THIS INDENTURE, made the l(~~'~ day of November, 2007, BETWEEN

the right of survivorship

WITNESSETH, that thc party ofthe first pm't, in consideration ofTEN (SI0.00) dollars,
lawful money of the United States paid by the party of the second pan, does hereby grant and release unto
the party of the second part, the heirs or successors and assigns of the party of the second part tbrever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in the

BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by deed
dated July 15, 1987 and recorded in the Office of the Clerk of the County of Suffolk on July 24, 1987
in tiber 10372 at page 594.
THE GRANTORS HEREIN RESERVE A LEGAL LIFE ESTATE IN THE PREMISES for the term
of the Grantors' lives.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roms abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights ofthe party of the first part in and to said
)remises.
FO HAVE AND TO HOLD the premises herein granted unto the party of the second pm't, thc heirs or
successors and assigns of the pmty of the second part forever.
AND the party of the first part covenants that thc party of the first part has not done or suffered anything
whereby the said premises have bccn incumbered in any way whatever, except as aforesaid.
AND THE party ofthe first part, in compliance with Section 13 ofthe Lien Law, covenants that the pmly
of the first part will receive thc consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose o£paying the cost of the improvement, and
will apply the same first to the payment ofthe cost of the mprovement before using any part of thc total of

ALL THAT CERTAIN PLOT, piece or parcel of land, with thc buildings and improvcments thereon
creeled, situate, lying and being at East Cmchogue, Town of Southold, County of Suffolk and Slate of New
York, known and designated as and by thc lot no. 40 on a certain map entitled, "Map of Moosc Cove at
Fast Cutchoguc, Town of Southold, County of Suffolk and Slate of New York, prepared by Otto W. Van
Tuyl and Sons, from surveys completed Sunc 14, 1960 and filed in thc Office of the Clerk of the County of
Suffolk on August 30, 1960 as Map No. 3230 which said map is bounded and described es follows.
BEGINNING at a monument on the wastcrly side of Little Neck Road, distant 227.22 feet south of
the comer formed by the intersection ofthe westerly side of Little Neck Road and the southerly side of
Moose Trail, said point of beginnin8 also being the division line between lot 40 and 39 as shown on said
aforementioned map;
RUNNING THENCE along the svestcrly side of Little Neck Road South 12 degrees, 35 minutes, 00
seconds East 113.50 feel to a monument and thc division linc between lot 40 and 41;
RUNNING THENCE along said division line, South 78 degrees 24 minutes, 40 seconds West
177.00 feet to a monument and the division line between lot 40 and 42;
RUNNING THENCE along said division line North 12 degwes 35 minutes 00 seconds West 113.50
feet to a monument and the division line between Lot 40 and 39;
RUNNING THENCE along said division line North 78 deg~es, 24 minutes, 40 seconds East
177.00 feel~ to a monument on the westerly side of Little Neck Road and thc point or place of BEGINNING.
