Box 1179 Southold, NY 11971-0959 Office Location: Town Annex IFirst Floor, North Fork Bank 54375 Main Road (at Youngs Avenue) Southold, NY 11971 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF MAY 10, 2007 ZB File # 6015 - Leila Hadley Luce CTM 10-8-1.2 Property Location: West Side of Montauk Avenue/East Side of Private Right-of-Way, Fishers Island SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicant's 4,517 square feet non-conforming parcel in an R-40 District is improved with an existing single-family, two-story dwelling and accessory shed, as shown on survey prepared by CME Associates Engineering, Land Surveying & Architecture, PLLC dated 1/5/2007. BASIS OF APPLICATION: Request for a Variance under Section 280-124, based on the Building Inspector's August 25, 2006 Notice of Disapproval, amended March 7, 2007 concerning proposed additions and alterations to an existing single-family dwelling at less than 35 feet from the westerly front yard lot line. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated April 5, 2007 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 26, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant proposes to construct a second-story seasonal, screened porch over an existing mudroom with a front yard setback instead of the code- required 35 feet from a private right-of-way. The setback is requested at 25.4 feet, as noted on the March 22, 2007 site plan prepared by CME Associates Engineering, Land Surveying & Architecture. Page 2 - May 10, 2007 ZB Fil~ No. 6015 - Leila Hadley Luce CTM No. 10-8-1.2 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed second-story screened porch is modest in size at 25' x 7' and will be supported by structural columns above an existing, at grade, one-story mudroom. The private right-of-way which the screen porch will face is a pedestrian footpath that is heavily vegetated and virtually unused. It will not be visible from the architectural front yard facing Montauk Avenue. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the applicant's irregularly shaped lot contains severe slopes that create practical difficulties for locating a screened porch addition to the home in an area that does not require a variance. Moreover the property contains two front yards and the principal two-story framed dwelling has a non-conforming front yard setback from Montauk Road of 4' 8" which additionally limits the siting of a screened porch in a conforming location. 3. The variance granted herein is substantial. The request is for a 9.6 feet setback variance starting at the southwest corner of the proposed addition, which is the closest point to the private right-of- way diminishes over a length of 20 feet of the total 25 ft. length of the proposed screened porch, at which point the setback is conforming at 35 feet. A reduction from 35 feet to 25.4 feet represents a variance of 27% from the code requirement. 4. The difficulty has not been self-created but is the result of pre-existing non-conforming setbacks, two front yards, and severe slopes on the subject property. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a benefit of a seasonal screened porch, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Oliva, and duly carried, to GRANT the variance as applied for, as shown on the 1/5/07 survey, the 2/9/2007 site plan, and undated elevation diagram with ZBA date stamp March 22, 2007, prepared by CME Associates Engineering, Land Surveying & Architecture, PLLC. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code.
