The Regular Meeting of the Board of Town Trustees was held
on NOVEMBER 27, 1985 at the Town Hall, Main Road, Southold.
President Smith opened the meeting at 7:30 P.M.
PRESENT WERE:
President Henry P. Smith
Trustee John Bredemeyer
Trustee Frank Kujawski
Trustee John Badnoski
Secretary Ilene Pfifferling
Trustee Smith advised that the date for the next regular inspections
of the Board will be held on December 19, 1985. Trustees will depart
from the Town Hall at 2:00 P.M.. The date for the next regular
meeting of the Board will be held on December 26, 1985 to commence at
7:30 P.M..
Trustee Smith gave the Trustee Monthly Report for October 1985 as
follows: Application fees $55.00, Bulkhead Fees $206.00, Wetland
Application Fees $550.00, Dock & Ramp Fees $80.00, Wetland Inspection
Fees $15.00 and Moorinq Renewal Fees $150.0D for a total amount
received of $1056.00 which has been forwarded to the Supervisor's
Office to be placed in the General Fund.
Moved by Trustee Kujawski seconded by Trustee Bednoski it was
RESOLVED to APPROVE the January 1986 Moorinq Renewals.

President Smith commenced with the communications as follows:
III. CO~,~UNICATIONS:
From Mr. Joseph Magagnin, President of the Willow Point Association
a request for a twelve (12) month extention on a Trustee and
Board of Trustees - November 27, 1985 - Page 2.
Wetland Applications. Permits are to expire on November~2, 1985.
Moved by Trustee Bredemeyer seconded by Trustee Kujawski it~was
RESOLVED to Approve the request made by Mr. Joseph Magagnin for a
six month extention on his permits. These permits will expire in
May of 1986.

This resolution was declared duly adopted.
2. From Mr. James McMahon, Administrator, Southold Community
Development Agency a request for Proposals from the New York
State Urban Development Corporation for aquaculture Programs.
Trustee Smith asked if any of the Trustees wished to comment on this
communication. Trustee Bredemeyer advised that he had a request
for a proposal prepared by Mr. McMahon and Mr. Chris Smith which should
be interesting to see. Trustee Bredemeyer advised that it was unfortunate
that this came so late. It came only a couple of weeks ago.
3. From the Town Attorney, Robert W. Tasker information regarding
the Wetland Application of Michael Carlucci. The Town Attorney advised
that the underwater land is privately owned. Trustee Smith advised
Mr. Carluc~i that there are no objections to the project.
4. From the Land Use Company a request to amend the wetland application
of Henry P. Smith. This request is to amend the dredging to 96 cu. yds.
Moved by Trustee Bredemeyer seconded by Trustee Kujawski it was
RESOLVED to AMEND the wetland application of Henry P. Smith as requested.

5. From Mr. Raymond Pluschau a request for an extention on Permit no.
1923. This permit will expire on December 26, 1985.
Moved by Trustee Bredemeyer seconded'by ~TrulStee KujaWski
RESOLVED to APPROVE the Trustee extention with a letter and a
wetland application to be forwarded to Mr. Pluschau. The Trustee permit
is granted for six months. Permit is to expire in June 1986. Trustee
Bredemeyer advised that he would be in contact with Mr. Pluschau to
let him know what has happened.

Trustee Smith proceeded with the Resolutions:
V. RESOLUTIONS:
1. MARY SAYEGH - REQUEST FOR A WAIVER OF THE WETLAND ORDINANCE
Request for a waiver of the Wetland Ordinance Chapter~97, Article II,
section 97-22 by Mary Sayegh of 515 Shore Drive, Greenport, New York.
Appellant requests permission to increase the floor area of_the deck_
by 19"
Following deliberations, the board took the following action:

WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area;
WHEREAS,the Board has considered all the documentation submitted
concerning this request; and
WHEREAS, the Board made the following findings of fact:
and
1. By this request, appellant requests permission to increase
floor space to a deck on an existing dwelling by 19",reducing setback to
the bulkhead-on the premises. ~
2. The property in question is known as Greenport Shores Section I
Subdivision, Lots 20 and 21; more particularly identified as
County Tax Map Parcel No. 1000-047-02-028.
In considering this request, the board finds and determines:
(a) The project will not adversely affect the wetlands of the Town.
(b) Will not cause damage from erosion, turbidity or siltation.
.(c) Will not increase the danger of flood and storm-tide damage.
(d) Will not adversely affect navigation on tidal waters or the
Tidal flow of the tidal waters of the Town.
(e) Will not adversely affect the health, safety and general
welfare of the people of the town.
Accordingly, on motion by Trustee Bednoski seconded by Trustee
Bredemeyer it was
RESOLVED, that permission BE AND~HEREB¥ IS GPa~NTED AS REQUESTED
for Mary Sayegh subject to the following provisions:
1. During excavation the fill must be contained so that it does
not wash into the creek.
2. Care should be taken so as to preclude the entry of any construction
material into adjacent waters.
3. Immediately following construction, all areas of exposed soil shall
be properly protected with suitable erosion control devices and/or
vegetated to prevent entry of soil into the creek.

RESOLVED to APPROVE the application submitted by Robert E. Copas
for the installation of an additional floating dock (8' x 40')
and 3 pilings adjacent to an existing floating dock in Sterling
Creek, Greenport. Property is located at 260 Robinson Road,
Greenport.

Application submitted by C. Rodilosso submitted by the Land Use Co.
for the construction of a 6' x 30' float dock to be connected to
an existing floatding dock constructed under permit no. 119 (1983~.
Property is located at 1500 Beebe Drive, Cutchogue, New York;
Foltowin~deliberations, ~the board took the following action:
Whereas the board members have personally viewed~and are familiar
with the premises in question and the surrounding area; and
Whereas, the board has considered all the documentation submitted
concerning this application; and it is noted that there has been
no public opposition; and
Whereas, the board made the following findings of fact:
1. By this application, appellant requests permission to
locate~a 6' x 30' float dock to be connected to an existing
float dock constructed under permit no. 119 in 1983.
2. There will be no adverse affect to the wetlands of the Town.
3. There will be no adverse affect to navigation on tidal waters
or tidal flow of the tidal waters of the town.
4. There will be no change in the course of any channel or the
natural movement or flow of any waters.
.5. The health, safety and general welfare of the people of
the town will not be affected.
Accordingly, on motion by Trustee Smith seconded by Trustee Bednoski
it was
RESOLVED that permission BE AND HEREBY IS GRANTED AS APPLIED in

Southold Town Trustees, as lead agency for the action described below,
has determined that the project will not have a significant effect
on the environment.
TYPE OF ~CTION: Unlisted
DESCRIPTION OF ACTION: To construct a timber bulkhead, 106' long.
Bulkhead will be built 18" in front of existing bulkhead. Fill will
be trucked in to backfill bulkhead.
LOCATION OF PROJECT: Town of SoUthold, County of Suffolk, more
particularly known as: Mattituck Fishing Station, Naugles Drive,
Mattituck, NY; Suffolk county Tax Map No. 1000-106-09-003.
REASONS SUPPORTING THIS DETERMINATION:
1. An Environmental Assessment in the Long Formhas been submitted
which indicated that no.~adverse~effects to the environment are likely
to occur should this project b~ implemented as planned.
2. Comments from the Conservation Advisory Council indicated that
there would be no adverse effect to the environment should the project
be implemented as planned.

for one month. The applicant is requested to submit a copy of

inspection.

south to north and create a deposition basin, including maintenance
of deposition basin and inlet dredging.

Code of the Town of Southold, notice is hereby given that the
Southold Town Trustees, as lead agency for the action described
below, ha.s determined that the project will not have a.significant
effect on the environment.
TYPE OF ACTION: Unlisted
DESCRIPTION OF ACTION: To maintenance dredqe an area 45°' x 40' to
a depth of 3' below low water directly in f~ont of his residence.
To fill with approximately 162 cu. yds. to be placed upland on
property of Carlucci and Baldwin.
LOCATION OF PROJECT: 8A Island View Lane, Greenport, New York.
REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment has been submitted in the
long form indicating that no adverse effect to the
environment is likely to occur should the project be
implemented as planned.
2. The Conservation Advisory Council recommended_.that a
retaining wall or bulkhead be constructed so that the
spoil does not wash into the creek.
3. Because there has been no response in the allotted time from
the New York State Department of Environmental Conservation
and the Southold Town Building Dept. it is assumed that
there are no objections or comments from those agencles~ .--

This resolution was declared duly adopted.
