A Regular Meeting of the Board of Town Trustees was held on
Thursday, September 27, 1984 at the Southold Town Hall, Main
Road, Southold, New York. The meeting was opened with President
Henry P. Smith presiding at 7:30 P.M.
Present:

Ilene Pfifferling, Secretary
On motion made by Trustee Kujawski seconded by Trustee Bednoski
and carried the minutes of the August 30, 1984 meeting were APPROVED.
On motion made by Trustee Bredemeyer seconded by Trustee Smith and
carried the November mooring renewals were APPROVED.
On motion made by Trustee Bednoski seconded by Trustee Bredemeyer
and carried the next regular meeting of the Board will be held on
Thursday, October 25, 1984 at 7:30 P.M., inspections will be mado
on Wednesday, October 24, 1984 at 2:00 P.M..
I. REPORT
TRUSTEE SMITH: The following fees were received by the Trustees' Office
for the month of August and forwarded to the Supervisor: Application
Fees $80.00, Grandfather Applications $115.00, Mooring fees $80.00,
Wetland Applications $550.00 and Dock fees $75.00. The total amount
collected for the month of August was $900.00.
II. PUBLIC NOTICES
On motion made by Trustee Bredemeyer seconded by Trustee Bednoski and
carried the Board dispensed with the reading of the Public Notices,
in light of the fact that there was only one person in the audience.
TRUSTEE SMITH: I would like to state that these Public Notices are
for information only. They are posted on the Town Clerk's bulletin
board if anyone wishes to review them.
III. COMMUNICATIONS

TRUSTEE SMITH: Number 1 is from Mark Iglesias regarding the house-
boat law that we are going to write up and send to the Town Board
for a hearing in the future. 2. From the DEC a review of the
Coliform Data for MattituCk Creek. 3. From the DEC a~review of the
Coliform Data for Arshamomaque Pond. Trustee Smith stated that he
believes that these creeks are closed.
IV. RESOLUTIONS
lB. Moved by Trustee Bredemeyer seconded by Trustee Kujawski, it was
RESOLVED that the Town Trustees of the Town of Southold-hereby declares
itself lead agency in regard to the State Environmental Qualit~ Review
Act in the matter of the application of Stanley Chase for a Wetland
Permit on certain property located at Home Pike Road, Mattituck, lot
no. 11/12.
Vote of Board: Ayes: All
This resolution was declared duly ADOPTED.
2B. Moved by Trustee Kujawski seconded by Trustee Smith, it was
RESOLVED that the Town Trustees of the Town of Southold hereby declares
itself lead agency in regard to the State Environmental Quality Review
Act in the matter of the application of Stanley Chase for a Wetland
Permit on certain property located at Home Pike Road, Mattituck, lot
No. 13/14.
Vote of Board: Ayes: All
This resolution was declared duly ADOPTED.
3B. Moved by Trustee Bednoski seconded by Trustee Smith, it was
RESOLVED that the Town Trustees of the Town of Southold hereby declares
itself lead agency in regard to the State Environmental Quality Review
Act in the matter of the application of Stanley Chase for a Wetland
Permit on certain property located on the East side of South Drive,
Mattituck.

4B. Moved by Trustee Smith seconded by Trustee Kujawski, it was
RESOLVED that the Town Trustees of the Town of Southold hereby declares
itself lead agency~in regard to the State E~ironmental Quality 'Review
Act in the matter of the application of Strongs Marine for a Wetland
Permit on certain property located on Main Road, Mattituck.
Vote of Board: Ayes: All
This resolution was declared duly ADOPTED.
5B. Moved by Trustee Smith seconded by Trustee Kujawski, it was
RESOLVED that the Town Trustees of the Town of Southold hereby declares
itself lead agency in regard to the State Environmental Quality Review
Act in the matter of the application of Carlo DeGaudenzi for a Wetland
Permit on certain property located at 3520 Ole ~ule Lane, Mattituck.
Vote of Board: Ayes: All

