The summary of it is in your papers and I will move on to the last page of it in my file, which shows appropriations for 2008 to be going from $34,549,000 to $36,223,000 which is a 4.85% increase. The taxes to support that would go up 6% in absolute terms and the tax rate would go up 4.99% in order to meet those needs. On the next page is revenues. Revenues would go from $8,843,000 to $9,5something, an increase of 7.5% and the appropriated fund balance would from $3.6 million to about $2.79 a reduction of about 9%. This is a brief review of the statistics, the individual budgets are all in the department by department showing. The previous actuals for 2006, the budget as amended for 2007. The Supervisor’s tentative budget for ’08 which is the budget the Supervisor prepared, presented to the Town Board and finally the preliminary budget which is the subject of this public hearing which is the budget that the Town Board took from what the Supervisor’s tentative. We have a few revisions and that is the budget that is in front of me today. I have a notice here that this has appeared as a legal notice in the local newspaper and what else do we have? TOWN COMPTROLLER CUSHMAN: Yes. SUPERVISOR RUSSELL: Okay. And the two stipends, can I, do I know which two from emergency management? TOWN COMPTROLLER CUSHMAN: You want names or do you want… SUPERVISOR RUSSELL: Positions are fine. TOWN COMPTROLLER CUSHMAN: One is a technical coordinator and the other one is a senior citizen site manager. SUPERVISOR RUSSELL: Okay, thank you. Councilman Wickham COUNCILMAN WICKHAM: While we are talking on this subject, could you outline to us, John, what we have done with stipends across the board? Comptroller Cushman TOWN COMPTROLLER CUSHMAN: I am going to do this from memory. As I recall, the Board decided that those that we could take out of the stipend category and include in the base salary, we have done that. Others, we don’t have that ability, for collective bargaining purposes we have left those as stipends. There had been no increases in those stipends for I think about three years now. As a matter of policy, the Board decided stipends don’t receive percentage increases on an annual basis and we have kept those flat. SUPERVISOR RUSSELL: Okay. COUNCILMAN WICKHAM: Thank you. SUPERVISOR RUSSELL: Do the Board members have anything to bring up? Councilman Edwards COUNCILMAN EDWARDS: I have something to bring up. I can give it in the form of a resolution, which I think is the ultimate definition of it or I can describe it. Why don’t I just read the resolution I drafted. And this addresses the salaries of elected officials, ‘Effective immediately, all elected officials of Southold Town shall receive an annual salary increase equal to the lesser of three (3 %) percent or the most recent trailing 12 month consumer price index for urban consumers, which is known as the CPI-U. This increase shall be effective every year as of January 1 and shall be reflected in the final version of the Town budget as adopted by the Town Board. This resolution shall not apply to the salary of any elected public official whose salary on the preliminary budget is proposed at a level, I should say a percentage level, higher than the lesser of three (3 %) percent or the aforementioned CPI-U percentage.’ The purpose of this is to take the politics out of the raises for elected officials which has led over the years to some very Page 18 November 7, 2007 Minutes Southold Town Board Board Meeting strange event where elected officials didn’t vote raises and all of a sudden they were trailing were they should be. It also affects, obviously, Trustees, the Highway Superintendent, the Town Clerk. Anybody who is elected. So I would propose that as a way of dealing with elected official salaries starting in 2008. Town Attorney Finnegan TOWN ATTORNEY FINNEGAN: The salaries that are set for 2008, I am not sure if those are the ones you are referring to but the Supervisor, the Town Board, the Town Clerk, the Highway Superintendent, can’t be higher than what has been advertised for the preliminary budget. So… COUNCILMAN EDWARDS: Which is no increase, right? TOWN ATTORNEY FINNEGAN: Correct. I believe so. So you can’t, unless you did a local law, which I believe you could do it one time by local law, you can’t… SUPERVISOR RUSSELL: How do you make adjustments to this budget? TOWN ATTORNEY FINNEGAN: You can’t make them for Supervisor, Town Board, Highway Superintendent or Town Clerk. SUPERVISOR RUSSELL: But for other items? TOWN ATTORNEY FINNEGAN: Yes. Councilman Wickham COUNCILMAN WICKHAM: I would like to address other Board members, apart from Bill who has been advocating something along these lines for sometime. If there is interest of other Board members in pursuing this, I would propose that we consider it for a year from now. But I would like to know if there is interest on the part of other Board members before taking it any further. Councilman Krupski COUNCILMAN KRUPSKI: I think there is interest and I think it was really awkward last year when the Town Board got a raise and then somehow the Supervisor got kind of shorted on that raise. It was kind of, awkward is the word, I think, to describe it and there should be a better way mechanically of addressing this and not having it come down to the last minute and everyone is kind of like… Supervisor Russell SUPERVISOR RUSSELL: I think actually Bill proposed a solution for that but just as a clarification, the Board didn’t short me. I had actually budgeted for no increase for myself. I think the Town Board is underpaid given the fact that these jobs are full-time, I don’t care what anybody says. And I budgeted them according to all the other increases I gave throughout Town Hall. I held back for myself because the predecessor to my position had raised the salary substantially. It was the Town Board that insisted that I shouldn’t be held back and what we agreed to was an actual dollar for dollar adjustment, so I got the same amount of dollar increase Page 19 November 7, 2007 Minutes Southold Town Board Board Meeting that the Town Board did. But it wasn’t the Town Board trying to short me in any way, they actually on the contrary tried to make sure that I had gotten a salary increase. I just didn’t want people to think that the Board was somehow playing games with me last year. They weren’t. They were trying to do the right thing. Councilman Edwards COUNCILMAN EDWARDS: No, I certainly remember that you said that, Scott. My concern was this, that for quite a few years before I was on the Town Board, Town Boards tended to take no increase, which I view as sort of a theatrical device which unfortunately over time leads to dramatic inequities. I think particularly with reference to the Supervisor’s position but I think it applies to all elected officials. And as you know, I know longer have a dog in this hunt, so I can speak freely; it is wrong for the Supervisor’s salary to be outranked by 25 or 30 other people in town government. We ask people who are elected to office to essentially take four years out of their life, presumably in the middle of their working career, to dedicate themselves to public service with a very real possibility as we certainly know now, that they will not be kept in office. And I think that elected officials salaries should reflect the increase in cost of living just like everybody else, that is why you and I disagreed but I understood your position, I think you understood mine. SUPERVISOR RUSSELL: Mmmhmm. COUNCILMAN EDWARDS: But I felt that you pay the position, you don’t pay the person and that is effectively do throughout town government except for these elected officials position. If we were in a situation of financial crisis where we weren’t collecting property taxes, you know, all sorts of terrible things were happening, then you would say, okay, we don’t give raises. We are not in that situation, and I think it is wrong that the elected officials and that includes the Town Board obviously as well as the Trustees and a whole lot of other people, shouldn’t get an increase because what it does is it creates a gap which simply gets bigger by next year. Because everything compounds. That is why I would have liked to have seen something happen this year and I would like to set this principal in place for future years so that it takes some of the politics out of something that the public is very sensitive to. SUPERVISOR RUSSELL: Generally I think, there is interest on Bill’s solution? Councilman Ross COUNCILMAN ROSS: Yeah. If you are looking for input, I would oppose a built in raise, everybody’s income does not rise with the CPI, I can appreciate Councilman Edwards position on it, I think he has given it thought but if the Board thinks salaries should go up every year; they should vote on it every year. If it is awkward, I was on this Board, we raised the Supervisor’s salary, we raised the Board’s salary. We raised salaries and I didn’t feel awkward about it and I don’t think you should feel awkward about it if that is what you feel is the right thing to do. So, I appreciate your position but I oppose a built in raise as such. Councilman Wickham COUNCILMAN WICKHAM: I think that this is not really a subject of this public hearing. This public hearing is to act or to take testimony and ultimately to take an action based on the Page 20 November 7, 2007 Minutes Southold Town Board Board Meeting preliminary budget. It is my understanding that we are not here to change the salaries of elected officials who are listed, whose salaries I read out at the beginning of the public hearing. If we are going to take it up, it seems to me that we ought to take it as a possible resolution or a policy at a subsequent regular meeting of the Town Board. Supervisor Russell SUPERVISOR RUSSELL: I appreciate that, Tom. I think Bill thought he could make a recommendation to this Board so that we can adjust the budget, since it is a budget hearing. And I appreciate, obviously to discuss it further, we should put it into a work session but I don’t think Bill understood that we couldn’t adjust the salaries and I appreciate his input. COUNCILMAN EDWARDS: I did not. SUPERVISOR RUSSELL: And we need something to talk about. Councilman Wickham COUNCILMAN WICKHAM: Well, I can give one other thing to talk about and that is this morning the Town Board, at its work session, took into account the loss of two resignations from our Planning Department staff. Accordingly, we agreed as a Board to add an additional $40,000 to the Planning Board’s consultant’s line or rather contractual’s line, so that they can go outside as needed to get support to cope with all of the applications before that Board. That, in addition to that, we have also reassigned nine months of salary for senior planner from their department into the contingencies budget of the 2008 budget. The first item that I mentioned, that additional $40,000 would raise the total appropriations and would bring the total cost of the 2008 budget such that the tax rate would rise just a little bit above 5 %. Tom Skabry, Pres CSEA TOM SKABRY: Tom Skabry, President of CSEA. With that thought, I heard rumblings about that idea… COUNCILMAN WICKHAM: What idea? MR. SKABRY: About the possibility of bringing consultants in to do planning work. I would just like the Town Board to keep in mind that there might be problems with the contractual requirements. Gunther Geiss GUNTHER GEISS: Gunther Geiss of Southold. I would just like clarification with regard to the public safety budget, there is a line for police equipment of $186,000. Is that just cars or does that include other than cars and how many cars have been budgeted? Supervisor Russell SUPERVISOR RUSSELL: The total of eight cars. Five are