BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD Town Hall, 53095 Main Road P.O. Box 728 Southold, New York 11971 DECEMBER 26, 1985 TELEPHONE (516} 765-1892 7:30 P.M. - REGULAR MEETING The Regular Meeting of the Board of Town Trustees was held on DECEMBER 26, 1985 at the Town Hall, Main Road, Southold. President Smith opened the meeting at 7:30 P.M. PRESENT WERE: President Henry P. Smith Trustee John Bredemeyer Trustee John Bednoski Trustee Prank Kujawski Secretary Ilene Pfifferling Bay Constable Don Dzenkowski Trustee Smith: May I have a motion to approve the minutes of the October 30, 1985 regular Trustee meeting? Moved by Trustee Kujawski seconded by Trustee Bredemeyer it was RESOLVED to APPROVE the minutes of the OCTOBER 30, 1985 meeting. Vote of Board: Ayes: Ail This resolution was declared duly adopted. Trustee Smith: Next is to approve the minutes of the Novermber 27th meeting. Moved by Trustee Bredemeyer seconded by Trustee Kujawski it was RESOLVED to APPROVE the minutes of the NOVEMBER 27, 1985 meeting. Vote of Board: Ayes: Ail This resolution was declared duly adopted. Trustee Smith advised that the date for the January field inspections will be held on January 16, 1986 to depart at 2:00 P.M. from Town Hall, Southold. The date for the next regular Trustee ~eeting will be held on January 23, 1986 to commence at 7:30 P.M.. There will be an~ Organizational Meeting held on January 2, 1986 at 7:30 P.M. for the purpose of electing a President of the Board, appointing a Vice-President and Clerk. Board of Trustees - December 26, 1985 - Page 2. Moved by Trustee Bredemeyer seconded by Trustee Kujawski it was RESOLVED to APPROVE the February 1986 mooring renewals. Vote of Board: Ayes: All This resolution was declared duly adopted. Trustee Smith gave the Trustee report for November 1985 as follows : Application fees $10.00, Wetland Application fees $400.00, Dock, Ramp fees $60.00, Wetland Inspection fees $35.00 and mooring renewal fees $60.00 for a total amount of $565.00 which has been turned over to the Supervisor to be deposited in the general fund. Trustee Smith di'spensedl with the reading of the public notices, but advised they are listed on.the a~end~ and posted on the bulletin board if any one wishes to review them. President Smith con~enced with the Communications. III. COMMUNICATIONS: Trustee Smith: The first one is from the Land Use Company requesting to amend the wetland application of Walter Wappus. Moved by Trustee Bredemeyer seconded by Trustee Kujawski it was RESOLVED to APPROVE the request made by the Land Use Company on behalf of Walter Wappus to amend the application submitted to include and additional 37' on the northern return of the bulkhead. Vote of Board: Ayes: All This resolution was declared duly adopted. Trustee Smith: Next is a request for an extension on a wetland permit for Stephen Shilowitz. Moved by Trustee Bredemeyer seconded by Trustee Bednoski it was RESOLVED to APPROVE the request by Stephen Shilowitz for an extension of slx months on his wetland permit. The permit will expire on May 26, 1986. Vote of Board: Ayes: All This resolution'was declared duly adopted. Trustee Smith: The next communication is from Robert Parkin regarding the wetland application for North Fork Property Development. ~. Then from George Bird another letter regarding the North Fork Property Development. 5. A request by the Town Board to meet with ~hem on December 27, 1985 to discuss the Matt-A-Mar application. Moved by Trustee Bredemeyer seconded by Trustee Bednoski it was RESOLVED that Trustee Smith and possibly Trustee Kujawski will meet with the Town Board on December 27, 1985 to discuss the Matt-A-Mar wetland application. Vote of Board: Ayes: Ail This resolution was declared duly adopted. Board of Trustees - December 26, 1985 - Page 3. 6. Is a request f~om .Attorne¥.Paul~A. Caminiti on behalf of Anna Pacifico~for .a determination on the need of an application for a swimming pool~on~property located on Blue Marlin Drive, Southold. It was the consensus of the Board that they did not have jurisdiction, in regard to this matter. 7. From Anthony DeMaula~.a request to rsplace damaged and broken spiles .at the Anchor Inn property in Mattituck. Trustee Smith advised that The Board would give him permission to do the work provided he submits a letter of permission from the owner of the property before he commences work. 8. From Rita M. Jones comments on the Carlucci wetland application. Trustee Smith advised that this letter will be read during the public hearing scheduled~'this_i_ evening~_~9.1Fr~m Eh-Consultants, Inc. on behalf of Neil Simon a request to hold the application of Neil Simon in abeyance until the question of the covenants and restrictions are resolved. 