The Regular Meeting of the Board of Town Trustees was held on August 30, 1984 at the Town Hall, Main Road, Southold. Present were: President Henry P. Smith Vice-President John Bredemeyer Trustee Frank Kujawski Trustee John Bednoski Secretary Ilene Pfifferling President Smith called the meeting to order. On motion, made by Trustee Kujawski seconded by Trustee Bednoski and carried the ~inutes of the July 18, 1984.~eeting were APPROVED. On motion made by Trustee Kujawski second by Trustee Bednoski and carried the October mooring renewal permits were APPROVED. On motion'made by Trustee Bednoski seconded by.Trustee Smith and carried the next regular meeting of the Board will be held on Thursday, September 27, 1984 at 7:30 P.M., inspections will be made on Wednesday, September 26th. RESOLUTIONS JAMES J. CANCRO On motion made by Trustee Kujawski seconded by Trustee Bredemeyer it was RESOLVED to APPROVE the application of James J. Cancro to place an offshore mooring in East Creek, with,the provision that the boat does not swing into any other boat or impede navigation. Vote of Board: Ayes: All RONALD GARSIK On motion made by Trustee Bednoski seconded by Trustee Kujawski it was RESOLVED to APPROVE the application of Ronald Garsik to place an offshore stake with pulley line to onshore stake in East Creek.. LEON MARCUS On motion made by T~us~ee Smith seconded by Trustee Kujawski it was RESOLVED to TABLE the~application of Leon Marcus to construct a fixed dock leading to a~ramp and two floats in Gull Pond, Greenport until a letter of permission from the property owner is submitted and the subject area is properly staked. Vote of Board Ayes: All LEON MARCUS - WETLAND APPLICATION NO.211 On motion made by Trustee Smith Seconded by Trustee Kujawski it was RESOLVED to recommend to the Town Board to TABLE the Wetland Application no. 211 for Leon Marcus until a letter of permission from the property owner is submitted and the subject area is properly staked. Vote of Board: Ayes: All THOMAS E. SAMUELS - WETLAND APPLICATION NO.2t2' On motion made by Trustee Ku~awski seconded by Trustee. Smith it.was RESOLVED to recommend to the Town Board APPROVAL of the Wetland AppliCation No. 212 for Thomas E. Samuels to construct a concrete rip-rap revetment, Narrow River Road, Orient with the stipulation that the revetment is planted in front with spartina grasses. Also, the Trustees would like to see enough open spaces so that the rip-rap does not become, a concrete wall. Sufficient inspections are to be made to see that the bottom of Hallocks Bay is no% invaded and that the navigational structures could be removed for the public's betterment as maintained in the application. Vote of Board: Ayes: All EDWARD JABLONSKI - WETLAND APPLICATION NO. 213 On motion made by>Trustee Smith seconded by Trustee Bednoski it was RESOLVED to recommend to the Town Board to DENY without prejudice, the Wetland Application No. 213 for Edward Jablonski as per application submitted. The Trustees do not want the marsh to the South end .of the boat basin destroyed; therefore, recommend disapproval of the application as submitted. Vote of Board: Ayes: All CHARLES J. GALLIGAN On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to APPROVE the application submitted by Charles J. Galligan to construCt a dock, ramp and float secured by two splles in Mattituck Creek, with the provision that the ~amp is elevated 3" over the marsh. Vote.of Board: Ayes: All Board of Town Trustees -3- August 30, 1984 6B. 7B. 8B. 9A. 9B. CHARLES J. GALLIGAN - WETLAND APPLICATION NO. 214 On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to recommend to the Town Board APPROVAL of the Wetland Application No. 214 for Charles J. Galliqan to construct a dock, ramp and float secured by two spiles in Mattituck Creek, with the provision that the ramp is elevated 3' over the marsh. Vote of Board: Ayes: All HEAGAN BAYLES - WETLAND APPLICATION NO. 215 The Trustees felt that the Wetland Ordinance does not apply to the application submitted by Hegan Bayles. Therefore, the Board would not make a recommendation regarding the application. GEORGE SWEENY - WETLAND APPLICATION NO. 216 On motion made by Trustee Bredemeyer seconded by Trustee Kujawski it was RESOLVED to recommend %o the Town Board to APPROVE the Wetland Application for George Sweeny as per application submitted. Vote of Board: Ayes: All EDWARD QUINTIERI AND RICHARD PULCINI On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to APPROVE the application of Edward Quintieri and Richard Pulcini to construct a timber bulkhead with two returns above the HWM and to backfill with 50 cu. yds.' of clean sand, James Creek, Mattituck. Vote of Board: Ayes: All EDWARD QUINTIERI AND RICHARD PULCINI - WETLAND APPLICATION 217 On motion made by Trustee Kujawski seconded by Trustee Bednoski 10A. 10B. it was RESOLVED to recommend to the Town Board APPROVAL of the Wetland Application no:. 