The regular meeting of the Board of Town Trustees was held on MARCH 27, 1985 at the Town Hall, Main Road, Southold. The meeting was opened with President Henry P. Smith presiding at 7:30 P.M. Present were: Trustee Henry P. Smith Trustee John Bednoski Trustee John Bredemeyer Trustee Frank Kujawski Secretary Ilene Pfifferling Bay Constable Donald Dzenkowski Moved by Trustee Bredemeyer seconded by Trustee Smith it was RESOLVED to APPROVE the minutes of the Regular Meetinq of February 27, 1985 with the correction to the minutes of the Public Hearing regarding the E. N. Richards application to read, on page 2,"I just think asthenically," and "The ramp will have to much torque on it." VOTE OF BOARD: Ayes: All This resolution was declared duly adopted. Moved by Trustee Ku¢awski seconded by Trustee Bednoski it was RESOLVED to APPROVE the mooring renewals for May, 1985. VOTE OF BOARD: Ayes: All This resolution was declared duly adopted. Trustee Smith advised that the date for the inspections will be held on APRIL 25, 1985 starting at 2:00 P.M. and the date for the next regular meeting will be held on MAY 1, 1985 at 7:30 P.M. Trustee Smith gave the monthly report for February, 1985 as follows: Applications $60.00, Dock and Ramp Fees $84.00, Wetland Inspections $5.00, Wetland Applications $200.00, Mooring Renewals $t10.00 for a total of $459.00. Board of Trustees -2- March 27, 1985 II. PUBLIC NOTICES Trustee Smith: We will move on to our Public Notices. 1. New York State Department of Environmental Conservation Notice of Complete Application for Constantine P. Georgiopoulos to place 2000 cu. yds. of clean fill; construct a one-family dwelling; and install septic system. Project will be in a 11,500 square foot area of freshwater wetlands. Projec~ located on Great Pond, at 180 Lake Court, Southold, New York. Comments by: April 11, 1985 2. Department of the Army New York District, Corps of Engineers r~quest for authorization for a repair to an existing 50 f~t open-pile supported walkway and to construct a 4' x 12' extension to be elevated 4 ft. over the grade of the marsh connecting to a hinged walkramp and outer seasonally installed "L" shaped float assembly to be secured by piles and to extend approximately 80 ft. seaward of ~he line of mean high water. Application by: Martin and Florence Gellman, 6 Legion Place, Malverne, New York 11565. Comments by: April 14, 1985 3. New York State Department of Environmental Conservation Lead Agency Request: Re: Sebastions Cove Ltd. and Twin Fork Fence & Siding Co. to redredge existing channel to gain access to federal channel in Mattituck Creek, removal of an estimated 6,000 cu. yds. of muck and silt and disposal on previous dredge spoil sites. Project location North of Mill Road., Mattituck. Comments by: April 8, 1985 It ~was the consensus of the Board to direct the_sscretary to forward a letter to the D.E.C. relative to the Lead Agency Re.quest for Sebastions Cove Ltd. Additionally, the secretary is directed to send a letter to the Army Cor.ps of Engineers relative to the application of Martin and Florence Gellman reflecting the provisions that were~added to.the permit when approved by the Board. Trustee Bredemeyer commented on Public Notice N6. 1 for Constantine P. Georgiopoulos. He advised he had spoken to Mr. Hamilton at th.e D.E.C. rslative to the~Notice~of Complete Application for Constantine P. Georgiopoulos. It was the consensus of the Board to declare lead agency on this application. See page 15 for S.~.Q.R. Significant Determination. Board of Trustees ~3- March 27, 1985 III COMMUNICATIONS Trustee Smith: We will move on to our communications. 1. Raymond, Parish, Pine & Weiner, Inc. regarding comments on the proposed Zoning Map, proposed revisions to the major sections of the Zoning Ordinance. Specifically, Marine Recreation Areas and Public Access to the water. Trustee Smith: Are there any comments on this one? Trustee Bredemeyre: Yes. I have a very strong feeling that anything that can be done to decrease the overloading of some of our very course sand and gravel with sewage would be good because the East End is certainly~ha~ing a problem with a number of water pollution problems, because course sand and gravel lets agricultural pesticides through and we already have two creek closures and if we don't do,something about density along some of our waterways we will have additional coliform pollution. I would move some sort of message of support in conformity with this item 5, to look seriously at the density. Moved by Trustee Bredemeyer and seconded by Trustee Bednoski it was RESOLVED to send a letter of support .in conformity with item 5, of this correspondence, to look seriously at sewage loading on our waterways, to the Planning Board for transmittal to Raymond, Parish, etc Vote of Board: Ayes: Ail This resolution was declared duly adopted. 