budgeted for next years money, for the next budget. However, with budget modifications for this year, tonight we will be passing a resolution that will secure the funds to buy three. So that is the three he got earlier this year, another three now plus six in the new year. That is the full compliment he was looking for. Because at present, you know, I was just going through this very quickly, but 14 out of 28 cars have over 100,000 miles on them and it is important for public safety and the safety of the officers that the cars be in the budget. I also noticed that in the capital budget, there was $5,000,000 for a police department, so I assume that that means that planning studies will begin next year on the question of what and where a new police facility and court facility would be built? Supervisor Russell SUPERVISOR RUSSELL: Well, we certainly have to do some scoping. I don’t know, speaking for myself, I don’t know if this is the climate where I want to build new in, we have just completed two capital projects. One is under way and one has been completed. I am not sure if the Town could afford much more new construction at this current time but obviously that is the one area of crisis because we are not even complying with state law regarding the holding areas, so. MR. GEISS: Right. Yeah. There is a real problem with the cells. Thank you. SUPERVISOR RUSSELL: Thank you. Anybody else want to comment? Councilman Ross COUNCILMAN ROSS: In between speakers I would just like to comment, I raised it during our informal sessions. The Department of Public Works has put in their budget funds for construction of a public bathroom on the recreation/athletic fields on Peconic Lane. I pointed out that there already is a public bathroom there. There is a street in between the fields and I guess there has been requests that there be a public bathroom on each side of Peconic Lane and that was the thinking and I don’t have a problem with that, I think it is a good idea, it is just that we have other athletic fields where there are no restrooms, no public bathrooms. Strawberry Fields being one and it would seem as though you would build a public bathroom, at least one on each field before you started putting two on any particular field. And I raised that, I am not going to vote against the preliminary budget on that basis but I think it should be taken into account and I would hope that Jim McMahon and the Department of Public Works would correct that next year or sooner if possible. Supervisor Russell SUPERVISOR RUSSELL: I am going to agree with Dan on that. There should be a distribution of our assets, as limited as they are. A better distribution. COUNCILMAN KRUPSKI: Does it specifically say the location of the public bathroom or can that be used, that money budgeted money, be used at Strawberry Fields? COUNCILMAN ROSS: I don’t think there was an indication where it was, in questioning and a little cross examination, we determined that during the sessions. On that note of Dan’s, I think that putting a new bathroom there is a great idea in Peconic because when we are on the west side of the road with a hockey games and the baseball games, you don’t want to be crossing over that road to go to the bathroom on the other side, so it is a good idea. But I also think that we should have one at Strawberry Fields at the same time. SUPERVISOR RUSSELL: We do. We need them in every location that Dan had mentioned actually. Purpose - It is the purpose and intent of the amendments to this Chapter to provide for the protection, the preservation and the proper use and maintenance of Town waters and lands under Town waters, to minimize damage thereto and to enhance their use for the propagation of shellfish and other beneficial marine organisms and thereby protect and promote the public health, safety and welfare of the Town of Southold. II. Chapter 219 of the Code of the Town of Southold is hereby amended as follows: ARTICLE I Catching of Shrimp [Adopted by 6-29-1933] General Provisions §219-1. Taking of shrimp by nonresidents prohibited. It shall be unlawful for any person not a resident of the Town of Southold to take shrimp from Page 37 November 7, 2007 Minutes Southold Town Board Board Meeting the waters of Brush's Creek, Willes Creek, Downs Creek, James Creek, West Creek, Richmond's Creek, Corey's Creek, Cedar Beach Creek, Goose Creek, Jockey Creek, Town Creek, Mill Creek, Long Creek, Budd's Pond, Dam Pond, Mattituck Creek, Goldsmith's Creek, Squash Creek, Wickham's Creek and Little Creek, or other creeks or inland waters within the bounds of said Township. §219-2 1. Residence requirements. Persons shall be deemed to be residents of the Town of Southold at any given date, within the meaning of this article Chapter, when they shall have actually and continuously resided within the said Town for a period of at least six (6) months sixty (60) days immediately preceding such date. §219-3 2. Effect. No provision of this article shall be deemed to prevent any person or persons residing within the Town of Southold from angling for fish for other than commercial purposes. §219-4. Penalties for offenses. Any violation of this article shall be subject to a penalty of not less than $5 nor more than $100 and costs. ARTICLE II Taking of Shellfish and Eels [Adopted by 6-23-1966] §219-5 3. Title. This article Chapter shall be known as the "Shellfish and Other Marine Resources Law of the Town of Southold." §219-7 4. Definitions. For the purposes of this article Chapter, the terms used herein are defined as follows: AQUACULTURE/MARICULTURE - The cultivation, planting, containment or harvesting of products that naturally are produced in the marine environment, including fish, shellfish, crustaceans and seaweed, and the installation of cribs, racks and in-water structures for cultivating such products, but excluding the construction of any building, any filling or dredging or the construction of any water regulating structures. BOAT/VESSEL - Any floating object capable of carrying people as a means of transportation in water, including without limitation an airplane capable of landing on water, any floating structure not otherwise considered to be part of a dock structure as defined herein, with or without means of propulsion, which object can be moored independently or can be secured by any means to a piling, dock, bulkhead, groin or other fixed device located above mean high water. Floating docks are excluded from this definition. Page 38 November 7, 2007 Minutes Southold Town Board Board Meeting CHANNEL SYSTEM - The bed of a natural waterway with well-defined banks presenting the evidence of the flow of tidal waters, which is commonly traversed by boat/vessel and is designated by channel markers, including man-made or stabilized waterways designed for the navigation of boats/vessels. For the purpose of this Chapter, boat basins and bathing areas are included within this definition. CHURNING - The removal of shellfish from lands below average low water by utilizing a propwash from a skip-mounted outboard motor. COMMERCIAL PURPOSES - Any use or purpose other than for food consumption by the persons taking the shellfish or by members of such person's household. Taking, containment or harvesting of shellfish or other marine resources to sell to a third party. CONTAINMENT - The placement and possession of shellfish in a basket, tub, bag, or any other type of container. CULLING - Separating shellfish or other marine resources according to size. EEL - The American eel. FIXED GEAR - Fishing equipment that is set in a stationary position, including without limitation pots, moorings, long line, hand line, weir nets, gillnets and traps. GUEST - A person who temporarily occupies living quarters in a dwelling maintained by a permanent resident. MARINE RESOURCES - Blue claw crabs, horseshoe crabs, eels and mussels. NON-RESIDENT - One who does not reside in the Town of Southold. PATENT LANDS - All uplands and underwater lands owned in fee title by the Town of Southold Board of Trustees by virtue of the Andros Patent. PERMANENT RESIDENT - A person who has maintained a permanent dwelling within the Town of Southold during the period of not less than 60 days immediately preceding the date of his application for a permit hereunder, or the date of taking shellfish if no permit is required. SCAP NET - A hand-operated net attached to a handle with an opening across the mouth of no more than 14 inches. SHELLFISH - Clams, scallops, oysters, blue claw crabs, mussels, periwinkles and , conchs, channeled whelk and knobbed whelk. TAKING - The removal or harvesting of shellfish and other marine resources by any means. TEMPORARY RESIDENT - A person who has occupied living quarters within the Town of Southold during the period of not less than seven days immediately preceding the date of his application for a permit hereunder. TOWN WATERS - All waters and lands under tidewater in any harbor, bay or creek, title to which and the right of fishing in which is vested in the Town of Southold and/or in the Board of Trustees of the Town of Southold. TOWN WATERS - All the waters lying over Patent Lands. ARTICLE II Shellfish §219-8 6. Permit requirements. A. Shellfish may be taken from Town waters for commercial purposes by a permanent resident over the age of 14 years upon first obtaining a commercial shellfish permit therefor from the Town Clerk of the Town of Southold. (1) Persons Aages 12 and 13 can apply for a junior commercial shellfish license which will allow them to catch half the commercial limit. The junior commercial shellfish license and will be at half the cost of a commercial license. The parents or guardian of the applicant for a junior commercial shellfish license must sign for the holder of the junior license, making the parent or guardian responsible for any violation incurred. B. Shellfish may be taken from Town waters by a non- temporary resident upon first obtaining a non- temporary resident shellfish permit therefor from the Town Clerk of the Town of Southold. C. Shellfish may be taken from Town waters for noncommercial purposes by a permanent resident or taxpayer upon first obtaining a permanent resident or taxpayer's permit therefor from the Town Clerk of the Town of Southold. Such a permit shall be required for all persons ages 10 and older. Persons under the age of 10 may take shellfish only when accompanied by a valid permit-holder, and any shellfish taken by such child shall count toward the maximum daily quantity allowed in this Chapter for such permit-holder. D. Shellfish may be taken from Town waters for noncommercial purposes without obtaining a permit therefor by a guest when accompanied by a permanent resident in whose dwelling such guest occupies living quarters, provided that such permanent resident is the holder of a valid shellfish permit. Notwithstanding any other provisions of this article Chapter, the quantity of shellfish taken by a guest or guests shall be added to the quantity taken by the permanent resident accompanying the guest or guests, and the total amount thereof shall not exceed, in the aggregate, the maximum daily quantity prescribed in this article Chapter for Page 40 November 7, 2007 Minutes Southold Town Board Board Meeting such permanent resident. E. No person not a permanent resident, a taxpayer, a temporary resident or a guest accompanied by a permanent resident shall take shellfish in any manner at any time from Town waters without a permit issued pursuant to this Chapter. F. The possession of shellfish in excess of the limits, or of less size than that, set forth in this Chapter, found aboard any boat or vessel in the waters of the Town of Southold, shall be deemed presumptive evidence of a violation of this article. G. Shellfish