217 for Edward Quintieri and Richard Pulcln~ as per application submitted. Vote .of Board: Ayes: All WILLOW POINT PROPERTY OWNERS ASSOCIATION The Trustees will hold this application until the State Environmental Quality Review is complete. WILLOW POINT PROPERTY OWNERS ASSOCIATION -WETLAND NO. 218 On motion.made by Trustee~Smith seconded by Trustee Bredemeyer it was RESOLVED that the Board of Southold Town Trustees hereby declares itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Willow Point Property Owners Association for a Wetland Permit on certain property located at Bay Home Road, Southold, New York. TREMBLAY - WETLAND APPLICATION NO¥ 219 On motion made by Trustee Smith seconded by Trustee Kujawski it was RESOLVED that the Board of Southold Town Trustees hereby declare itself lead agency in regard to the state Environmental Quality Review Act in the matter of the application'of Henry J. Tremblay for a wetland permit on certain property located at 6060 Main Bayview Road, Southold, New York. Vote of Board: Ayes: All JOHN J. NEWMAN On motion made by Trustee Kuuawski seconded by Trustee Bredemeyer it was RESOLVED to DENY without prejudice the application of John J. Newman to place an offshore mooring in J~%es Creek~ Mattituck. Vote of Board: Ayes: All There was discussion held relative to the applications submitted by John J. Newman. Trustee Kujawski spoke to Mr. Newman and it was the consensus of the Board that the application for the 43 ft. boat be denied and that this boat should be moored in a marina. JOHN J. NEWMAN On motion made by Trustee Kujawski seconded by Trustee Bredemeyer it was RESOLVED to APPROVE the mooring application of John J. Newman to place an offshore mooring in James Creek, with the provision that the boat will not swing into the channel or interfere with any other boat. Vo~e of Board: Ayes: All JOHN J. Newman to place an offshore mooring in James Creek, Mattituck. Vote of Board.: ~Ayes: All BEIXEDON ESTATES AssocIATION - WETLAND APPLICATION 220 On motion made by Trustee Smith seconded by Trustee Bednoski it was RESOLVED that the Board of Southold Town Trustees hereby declares itself lead agency in regard to the State.Environmental Quality Review Act in the matter of the application of Beixedon Estates Association_for a wetland permit on certain property located at Orchard Road, Beixedon Estates, Southold, New York. Ludwig Becker On motion made by Trustee Smith seconded by Trustee Bredemeyer it was RESOLVED to TABLE the Trustee application submitted by Ludwig Becket until a new wetland application is submitted, seeing t a--~he Trustees have taken over the Wetland Ordinance they will be acting on the Trustee and Wetland applications for this revised project. Vote of Board: Ayes: All BERNARD O. MONSON On hold until the SEQA prQcessis ~omplete. BERNARD O. MONSON - WETLAND APPLICATION NO.221 On motion made by Trustee Smith seconded by Trustee Bednoski it was RESOLVED that the Board of Southold Town Trustees hereby declares itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Bernard O. Monson for a wetland permit on certain property located at 750 Budd's Pond Road, Willow Point, Southold, New York. Vote of Board: Ayes: All JO-ANN GERARDI On motion made by Trustee Smith seconded by Trustee Kujawski it was RESOLVED to table the mooring application of Jo-Ann Gerardi for one mont~ to check for the availability of space for a mooring in the area. Vote of Board: Ayes: All JUNE L. HUSSEY On hold until the SEQRA process zs complete. JUNE L. HUSSEY - WETLAND APPLICATION NO. 224 On motion made by Trustee Smith seconded by Trustee Kujawski it was RESOLVED that the Board of Southold Town Trustees hereby declares itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of June L. Hussey for a wetland permit on.certain property loca--~at i065 Fleetwood Road, Cutchogue, New York. Vote of Board: Ayes: All Miss Lori Brooks appeared before the Board of Trustees to appraise the Board of the creek survey that was conducted this summer. Miss Brooks stated that by going out and meeting the public directlyit helped to clear up alot of the questions that the people may have had. It also helped to explain what the project is about and the purpose Of same. Miss Brooks felt that this process-takes a little more time to do, but the results are much better. Board of Town Trustees -6- August 30, 1984 COMMUNICATIONS 1. Fleet's Neck Property Owners Association requesting an easement for property located at Eugene's'Creek, near Fleet's Neck} Cutchogue. The Trustees referred this letter to ~Attorney Yakaboski. ~ 2 John Wlckham ' .letter reqnesting a quitclaim to a portion of land in Cutchogue. This letter will be referred to the Town Attorney for his review and recommendations. 3. Ethel Wortis requesting a quit claim to an area of beach which lies over the north channel the length of Mott Island. The Trustees visited the site and spoke to Mrs. Cook relative to this matter. The Trustees felt that ,no agreement has been reached at~thi~ time. They will forward this letter along with. a copy of a survey showing the proposed line to divide %he subject property. Copy. of the letter and survey will be forwarded to the Town Attorney and Southold Park District. 4. Lead Agency agreement between the Southold Town Trustees and the DEC. It was the consensus of the Board that each dredging project would be treated on .a case by case basis. A letter will be sent to Mr. Hamilton relative to this matter. Copy to Judith T. Terry, Town Clerk. 5. The Trustees discussed the letter from the BayvieW Development Corp. regarding a DEC permit. The Trustees advised that the Town will pursue the viQta~ion~,c .'- ~ .... 6. Letter from Mr. Van Name of Matt-A-Mar Marina. This matter was pre~iously discussed at a work session relative boat dockage. 7. Letter from Stephen Lupow in reference to Gull Pond bulkhead. In ~egard~-to-Ludwig Becker the trustees have requested a new wetland application for the project. 9. Letter from Cron &_Cron, Esqs., haS been referred to Attorney Francis J. Yakaboski the Trustees legal counsel zn regard to the Wade matter. 10. Letter from Joseph Ulrich requesting support of proposed dredging of Jockey Creek. The trustees directed that a letter be sen~ to Mr. Ulrich advising him that if he wishes to pursue the dredging of Jockey Creek, he could apply privately at his own expense, if at all possible. Com~ents relative to the Cantwell application were forwarded to the Town Clerk's office. Francis Romano - To secure a permit for decks, walks, retaining wall ramp and floating dock in East Creek, Cutchogue. W. P.
