The regular meeting of the Board of Town Trustees was held on Thursday, March 29, 1984 at the Town Hall, Main Road, Southold. Present were: President Henry P. Smith Vice-President Jean Cochran Trustee Frank Kujawski Trustee John Bednoski Trustee John Bredemeyer Clerk Ilene Pfifferling President Smith called the meeting to order. On motion made by Trustee Cochran seconded by Trustee Bednoski and carried it was RESOLVED to approve the minutes of the Febr.uary 27, 1984 meeting with the correction on page 4, the application for Daniel Silverman is to read "the length of the boat be limited to 32 ft." On motion made by Trustee Kujawski seconded by Trustee Cochran and carried the mooring renewal permits fOr the month of May were approved with the stipulation that a letter is to be sent to Mr. Roger Sie~ka advising him to move his mooring away from the launching ramp and out away from the anchorage area. On. motion made by Trustee Smith seconded by Trustee Cochran &nd carried it was RESOLVED that the date for the next regular Trustee meeting will be held on April 26, 1984, inspections will be made on April 25, 1984 starting at 2:00 P.M. K. W. AKSON On motion made by Trustee Bednoski seconded by Trustee Cochran it was RESOLVED to Approve the application of K. W. Akson to construct a floating dock parallel to existing bulkhead at Kimogenor Point, New Suffolk with the provision that a letter of permission is submitted from the Kimogenor Point Association, stating that Mr. Akson Bcard of Town Trustees -2- March 29, 1984 has approval from them dock in front of the ~ bulkhead. ~ .... AKSON-WETLAND APPLICATTON 't84 On motion made by Trustee Bednoski seconded by Trustee Cochran it was RESOLVED to recommend to the Town .Board Approval of the Wetland Appl- ication ~184 for K. W. Akson to construct a float dock in front of Existing bulkhead at Kimogenor Point, New Suffolk with the provision that a letter of permission is submitted from the Kimogenor Point Association, stating that Mr. Akson has approval from them to place the dock in front of the bulkhead. Vote of Board: Ayes: All ROBERT WILSON On motion made by Trustee Cochran seconded by Trustee Ku~awski it was RESOLVED to Approve the application of Robert Wilson to construct a catwalk, ramp and floats in West Creek, Southold, with the provision that the float does not go out more than 10 ft. out from the bank into the water. Vote of Board: Ayes: All ROBERT WILSON-WETLAND APPLICATION 187 On motion made by Trustee Cochran seconded by Trustee Kujawski it was RESOLVED to recommend to the Town Board Approval of the Wetland Application ~187 for Robert Wilson to construct a catwalk, ramp and floats in West Creek, Southold, with the provision that the float do¥~% not go out more than 10 ft. out from the Bank into the water. ~ Vote of Board: Ayes: All MATTITUCK INLET MARINA On motion made by Trustee Bredemeyer seconded by Trustee Kujawski it was RESOLVED to Approve the application of Mattituck Inlet Marina to replace (within 18") 90+ lf. of existing steel bulkhead and backfill with 10 cu. yds. of sand to be trucked in from commercial upland source with the provision that the new steel bulkhead is replaced 18" inshore of the existing bulkhead. Vote of Board: Ayes: All MATTITUCK INLET MARINA-WETLAND APPLICATION 186 On motion made by Trustee Bredemeyer seconded by Trustee Kujawski it was RESOLVED to recommend to the Town Board Approval of the Wetland Application 186 for Mattituck Inlet Marina to replace (within 18") 90+ lf. of existing steel bulkhead and backfill with 10 cu. yds. of sand to be trucked in from commerical upland source with the provision that the new steel bulkhead is replaced 18" inshore of the existing bulkhead. Vote of Board: Ayes: All FERUCIO FRANKOLA-WETLAND APPLICATION 185 On motion made by Trustee Bedenoski seconded by Trustee Kujawski it was RESOLVED to recommend to the Town Board denial of the Wetland -- Application 185 for Ferucio Frankola to construct two atlantic davit~,~ and to dredge in basin off Goose Creek. Vote of Board: Ayes: Trustee Smith, Trustee Kujawski, Trustee Bednoski Abstain: Trustee Coc~ran, Trustee Bredemeyer Board of Town Trustees -3- March 29, 1984 There was discussion held as to the reasons for recommending disapproval of the aforesaid application. Some of the reasons mentioned were that the Trustees would not approve of the installation of davits on private property, but would.approve of the dredging portion of the application; recommend approval subject to no commercial use. WILLIAM KNOELLER On motion made by Trustee Cochran seconded by Trustee Bednoski it was RESOLVED:to approve the application of William Knoeller to construct an elevated walk, ramp and floating dock in Jockey Creek, Southold all in accordance with the detailed specifications as presented in the originating application. Vote of Board: Ayes: All WILLIAM KNOELLER-WETLAND APPLICATION 188 On motion made by Trustee Cochran seconded by Trustee Bednoski it was RESOLVED to recommend to the Town Board approval of the Wetland Application 188 for William Knoeller to construct an elevated walk, ramp and floating dock in Jockey Creek, Southold all in