may be taken from Town waters for noncommercial purposes by a permanent resident under the age of 14 years without obtaining a permit therefor. [Added 7-7-1982 by L.L. No. 5-1982] §219-9 7. Permit fee; expiration; display. A. The fee for a commercial shellfish permit shall be set from time to time by resolution of the Town Board, upon recommendation by the Board of Trustees. $20. Effective on and after January 1, 1991, the fee for a commercial shellfish permit shall be $35. Such permit shall expire on December 31 of the year of its issuance. B. The fee for a non- temporary resident shellfish permit shall be set from time to time by resolution of the Town Board, upon recommendation by the Board of Trustees. $10. Such permit shall be issued only for the period of time that such temporary resident occupies living quarters within the Town of Southold. The non-resident permit shall expire on September 15 of the year of its issuance. C. The fee for a non-commercial permanent resident or taxpayer shellfish permit shall be $3. Effective on and after January 1, 1991, the fee for such permit shall be $5. Such permit shall expire on December 31 of the year of issuance. There shall be no fee for a permanent resident who has attained the age of 62 years. D. The holder of a shellfish permit shall carry the permit assigned to him them on his their person while engaged in the permitted activities, and the failure of such holders to exhibit his their permit to an enforcement officer shall be presumptive evidence that no valid permit has been issued to them him. §219-10 8. Scallops. A. The Trustees of the Town of Southold may establish, by resolution, the dates of the commercial and noncommercial scallop season based on the environmental and economic conditions in effect each year. [Amended 9-6-1994 by L.L. No. 19- 1994] Scallop season for residents and non-residents shall be set pursuant to New York State, as adopted by Board of Trustee resolution. B. Subject to the provisions of this section, during the first two weeks of Scallop Page 41 November 7, 2007 Minutes Southold Town Board Board Meeting season, harvesting in Town Waters shall be by hand or with a scalp net only. During the first two weeks of Scallop season, harvesting in Town Waters shall be open to all permit holders, for the noncommercial limits set forth herein. During the noncommercial scallop season, not more than 1/2 bushel of scallops may be taken from Town waters in any one day by hand or with a scalp net. [Amended 7- 7-1982 by L.L. Except as set forth above, dDuring the commercial scallop season, scallops may be taken from Town waters with a dredge or scrape having an opening at the mouth of not more than 36 inches in width when towed by a boat operated by mechanical power or other means, provided that such dredge or scrape is brought aboard the boat by hand power without the use of a mechanical device.] D. Subject to the provisions of this section, a permanent resident, a taxpayer, a temporary non-resident or a guest, when accompanied by a permanent resident, may take from Town waters not more than 1/2 bushel of scallops for noncommercial purposes in any one day by any one (1) person. Two (2) or more persons occupying the same boat may take, in the aggregate, not more than two (2) bushels of scallops in one (1) day for noncommercial purposes. for other than commercial purposes. Scallops shall not be taken from Town waters during the period from sunset to sunrise. G. Scallops shall not be taken from Town waters on Sundays except by hand or with a scalp net by uses of dredge or other power device. H. Only scallops measuring more than 2 1/4 inches from the middle of the hinge to the middle of the bill may be taken from Town waters except as provided below. Amended 1-21-1997 by L.L. No. 2-1997] H. I. Scallops measuring less than 2 1/4 inches with an annual growth line having an annual growth line and measuring not less than 2 ¼” from the middle of the hinge to the middle of the bill may be taken from Town waters only by resolution of the Southold Town Board of Trustees. §219-11 9. Clams. A. Hard clams less than one inch in thickness shall not be contained taken from Town waters and shall be subject to the requirements set forth in Section 219- 14A. B. Soft or steamer clams less than two inches in the longest diameter shall not be contained taken from Town waters and shall be subject to the requirements set forth in Section 219-14A. C. Churning by power may not be employed in the taking of soft clams on land below the high-tide line in Town waters. Page 42 November 7, 2007 Minutes Southold Town Board Board Meeting D. A permanent resident, a taxpayer, a temporary non-resident or a guest accompanied by a permanent resident may take contain not more than 100 hard clams and 100 soft clams from Town waters in one day for noncommercial purposes. E. Not more than 2,000 hard clams may be taken from Town waters for commercial purposes in any one day by any one person. Two or more persons occupying the same boat may take, in aggregate, not more than 4,000 hard clams in one day for commercial purposes. §219-12 10. Oysters. A. Oysters shall not be taken from Town waters during the period from May 1 to August 31 in each year, both dates inclusive, and shall be subject to the requirements of Section 219-14A. B. Oysters shall not be taken from Town waters during the period from sunset to sunrise. C. Only oysters measuring more than three inches from the hinge to the bill may be taken from Town waters, and shall be subject to the requirements of Section 219- 14A. D. A permanent resident, a taxpayer, a non-resident or a guest accompanied by a permanent resident may take not more than one-half (1/2) bushel of oysters from Town Waters for noncommercial purposes in any one (1) day by any one (1) person. Two (2) or more persons occupying the same boat may take, in the aggregate, not more than one (1) bushel of oysters from Town Waters in one (1) day for noncommercial purposes. The Trustees of the Town of Southold may establish, by resolution, the limits on the number of oysters which may be harvested for commercial purposes and noncommercial purposes. A permanent resident, a taxpayer, a temporary resident or guest accompanied by a resident may harvest oysters for noncommercial purposes in the quantities set by resolution of the Trustees. No. 1- 1997] Editor's Note: Former Subsection E, amended 7-31-1973, which immediately followed this subsection and dealt with the amount of oysters allowed to be taken from Town waters for commercial purposes, was repealed 1- 21-1997 by L.L. No. 1-1997. E. Not more than two thousand (2,000) oysters may be contained or taken from Town Waters for commercial purposes in any one (1) day by any one (1) person. Two (2) or more persons occupying the same boat may take, in aggregate, not more than four thousand (4,000) oysters in one (1) day from Town Waters for commercial purposes. ARTICLE III Other Marine Resources §219-113. Blue claw crabs. A. Blue claw crabs must be harvested according to New York State Department of Environmental Conservation regulations. Blue claw crabs measuring less than Page 43 November 7, 2007 Minutes Southold Town Board Board Meeting five inches from point to point of the upper shell shall not be taken from the waters of the Town of Southold. B. A permanent resident, a taxpayer, a temporary resident or a guest accompanied by a permanent resident may not take more than 1/2 bushel of blue claw crabs from Town waters in any one day for noncommercial purposes. [Amended 7-7-1982 by L.L. No. 5-1982] C. Female blue claw crabs shall not be taken from the waters of the Town of Southold. [Amended 7-14-1987 by L.L. No. 12-1987] D. Crab pots. No individual may set more than one crab pot, and each crab pot and buoy shall have affixed thereto the individual's shellfish permit number. [Added 7-14-1987 by L.L. No. 12-1987] §219-12 4. Mussels. A. A permanent resident, a taxpayer, a temporary non-resident or a guest accompanied by a permanent resident may not take contain more than one bushel of mussels from Town waters in one day for noncommercial purposes. Two (2) or more persons occupying the same boat may contain, in aggregate, not more than two bushels of mussels from Town Waters in one (1) day for noncommercial purposes. B. Not more than 10 bushels of mussels may be taken from Town waters for commercial purposes in one day by any one person. Two or more persons occupying the same boat may take contain, in the aggregate, not more than 20 bushels of mussels in one day for commercial purposes. C. Ribbed mussels shall be contained by handpicking only. Raking for mussels in peat bog areas shall be prohibited. D. The containment of mussels is further regulated by New York State. §219-135. Eels. A. Commercial purposes. No more than 50 eel pots or traps per permitted in Town waters shall be permitted. All pots must be identified with the shellfish permit number. B. A permanent resident, taxpayer and temporary non-resident. No more than five eel pots in Town waters shall be permitted. All pots must be identified with the shellfish permit number. C. The containment of eels is further regulated by New York State. ARTICLE IV Operational §219-146. Culling shellfish and restoration of underwater lands. A. Shellfish shall be culled when taken. All shellfish taken which do not comply with the provisions of this article Chapter shall be immediately returned alive to the water in the immediate vicinity of where they were harvested. B. All lands under Town waters disturbed by the taking of shellfish shall be restored Page 44 November 7, 2007 Minutes Southold Town Board Board Meeting to their condition prior to the taking of such shellfish by the person taking such shellfish. §219-15. Fixed Gear A. Fixed gear shall be placed no closer than the outer edge of any channel system and the gear shall not impede navigation. §219-167. Restricted areas. Shellfish shall not be taken from any Town waters which have been restricted by the Town Board of Trustees, provided that such restricted areas shall have been properly designated by a resolution duly passed by said Board of Trustees and properly staked and notices posted by said Board of Trustees. In addition, shellfish shall not be taken from the following habitat sanctuary zone in Hallock Bay, North of the line formed by the following coordinates (excluding Little Bay): from a westerly point at Lat 41 degrees 8 minutes 17.22 seconds N, Long 72 degrees 16 minutes 40.68 seconds W, for a distance 5,190 feet, S 81 degrees 10 minutes 8 seconds E, to an easterly point at Lat 41 degrees 8 minutes 24 seconds N, Long 72 degrees 15 minutes 33.81 seconds W. Such sanctuary area, depicted on a mapped image, shall be made part of all permits issued pursuant to this Chapter. §219-17. Planting of Shellfish Seed. Notwithstanding any other provision of this Chapter, the Board of Trustees may approve an organization plan for planting shellfish seed in Town Waters and upon approval, the Board of Trustees may then authorize the approved organization and other volunteers acting under its supervision to plant shellfish seed in accordance with the approved plan. §219-18. Transplanting of shellfish. Notwithstanding any other provision of this article Chapter, the Town Board of Trustees may authorize the transplanting of shellfish in Town waters of any age or size, subject to its supervision, when it shall find that such shellfish are in danger of destruction as the result of predators, economic factors or other detrimental causes. §219-19. Dredges and scrapes. Except as permitted by § 219-810C of this article Chapter, the use of a dredge, scrape, ell eel dredge, hydraulic means or similar device towed by a boat operated by mechanical