A Special Meetin~q of the Board of Southold Town Trustees was called to order
at 8:55 P.M., Tuesday, September 10, 1985, at the Southold Town Hall, Main Road,
Southold, New York. Waiver of Notice of Town Trustee meeting attached hereto.
Present: Henry P. Smith, President
Frank A. Kujawski~ Jr.
John M. Bredemeyer Ill
Absen~: John L. Bednoski, Jr.
The Trustees discussed the urgent need to delay the opening of Town creek~
for the harvesting of scallops, due to the algae bloom which has retarded the growth~
'~f the scallop cro~. It was decided an opening of October 25th for non-commercial
purposes and November 1st for commercial purposes would be the only feasible measure
to give the scallop crop an opportunity to improve. ~
Moved by Trustee Kujawsl~i~ seconded by Trustee Bred~emeyer,
WHEREAS, it. has -been brought to the attention.-i~f the Board of Town Trustees that
the creeks of the.Town .of Southoid have been afflicted with algae bloom causing
dis~'ess to the scallop crop," and .....
WHEREAS, such affliction has been moderated and the Trustees are advised that
there is a possibility that the scallop crop may improve if left unharvested and
given an opportunity to grow during the-warm Weather in the fall season,

NOWr THEREFORE, BE IT RESOLVED that pursuant to Section 77-210 of the Code
of the'Town of Southold, the Board of Trustees do hereby close all Town creeks
for the harvest of scallops until October 25, 1985, when said creeks will be opened
for the harvest of scallops for non-commercial purposes and will be opened on
'~lovember 1, 1985 for commercial purposes, and
BE'IT FUR-i:HER RESOLVED that notice of such closing shall be posted in all creeks
and publication be given in the o~icial Town newspapers.
Vote of the Town Trustees: Ayes: Trustee Smith, Trustee Kujwaski, Trustee
B redemeyer.
This resolution was declared duly ADOPTED.
Moved by Trustee Kujawski, seconded by Trustee Bredemeyerj it was
RESOLVED that this Special Meeting of the Board of Town Trustees be and hereby
is adjot~rned at 9:05 P.M.

WAIVER OF NOTICE OF TOWN TRUSTEE MEETING
WE, the undersigned, being members of the Board of Town Trustees of the
Town of Southold, Suffolk County, New York, do hereby severally waive notice
of time, place and purpose of the meeting of the Board of Town Trustees to be
held at 9:00 P.M., at the Southold Town Hall, Main Road, SoUthold, New York,
on Tuesday, September 10, 1985, and do hereby consent that the same be held
on said date for the transaction of any business which may properly come before
said meeting.

The Board of Town Trustees held a Special Meeting this evening at 9:00 P.M.
! recorded the minutes, they signed a waiver (except John Bednoski who will be in
the office in the morning to do so).
The attached resolution has been distributed as you see at the bottom of same.
The attached resolution will be made a part of the minutes which I will prepare,
and I have also prepared a copy for Don Dzenkowski.
Please call Don first thing in the morning (9/11) and ask him to stop and pick
up the envelope with the copy of the legal and the resolution. Also tell him it is most
important that ALL C-REEKS be posted with the closing dates.

RESOLUTION - SEPTEMBER 10, 1985
WHEREAS, it has been brought to the attention of the Board of Town Trustees that
the creeks of the Town of Southold have been afflicted with algae bloom causing

NOTICE IS HEREBY GIVEN that pursuant to the provisions of Section
77-210 of the Code of the--Town of Southold, the Trustees of the Town of
Southold hereby give public notice that All of the creeks of the Town of
Southold are hereby closed for the harvesting of scallops until October 25,
198~, when said creeks shall be opened for the taking of scallops for
non-commercial purposes, and that on and after November 1, 1985, said creeks
shall be open for the harvesting of scallops for commercial pur_poses.