6B. Moved by Trustee Bredemeyer seconded by Trustee Kujawski it was,
RESOLVED that the Town Trustees of the Town of Southold hereby declares
itself lead agency in regard to the State Environmental Quality Review
Act in the matter of the application of Bess Pulitzer for a Wetland
Permit on certain property located at Lighthouse Lane, Southold.
Vote of Board: Ayes: All
This resolution was declared duly ADOPTED.
7. Moved by Trustee Smith seconded by Trustee Bredemeyer it was
RESOLVED to APPROVE the mooring application submitted by Frank Kujawski,
Jr. to place an offshore mooring in Deep Hole Creek, Mattituck.
Vote of Board: Ayes: Smith, Bednoski, Bredemeyer
Abstained: Kujawski
This resolution was declared duly ADOPTED.
8. Moved by Trustee Smith seconded by Trustee Bredemeyer it was
RESOLVED to APPROVE the mooring application submitted by Maryann
Messina to place an onshore stake in Goose Creek, Southold.
Vote of Board: Ayes: All
This resolution was declared duly ADOPTED.
9. Moved by Trustee Kujawski seconded by Trustee Smith it was
RESOLVED that the Town Trustees of the Town of Southold hereby declares
itself lead agency in regard to the State Environmental Quality Review
Act in the matter of the application of Leonard Beckenstein for a
Wetland Permit on certain property located on the South side of
Jacksons Landing, Mattituck, lot no. 8.
Vote of Board: Ayes: All

10. Moved by Trustee Bredemeyer seconded by Trustee Bednoski it was
RESOLVED that the Town Trustees of the Town of Southold hereby declares
itself lead agency in regard to the Sta~e Environmental Quality Review
Act in the matter of the application of Leonard Beckenstein fox a
Wetland Permit on certain property located on the South Side of
Jacksons Landing, Mattituck, lot no. 3.
Vote of Board: Ayes: All

11. Moved by Trustee Bednoski seconded by Trustee Kujawski it was
RESOLVED to APPROVE the mooring application of Robert Pellegrini to
place an offshore mooring in East Creek, Cutchogue.

RESOLVED to APPROVE the mooring application of Arthur F. Schmitz
to place an onshore stake in Haywater Cove, Cutchogue.

13. Moved by Trustee Smith seconded by Trustee Bednoski it was
RESOLVED that the Town TruStees of the Town of 'Southold hereby declares
itself lead agency in regard to the State Environmental Quality Review
Act in the matter of the application of Stephen Shilowitz for a
Wetland Permit on certain property located on Sixth Street, Greenport.
Vote of Board: Ayes: All

14. Moved by Trustee Bednowski seconded by Trustee Bredemeyer it was
RESOLVED that the Town Trustees of the Town of Southold hereby declares
itself lead agency in regard to the State Environmental Quality Review
Act in the matter of the application of Ludwig. Becker for a Wetland
Permit on certain property located on Pine Neck Road, Southold.
Vote of Board: Ayes: All
This resolution was declared duly ADOPTED.
15. Moved by Trustee Smith seconded by Trustee Kujawski it was
RESOLVED to APPROVE the request to transfer mooring permit no. 978
mooring no. 187 to Mr. John c. Vassil.

This resolution was declared duly ADOPTED.
16. Moved by Trustee Kujawski seconded by Trustee Bredemeyer it was
RESOLVED to APPROVE the mooring application of'Jo-Ann Gerardi to
place a mooring in Corey Creek, Southold. There is room for a
mooring On the Association property. The permit will be granted with
the provision that a letter from the Association, giving approval
for the mooring, is submitted.

Trustee Smith: We will move on to the Environmental Assessments.

