The~Regular Meeting of the Board of Town Trustees was held on July 18, 1984 at the Town Hall, Main Road, Southold. Present were: President Henry P. Smith Vice-President John Bredemeyer Trustee Frank Kujawski Trustee John Bednoski Secretary' Ilene Pfifferling President Smith called the meeting to order. On motion made by Trustee Bredemeyer seconded by Trustee Kujawski and carried the minutes of the June 28, 1984 meeting were APPROVED. On motion made by Trustee Kujawski seconded by Trustee Bednoski and carried'the September mooring renewal permits~were APPROVED. On motion made by'Trustee Smith seconded by Trustee Bredemeyer and carried the next regular meeting of the Board will be held on Thursday, August 30, 1984. Inspections will be made on Auqust 29th. 1. JUNE L. HUSSEY On motion made by Trustee Kujawski seconded by Trustee Bredemeyer it was RESOLVED to TABLE 'the ~pplication of June'L. Husse¥ to replace an existing bulkhead and recover sand lost into the creek, East Creek, Cutchogue, un.tilha Wetland Application is submitted. Vote of Board: ~.Ayes: All 2A. JANET MADDAMS On motion made by Trustee Bredemeyer seconded by Trustee Bednoski it was RESOLVED to APPROVE the application of Janet Maddams to remove old deteriorated bulkhead and construct approximately 120' of new CCA-treated bulkhead in same location. Vote of Board: Ayes: ALL 2B. JANET MADDAMS-WETLAND APPLICATION NO. 200 On motion made by Trustee Bredemeyer seconded by Trustee Bednoski it was RESOLVED to recommend to the Town Board to APPROVE the Wetland Board of Town Trustees July 18, 1984 Application submitted by coS%e~io Marine Contracting Corp. on behalf of Janet Maddams as per application submitted. Vote of Board: Ayes: ALL 3A. THOMAS D. MAC DOUGALL On motion made by Trustee Bednoski seconded by Trustee Kujawski it was RESOLVED to APPROVE the application Of Thomas D. Mac Douqall to construct a ramp ~nd float .in Arshamomaque Pond, Southold with the provision that the width~of the~amp is 'reduced from 6ft. to 3ft. or less. Vote of Board: Ayes: ALL 3B. THOMAS D. MAC DOUGALL - WETLAND APPLICATION NO. 205 On motion made by Trustee Bednoski seconded by Trustee Kujawski it was RESOLVED to recommend ~to the Town Board to APPROVE the Wetland Application No. 205 submitted by Thomas D. Mac Dougall to construct a ramp with a float dock, with the provision that the width of the ramp is reduced from 6ft. to 3ft.~of less. Vote of Board: Ayes: ALL ~. ~.~ 4A. JAMES C. BROWN ~ On motion mad.e by Trustee Ku~awski'seconded by Trustee Bredemeyer it was RESOLVED to APPROVE the application submitted by. James C. Brown to construct a ramp and floats in East Creek, Cutchogue, as per ~application submitted. Vote of Board: Ayes: ALL 5B. BAYVIEW DEVELOPMENT CORP. - WETLAND APPLICATION NO. 204 On motion made by Trustee~Smith seconded by Trustee Bednoski it was R~SOLVED to recommend to the Town Board to DENY the Wetland Application No. 204 submitted by Bayview'DevSlopment Corp. 'because of the work that has been done ~ithout proper wetland and trustee permits. _The Trustees feel this is wetland area, and will not take action until such violations are satisfied. Vote of Board: Ayes: ALL 6B. HARBOR LIGHTS PROPERTY ASSOCIATION - WETLAND APPLICATION NO..206 The Trustees discussed the Wetland~Application NO. 206 submitted by the Harbor Lights Property Association, in South~ld. Trustee Smith and Trustee Kujawski would recommend to the Town ~Board APPROVAL of said application, with the provision that the spoil is removed in a manner consistant with the bulkhead height, and to the satisfaction of Mr. McGuire, the property owner on the North side of the canal. Trustee Bredemeyer an~ Trustee Bednoski would recommend DENIAL. Trustee Bednoski felt that this work has been done before the proper permits were secured. He will not approve of any work that is done before permits are secured. Trustee Bredemeyer felt that permits should be secured first, before work is done. He would refer this to the Building Department for further action, then take up the matter at a later date. Vote of Board: Ayes: Trustee Smith, Trustee KUjaWski Noes: Trustee Bredemeyer, Trustee Bednoski This Resolution was declared lost. Board of 'Town Trustees - July 18, 1984 7. WILLIAM ROSE On motion made by Trustee Bredemeyer seconded by Trustee Kujawski it was RESOLVED to APPROVE the application of William Rose to place an offshore stake with pulley line to onshore stake in Narrow River, with the provision that the boat is placed between mooring numbers 197 and 394. Vote of Board: Ayes: All 8. LEONARD BECKENSTEIN On motion made by Trustee Kujawski seconded by Trustee Bredemeyer it was RESOLVED to APPROVE the application of Leonard Beckenstein to place an offshore mooring in Mattituck Creek, with the provision that a minimum of a 150 lb. anchor is used and that a stern anchor is used to keep the boat from swinging. Vote of Board: Ayes: All 9. ANN ROGERS On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to APPROVE the application of Ann Rogers tO place an offshore stake with pulley line to onshore stake in James Creek as per application submitted. Vote of Board: Ayes: All 10B. RICHARD CANTWELL On motion made by Trustee Bredemeyer seconded by Trustee Kujawski it was RESOLVED to recommend to the Town Board to Disapprove the Wetland Application No. 207 submitted by Richard J. Cantwell to dredge Approximately 18,600 cu. yds. to enlarge and connect-two existing irrigation p~nd~- Main Road. Orient. The Trustees recommended disapproval.of this application because of the irreversible damage to th~ spartina ring around the pond. They felt that a project of such size would puncture and possibly irreversibly damage the water supply. The project directly faces a number of residential homes along Cedar Birch Drive and could directly affect the water supply. Looking over the Short Environmental Assessment form several of the questions should have been answered affirmative. Vote of Board: Ayes: All llA. LUDWIG BECKER-HUNT On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to Deny without prejudice the application of Ludwig Becker toconstruct a timber retaining wall plus two returns, timber dock, catwalk, ramp, mooring piles and to dredge, Jockey Creek, Southold. Vote of Board: Ayes: All The Trustees were opposed to the size of the above referenced project. They were concerned with the dredging so close to the existing shore- line, that it could possibly under-mine the marsh area. Board of Town Trustees - July 18, 1984 liB. LUDWIG BECKER-HUNT - WETLAND APPLICATI©N NO. 208 On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to recommend to the Town Board to Deny without prejudice the Wetland Application No. 208 submitted by En-Consultants, Inc. on behalf of Ludwiq Becker. The Trustees were opposed to the size of the project. They were concerned with the dredging so close to the existing shoreline that it could possibly under-mine the marsh area. Vote of Board: Ayes: ALL 12A~ JOHN DICARLO On motion made by Trustee Smith seconded by Trustee Bredemeyer it was RESOLVED to APPROVE the apPlication submitted by John Di Carlo to reconstruct a timber retaining wall and return within 18" of the existing structure, Town Creek, Southold, with the provision that the structure is replaced in place. The Trustees felt that there was no reason to go out the 18" in front. Vote of Board: Ayes: All 12B. JOHN DICARLO - WETLAND APPLICATION NO. 209 On motion made by Trustee Smith seconded by Trustee Bredemeyer it was RESOLVED to recommend to the Town.Board to APPROVE the Wetland Application No 209 for John DiCarlo with the provision that the structu~e'is ~eplaced in place. The Trustees felt that there was no need to go 9ut the 18" in front. Vote ofi~Board:~ AyeS: All 13. MARTIN GELLMAN on motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to APP.ROVE the offshore mooring application for Martin Gellman in Mat~it~uck Creek, with the provision that a minimum of a 150 lb. anchor is used. If the boat swings, then a stern anchor may be needed. Vote of Board: Ayes: All 14. RICHARD & JANET BROCK-KRAEBEL On motion made by Trustee Bredemey~r seconded by Trustee Smith it was RESOLVED to APPROVE the mooring ~application of Richard & Janet Brock-Kraebel to place an offshore mooring in Goose Creek, Southold as per application. Vote of Board: Ayes: All 15. RICHARD DEMARIA On motion made by Trustee Smith seconded by Trustee Kujawski it was RESOLVED to APPROVE the mooring application of Richard DeMaria to place an offshore mooring in Corey Creek, as per application. Vote of Board: Ayes: All Board of Town Trustees - July 18, 1984 16. CHRIS MESKOURIS On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to APPROVE the mooring application of Chris Meskouris to place an offshore mooring in Mattituck Creek, with the provision that a 100 lb. anchor is used, and provided that the boat does not swing into any other boat or impede navigation. Vote Of Board: Ayes: All 17. JOSEPH DENICOLO On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to APPROVE the offshore mooring application of Joseph DeNicolo to place an offshore mooring in James Creek, with the provision that the boat does not swing into any other boat or impede navigation. Vote of Board: Ayes: All On motion made by Trustee Kujawski seconded by Trustee Bredemeyer and carried, the following Grandfather Applications were APPROVED. Vote of Board: 1. William Nicol - To secure a permit for a dock in East Creek. 2. Nancy P. Cogswell - To secure a permit for a ramp and dock in Wickham Creek. 3. Lorraine Dunhuber.- To secure a permit for a_bulkhead in East Creek. 4. Jay Tuthill - To secure a permit for a bulkhead in East Creek. 5. George Kiefer - To secure a permit for a catwa-£k and dock in East Creek. Ayes: All The Following correspondence 'was reviewed: 1. Letter from Mrs. Gledich requesting an extention of time on her permit no. 1452. 2. Request from Dr. Rauch for a quitclaim to property at Gull Pond, Greenport. 3. Mr. Kassners request to delete a name on his permit. 4. Discussion on Scallop Bag for the harvest of Shellfish. 5. Letter from Arthur Tyrrell regarding rip-rap project for Mr. Samuels at Narrow River, Orient. 6~ Name plates for the Trustees. The Board discussed, with Mr. Roger Stoutenburgh, a problem that was brought to the attention of the Board regarding Mr. Stoutenburghs dock in Mud Creek, It was decided that the dock should be placed on an angle to avoid blocking the channel. The Trustees asked for an updated sketch of the dock structure for the files. Mr. Bondarchuck appeared before the Board and requested to be entered into the record as being opposed to the use of the measured bag for the harvest of shellfish. Board of Town Trustees - July 18, 1984 There was a discussion held relative to the proposed housebarge ordinance. It was decided that a meeting should be scheduled with Mr. Irving Price, Jr.,~Mr. Iglesias, Mr. William Yetter, Mr. Tasker and the Town Board Members to get more input in regard to this matter. On motion made by Trustee Kujawski seconded by Trustee Bredemeyer it was RESOLVED that this meeting be and hereby is adjourned at 9:30 P.M.