power or other means is prohibited in Town waters. Except as permitted by § 219-10C of this article, the use of a dredge, scrape, ell dredge or similar device towed by a boat operated by mechanical Page 45 November 7, 2007 Minutes Southold Town Board Board Meeting power or other means is prohibited in Town waters except by special permission of the Trustees for scientific study projects. §219-20. Vegetation removal prohibited. No person shall remove beach grasses or wetland vegetation of any kind, nor place spoil thereon, in any other area of the Town of Southold without prior written approval by the Board of Town Trustees of the Town of Southold. §219-21. Aquaculture/Maraculture Exemption. The Board of Trustees may grant an exemption or variance, in terms of permitted sizes, number and time periods of harvest, from the provisions of this Chapter for aquaculture/maraculture activities that are properly permitted by the New York Department of Environmental Conservation. §219-221. Penalties for offenses. A. Any person convicted of an offense against any provision of this article shall be deemed to have committed a violation against such article and also shall be liable for any such offense or penalty therefor. A.B. For every each offense against any provision of this article Chapter, the person committing the same shall be subject to a fine not to exceed $500 or imprisonment not exceeding 15 days, or both such fine and imprisonment. B.C. A second conviction for an offense against any of the provisions of this article within a period of one year shall result in immediate revocation of their permit. shall constitute and effect an immediate forfeiture of a permit issued to such person. No new permit shall be issued to such person for at least one year after such forfeiture. D. Any person committing an offense against this article shall be subject to a civil penalty enforceable and collectible by the Town for each such offense. Such penalty shall be collectible by and in the name of the Town. C.E. In addition to the above-provided penalties and punishment, the Town Board may also maintain commence an action or proceeding in the name of the Town in a court of competent jurisdiction to compel compliance with or to restrain by injunction the offense against this article Chapter. §219-23. Coordination and enforcement. The Director of Code Enforcement and/or the Bay Constable are responsible for coordination and enforcement of the provisions of this Chapter, and have the authority to issue violations of the provisions of this Chapter. SEVERABILITY If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. Purpose – In order to provide for the health, safety and welfare of the citizens of the Town of Southold, and to protect the natural protective areas existing within the Town, it is necessary to make certain amendments to Chapter 275. These amendments are intended to support the protection of environmental features within the Trustees’ jurisdiction, strengthen enforcement, simplify the permit process and clarify activities that may be conducted in protected areas. II. Chapter 275 of the Code of the Town of Southold is hereby amended as follows: §275-2. Definitions; word usage. ACCESS PATH -- an area, cleared by hand or hand-held equipment, no more than 4 feet wide, left in its natural state and devoid of any manmade structure, to provide a walkway to a body of water. DOCK -- Any permanent or seasonal structure, except a building, located or proposed to be located on lands abutting or comprised of freshwater or tidal wetlands or connected to a bulkhead or the upland and extending over the water's surface, designed to secure vessels and provide access from the shore to a body of water. For the purpose of this chapter, this term shall also include the associated structures necessary to cross wetlands and adjacent natural areas. The term “dock” includes the terms “wharves,” “piers,” “fixed docks,” “floating docks,” or “floats”. or “catwalks.” FUNCTIONAL – Any structure that, in its current state, primarily retains its purpose and use as determined by the Board of Trustees. NONDISTURBANCE BUFFER – An A vegetated area, typically 50 feet wide a minimum of 30 feet wide as designated by the Board of Trustees, immediately landward of the wetland boundary, shoreline structure, or other line designated by the Trustees where no operations, maintenance, placement of signs or other activities can may take Page 51 November 7, 2007 Minutes Southold Town Board Board Meeting place, except that manmade debris may be removed from such area by hand without the permission of the Board of Trustees. RESIDENTIAL DOCK -- Any catwalk, fixed dock and/or floating dock designed or constructed as a continuous unit to provide access to the surface waters from a lot that is zoned for residential use. The term "dock" shall include all associated structures such as ramps and mooring piles. §275-4. Exceptions. A. The provisions of this chapter shall not affect or prohibit nor require a permit for the following: (4) The ordinary and usual operations relative to residential horticulture within Trustees’ jurisdiction limited to the use of non-invasive native species of vegetation. Re-grading and removal of trees outside any designated buffer area are not included in this exception. landward of the wetland boundary. (5) The ordinary and usual maintenance or repair (of the same dimensions) of a presently permitted by this chapter, existing and functioning building, dock, pier, wharf, jetty, groin, dike, dam or other water-control device or structure. (10) Installation of new or replacement windows, roof shingles, doors, dormers and siding on existing structures only. (11) Notwithstanding the above listed exceptions, activity within a designated non- disturbance buffer is prohibited. B. Nothing contained in this section shall alter the jurisdiction of the Southold Town Board of Trustees. These listed exceptions do not provide an exemption from the requirements of other departments or agencies. §275-5. Permit procedures. B. Administrative permit. (2) The following operations will be considered for administrative review: (j) The reconstruction of a permitted bulkhead as per §275-11, which is to Page 52 November 7, 2007 Minutes Southold Town Board Board Meeting replace an existing functional bulkhead, subject to the following: [3] Any such activities shall require the addition of a nonturf pervious buffer area. not to exceed 20 feet wide as defined in §275-2. (l) Minor restoration or alterations of landscaping. (m) Decks. (n) Minor alterations to existing permitted shoreline structures including stairs, bulkheads and docks. (o) Installation or burial of a residential propane/liquid gas tank 25 feet from wetlands in an existing, established yard area when more appropriate upland placement is not possible. Installation, burial or removal of a propane tank less than 25 feet from wetlands is generally prohibited. (p) Dredging work caused by the accumulation of silt from run-off or other circumstances not the result of activity by or on behalf of the owner of the property and in event at the discretion of the Board of Trustees. §275-7. Fees. F. Dredging Fee. Every application for a permit for dredging within Town-owned underwater lands shall include a fee as set by the Town Board based on the amount of cubic yard of dredge spoil to be removed. §275-10. Contents of permit. L. A statement that “The permittee is required to conspicuously post the permit and have the supporting plans available for immediate inspection at the worksite at the commencement of work until which time the project is completed.” §275-11. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (4) Fences. In general, fences are prohibited from beaches and wetland areas. Any Page 53 November 7, 2007 Minutes Southold Town Board Board Meeting fence, barricade or impediment to pedestrian traffic on the beach or wetland area in violation of the provisions of this chapter shall be removed upon written notice to the owner of the premises upon which such fence, barricade or impediment is located sent by certified or registered mail. Such fence, barricade or impediment shall be removed by the owner within 30 days of the date of the notice. Upon failure to comply with such notice, the Building Inspector, Code Enforcement Officer or Bay Constable may remove or cause the removal of the illegal structure. If any fence, barricade or impediment is determined by the Building Inspector, Code Enforcement Officer or Bay Constable to create a hazard to the health, safety or welfare of the public, such structure may be removed and disposed of by the Town without prior notice to the owner. Upon removal by the Town, all costs and expenses incurred by the Town for the removal of such fence, barricade or impediment shall be the responsibility of the owner. The Town may pursue any and all remedies available at law to recover any unpaid costs associated with removal, including filing a statement with the Town Assessors, identifying the property in connection with which such expenses were incurred and the owner thereof as shown on the latest assessment roll of the Town. The Assessors, in preparation of the next assessment roll, shall assess such amount upon such property. Such amount shall be included in the levy against such property, shall constitute a lien and shall be collected and enforced in the same manner, by the same proceedings, at the same time and under the same penalty as is provided by law for the collection and enforcement of real property taxes in the Town of Southold. A fence may be permitted if the applicant has demonstrated a special need. Upon such a finding by the Trustees the fence must be split-rail, perpendicular to the waterline and not closer than 10 feet to MHW. Only one posted sign per 100 linear feet of fence is allowed, no larger than 12 inches by 12 inches square. (9) Pumping of Town-owned freshwater wetlands for irrigation purposes shall be prohibited. (10) Access paths. A permit for only one path shall be granted per lot for the purposes Page 54 November 7, 2007 Minutes Southold Town Board Board Meeting of shoreline access unless otherwise determined by the Board of Trustees. B. Shoreline structures. The following standards are required for all operations relating to shoreline structures on residential properties. Operations conducted on properties zoned M1 or M2 may be given greater flexibility in these requirements given the water- dependent nature of their use. (1) Bulkheads, retaining walls, revetments and gabions. (f) In order to prevent the release of metals and other contaminants into the wetlands and waters of Southold, the use of lumber pre-treated with any preservative, including but not limited to chromated copper arsenate (also known as "CCA"), creosote, penta products, Alkaline Copper Quat (ACQ), or homemade wood preservatives is prohibited for use in sheathing and decking on structures in the wetlands as well as on any part of a structure in low tidal flow wetland areas as determined by the Trustees. Any use of creosote is prohibited. Preservatives of any type, including but not limited to those listed above cannot be applied to any bulkheads, retaining walls or revetments after installation. Encapsulated pilings or native nonchemically treated (untreated) lumber only should be used in sensitive areas. (l) Lighting: Any and all lights associated with bulkheads, retaining walls, stairs or poles in Trustee jurisdiction must be directed on the subject structure and not out into the adjacent wetland, waterway or property. Lights shall not be on unless the waterfront is in active use. C. In water. The following standards are required for all in-water operations adjacent to residential