17B. Moved by Trustee Bednoski seconded by Trustee Bredemeyer it was
RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law State Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that the Southold Town Trustees, as lead agency for the
Board of Trustees 5 September 27, 1984
action described below, has determined that the project, which is
unlisted, will not have a significant effect on the environment.
DESCRIPTION OF ACTION: Application of Bernard O. Monson for a permit
under the provisions of the Wetland Ordinance of the Town of Southold
to construct a bulkhead and docking assembly for erosion control and to
provide mooring for a private boat and to dredge, on property located
at 750 Budd's Pond Road, Willow Point Southold, New York.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted'which indicated
that no significant adverse effect to the environment are likely to
occur should the project be implemented as planned.
Because there has been no response in the alloted time from
the New York State Department of Environmental Conservation and the
Southold Town Building Department, it is assumed that there are
no objections nor comments from those agencies.
Vote of Board: Ayes: All
This resolution was declared duly ADOPTED.
18B. Trustee Smith: This application is on hold. We are waiting
for the Conservation Advisorys' comments and recommendations. Let's
move on-to number 19. This is another environmental assessment.

19B. Moved by Trustee Kujawski seconded by Trustee Bredemeyer it was
RESOLVED that pursuant to Article 8 of the Envirohmental Conservation
Law State Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that the Southold Town Trustees, as lead agency for the
action described below, has determined that the project, which is
unlisted will not have a significant effect on the environment.
DESCRIPTION OF ACTION: Application of Willow Point'Property Owners
Association for'a permit' under the provisions of the'Wetland Ordinance
of the Town of Southold to maintenance dredge a 50' x 50' area of
Budd's Pond channel, removing 300 cu. yds. of sand and to be deposited
on Association Property located at Bay Home Road, Southold, New York.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effect to the environment are likely to
occur should the project be implemented as planned.
Because there has been no response in the atloted time from the
New York State Department of Environmental Conservation and the
Southold Town Building Department, it is assumed that there are no
objections nor comments from those agencies.

Trustee Smith: Number 20 is another Environmental Assessment for
Henry J. Tremblay. I'll take this one.
20B. Moved by Trustee Smith seconded by Trustee Bredemeyer it was
RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law State Environmental Quality Review and 6NYCRR Part 617, SeCtion
617.10 and Chapter 44 of the Code of the Town of Southold, notice
hereby given that the Southold Town Trustees, as lead agency for the
action described below, has determined that the project, which is
unlisted will not have a significant effect on the environment.
DESCRIPTION OF ACTION: Application of Henry J. Trembla¥ to construct
two floating docks on property located at 6060 Main Bayview Road,
Southold, New York.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment~has been submitted which indicated
that no significant adverse effect to the environment are likely to
occur should the project be implemented as planned.
Because there has been no response in the alloted time from the
New York State Department of Environmental Conservation and the
Southold Town Building Department, it is assumed that there are no
objections nor comments from those agencies.
Vote of Board: Ayes: All
This resolution was declared duly ADOPTED.
Trustee Smith: Number 21 is an Environmental Assessment for
the Beixedon Estates Association. John Bredemeyer will you take
this one.
Trustee Bredemeyer: Sure.
2lB. Moved by Trustee Bredemeyer seconded by Trustee Smith it was
RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law State Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the code of the Town of Southold, notice is
hereby given that the Seuthold Town Trustees, as lead agency for the
action described below, has determined that the project, which is
unlisted will not have a Significant effect on the environment.
DESCRIPTION OF ACTION: Application of the Beixedon E~tates Association
to maintenance dredge 50 to 60 cu. yds. using, scoup shovel in Hippodrome
Pond, on property located at Orchard Lane, Southold, New York.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effect to the environment are likely to
occur should the project be implemented as planned.
Because there has been no response in the alloted time from the
New York State Department of Environmental conservation and the Southold
Town Building Department, it is assumed that there are no objections or
comments from those agencies.
Vote of Board: Ayes: All -

Trustee Smith: Number 22 is to set Public Hearings on the Wetland
Applications. Any questions? (no response)
22. Moved by Trustee Smith s~con~e~ by Trustee Bednoski it was
RESOLVED that notice is hereby-given that public hearings will be
held by the Town Trustees of the Town of South01d, at the Southold
Town Hall, Main Road, Southold, New York, on Thursday, October 25,
1984 on the following applications for permits under the provisions
of the Wetland Ordinance of the Town of Southold:
8:00 P.M. - In the matter of the application of Bernard O. Monson
for permission to construct a bulkhead and docking assembly,
to dredge and backfill on property located at 750 Budd's Pond
Road, Willow Point, Southold.
8:05 P.M. - In the matter of the application of Willow Point
Property Owners Association to maintenance dredge in Budd's
Pond channel, removing sand and to deposit on Association Property
located at Bay Home Road, Southold.
8:10 P.M. - In the matter of the application of Henry J. Tremblay
to construct two floating docks on property located at 6060
Main Bayview Road, Southold.
8:15 P.M.- In the matter of the application of Beixedon Estates
Association to maintenance dredge, using scoup shovel, in
Hippodrome Pond, property located at Orchard Lane, Southoid.
All persons interested in said matter should appear at the time and
place above specified and will be given an opportunity to be heard.

