ALL that certain plot, piece or pamel of land, with the buildings and improvements thereon erected, situate, lying and being at Nassau Point in the Town of Southoid in the County of Suffolk and State of New York, being more particularly bounded and described as follows: COMMENCING at a point formed by the intersection of the center line of "Old Cove Road" and the ordinary high water line of Cutchogue Harbor, and from said point or place of beginning; RUNNING THENCE northerly along the mean high water line of Cutchegue Harbor along a fie line course of North 06' 39' 10' East, 173.17 feet to land n/off of Charlotte B. Finney; THENCE North 69* 39' 50" East along said land n/off of Charlotte B. Finney. a distance of 482.72 feet to the center line of 'Old Cove Road" and a point; THENCE along the center line of "Old Cove Reed' the following two (2) courses and distances: 1) South 39° 16' 20" West. 249.71 feet to a point; and 2) South 65' 02' 40' West, 347.00 feet to the ordinary high water mark of Cutchogue Harbor, the point or place of BEGINNING. TOGETHER WITH an easement of ingress and egress over "Old Cove Reed' to the nearest public highway. BEING AND INTENDED TO BE the same premises as conveyed to the party of the first part by deed dated 1213/02 and recorded in the Suffolk County Clerk's Ofrme on 12/18/02 in Liber 12226 at Page 52. TOGETHER with all right, title and interest, if any, of the party of the first p~rt in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second parl, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, excepl as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideraUon as a trust fund to be applied first for the purpose of paying the cost o! the improvement and will apply the same first to the.payment of the cost of the improvement before using any part of the total of the same for an~/other purpose.