accordance with the detailed specifications as~ presented in the originating application. Vote of Board~ Ayes: All JAMES & PETER KREH On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to approve the application of James & Peter Kreh to re- construct a floating dock and ramp and to dredge and backfill behind new bulkhead and to install piling for the dockage of boats in James Creek, north of Strongs Marina, Mattituck, with the provision that there is to be no dredgIng, clean fill is to be brought in from upland source. Vote of Board: Ayes: All JAMES & PETER KREH-WETLAND APPLICATION 191 On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to recommend to the Town Board approval of the Wetland Application for James & Peter Kreh to reconstruct a floating dock and ramp and to dredge and backfill behin~ new bulkhead and to install piling for the dockage of boats in James Creek, north of Strongs Marina, Mattituck, with .the provision that there is to be no dredging, clean fill is to be brought in from upland source. Vote of Board: Ayes: All JOHN G. SCOTT, III On motion made by Trustee Bednoski seconded by Trustee Kujawski it was RESOLVED to approve the application of John G. Scott, III to construct a catwalk and two floats secured by pilings in Richmond Creek, Cutchogue, with the provision that this permit will be issued for one year as a pilot project. Vote of Board: Ayes: All JOHN G. SCOTT, III-WETLAND APPLICATION 189 On motion made by Trustee Bednoski seconded by Trustee Ku~awski it was RESOLVED to recommend to the Town Board approval of the Wetland Application for John G. Scott to construct a catwalk and t~u floats Board of Trustees -4- March 29, 1984 secured by pilings in Richmond Creek, Cutchgoue, with the provision ~ that this permit will be issued for one year as a pilot project. ~-~ Vote of Board: Ayes: All Mr. Scott will install clam racks between these floats to experiment with the growth of clams and oysters. The Trustees feel that this permit would be given for one year because the floats are put out a little farther than usual. If the project works, it would be to the advantage of the town. At one time there were numerous oysters at the head of the creek. If the dock was to be used only for the mooring of a boat, the Trustees would not want the dock to extend as far out into the water. ROBERT J. MUNCH On motion made by Trustee Kujawski seconded by Trustee Cochran it was RESOLVED to approve the application of Robert J. Munch to place an offshore mooring in Mattituck Creek, Mattituck with the provision that the boat is placed ahead of the northwest and northeast markers of the Federal Anchorage Area, so that it doesn't block the channel or interfere with the Anchorage Area. Vote of Board: Ayes: All THOMAS HEWLETT On motion made by Trustee Bednoski seconded by Trustee Kujawski it was RESOLVED to Approve the application of Thomas Hewlett to place an offshore mooring in Mud Creek, with the provision that the boat does not swing into any other boat or impede navigation. Vote of~Board: Ayes: All JOHN L. BRAIDER On motion made by Trustee Cochran seconded by Trustee Bredemeyer it was RESOLVED to approve the application of John L. Braider to construct catwalk, ramp and two floating docks, in a T formation, in Gull Pond, Greenport, with the provision that the entire structure does not exceed 50' out into the water, offshore, unless need for greater length can be established. Vote of Board: Ayes: All JOHN L. BRAIDER-WETLAND APPLICATION 190 On motion made by Trustee Cochran seconded by Trustee Bredemeyer it was RESOLVED to recommend to the Town Board approval of the Wetland Application ~190 for John L. Braider to construct a catwalk, ramp and twu floating docks, in a T Formation.. in Gull Pond, Greenport, with the provision that the entire structure does not exceed 50' out into the water, offshore, unless need for greater length can be established. Vote of Board: Ayes: All The applications for Peter Holland and Maxine Kessler were not acted upon, seeing that they were out of the Trustees jurisdiction. On motion made by Trustee Smith seconded by Trustee Kujawski it was RESOLVED that the application fees, for the persons listed above, would be returned.. Vote of Board: Ayes: All Board of Trustees -5- March 29, 1984 DR. FRANCIS PERRONE On motion made by Trustee Smith seconded by Trustee Cochran it was RESOLVED to Table the application of Dr. Francis Perrone to construct a catwalk, ramp and float at the edge of Gid's Island, Orient, for one month. Vote of Board: Ayes: All DR. FRANCIS PERRONE-WETLAND APPLICATION 192 On motion made by Trustee Smith seconded by Trustee Cochran it was RESOLVED to recommend to the Town Board to Table the Wetland Appli- cation of Dr. Francis Perrone to construct a catwalk, ramp and float at the~edge of Gid's Island, Orient, for one month. Vote of Board: Ayes: All Due to the inclement weather, the Board felt it would be only fair to the people in Orient to Table the above referenced application. NORTH FORK PROPERTY DEVELOPMENT lots 21 On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to disapprove the application of North Fork Property Development