Trustee Smith: The next item is a request for an extention on
a permit from the Department of Public Works for the Jockey Creek
Bridge reconstruction, Oaklawn Avenue, Southold.
23. Moved by Trustee Smith seconded by Trustee Bednoski it was
RESOLVED to approve the request made by the Suffolk County Dept. of Public
Works for an extention on permit no. 1691, Jockey Creek Bridge
reconstruction at Oaklawn Avenue, Southold for a period of Six
months. The permit will expire on April 24, 1984.

RESOLVED that the following Grandfather Applications are hereby
APPROVED.
1. John Timpson - To secure a permit for a dock in Mud Creek,
Cutchogue.
2. Russell A. Stassen - To secure a permit for a dock in East
Creek, Cutchogue.
3. Debra S. Cantor/Chester H. Hochbaum - To secure a permit for
a bulkhead in Broadwaters Cove, Cutchogue.
4. Robert P. Wreden - To secure a permit for a bulkhead in East
Creek, Cutchogue.
5. Francis S~ Perrone - To secure a permit for a catwalk, ramp
and float in Haywater Cove, Cutchogue.
6. Robert Pellegrini - To secure a permit for a catwalk and float
in East Creek, Cutchogue.
7. Roger A. Johnson/Jill A. Nord - To secure a permit for a dock
in Broadwaters Cove, Cutchogue.

This Resolution was declared duly ADOPTED.
Trustee Smith: We will move on to our Off-Agenda items now.
We have received information from the Packaging Products Corp.--
prices on the woven polypropylene bags for shellfish. 2. From
the Cooperative Extention Office an informational paper entitled
"Not in My Backyard." 3. Letter From Mr. Muehlbauer and Leah
Indelman regarding their dock. 4~ Letter from Mrs. Marion Mucciol.
They are putting the Trustees on alert that they do not want a
pond dredged and opened up. (In the Cedar Beach Area.) 5. The
Trustees will set up a meeting with the Town Board to discuss the
possibility of the trustees making the determination on the Wetlands.
Trustee Smith stated that they do not want to get into the enforcement
of the ordinance. 6. The Trustees directed a letter to go to the
DEC, advising them that they wish to be kept abreast on the progress
in Mattituck and Ashamomuck Pond, in regard to the bacteriological
results from water samples collected in these creeks. 7. A letter is
directed to Administrative Judge Samuel Kearing relative to the
hearing on Bayview Ventures. (DEC application fQr SPDES Permit.)
Trustee Bredemeyer: Are we going to have a work session with the
Town Board on the Houseboat Ordinance?
Trustee Smith: Yes. I think we will wait until after the November
meeting.

Trustee Bredemeyer: We were going to meet with %he Town Planner
to discuss the installation of bulkheads and retaining walls, and
what might be a good way to go.
Trustee Kujawski: I had a conversation with him some time ago.
He has no background on replacement at all. Most replacement on
the south shore is done in front. They have required in some cases
where leaching or something like that would not be a problem some
excavation, and replacement in back.
Trustee Smith: We will have to do it on a case by case basis.
Thats the end of our prepared agenda, does any of %he Trustees
have anything they would like to say?
Trustee Kujawski: I make a motion to adjourn.
Trustee Bredemeyer: I'll second that motion.
Moved by Trustee Kujawski, seconded by Trustee Bredemeyer it was
RESOLVED that this meeting be adjourned, at 8:35 P.M., there being
no further business to come before the board.