properties. [3] [a] Given the unique and sensitive natural environmental characteristics described in the Town of Southold Local Waterfront Revitalization Plan and the New York State Department of State Significant Habitat descriptions, No new docks will be permitted, over vegetated wetlands or such that it causes habitat fragmentation of vegetated wetlands in the following areas: Downs Creek, Hallocks Bay, Hashamomuck Creek and Pond, Long Creek (branch of Mattituck Creek, East of Grand Avenue bridge), Pipe’s Cove Creek and West Creek. [3] [d] No floating docks, floats, dock components, duck blinds or boats shall be stored on tidal wetlands, other intertidal areas or freshwater wetlands, except that floats 20 feet in length or smaller and boats 16 feet in length or smaller may be stored above mean high tide, on blocks at a minimum of 12” above grade, during the period beginning November 1 Page 56 November 7, 2007 Minutes Southold Town Board Board Meeting through May 1. (c) Regulations for the placement and configuration of docking facilities. [1] Residential docks. [a] Only one dock, catwalk may be permitted per residential lot. Only one mooring or dock may be mooring is permitted per residential lot. Upon a showing of special need due to low water level and hazard to property, the Trustees may permit both a mooring and a dock for the same residential property. [b] If any part of a residential dock structure includes a float or floating dock, the float or floating dock portion shall be designed so that, with the exception of the pilings: [i] It is no larger than six feet wide and 20 feet long except on Fishers Island if the need is demonstrated; or of equal square footage as determined by the Trustees; (3) Dredging. (a) Creeks. [1] Only maintenance dredging (as defined in §275-2) only is permitted, unless the applicant owns underwater land or the applicant is requesting permission to dredge in connection with installation of low-sill bulkheads. All maintenance dredging permits shall be valid for a period no greater than 10 years. (c) All dredging applications must demonstrate a specific location for the deposit of dredging material. §275-12 A Standards for Issuance of permit §275-12 B Stop work orders. A. The Bay Constable or Code Enforcement Officer is authorized to issue stop-work orders pursuant to this section. The Bay Constable or Code Enforcement Officer Page 57 November 7, 2007 Minutes Southold Town Board Board Meeting shall issue a stop-work order to halt: (1) Any work that is determined by the Bay Constable or Code Enforcement Officer to be contrary to any applicable provision of this Chapter, or: (1) Any work that is being conducted in a dangerous or unsafe manner in the opinion of the Bay Constable or Code Enforcement Officer, without regard to whether such work is or is not work for which a trustee permit is required, and without regard to whether a trustee permit has or has not been issued for such work; or (2) Any work for which a trustee permit is required which is being performed without the required trustee permit, or under a trustee permit that has become invalid, has expired, or has been suspended or revoked. B. Stop-work orders shall: (1) Be in writing; (2) Be dated and signed by the Bay Constable or Code Enforcement Officer; (3) State the reason or reasons for issuance; (4) If applicable, state the conditions which must be satisfied before work will be permitted to resume. C. The Bay Constable or Code Enforcement Officer shall cause the stop-work order, or a copy thereof, to be served on the owner of the affected property, and if the owner is not the permit holder, on the permit holder, personally or by certified mail to the owner or permit holder and posting at the work site. The Bay Constable or Code Enforcement Officer shall be permitted, but not required, to cause the stop- work order, or a copy thereof, to be served on any or all of the following: builder, architect, tenant, contractor, subcontractor, construction superintendent, or their agents, or any other person taking part or assisting in work affected by the stop- work order, personally or be certified mail and posting; provided, however, that failure to serve any person listed above shall not affect the efficacy of the stop- Page 58 November 7, 2007 Minutes Southold Town Board Board Meeting work order. D. Upon issuance of the stop-work order, the owner of the affected property, the permit holder and any other person performing, taking part in or assisting in the work shall immediately cease all work which is the subject of the stop-work order. E. The issuance of a stop-work order shall not be the exclusive remedy available to address any event described in this section, and the authority to issue a stop-work order shall be in addition to, and not in substitution for or limitation of, the right and authority to pursue any other remedy or impose any other penalty under any other applicable local or state law. Any such remedy or penalty may be pursued at any time, whether prior to, at the time of, or after the issuance of a stop-work order. §275-16. Compliance requirements; penalties for offenses. B. For each offense against any of the provisions of this chapter or any regulations made pursuant thereto, or failure to comply with a written notice or order of any Director of Code Enforcement or Bay Constable within the time fixed for compliance therewith, the owner, occupant, builder, architect, contractor or their agents or any other person who commits, takes part or assists in the commission of any such offense or who shall fail to comply with a written order or notice of the Director of Code Enforcement or Bay Constable shall be subject to the following fine schedule. Each day on which such violation occurs shall constitute a separate, additional offense. (2) Failure to comply with the terms of a permit. (a) Any person failing to comply with the terms of a permit shall be subject to a fine of not less than $500 and not more than $1,000. $4,000 For each subsequent offense, the violator shall be guilty of a misdemeanor punishable by a fine not less than $1,000 nor more than $2,000 $7,500 or a term of imprisonment of not less than 15 days nor more than six months, or both. Page 59 November 7, 2007 Minutes Southold Town Board Board Meeting (b) Any person failing to comply with posting the permit and/or the requirement for supporting plans to be available for immediate inspection pursuant to §275-10 shall be subject to a fine of not more than $1,000. (3) Failure to heed a cease and desist order stop work order. Any person conducting operations in direct contradiction to the terms of a stop- work order shall be subject to a fine of not less than $1000 and not more than $2000. $4000. For each subsequent offense, the violator shall be guilty of a misdemeanor punishable by a fine not less than $1000 nor more than $2000 $7500 or a term of imprisonment of not less than 15 days nor more than six months, or both. (4) Restoration. In lieu or in addition to these punishments, any offender may be punished by being ordered to restore the affected wetland to its condition prior to the offense. Any such order shall specify a reasonable time for the completion of such restoration, which shall be effected under the supervision of the approving authority. The Trustees reserve the right to require specific replanting and restoration methods including specific survivability and success criteria. (5) Failure to comply with a restoration plan. Any person failing to comply with the terms of a mandated restoration plan as detailed in subsection 4 of this section within the proscribed period of time for completion shall be guilty of an offense and subject to a fine of not less than $1,000 and not more than $4,000. (5)(6) Mitigation. When on-site wetlands restoration and creation may be unfeasible due to technical or other constraints, other mitigative measures, such as off-site wetland restoration or creation, may be required. C. The Trustees may revoke a permit when a violation of this Chapter or Chapter 111 is found on the same property. No new permits will be issued to any carter, owner, occupant, builder, architect, contractor or their agents if they are a named as defendants in an outstanding or unresolved wetland violation.violation of Chapter 275 Wetlands and Shoreline or Chapter 111 Coastal Erosion Hazard Areas. Benja Schwartz, Cutchogue BENJA SCHWARTZ: Good evening. I am Benja Schwartz. Speaking at Town Board meetings like this is like eating potato chips. You eat one and it is hard to avoid eating another. COUNCILMAN WICKHAM: I thought you would eat one and you’d get sick. MR. SCHWARTZ: I love potato chips. Last week I was contacted by a John Kent, who lives next to what used to be the East Marion oyster factory. Since pollution of the bays has decimated our oyster population, oyster factories in East Marion, Greenport and New Suffolk have been out of business. If the oyster factory were to re-open in East Marion, that would not be a problem for John Kent. The old factory is on the waters edge and John’s house is on the landward side of the property. John was telling me that the proposal to develop the property where the East Marion oyster factory used to be includes a motel with over 100 rooms, a restaurant with around 200 seats plus a private restaurant annex with another 100 seats; a floating dock protruding 500 feet out into the bay, entertainment facilities for outdoor concerts. Well, it is not just going to fill the property, it is going to fill the neighborhood with music or whatever. If this development is permitted, all of this and much more will be on 18 acres in East Marion. Right next to John Kent’s house, that is where they are going to put an electric generator, a solid waste or garbage transfer station and a high capacity sewage treatment plant. Do you Councilman Edward’s, really believe that John Kent should have reviewed the zoning map before he bought his house? And expected a sewage treatment plant to move in next door? With all due respect, members of the Town Board should not expect individual members of the public to review the zoning map for themselves. The zoning map means nothing by itself. It must be read in connection with the zoning district designations and regulations, lot size and density schedules and many, many supporting planning studies, reports quote-unquote master plans, etc. The documents are voluminous. Even if an individual could access, read and comprehend all of that, it still wouldn’t explain the zoning map. Zoning map is interpreted not only by the property buyers and owners but by the Building department, the Zoning Board of Appeals, Planning Board, Planning Department. You, the Town Board, as well as trial courts, appellate courts and Page 62 November 7, 2007 Minutes Southold Town Board Board Meeting ultimately the courts of last resort. It is the responsibility of our Southold Town government to plan for our community. That responsibility includes obligations to prepare plans, to present those plans to the public and to implement those plans. Myself and others would like to assist our government. It is our government and to work properly, you need our help. But when it is hard to find out what government is doing, when efforts to get involved result in defensive reactions, refusals to admit mistakes and failures to consider options, opinions which are different from your own, our efforts are wasted. If we allow commercial developers to use our town to make profits without properly planning for, discovering and regulating the impacts on our town, our community will be destroyed. Thank you. Supervisor Russell SUPERVISOR RUSSELL: Would anybody else like to come up and address the Town Board? Linda Goldsmith, East Marion LINDA GOLDSMITH: Good evening, my name is Linda Goldsmith. This is going to be East Marion night, it looks like. I would like to present a petition to you, I hope you will accept it. This is a petition signed by 350 residents in the hamlet of East Marion, this petition states in part that the residents of East Marion are against the construction of a hamlet center in the defined halo zone of our rural hamlet. These signatures represent about 325 households out of a total of 440 in our hamlet. Every household is not covered in this document but only 3 people of the 328 who were asked, refused to sign this petition. And I do want to say that Mr. Copertino got most of these signatures. I can probably account for 10, I am not just as, I don’t know what the word is, dedicated I think is the word. It was getting cold out and I don’t think I am quite as dedicated as he is, although I fully support what he has done and I do want you to know that this is not, this is not on behalf of the stakeholders. This is on behalf of the citizens of East Marion. So, may I present it to you? SUPERVISOR RUSSELL: Absolutely. COUNCILMAN WICKHAM: Would you like to read out what the petition states? MS. GOLDSMITH: Certainly. ‘We, the undersigned residents of East Marion are against the construction of a hamlet center in the defined halo zone in our rural hamlet.’ COUNCILMAN WICKHAM: Period? MS. GOLDSMITH: Period. That is it. And believe me, people did read it because it wasn’t very long, wasn’t very complicated. So they did read it before they signed it. COUNCILMAN WICKHAM: Do we know what a hamlet center is? MS. GOLDSMITH: The hamlet center, what I understand a hamlet center is, is the hamlet center was to be created in East Marion, the back of East Marion fire department. SUPERVISOR RUSSELL: Yeah, the issues are the hamlet center stakeholders initiatives and that specific plan, which sort of came out of the original stakeholders recommendations, is Page 63 November 7, 2007 Minutes Southold Town Board Board Meeting getting a little confusing here. That, the Kokkinos property I believe it is called? MS. GOLDSMITH: Kortsolakis. SUPERVISOR RUSSELL: Who was I thinking of? Well, at any rate, okay, that was one of the concept designs that was being discussed initially but I think it is clear that there is no public support for that concept in East Marion and these are planning initiatives and without public support, there is no need to move forward on that. What I would recommend, I will certainly take that petition tonight but also, stay in touch. I opened up the stakeholders process to the public for this very reason, so we get a real sense of what the communities want and that particular site, if the stakeholders want to say we think the Town should work to preserve it, than that should be the goal that we pursue. That is why we are there. th MS. GOLDSMITH: I am sure you know that there is a stakeholder meeting on November 17 at 10:00 at the East Marion chapel and there is also a meeting, if any of you would like to attend and listen to the citizens of East Marion this coming Saturday at 10:00 and it is being sponsored by the Cleaves Point condominiums and the East Marion community association has been invited and anyone that is interested in hearing what they have to say is invited to come. Oh, I thth am sorry, it is on the 10 at 11:00. Excuse me. It is on November 10 at 11:00. I am sorry. th Stakeholders is November 17 at 10:00. This Saturday is at the East Marion Fire Department. And what Benja was talking about, I want to, if you don’t mind, letting me tell the audience; it looks like, this is Oki-do as it is planned. It looks like an out of control Disneyland. It really does. It looks like someone has planned a Disneyland and went berserk with the rides. SUPERVISOR RUSSELL: We have talked about it a lot of times. MS. GOLDSMITH: We have. SUPERVISOR RUSSELL: There is a real difference between Oki-do and what we are, the challenge we are facing in Cutchogue. The challenge in Cutchogue is, someone submitted a plan based on the zoning as a matter of right under that zoning. And although they scaled it back, clearly that is not enough for anyone’s satisfaction. Oki-do, on the other hand, is actually not necessarily a right. It is the right to ask for it, it is a, that would require several variances. One being that use, one being the size and the scope of that use and the other is the restaurant, which is a separate hearing. So there is a lot of governmental jurisdictional review that has to be done before they even get close to achieving that plan. MS. GOLDSMITH: Some of even believe that it is not a transient motel; this is a resort. And it actually would need a change of zoning. But that is something… SUPERVISOR RUSSELL: It is a very good possibility. I am not an attorney but certainly that, it is one of those things that somebody lays a grand scheme on the table based on, you know, the code and it is a question of going through a reasonable process of town government to make sure it is not inconsistent with the community that is surrounding. Yes, Mr. Copertino. John Copertino, East Marion JOHN COPERTINO: John Copertino, East Marion. About this petition, an important fact pertaining to this petition is that it truly reflects the desires of the residents of East Marion. The original stakeholders that were appointed by Mr. Horton never went to the community to ask them what they wanted. That was their idea and they presented it to the Planning Board and they put together this elaborate plan but nobody asked the residents. So as I was accumulating the names, I was explaining to each, anybody that was interested which they all were. In fact, they sought me out to sign this. People are really up in arms about it. And they were adamant in that they didn’t want anything built in East Marion, in the hamlet center. An important point is, if they wanted that shopping areas or village malls or whatever, they would have went to Mattituck and settled in Mattituck. They would have settled in Cutchogue. East Marion is East Marion. There is nothing there. They want a status quo, they want to keep it as it is and that petition reflects it. Again, it was not your appointees, it was an appointees… SUPERVISOR RUSSELL: Well, that, I think that was you know, the original stakeholders was a well-intentioned effort. The only thing I did was put more of a public input component to it and gave the second round of stakeholders the charge of saying, first open it up to anybody that wants to be a stakeholder can submit their name and secondly, develop that community rapport, so you are going in the direction the community wants. And that is all it is. But you know, look, it is a point well-taken by me and I am sure the Board, there is support at this point for any type of development or town involved development of that site behind the post office. MR. COPERTINO: Right. And this backs them up by the people. The signature is sacred. There is a few lawyers up here, so I don’t have to tell them what, you know, once you sign a contract, the signature is what….isn’t that true? Or not? I don’t know. Maybe not. Alright. Can I continue with another subject? SUPERVISOR RUSSELL: By all means. COUNCILMAN WICKHAM: Wait, can I make a comment on this? MR. COPERTINO: Sure. COUNCILMAN WICKHAM: When the stakeholders first proposed doing something with that property, they and we had the impression that the property was on the market. The owners of that property have the right to develop that property. They may develop it and if your wish and the wish of 325 people around East Marion that it not ever be developed, that may not be a wish that is consistent with the owners of the property. MR. COPERTINO: That is absolutely correct. Page 65 November 7, 2007 Minutes Southold Town Board Board Meeting COUNCILMAN WICKHAM: They have a right to do something with that property. MR. COPERTINO: You are absolutely right. But it is the stakeholders that are directing what is to be done to that property. COUNCILMAN WICKHAM: They were not directing. They were trying to come up with a proposal that the owners of the property could buy into and it would still be a benefit to the village of East Marion. There were many review steps in which that proposal would be brought to the attention of the people of East Marion. This was not something that they were trying to put over on them. I agree with Scott, if there is no wish to go forward; definitely it is not going to go forward but I don’t think the public should get the impression that this was a group of people who were trying to put over on the people of East Marion. MR. COPERTINO: I don’t think they, anything, they thought that people, that something was being over on them. It is something that was never brought to them, to ask them what they wanted. SUPERVISOR RUSSELL: But this, I am sorry, that was a sense of timing. I think it was their intention to bring it to the community. We talked about it early on with the Peconic Land Trust to come in to sort of shepherd that plan and we made it clear, Albert and myself and the rest of the Board that at the end of the day, we had to make sure that is what the community of East Marion wanted, because you would be talking about possibly an investment on the town’s part. But I think the stakeholders meant well, I don’t, you know, I know some of them. Kevin Webster I have known for years. They are good people and it was just an idea. Like I said, I don’t think at this point there is any need to… MR. COPERTINO: Right. COUNCILMAN KRUPSKI: Well, we had a… SUPERVISOR RUSSELL: Fear it. JUSTICE EVANS: What was proposed to do was that each hamlet stakeholders were told to find a hamlet center. This is what they were pulled together… MR. COPERTINO: Mmmhmm. JUSTICE EVANS: To find a hamlet center and to make sure there is an affordable housing component within that hamlet center, so that every hamlet was having a place maybe for affordable housing and this was all what they thought what the best place was. It wasn’t like they said, we want this but they were, that was part of their mission. MR. COPERTINO: Well, my objection from the beginning was that they didn’t go to the public. COUNCILMAN KRUPSKI: Well, there is going… Page 66 November 7, 2007 Minutes Southold Town Board Board Meeting MR. COPERTINO: That was the only objection I had to it. COUNCILMAN KRUPSKI: There is going to be more stakeholder initiatives. We had that discussion today at the work session on how, when the stakeholders come up with their initiatives, some are going to be very small like a stop sign or a drainage or something. Some are going to be large initiatives that aren’t going to be implemented maybe ever and it is up to the town and we are kind of in flux here making up a committee that is going to deal with the stakeholders, that is going to try to prioritize each of these initiatives throughout each hamlet… MR. COPERTINO: Right. Sure. COUNCILMAN KRUPSKI: …so if people come up with ideas, it doesn’t necessarily mean because it is on paper that it is ever going to happen. It is just that these are ideas that the community has and then it has to go through the whole public scrutiny to see what kind of town investment, what kind of private investment. You know, exactly how it is going to happen. MR. COPERTINO: Well, this is how the people feel at this time. If they change their minds, we will let you know. Anyway, can I move on or do you want to… SUPERVISOR RUSSELL: Yeah, no, please. th MR. COPERTINO: Sunday is Veteran’s Day. The 10, a day that all Americans should give thanks to the anybody that served at any time, who is a veteran in the services. As you know, New York state has just passed a law that leaves each