Present were: Trustee Henry P. Smith, Trustee John Bredemeyer,
Trustee Frank Kujawski, Trustee John Bednoski, Bay Constable

The Trustees discussed the protocol for operating the
Arshamomaque Pond "Conditional Clamming Program" a~d.the
criteria-to be met: When not more than 0.25 inches of rain is
recorded for each of seven successive days, the area shall be
"opened" (conditionally certified) on the eight day for shellfish
harvesting and shall remain "open" until greater than 0.25 inches
of rain is recorded in 24 hours. A permanently bound book must
be maintained to provide proof of telephone calls showing the
time and date of the calls, the caller and the recipient of the
calls. The procedure is that daily, as early as possible each
a.m. the rain gauge is read and recorded in the record book.
Daily, after reading the rain gauge, call_the Radio Station WLNG
and WBAZ and request that the announce, "The Arshamomaque Pond
conditional clamming is OPEN (CLOSED) on day, date." Daily,
after reading rain gauge, call N.Y.S;D.E.C. to provide the rain
gauge reading and the status of the area. The rain gauge reading
is to commence on November 4, 1985.

The regular meeting of the Board of Town Trusees was held on
October 30, 1985 at the Town Hall, Main Road, Southold.

Trustee Smith advised that the field inspections will be held on
NOVEMBER 21, 1985 departing from Town Hall at 2:00 P.M., the
date for the next reqular meetinq will be held on NOVEMBER 27, 1985
at 7:30 P.M..
President Smith gave the Trustee monthly report for
September 1985 as follows: Application Fees $65.00, Bulkhead fees
$400.00, Wetland Inspection fees $55.00, Wetland Application fees
$450.00, Dock & Ramp fees $289.50 and Moorinq Renewals $100.00 for
a total amount of $1359.50 which has been submitted to the
Supervisor to be placed into the general fund.

RE: Notice of Complete Application for Ruth Bohn to subdivide
a 81,000 sq. ft. parcel into two residential lots (one already
developed with a single-family residence, swimming pool, etc. )

of remaining lot shall require filing for a N.Y.S. D.E.C. Wetland
Permit. Comments by October 11, 1985.

Sanitary system shall be less than 100' from proposed well and
adjacent wells. Project is located on the east side of Little

Department of the Army - New York District Corps of Engineers
Re: Notice of Application for Ingeborg Mueller to construct a
four ft. by seventy ft..fixed pier, two and one-half ft. by
sixteen ft. ramp and six ft. by forty ft. floating pier secured
by two timber piles. Property is located on Westview Drive,
Mattituck. Comments by October 15, 1985.

Re: Notice of Application for Matt-a-Mar Marina tO construct
a floating dock assembly consisting of a 4 ft. by 35 ft. fixed
elevated ramp (a minimum of 4 ft. above grade) a 3 ft. by 15 ft.
hinged ramp and eighteen 5 ft. by 24 ft. floats (432 lin. ft.)
A 5 ft. by 30 ft. float would also be attached at a slight angle
to the western end of the 432 ft. float assembly and be secured
to an existing bulkhead by a 2 ft. by 24 ft. float in Mattituck
Creek, Mattituck. Comments by October 20, 1985.

President Smith proceeded with the Communications.
1. From the Land Use Company a letter advising that the application
for the Marina Bay Club should be held pending submission of a
site plan to the Planning Board for the project.

the June Hussey application.
3. From Southold Town Baymen's Association, Inc. regarding Hallocks
Bay.

a permit for an offshore mooring in Little Creek, Cutchogue,
using public access with the provision that the boat does not
swing into any other boat or impede navigation.

and sanitary system.
LOCATION OF PROJECT: Town of Southold, County of Suffolk, more
.particularly known as: Meadow Lane, Mattituck, Lot No. 42 of
Mattituck Estates, County Tax Map No. 1000-115-5-7
REASONS SUPPORTING THIS DETErmINATION: 1. The intertidal marsh is extremely close to this property.
2. Within the marsh there are a variety of species of nesting
fowl.
3. Controversy over the development of this lot within the
neighborhood itself.

