulkhead, dock and to dredge in Corey Creek, Southold, with the
provision that a retaining wall is placed above the present MHW line
and that a catwalk goes across the meadow, and there is to be no
dredging. The trustees placed 5 pipes into the ground above the
wetlands to make sure there is no misunderstanding as to where the
retaining wall is to be placed. Vote of Board: Ayes: Stoutenburgh,
Smith, DiVello, Bednoski, Kujawski
WETLAND APPLICATION ~136 - JAMES BITSES
ON motion made by Henry Smith seconded by Frank Kujawski it was
RESOLVED to recommend to the Southold Town Board approval of the
Wetland Application ~136 for James Bitses to construct a bulkhead,
dock and to dredge in Corey Creek, Southold, with the provision that
a retaining wall is placed above the present MHW line and that the
catwalk goes across the meadow, and there is to be no dredging. ~

WETLAND APPLICATION ~137 - CHARLES ZAHRA & ALFRED GRASSKLAUS
On motion made by John DiVello seconded by ~enry Smith it was
RESOLVED to recommend to the Southold Town Board approval of the
Wetland Application ~137 for Charles Zahra & Alfred Grassklaus
to construct a retaining wall on the East Side of Eugene's Road,
Cutchogue, with the provision that the Town Engineer makes an
inspection and approves the installation as adequate with respect
to the size of the pipes going under the roadway. Vote of Board:
Ayes: Messrs. Stoutenburgh, Smith, Kujawski, DiVelto, Bednoski
MARK GORDON
On motion made by Henry Smith, seconded by John Bednoski it was
RESOLVED to table the application of Mark Gordon to place a mooring
in Richmond Creek, Southold, until the creek is dredged, which
should be done by early spring or this summer, after that time,
the trustees will see if there is room at the end of Harbor Lan~
where Mr. Gordon wishes to place his boat. Vote of Board: Ayes:
Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski. -
ANTHONY CENSOPLANO
On motion made by John DiVello seconded by Henry Smith it was
RESOLVED to table the application of Anthony Censoplano to place
a mooring in Howards Creek, Mattituck, until Trustee John DiVello
speaks to Mr. Censoplano in reference to his application. Vote of
Board: Ayes: Messrs. Stoutenburgh, Smith, DiVello, Bednoski, Kujawski
ROGER K. SIEJKA
On motion made by Frank Kujawski seconded by John Bednoski it was
RESOLVED to approve the application of Roger K. Siejka to place
an offshore mooring in the Mattituck Inlet, Mattituck, with the
provision that both bow and stern moorings are used and that he
stays with his previous location, and that the boat does not swing
out into the channel or impede navigation. Vote of Board: Ayes:
Messrs. Stoutenburgh, Smith, Kujawski, DiVello, Bednoski
HENRY P. SMITH
On motion made by John Bednoski seconded by John DiVello it was
RESOLVED to approve the application of Henry P. Smith, to amend his
previous permit for a dock, in Corey Creek,. Southold, by deleting
a portion of dock 8'x4' and adding 20'x8' of new dock, off to the side.
Vote of Board: Ayes: Messrs. Stoutenburgh, Kujawski, DiVello,
Bednoski Abstained: Smith
EDWARD R. YANKE
On motion made by John Bednoski seconded by Henry Smith it was
RESOLVED to approve the application of Edward R. Yanke to construct
a 24'x4' floating dock and a 36'x3' catwalk in Corey Creek, Southold.
Vote of Board: Ayes: Messrs. Smith, Stoutenburgh, Kujawski,
DiVello, Bednoski
WETLAND APPLICATION ~138 - EDWARD R. YANKE
ON motion made by John Bednoski seconded by Henry Smith i~ was
RESOLVED to recommend to the Southold Town Board approval of the
Wetland Application for Edward R. Yanke as per application. Vote of
Board: Ayes: Messrs. Stoutenburgh, Smith, DiVello, Bednoski, Kujawski

DONALD PASSUDETTI
On motion made by Frank Kujawski seconded by John Bednoski it was
RESOLVED to table the application of Donald Passudetti to place
an offshore mooring in Gull Pond, Greenport, until the moorings
in Gull Pond are reviewed by the Trustees, to see what sites
are available. Vote of Board: Ayes: Messrs: Stoutenburgh,
Smith, DiVello, Bednoski, Kujawski
JOHN A. TANTILLO
On motion made by John Bednoski seconded by Henry Smith it was
RESOLVED to approve the application of John A. Tantillo to dredge
washed in fill from privately owned property in Broadwaters Cove,
Cutchogue, with the provision that the private dredging will not
intefear with any of the wetlands. Vote of'Board: Ayes: Messrs.
Stoutenburgh, Smith, DiVello, Bednoski, Kujawski
ROGER STOUTENBURGH
On motion made by Henry Smith seconded by John Bednoski it was
RESOLVED to approve the application of Roger Stoutenburgh to
construct a 75'x3' catwalk over the marsh and a 25'x3' dock off
the north end of Mudd Creek, Cutchogue. Vote of Board: Ayes:
Smith, Kujawski, DiVello, Bednoski Abstained: Stoutenburgh
WETLAND APPLICATION ~139 - ROGER STOUTENBURGH
On motion made by Henry Smith seconded by John Bednoski it was
RESOLVED to recommend to the Southold Town Board approval of the
Wetland Application for Roger Stoutenburgh as per application.
Vote of Board: Ayes: Messrs. Smith, DiVello, Bednoski, Kujawski
Abstained: Stoutenburgh
GDSTAVE J. WADE
The Trustees reviewed the application of Gustave J. Wade to obtain
an easement at the end of East Road, Cutchogue. President Paul
Stoutenburgh reported that the Trustees are waiting for the
Town Board to act upon this application, being there are many
complicated legal problems to be worked out.
DOROTHY NORTHRIDGE
On motion made by Frank Kujawski seconded by Henry Smith it was
RESOLVED to approve the application of Dorothy Northridge to
secure a permit number for a 40'x5' retaining wall in Mattituck
Creek, under the Grandfather Clause. Vote of Board: Ayes: Messrs.
Stoutenburgh, Smith, DiVelto, Bednoski, Kujawski
DANIEL ARGENTIERI
On motion made by Frank Kujawski seconded by Henry Smith it was
RESOLVED to approve the application of Daniel Arqentieri to secure
a permit number for a 61'x3' 6" floating dock, a 12i 4'2" dock
a 9'6"x6' float a 6'x11'6" float and a 12'x5' float in the Howards
Branch of the Mattituck Creek, under the Grandfather Clause.