town the option to grant cold war veterans real estate tax relief. I would like this Board to consider… SUPERVISOR RUSSELL: We talked about it today and in two weeks at the meeting in two weeks, we are going to set the public hearing date for adoption of the cold war veterans st exemption. The first effective date would be for the March 1 taxable status date anyway but we will set, in two weeks we will set a public hearing, that will have to be 30 days after that for the adoption of that. So we have already started the legal process to adopt that. MR. COPERTINO: Thank you. Just one thing to consider is that there are veterans that aren’t, that are really cold war veterans that are getting that now. For instance, the Korean war, some of you’se might have been around then. One or two. I know I was. Started in June of ’50 and ended sometime…. COUNCILMAN EDWARDS: June of ’53. MR. Anybody since 1990, that has served in the military, gets an exemption as they come out now because we have never ceased hostilities from the Iraqi war of 1990. And all these other sandwich or bookend dates in the middle, all this effectively does at this point is it says that anybody that served in the military since World War II is entitled to exemptions. And that is appropriate… MR. COPERTINO: Yeah. That is with this cold war… SUPERVISOR RUSSELL: Yeah, it more or less declares everything post 1942 and that is appropriate because veterans, you know, they get drafted at certain times. They, you know, service is very similar so the exemption will be the same for everybody as soon as we adopt that local law. MR. COPERTINO: Yeah. What should be considered, if there is any argument at all, is that the sacrifice that they all made. They were in the service; if battles broke out, they would have gone into it. SUPERVISOR RUSSELL: That is right. MR. COPERTINO: And, what other point did I want to make on it? Oh, they had to sacrifice their careers, especially up until 1973 when the draft ended. Nobody would hire you, no corporation would hire you if you hadn’t served your military time. So you had to put your career on hold to go into the military or enlist into the military, get drafted, before anybody would consider any type of employment. So therefore, that was a sacrifice in itself. SUPERVISOR RUSSELL: Right. MR. COPERTINO: So thank you for considering that. One other plan that I sort of passed through you guys, Mr. Beltz it was, consider sponsoring a program that would have our experienced retired senior citizens educate the high school seniors and juniors, ones that are going to go out into the world soon, on their job experiences; like they do on their career day but to go further, to, if they are interested in, I was in avionics, aircraft electronics. I was in aircraft maintenance etc. flight engineer, if they are interested in that, I could take them and discuss all of the intricacies of the job. I could even go further and teach them aircraft electronics. You know, systems and stuff. And somebody could teach them law, the basics of law or just to get them interested and involved. There is no schooling here for these kids to go to that would direct them into a category that they might be interested in. And we have so many senior citizens in this town, very experienced professionals that might get interested in a program like that and might elaborate on it and start holding classes. You know, in my category, my profession, all I would need would be an overhead projector and a copying machine. Page 68 November 7, 2007 Minutes Southold Town Board Board Meeting SUPERVISOR RUSSELL: I would gladly go out and tell the youth, talk them out of politics as a career. MR. COPERTINO: Well, it doesn’t pay much but there are possibilities. But at least consider that. SUPERVISOR RUSSELL: Oh, absolutely. MR. COPERTINO: You know, if we start a program, a lot of the senior citizens I am sure are willing to share their wealth of information, you know, and see that these kids here who haven’t really got the opportunities that other kids have on the island because of your schooling you know, they are so far away. Your schools are so far away but just to direct them and spur them on and give them some more information on a career. And we have enough and I am sure you are going to have enough volunteers if it is presented to the seniors in a good way. That is all I have. Thank you. SUPERVISOR RUSSELL: Thank you, John. Nancy Sawastynowicz, East Marion NANCY SAWASTYNOWICZ: Good evening, I am Nancy Sawastynowicz from Cutchogue. Supervisor Russell, Justice Evans, Councilman Wickham, Councilman Ross, Councilman Edwards and Councilman Krupski. Don’t you know that Southold was a small town? A large scale development does not fit in a small town. Already under construction are monster size developments, like the cliff side resort condominiums opposite the San Simeon by the Sound nursing home. That one got in under the radar. Already built are developments like Cleaves Point in East Marion. Pheasant Run in Greenport, Colonial Village in Southold and there were a lot more that I looked in the yellow pages and they are not listed, it just said call this real estate office and I didn’t have time. I guess all these developments get the New York state condominium property tax break. Doesn’t that mean that all of us who live here, does that mean that all of us who live here but do not live in condominiums have to pay higher taxes? I also have a question for the entire Town Board, including the lame ducks and the Board members elect. I am not going to ask you to respond immediately but I do request that each one of you answer my question. If we cannot re-zone to stop over size development proposed in our town like the Heritage, why do we have a town government? Thank you. SUPERVISOR RUSSELL: Would anybody else like to address the Town Board? Roberta Lee ROBERTA LEE: Supervisor Russell, members of the Town Board, good evening. When discussion turned, my name is Roberta Lee, I live in Cutchogue. When discussion turns to the proposed condominium development named the Heritage at Cutchogue, I would like to know whose heritage it is, the hot question people ask is, how will it affect me? For myself personally, I could only think of the visual horror and the traffic and everything else but other thoughts later came to my mind. The Heritage at Cutchogue is not just one more super sized McMansion like the gigantic pre-fab on New Suffolk Avenue which looks like it belongs in Brooklyn or Queens. I left Brooklyn and Queens to come here, where nothing looks like that. But not on the north Page 69 November 7, 2007 Minutes Southold Town Board Board Meeting fork, the Heritage at Cutchogue is almost 50 acres and 150 houses. In one slam, this commercial development redefines the hamlet of Cutchogue and degrades the character of Southold Town. There are many answers to ‘how will it affect us’. The answer most people consider important is if you own property in Southold, your taxes will go up because of this development. And how about the other developments? How have they affected our tax rate? Unlike other properties in Southold Town, condominiums have their own bylaws. They call them bylaws. Does Southold Town regulate those laws? That is not a rhetorical question. SUPERVISOR RUSSELL: Which laws? Bylaws are actually filed with the state Attorney General and all of that is done under the auspices of the state Attorney General’s office. MS. LEE: Through the developer. SUPERVISOR RUSSELL: I imagine he has to apply…. MS. LEE: So we have nothing to say about that? I think that stinks. Are condominiums offering plans subject to any municipal review? SUPERVISOR RUSSELL: This one? Substantially. MS. LEE: Really? SUPERVISOR RUSSELL: Yes. We have a pos dec on this that is probably as broad and as all inclusive… MS. LEE: You have a what dec? SUPERVISOR RUSSELL: A positive declaration for SEQRA for environmental impact drafted by the Planning Board that is probably as broad a positive declaration has ever been. UNIDENTIFIED: Inaudible. SUPERVISOR RUSSELL: She asked about the governmental review. The pos dec is absolutely part and parcel. MS. LEE: Municipal review. SUPERVISOR RUSSELL: Oh, on the offering. She asked about the, oh, okay. MS. LEE: So what is the answer? SUPERVISOR RUSSELL: To what? The offering? MS. LEE: Are condominiums offering plans subject to any municipal review? Is that what you mean? MS. LEE: No. JUSTICE EVANS: Okay. Well, that is why we are confused. COUNCILMAN WICKHAM: What do you mean? MS. LEE: I mean, are condominiums, the developers offering plans subject to any municipal review regarding the laws by which these condominiums are going to be governed? JUSTICE EVANS: She wants to know if their plans…. SUPERVISOR RUSSELL: I am sure the Planning Board would receive a copy of any covenants and restrictions from any developer. They do in every community that gets filed through them. And they will also have their own covenants and restrictions that I am sure they will impose on the facility, presuming it gets built and presuming it gets built in the manner that he is applying for. COUNCILMAN ROSS: And while the bylaws of the condo may not be subject to municipal review, there are rules such as if it is going to be a 55 and older that do come before the Planning Board and that the Planning Board could and does require compliance in filing of covenants and restrictions with regard to. MS. LEE: How many condominium developments are already in Southold Town? How many? SUPERVISOR RUSSELL: Counting the Village of Greenport? MS. LEE: Sure. That is Southold Town. SUPERVISOR RUSSELL: I would say seven or eight. MS. LEE: Seven or eight. SUPERVISOR RUSSELL: Not counting that whatever that thing is going to be on the North Road. I have no idea what that is going to be. MS. LEE: Thing is the word for it. Have Southold Town planners ever considered the impact of so many condominium developments? How do all these condominiums affect our taxes? Do I, okay I will make it a personal thing, okay? I bought my house 20 years ago, I paid about $290,000 for it. I have taken care of my property, I have invested myself in this community. I participated in governmental issues on different levels and in the schools. Why do I have to pay money towards the taxes that these people who are buying as a condominium, they are paying like 30% at the maximum 40% on the tax rate. I have to pay, they are buying houses for Page 71 November 7, 2007 Minutes Southold Town Board Board Meeting $400,000-$600,000. How many affordables are there? Maybe six, seven, eight, nine, ten. They want to abuse the whole eco-system and we are supposed to support this with our tax money, our taxes being raised in order to supply these people who do not participate in this community, do not participate in the development of the Town, do not participate in interest in what goes on in this Town in regard to schools, churches or anything else. Everybody is gone out of here as soon as October comes around and they are in their McMansions someplace else. I resent having to pay taxes that those people should be paying for themselves, especially when they despoil our magnificent landscape. Thank you very much. SUPERVISOR RUSSELL: Thank you. We have actually a public hearing set for the budget but I do want to make sure that everybody that wants to be heard, gets heard because… JUSTICE EVANS: We can start the hearing late. SUPERVISOR RUSSELL: Okay. Does anybody… John Copertino MR. COPERTINO: It is along the lines of jobs for the young. Almost everyday I pass this new storage facility on the North Road in Cutchogue… SUPERVISOR RUSSELL: Right. MR. COPERTINO: And I look at that building, I have nothing against the owner of that building, I just wonder