10. From Dr. George D. Richards comments regarding the application of the North Fork Property Development. This letter will be placed in the file. 11. From James H. Redman comments regarding the shellfish lands in the Town of Southold. 12. From J. J. Newman a request to modify his proposal for the bulkhead. 13. From Joseph Schoenstein a request to amend his wetland application. Moved by Trustee Bredemeyer seconded by Trustee Bednoski it was RESOLVED to Approve the request of Joseph Schoenstein to modify his wetland application to include the construction of a Building and to fill all in accordance with the site plan submitted. Vote of Board: Ayes: All This resolution was declared duly adopted. Trustee Smith: That concludes our communications. Next ws wilt do our Resolutions, since it is not eight o'clock yet. V. RESOLUTIONS: Trustee Smith: The first one is to make a request for Town Board approval to authorize Town Planner, David Emilita to review the DEIS submitted by Thomas Cramer. Moved by Trustee Bednoski seconded by Trustee Kujawski it was RESOLVED that the Town Trustees request that the Town Board authorize David Emilita, Town Planner to review the DEIS submitted by Thomas Cramer for the construction of a single family residence on Meadow Lane, Mattituck. Vote of Board: Ayes: All F~TT-A-MARMARINA M~ed by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED that the Town Trustees recommend disapproval on the Wetland Application submitted by Matt-A-Mar Marina and directed the secretary to submit a letter stating the following: This application was disapproved by the Trustees as the Board felt Board of Trustees - December 26, 1985 - Page 4. that the application was excessive and more importantly the Board had an agreement with Dr. Agarabi, President of Matt-A-Mar Marina that there would be no construction or further~expansion of the marina on the south side of the property after the Board allowed the the retaining wall to remain. The Trustees have reviewed a DEIS, and have feelings that environmental impacts, such as the lighting and personal protection of a dock of that lenqth~ '.This would create a noisy and distributive intrusion into the night- time life, especially the shorebirds and other creatures that would use that almost 500 ft. section off.intertidal marsh~'for feeding. That would irrevocably remove that from natural feeding f0r the most part of the summer. The fact that the DEIS did not include an alternative, or mitigation, for the need of a launch, was an obvious point ~hat should have been mentioned. 2. JOHN XIKIS - LEAD AGENCY DECLARATION Moved by Trustee Smith seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of En-Consultants, Inc. on behalf of John Xikis for a wetland permit on certain property located on Middle Road, Southold. 3. Vote of Board: Ayes: All This resolution was declared duly adopted. 4. JOSEPH SCHOENSTEIN - LEAD AGENCY DECLARATION Moved by Trustee Bredemeyer seconded~by Trustee Bednoski it was RESOLVED that the Southold Town Trustees declare itself lead aqency in regard to the State Environmental Quality Review Act in the matter of the application of Joseph Schoenstein for a wetland permit on certain property located on Main Road, Greenport. 4. Vote of Board: Ayes: All This resolution was declared duly adopted. 5. ALBERT BRENEISEN - LEAD AGENCY DECLARATION Moved by Trustee Bredemeyer seconded by Trustee Bednoski it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Albert Breneisen for a wetland permit on certain property located on Dawn Drive, East Marion. 5. NEGATIVE DECLARATION NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT December 26, 1985 APPLICATION N0.327 NAME: Land Use Company on behalf of Ian Shand This notice is issued pursuant to the provisions of Article 8 of the Environmental Conservation Law State Environmental Quality Review and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that the Southold Town Trustees, as lead agency for the action described below has determined that the project will not have a significant effect to the environment. TYPE OF ACTION: Unlisted DESCRIPTION OF ACTION: To construct a 5' x 15' fixed dock, a 3' x 15' ramp~and two 5' x 15' float dock's supported by three 8" spiles. LOCATION OF PROJECT: 1460 North Oakwood Road, Laurel, New York, Town of Southold, County of Suffolk, more particularly identified as Suffolk County Tax Map No. 1000-127-6-11. REASONS SUPPORTING THIS DETERMINATION: 1. An Environmental Assessment form in the short form has been .submitted and reviewed and indicated that there would not be an adverse effect to the environment should the project be implemented as planned. 