DECLARATION OF COVENANTS AND RESTRICTIONS
DECLARATION made this ~o~'~- day of July, by ALBIN
PIETPd~WICZ, residing at Cox Lane, Cutchogue, New York,
hereinafter referred to as the "Declarant";
W~EREAS, 'the Declarant is the owner in fee simple
of a certain parcel of land situate at Cutchogue, Town· of
Southold, County of Suffolk and State of New York, being the
premises described in deed recorded in the Suffolk County
Clerk's office on December 26,' 1957 in Liber 4411 at page
319, a metes and bounds description of which is shown on
Schedule A attached hereto and made a part hereof,
hereinafter referred Ho as the "premises".
W~EREAS, the Declarant intends to subdivide said
premises into two lots for residential purposes and desires
to subject said premises to certain conditions, covenants
DISTRICT and restrictions.

NOW, THEREFORE, the Declarant does hereby declare

covenants and restrictions hereinafter set forth, and that

the acceptance of a deed thereto, covenants and agrees that

ARTICLE I: None of the lots in the aforesaid
subdivision shall be further subdivided without the approval
of the Planning Board of the Town of Southold.
ARTICLE II: All driveways on Middle Road shall
make an angle of at least 70° and preferably 90° with the
county road.
ARTICLE III: Each lot having frontage on Middle
Road shall have a turnaround provision, such as a T-shaped
shunt, so that a vehicle leaving a lot will not have to back
out into the traffic stream on the road.
ARTICLE IV: No driveway or entrance road on
Middle Road and Cox's Lane shall be located within fifty
(50) feet of the ends of the short radius curve connecting
the northerly side of the right-of-way of Middle Road with
the westerly side of the right-of-way of Cox's Lane.
ARTICLE V: All stormwater runoff resulting
from the development and improvement of this subdivision or
any of its lots shall be retained on the site by adequate
drainage structures so that it will not flow out onto the
right-of-way of Middle Road.
ARTICLE VI: The final map shall bear a note
that the subdivision is located adjacent to to the Town of
Southold Landfill site, and notice is hereby given to all
prospective purchasers of any of the lots of this
subdivision that the property is in fact located near the
Southold Town Landfill site. Notice of same is hereby given

situate, lying and being at Cutchogue, in the Town of
Southold, County of Suffolk and State of New York, bounded
and desoribed as follows:
BEGINNING at a point on the southerly end of a
curve which marks the intersection of the northerly side of
Middle Road (C.R. 48) with the westerly side of Cox's Lane~
and from said point or place of beginning,
RUNNING THENCE along the northerly side of Middle
Road (C.R. 48) the following two (2) courses and distances:
(1) Along the arc of a curve to the left having a