how it got there. It is just so out of place. But every time I look at it, I say, gee, this could be a high-tech industry site. If they were willing to allow this to be built, a storage facility, I don’t know how well they are doing, I hope they do well but to me, I look at it and I see it could be a high-tech facility. A medical, a computer facility, not necessarily manufacturing; architectural firms with real tax relief, tax benefits given by the Town. Does the Town consider, I am sure you consider that? I mean, that is a dumb question but something has to be done to build the economy up for the young people in this town. You have a problem with affordable, they can’t afford the houses because the salaries aren’t there. And can we bring some type of high-tech professional, I keep using the word industry, well, I will use the word industry. I don’t mean manufacturing, I don’t mean anything that will pollute the waters. Something professional. Research labs with, and charging no tax; you have considered it, I am sure. Would you like to…. COUNCILMAN KRUPSKI: I think it is just whatever came into use that existing zoning, I don’t know when that was re-zoned from a potato field to light industrial but at that point, someone on the Town Board made the decision to re-zone that property for a different kind of uses and I think the storage use was just sort of coincidental, that is what someone had an idea for and they bought the property and that is what they wanted, you know? MR. COPERTINO: I have nothing against what is in there, it is just when I look at it, I say gee, what a nice place for some type of high tech, (inaudible) that would pay high tech wages. COUNCILMAN EDWARDS: Can I respond to that question? Page 72 November 7, 2007 Minutes Southold Town Board Board Meeting MR. COPERTINO: Sure. COUNCILMAN EDWARDS: All up around to the north and around the landfill is zoned LIO, which is three acre minimum zoning. It was zoned that way as you go up Depot Lane, on the east side of the road, the goal was to attract exactly the kind of business you are talking about. It never happened. And it was re-zoned that way quite a few years ago because there hasn’t been an appetite from industry for exactly the kind of… MR. COPERTINO: But there could be, though. COUNCILMAN EDWARDS: There could be but nobody has done it, which says something about the fact that the Town essentially put out the welcome mat and nobody walked in. MR. COPERTINO: Well, could we put that mat out again? Just draw a little… COUNCILMAN EDWARDS: Well, it is out in the form of zoning. MR. COPERTINO: Zoning. But how about tax incentives? You know, I am not a professional, you guys are the professionals. It is easy to guess what you can do without any knowledge… SUPERVISOR RUSSELL: The things we need to think about when we look at those types of options, we need to look at transportation. There is the high tech industry that surveys and one of their problems is we can’t get them in because they say well, our young people can’t work here because they can’t live here, it is too expensive. But we can’t make it less expensive or pay them more money, it is a catch-22. Let me just say about the storage facility, it is actually a beautiful structure and as a side issue, I know this wasn’t really the point, storage facilities are great for taxation. Dollar for dollar they are some of the best commercial producers of taxes for that school district. MR. COPERTINO: Yeah, that is not the point that it is a storage facility… SUPERVISOR RUSSELL: Small business is another way… MR. COPERTINO: My concept is when I look at that I say, gee, what a great place for a high tech lab, testing lab or something that would draw some money into the town. These kids can’t be landscapers forever here, you know? You know, they are not making the money and then you are going to lose the youth. Look, I know it is hard, I am a proponent of conservation, you know, so this is really, I am switching hats here. You know but anyway, that is all I have. SUPERVISOR RUSSELL: Thank you very much. I will move to, first I will just mention that the budget process begins with departments making requests, Supervisor reviews those requests and Supervisor gives to the Town Board the Supervisor’s proposed budget. The Town Board then takes a look at it, makes some revisions usually. In this case, made a few and that becomes the so-called preliminary budget which is what we are holding a hearing on tonight. Flipping to the very last pages of the document that is out there in the hallway, 2008 tax statistics show appropriations for 2008 of some 36.2 million dollars, a 4.85 percent increase over last year. The taxes would be for 2008 some 23.9 million dollars, which is a 6 percent increase. And the tax rate increase would be 4.99 percent on the bottom of that page. Revenues on the next page would be 9.5 million dollars, for about a 7.5 percent increase and we would have an appropriated fund balance carried over from 2007 of 3.6 million and in 2008 it would be 2.79. Those are a summary of the overall statistics, the detail are inside and the Town Board would welcome comments from the public on this proposed budget. On page 26, Community Preservation Fund, there are a set of numbers that I would like to have explained. Basically it says that the actual 2006, the land acquisitions was 10 million and some change, the budget was set for 2007 was 32 million, the Supervisor’s tentative budget for 2008 is back down to 2 million and some change and preliminary budget is at 2 million. What happened to the 32, where did the 32 come from and where did they go to? SUPERVISOR RUSSELL: Is that, are you looking at appropriation? I think, is that the $25 million bond? MR. WILLS: You have got the $22 million. Comptroller John Cushman COMPTROLLER CUSHMAN: If I may, I believe the budget for 2007 includes a bond for $22.5 million, so that is why there is such a fluctuation between last year and this year and it is back down again. SUPERVISOR RUSSELL: The bond we executed which is bond against anticipated CPF futures. COMPTROLLER CUSHMAN: Correct. Couuncilman Krupski COUNCILMAN KRUPSKI: The Town basically borrowed $22 million and basically we are in Page 75 November 7, 2007 Minutes Southold Town Board Board Meeting the process of spending it. So it, it is just that it was a one time event. Mr. Wills MR. WILLS: Okay. That is the one that is listed at the bottom of the page? COUNCILMAN KRUPSKI: Yes. MR. WILLS: Okay. Thank you. Supervisor Russell SUPERVISOR RUSSELL: Thank you. Would anybody else like to comment on the budget? Dave? Mr. Bergen? Town Trustee, Dave Bergen DAVE BERGEN: Dave Bergen from Cutchogue. I am here to comment on the budget or ask a question. On page 4 in the police equipment line, how many police cars, the replacement of police cars are included in this preliminary budget? SUPERVISOR RUSSELL: There are five cars included in this budget. The other three that were requested, we already authorized tonight to purchase with this years money. In other words, there is no need to wait to budget for eight next year when we had an overage of money unused in police retirement. So we bought the three, so that will complete the eight he requested. MR. BERGEN: Well, I just want to speak on behalf of the Police Advisory Committee and tell you we really appreciate the support of the police department, with what this Board has done. Over the past couple of years, unfortunately, the cars have been cut back, as far as purchasing new cars to the point where we had to bite the bullet and I appreciate the fact that the Board has done that for this year so there has been some catch up done… SUPERVISOR RUSSELL: He had the three for this year and then we just authorized another three, so six for this. MR. BERGEN: I understand the three. The way the cycle works, three were authorized the year before and they finally can get them next year. But with the authorization tonight of the three plus the five that are in this preliminary budget; that would meet the Chief’s needs and I appreciate that. Thank you. Supervisr Russell SUPERVISOR RUSSELL: Sure. Councilman Wickham COUNCILMAN WICKHAM: May I make a comment to the Committee? I gather the Committee felt strongly that it is important to have all of these police cars and my comment is, it would be helpful to have that comment come to the Town Board, rather than be coming through a newspaper. Page 76 November 7, 2007 Minutes Southold Town Board Board Meeting COUNCILMAN ROSS: I join in that comment. MR. BERGEN: Actually, I can only speak for myself not for the entire Police Advisory Committee, we have a Town Board liaison person and my understanding is there is a liaison from the Town Board that is assigned to the Police Advisory Committee and that liaison hasn’t shown up this year for these discussions. We have had these discussions on not just police car needs but other items for the police department throughout the year and our communication to the Town Board we thought would be via the Town Board liaison person who elected not to come to these meetings. We also had at several times written letters with concerns, whether it was about police cars or other matters to the Supervisor, so we have been communicating to the Town Board outside of, as you say, the newspaper. The newspaper is welcome to come to any of our meetings and the newspaper elected to come to one of our meetings where this discussion went on. We don’t invite the newspaper there, they are invited like to every meeting we hold throughout the year and they chose what meetings to come to. They happened to come to the meeting where this was a topic for discussion. But it wasn’t that we contacted the newspaper or asked the newspaper to come to us, so that we would maybe plant the seed to the community and all. That was not the intention. SUPERVISOR RUSSELL: Okay. Would anybody else like to address the Town Board on the budget? Linda Goldsmith LINDA GOLDSMITH: I have a question on your employee benefits. Do all of your unions have the same health insurance plan? SUPERVISOR RUSSELL: No. We are self insured through CSEA. The PBA I believe we still have Blue Cross. Empire. The elected to stay with Empire some years ago. MS. GOLDSMITH: The same with dental? SUPERVISOR RUSSELL: Then dental is, yes, the CSEA again operates dental through, I believe, their CSEA union. MS. GOLDSMITH: How about elected officials? SUPERVISOR RUSSELL: Elected officials match the CSEA agreement on both medical and dental but we pay into the dental, prescription… MS. GOLDSMITH: That would be self insured? SUPERVISOR RUSSELL: Yes. MS. GOLDSMITH: Okay. We just had the real property tax committee, maybe it would, is there any way that all the unions could get together and use the same insurance and maybe go out for a RFP? Page 77 November 7, 2007 Minutes Southold Town Board Board Meeting SUPERVISOR RUSSELL: Yeah, we actually held off on proposing the recommendations of the Real Property Tax Council, it sort of got dragged into the political process unfortunately, so what we did was, we are going to have recommendations coming out in the near future and that would be one of them, certainly, to pool our resources as best we can and see, go out in the market and see if we can affect savings. Those are the types of recommendations we will be making shortly. JUSTICE EVANS: But it is also contractual with their union. SUPERVISOR RUSSELL: Yes, I mean, we do have to have the union sign off and that would be the same when we participate with the schools and everybody else. MS. GOLDSMITH: For your tpa you did an RFP I take it, right? Or may I ask who your third party administrator is? SUPERVISOR RUSSELL: Our administrator is Island Group. MS. GOLDSMITH: Okay. Thank you.