ALBERT ROUNTREE
On motion made by Frank Kujawski seconded by Henry Smith it was
RESOLVED to approve the application of Albert Rountree to secure
a permit number for a 40'x5' dock a 12'x3' walk and a 40'x5' float
in the Howards Branch of the Mattituck Creek, Mattituck under the
Grandfather Clause. Vote of Board: Ayes: Messrs. Stoutenburgh,
Smith, Kujawski, DiVello, Bednoski
EDNA ROBB
On motion made by Frank Kujawski seconded by Henry Smith it was
RESOLVED to approve the application of Edna Robb to secure a permit
number for a 4'6"x3' ramp a 4'x15' ramp and a 18'6"x5' dock in
East Creek, Cutchogue under the Grandfather Clause. Vote of Board:

HELEN REITER
On motion made by Frank Kujawski seconded by Henry Smith it was
RESOLVED to approve the application of Costello Marine, Inc. for---
Helen Reiter to secure a permit number for a 4'x30' dock a 2'6"x14'
ramp and a 6'x40' float in Budd's Pond, Southold under the Grand-
father Clause. Vote of Board: Ayes: Messrs. Stoutenburgh, Smith,
DiVello, Bednoski, Kujawski
PHIL MARCO
On motion made by Henry Smith seconded by John Bednoski it was
RESOLVED to approve the amending of permit number 1578, issued to
Phil Marco, to add two additional spiles to his floating dock, in

JOHN J. FARRELL
On motion made by Henry Smith seconded by John Bednoski it was
RESOLVED to approve the application of John J. Farrell to place
a 8'x12' float a 4'x6' ramp, and a 4~'x15' dock in Goose Creek,
Southold, with the provision that 2 additional spiles are used to
secure the floating dock for safety. Vote of Board: Ayes: Messrs.
Stoutenburgh, Smith, Kujawski, DiVello, Bednoski
WETLAND APPLICATION ~130 - JOHN J. FARRELL
On motion made by Henry Smith seconded by John Bednoski it was
RESOLVED to recommend to the Southold Town Board approval of the
Wetland Application 9130 for John J. Farrell with the provision
that 2 additional spites are used to secure the floating dock for
safety. Vote of Board. Ayes: Messrs. Stoutenburth, Smith, Kujawski,
DiVello, Bednoski
HAROLD J. HANNAFIN
On motion made by Frank Kujawski seconded by John Bednoski it was
RESOLVED to approve the application of Harold J. Hannafin to place
an offshore mooring in MattitUck Creek, Mattituck with the provision
that the boat is placed between Westphalia and the Park District, on
the South side, and that the boat does not impede navigation or
swing out into the channel. Vote of Board: Ayes: Messrs. Smith,
Stoutenburgh, Kujawski, DiVello, Bednoski

NICHOLAS FONTANA
On motion made by Frank Kujawski seconded by Henry Smith it was
RESOLVED to approve the request for an extention of one year on
permit number 1532, for Nicholas Fontana, the permit is valid
from May 1, 1983 until May 1, 1984. Vote of Board: Ayes: Messrs.
Stoutenburgh, Smith, Kujawski, DiVello, Bednoski
ANNETTE GOLDEN & NICHOLAS CARNES
In reference to the letter dated April 12, 1983 from Mr. Roy Haje,
requesting a determination as to the need for a Trustee permit for
the installation of a rip-rap revetment above the line of MHW, at
635 Bay Shore Road, Greenport, Trustees Smith and Stoutenburgh
visited the site and it was determined that the site is in State
waters and, therefore, does not come under the Trustee jurisdiction.
A letter will be sent ot the Town Board requesting permission to
seek applications for an assistant to Lori Brooks, seeing that
she may not be availab~ after this summer. The Trustees will
also request to start on this year's survey and inventory process
of the local creeks.
Tom Czlatka, our Bay Constable, read the Trustees a letter from
Mr. John Holzapfel, a teacher, in the Shoreham-Wading River High
School in reference to Eel Grass and scallops. A student in the
school has done some research with artificial eel grass and the
attachment of scallops to this artificial substrates.
Tom also requested that the Trustees support his. request for the
hiring of one full-time assistant. The Trustees were in agreement,
to support his efforts. A letter will be sent to the Town Board.
A letter is to be sent to the Town Board in request to purchase
a sign and bouys for the Mattituck Inlet.
On motion ma'de by Frank Kujawski seconded by Henry Smith and
carried, the'meeting was adjourned at 10:00 P.M., there being
no further business to come before the Board.
