Dear Mr. Sfaelos:
I am writing to confirm our telephone conversation this af~moon during which we
discussed the above-noted property. A~ noted In your letter, dated September
10, 2002, you wish to explore alternative land developmer)t options for this
property. During the convematlon you raised the following options that you wee
interested In pursuing: a~rdable housing or assisted living facilities. You
emph~i~-ed that as e part of an easement you had granted to the Suffolk County
Water Authority, that you had access to public water for whatever project you
decided to pumue. You also Indicated that you felt the A-C zoning of this
property was not In keeping with the chara~'t~r of the surrounding neighborhood.
I advised you that the Planning Board was unable to process a subdivision or site
plan application for any of the above-options. I also was unable to provide
guidance as to whether the Town Board would support a change of zone petition
for moro intensive uses. Attached Is a copy of the moratorium language under
which the Planning Board is operating. Its terms prohibit the acceptance of any
residential subdivision or residential site plan application by the Planning Board
except where an application meet~ with the exemption clauses: to wit, a lot-line
change, a set-off or a preservation-oriented application whereby 75~/o of the land
(excluding unbuildable land) is preserved. If you wish to explore the 75%

I advised you that the Planning Board was unable to process a subdivision or site
plan application for any of the above-options. I also was unable to provide
guidance as to whether the Town Board would support a change of zone petition
for more intensive uses. Attached is a copy of the moratorium language under
which the Planning Board is operating. Its terms prohibit the acceptance of any
residential subdivision or residential site plan application by the Planning Board
except where an application meets with the exemption clauses: to wit, a lot-line
change, a set-off or a preservation-oriented application whereby 75% of the land
(excluding unbuildable land) is preserved. If you wish to explore the 75%
preservation option, please contact the Land Preservation Coordinator, Melissa
Spiro, at 765-5711.
In response to your objection to waiting until the end of the moratorium before
taking any action, you were informed that you have the right to submit a request
to the Town Board for a waiver from the moratorium. Also, that the moratorium
does not preclude you from making a change of zone petition to the Town Board.
These application forms can be obtained from the Town Clerk's office at 765-
1800.

Dear Ms. Scopaz,
I have been advised that the Township is interested in
providing "affordable housing" for its residents and that the
panel is or may be reviewing areas in which such a project
would be suitable.
On September 10, 2002, I hand delivered the original of the
letter enclosed to the office of the Planning Board.
It is my belief that the premises identified above for the
reasons stated in my letter of September 10, 2002, would make
a good location for "affordable housing". Suffolk County Water
Authority has, by agreement, granted me public water to the
premises, which I feel is an essential element of my belief.
It would therefore be appreciated if

It is not my intention to bore you with details, but I feel some
background is necessary in this case.
Nearly four years ago, I hand deiivereO to the Planning Department a
proposed subdivision map of property consisting of 9.6 acres on
County Rd. 48 having a tax map designation: #74-2-22.1, and
requested a review and meeting with the Board upon review.
At that time, ! was advised that there was a new "study" was
underway for property on Route 48, and I would be advised. I waited
patiently but was never notified. In August of 2000, on visiting the
Town Hal!, I was told that the study was on!y for "comn~ercial

My intention was to construct something in keeping with the
surrounding area such as a cluster of single-f ~mily homes despite
the fact that the Zoning Code permits applications for many "non-
residential" alternative uses.
In fact, I was subsequently advised by the Housing Alliance that the
Southold desired to provide "affordable housing" in the area. Since
I have access to public water, having granted Suffolk County Water
an easement, I would desire to explore ~hat possibility with you.
In any event, my latest call to the Planning Board on September 6,
2002 revealed a new impediment has been placed before me, a
"moratorium". When i asked the reason for this new restriction on
subdivisions, no answer was forthcoming. I was told to call Mr. Mark
Terry today at !0:00 am. I called at 09:30, only to De informed that
he was going to a meeting, and could not speak to me. I was told
that he would call back by late afternoon. As of this date, I have
yet to receive a return call.
It would be appreciated therefore if you would extend to me the
courtesy of a meeting to discuss this situation at the earliest
possible opportunity, i have been patient for four years.