to construct a bulkhead, with returns, ramp and float dock and to dredge in Deep Hole Creek, Mattituck. Vote of Board: Ayes: All NORTH FORK PROPERTY DEVELOPMENT Lot 21 - WETLAND APPLICATION 176 On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to recommend to the Town Board Disapproval of the Wetland Application 176 for North Fork Property Development for lot 21 in Deep Hole Creek, to construct a bulkhead, with returns, ramp and float dock and to dredge in Deep Hole Creek, Mattituck. Vote of Board: Ayes: All NORTH FORK PROPERTY DEVELOPMENT lot 22 On motion made by Trustee Kujawski seconded by Trustee BednoSki it was RESOLVED to disapprove the application of North Fork Property Development to construct a bulkhead, with returns, ramp and float dock and to dredge in Deep Hole Creek, Mattituck. Vote of Board: Ayes: All NORTH FORK PROPERTY DEVELOPMENT lot 22-WETLAND APPLICATION 177 On motion made by~Trustee Kujawski ge¢onded by Trustee Bednoski it was RESOLVED to recommend to the Town Board disapproval of the application of North Fork Property Development, to construct a bulkhead, with returns, ramp and float dock and to dredge in Deep Hole Creek, Mattituck, Vote of Board: Ayes: All After a lenghty discussion, it was the consensus of the board that if ~r. Perricone could get together with the neighbors in that area, he could submit another application, for a structure similar to that in the neighboring area. Board of Trustees -6- March 29, 1984 MATT-A-MAR MARINA On motion made by Trustee Kujawski seconded by Trustee Cochran it was RESOLVED to disapprove the application of Matt-A-Mar Marina to construct a catwalk, ramp and floating dock in Mattituck Creek, Mattituck. Vote of Board: Ayes: All MATT-A-MAR MARINA-WETLAND APPLICATION 193 On motion made by Trustee Kujawski seconded by Trustee Cochran it was RESOLVED to recommend to the. Town Board to disapprove the application of Mat-A-Mar Marina to construct a catwalk, ramp and floating dock in Mattituck Creek, Mattituck. Vote of Board: Ayes: All There was a lenghty discussion held in reference to this application. Mrs. Dorothea M. Delehanty, President of the Mattituck Creek Watchdogs, appeared before the board to discuss this application. She gave a brief account of the area, and the Marina. After hearing her account the above referenced resolution was offered. On motion made by Trustee Cochran Seconded by Trustee Bredemeyer it was RESOLVED that the request for an extention on the permit of Mr. Howard Stabile was granted for a period of six months, permit expires Sept. 84. Vote of Board: Ayes: All On motion made by Trustee Smith seconded by Trustee Bednoski it was Resolved to accept the letter from Mr. William Smith on behalf of Augustus Fink, withdrawing his application before the Board. This Letter pertains to his Wetland Application also. Vote of Board: Ayes: All TERRY C. NAGY On motion made by Trustee Cochran seconded by Trustee Smith it was RESOLVED to deny the application of Terry C. Nagy to place blocks and a Stake in Town Creek. Vote of Board: Ayes: All The trustees decided that,Mr. Naqy should reapply using a mushroom anchor, he will have to state where his public access is from. A letter is to be sent to ~rs. Pauline Israe~ i~ Qull Pond_ stating that the bulkhead that was constructed has no permit. This letter~ ~ ~ts ~o ~b~-~e~% C~rti_led Mail ROBERT STEWART On motion made by Trustee Smith seconded by Trustee Cochran it was RESOLVED to approve the request of Mr. Stewart to construct the dock to a width of 4'~ in Mattituck Creek. Vote of Board: Ayes: All Board of Trustees -7- March 29, 1984 HOWARD STABILE On motion made by Trustee Cochran seconded by Trustee Bednoski it was Resolved to approve the request of Howard Stabile, for an extention of time on his permit No. 1594 for a period of six months. The permit will expire on September 29, 1984. Vote of Board: Ayes: All A letter is to be sent to Mr. Stabile advising him of this extention of time· on his permit. DOROTHY~SORRANO _ On motion made by Trustee Bednoski seconded by Trustee Kujawski it was Resolved to approve the application of Dorothy Sorrano to secure a permit for a dock in Fairhaven Inlet· SouthOld, under the Grandfather Clause. Vote of Board: Ayes: All ROBERT GARBEN On motion made by Trustee Bednoski seconded by Trustee Kujawski it was Resolved to approve the application of Robert Garben to secure a permit for a dock in Deep Hole Creek· under the Grandfather Clause. --~.~- Vote of Board: Ayes: All ROBERT GARBEN On motion made by Trustee Bednoski seconded by Trustee Kujawski ~t was Resolved to approve the application of Robert Garben to secure a permit for a mooring in Deep Hole Creek, Mattituck, with the provision that the boat does not swing into any other boat or impede navigation. Vote of Board: Ayes: All RUTH BELL On motion made by Trustee Smith seconded by Trustee Bredemeyer it was Resolved to approve the request of Robert Wesley, to transfer his permit to Ruth Bell.(Permit 1530) Vote of Board: Ayes: All Board of Trustees -8- March 29, 1984 On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED that this meeting be and hereby is adjourned at t0'%20 P.M.