2. The Conservation Advisory Council has reviewed the proposal and conducted an inspection of the subject property and recommended approval indicating that the project would not have any adverse effects to the environment. 3. The project will not adversely effect the health, safety and general welfare of the people of the town. 6. Vote of Board: Ayes: Ail This resolution wad declared duly adopted. Board of Trustees - December 26, 1985 - Page 6. 7. NORTH FORK PROPERTY DEVELOPMENT - ENVIRONMENTAL ASSESSMENT Moved by Trustee Bredemeyer seconded by Trustee Smith it was RESOLVED to TABLE the application submitted for the North Fork Property Development. The secretary is directed to forward a letter to the agent requesting that he or the applicant attend the next Trustee meeting. 7. Vote of Board: Ayes: All This resolution was declared duly adopted. The Board members discussed the above-referenced application. They tried to give the applicant an opportunity to meet the concerns of the Board. There have been several letters and placed in the file objecting to this project. The Board is going to request that the project be scaled down. 8. JOHN J. NEWMAN - ENVIRONMENTAL ASSESSMENT Mr. Martin Garrell, Chairman of the Conservation Advisory Council addressed the Board regarding this application. He advised that the real question the Council had regarding this application was if the garage was going to be used as living quarters? If it was going to be expanded for living quarters, with the need for bathroom facilities, sinks, etc., would the cesspools that are existing be adequate for this purpose? The Conservation Advisory members were sympathetic with "What do you do when the garage is sinking"? You have to drive spiles and block up the garage, but at the same time what would happen if you left it in its present state and just worked over the flooring? Mr. Garrell added that the board would approve it if the garage remained as a garage, with no disturbance. Trustee Smith advised that the application before the Trustees is for the spiles. The Trustees do not have any jurisdiction in regard to cesspools, bathrooms, sinks, etc.. Board of Trustees - December 26, 1985 - Page 7. JOHN NEWMAN - ENVIRONMENTAL ASSESSMENT Cont. Moved by Trustee Bednoski seconded by Trustee Kujawski S.E.Q.R.A. NEGATIVE DECLARATION NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT December 26, 1985 APPLICATION NO: 335 NAME: John J. Newman This notice is issued pursuant to the provisions of Article 8 of the Environmental Conservation Law State Environmental Quality Review and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that the Southold Twon Trustees, as lead agency for the action described below has determined that the project will not have a significant effect to the environment. TYPE OF ACTION: Unlisted DESCRIPTION OF ACTION: To place pilings, to be driven landside, not in the creek or on wetland. Existing garage is sinking and must be placed on pilings. Addition of second floor. LOCATION OF PROJECT: Sailors Needle Road, Mattituck, New York; Town of Southold, County of Suffolk and Suffolk County Tax Map No. 1000 Section 144 Block 5 Lot 29.1. REASONS SUPPORTING THIS DETERMINATION: 1. An environmental assessment in the short form has been submitted which indicated that there would be no adverse effect to the environment should the project be implemented as planned. 2. The Conservation Advisory Council has recommended approval and indicated that there would be no adverse effect to the environment should the project be implemented as planned as a garage. 8. NEWMAN - ENVIRONMENTAL ASSESSMENT Moved by Trustee Kujawski seconded by Trustee Bredemeyer it was RESOLVED to APPROVE three pilings on the application' which are to be added to an existing permit~ and withdraw the wetland application Board of Trustees - December 26, 1985 - Page 8. 9. JOHN J. NEWMAN - ENVIRONM]2~TAL ASSESSMENT Mr. Newman appeared before the Board and requested to with- draw the wetland application for the retaining wall. The Board determined that the three spiles that w~re on that application could be added to an existing permit for a dock (Permit I925). Mr. Newman advised that if in the future he found that a retaining wall was necessary to prevent erosion, he would reapply. Moved by Trustee Kujawski seconded by Trustee Bredemeyer it was RESOLVED to APPROVE the Three spiles for John J. Newman as applied for. Project is located at Sailors Needle Road, Mat~ituck. 9.