NAME: Daniel Silverman
This notice is issued pursuant to.th~ provisions of Article 8 of
the Environmental Conservation Law, Part 617 of Title 6 of the
New York State Codes, Rules and Regulations, and Chapter 44 of the
Southold Town Codes, theSouthold Town Trustees, as lead agency, does
hereby determine that the action described below is a Type 1 Action
and is likely to have a significant effect on the environment and
that a Draft Environmental Impact Statement is requested to be
prepared.
TYPE OF ACTION: Type 1
DESCRIPTION OF ACTION: To construct a dock and dredge approximately
150 cu. yds. of dredge spoil to be removed to upland site. An
alternate dredge spoil method is to construct an intertidal wetland
on location Shown.
LOCATION OF PROJECT: Town of Southold, County of Suffolk, more
particularly known as: Wunneweta Road, Nassau Point Cutchogue,
Suffolk County Tax Map No. 1000-111-14-32.
REASONS SUPPORTING THIS DETERMINATION:
1. The unanimous disapproval of the Conservation Advisory Council.
2. The environmental magnitude of the project in this small pond.
3. The consroversy surrounding this project, from the immediate
neighbors.
4. The precedent that would be set to begin dredging in an area like
this and the subsequent applications that would come before the
board, by lots of other people who have been denied dredging in a
small area like this.
5. The inability of qetting a barge in there.

The Trustees commenced with the approvals of the Wetland Applications
as follows:
16- A. MATTITUCK INLET MARINA - APPROVAL
Moved by Trustee Kujawski seconded by Trustee Bredemeyer .
WHEREAS;' En-Consultants, !nc. on behalf of Mattituck Inlet Marina
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
aDplication dated July 18, 1985 and,
WHEREAS, said application was referred to the Southotd Town
Conservation Advisory Council for their findings and recommendations
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on October 30, 1985 at which time all interested
persons were given an opportunity to be heard, now, therefore, be it
RESOLVED that En-Consuttants, Inc. on behalf of the Mattituck
Inlet Marina be granted permission under the provisions of the
Wetland Ordinance of the Town of Southold, New York, all in
accordance with the application. This permit will expire on
October 30, 1986 if work has not commenced by said date. The~e
shall be two inspections required; and the Trustees shall be
notified when the project is complete.

Moved by Trustee Kujawski seconded by Trustee Bredemeyer
WHEREAS, the North Fork Marine Construction, Inc. on behalf of
Kathleen A. Neumann applied to the Southold Town Trustees for a
permit under the provisions of the Wetland Ordinance of the Town of
Southold, appl~ication dated July 31, 1985 and
WHEREAS, said application was referred to the Southold town
Conservation. Advisory Council._for their findings and recommendations,
and
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on October 30, 1985 at which time all interested
persons were given an opportunity to be heard, now, therefore, be it
RESOLVED that North Fork Marine Construction, Inc. on behalf of

Mrs. Walker of Stype Real Estate, Inc. requested a determination
on the need of a wetland permit regarding property of Ernest Sauer.
The Board personally visited the subject property and it was
determined that a wetland permit would be required. The secretary
has forwarded a letter to the Stype Real, Estate C/o Mrs. Walker along
with a wetland application for their pursual.
A request was made by Gerald Doroski for a determination on the
need of a wetland permit to fill on property located off of a
R.O.W. off of the North Road, Peconic. The Board made a site
inspection on ~cteh~ 2~, 1985. The subject parcel was not
properly staked so the Board directed that a letter be forwarded
to Mr. Doroski advising him to properly stake the parcel for a
reinspection on November 21, 1985.
There being no further business to come properly before the
Board a motion was made by Trustee Kujawski seconded by
Trustee Bredemeyer to adjourn at 10:05 P.M.