2. Letter from Legislator Gregory J. Blass regarding Arshamomaque Pond. 3. Letter from Gordon C. Colvin, N.Y.S.D.E.C. regarding Arshamomaque Pond. 4. Letter from David Harris, Department of Health Services regardingArshamomaque Pond. Trustee Smith: John will you take these? Trustee Bredemeyer: Okay, twoT~three and four, communications relative to establishing some bacteriological work on Arshamomaque Pond, the individuals involved have both requested, and now stated, what the involved aid would be on the pond. in add!tiOn two weeks, bacteriological sampling will begin with som~ of the samples going to the Health Dept. and some samples going to the Conservation Department for their laboratories to analyze and, hopefully, to give us an indication of what some of the problems are there, and the seriousness of the pollution there. Board of Trustees -4- March 27, 1985 5. Letter from Mr. Edward Flynn and Charles D. Hardy. relative to a mooring in Jocke~ Creek, Southold. Trustee Smith directed the secretary to send a letter to Mr. Flynn advising him that according to our records we have no application or permit on file for a mooring in Jockey Creek, Southold, in his name. An application for same will accompany the letter. 6. Letter from gr. David Harris, County Health D~pt. regarding the Red Tide Organisms. 7. Letter from J. Bambrick in regard to the application of Constantine P. Georgiopoulos. 8. Letter from Gerald JacObson in regard to the application of Constantine P. Georgiopoulos. Trustee Smith: Both communication number seven and eight are letters in opposition to the application of Constantine P. Georgiopoulos. 9. Letter from the Fleet'is Neck Property Owners Association regarding a request to dredge at the end of East Road, Cutchogue. Moved by Trustee Smith,~seconded3b~ T~u~tee~K~j~ski it was RESOLVED to send a letter to the Town Board and copy to the Fleet's Neck Property Owners Association advising that the Trustees are in support of any dredgin~ project that will increase public access to town waters. Trustee smith recessed the ~egular meeting for the purpose of holding two public hearings' at 8:00 P.M. IV. PUBLIC HEARINGS In the matter of the application for a wetland permit for Donald Bayles, Michael Levinson and Wilhelm Franken submitted by the La~d Use Company to dr~dge in a private canal south o~ Tarpon Drive/Albacore Drive, Southold. In the matter of the application for a wetland permit for J. Louise Moyte to replace an existing eroded cinder block bulkhead~with treated wood materials on property located at 1920 Minnehaha Blvd., Southold Meeting reconvened at 8:07 P.M. Board of Trustees -5- March 27, 1985 V. RESOLUTIONS 1. JOHN R. SAHM Moved by Trustee Bredemeyer seconded by Trustee Bednoski it was RESOLVED to APPROVE the mooring application submitted by John R. Sa~--~o-~ce an offshore mooring in Jockey Creek, Southold, using a 300 lb. anchor on stern and~bow to moor a 23 ft. sailboat, with access from private property. of permission has been submitted. 1. Vote of Board: Ayes: All This resolution is declared duly adopted. A letter 2. JOHN P. DEWAR Moved by Trustee Smith seconded by Trustee Bredemeyer it was RESOLVED to APPROVE the mooring application submitted by John P. Dewar to place an offshors stake in Goose Creek., .Southold using public access to moor. a t4 ft. boat, with the provision that the boat does not swing into the Channel or interfere with any other boat and that an offshore-onshore stake with pulley line is used to keep~ the boat from swinging in front of private property at the end of Gagen's Landing. 2. Vote of Board: Ayes: All This resolution was declared dul~ adopted. 3. JOHN LORETTO Moved by Trustee Frank Kujawski seconded by Trustee Bednoski it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental QUality Review Act in the matter of the application of John Loretto submitted by the Chesterfield Association for a Wetland Permit on certain property located at Glenn Court, Cutchogue. 3. Vote of Board: Ayes: Ail This resolution was declared duty adopted. 4. JOHN W..~& CATHERINE M. DEMPSEY Moved by Trustee Bednoski seconded by Trustee Kujawski it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of John W. & Catherine M. Dempsey for a Wetland Permit on certain property located at 705 Meday Ave., Mattituck. 4. Vote of Board: Ayes: All This resolution was declared duly adopted. Board of Trustees -6- March 27, 1985 '5. Negative Determination Moved by Trustee Smith seconded by Trustee Kujawski it was RESOLVED that PursuanE to Article 8 of the Environmental Conservation Law State Environmental Quality Review and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that the Southold Town Trustees, as lead agency for the action described below, has determined that the project, which is unlisted will not have a significant effect on the environment .... DESCRIPTION OF ACTION Application of Jo~. C. Kerbs to construct a fixed catwalk to a floating dock for access to navigable water on property located on the South Side of Riley Avenue, Mattituck, 475' East of-Bay Avenue. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effect to the environment are likely to occur should the project be implemented as planned. Because there has been a response from the Southold Town Conservation Advisory Council indicat~lng that this project would not have a significant effect to the environment. Because there has been no response in the alloted time from the New York State Department of Environmental Conservation and the Southold Town Building Department, it is assumed that there are no objections nor comments from those agencies. 6. Bredemeyer it was RESOLVED that pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that the Southold Town Trustees as lead agency, for the action described below, has determined that'the project, which is unlisted, will not have a significant effect on the environment. DESCRIPTION OF ACTION: John Dempsey submitted by Eh-Consultants, Inc. Applicant proposes to construct a timber dock consisting of a 180' x 4'.fixed elevated walkway, 16' x 4' hinged ramp and a 16' x 6' float secured by two 8". x 20' pilings., on .pr°perty. located at Haywaters Drive, Cutchogue. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effect to' the environment are likely to occur should the project be implemented as planned. Because there has been a response from. the Southold Town Conservation Advisory Council indicating that this project would not have a significant effect on the environment. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation and the Southold TownBuilding Department, it is assumed that there are no objections nor comments from those agencies. 7. NEGATIVE DETERMINATION Moved by Trustee Bednoski seconded by Trustee Kujawski it was RESOLVED that pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality REview and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that ~he Southold Town Trustees as lead agency for the action described below, has determined that the project, which is unlisted, will not have a significant effect on the environment. DESCRIPTION OF ACTION: Kearnsport, Ltd~ submitted by En-Consultants, Inc. Applicant proposes to remove all existing docks. Install (2) similar docks consisting of: 16' x 3.5' hinged ramp off the bulkhead; 70' x 3.5' main floats with (3) 20' x 3.5' finger floats Board of Trustees -8- March 27, 1985 spaced approximately 20 ' apart. Ins%all 100' x 3.5' floats along bulkhead. Maintenance dredge 115' x 90' area to max. depth of 10' below MLW. Approximately 1000 cy. of spoil will be partially used as backfill on subject parcel (250± cu. yds.) with the remainder to be removed to suitable upland site (Town dump or similar). Construct new 15' section of bulkhead across existing marine railway cutout and backfill~. Raise elevation of exist±hq bulkheads (95',) by approximately 2' and add a 20' return on south side alonq road (Monsell Place). Because there has been a response from the Southold Town Conservation Advisory Council indicating that this project would not have a significant effect on the environment. Because there has been no response in the allotted time from the New York stare'Department of Environmental COnservation and the Sou~hold Town Building Department, it is assumed that there are no objections nor comments from those agencies. 10. Vote of Board: Ayes: Ail This resolution was declared duly adopted. 11. Trustee Smith: This is a resolution to authorize the secretary to advertise for the availability of Ice Damage Permits. 11. Moved by Trustee Kujawski seconded by Trustee Bredemeyer it was RESOLVED that notice is hereby given that Special Ice Damage Permits, for Town Waters are now available at the Trustee Office between the hours of 9 A.M. to 5~P3~M., Monday thru. Friday for Board of Trustees -10- March 27, 1985 repair to docks, ramps, piles, etc. that have been damaged as a result of ice this winter. There is No Fee for this permit, but a permit is required for all repairs. 11. Vote of Board: Ayes: All This resolution was declared duly adopted. ALBERT TESSITORI Moved by Trustee Kujawski seconded by Trustee Bredemeyer it was RESOLVED to APPROVE-the mooring apDlication for ALbert Tessitori to place an offshore mooring in. Mattituck Creek, using park district as access with the provision that a 150 lb. anchor is used, and that the boat does not impede navigation or interfere with any other boat. The mooring must be kept out of the federal anchorage area. 13. Vote of Board: Ayes: All This resolution was d~clared du~y adopted. 14. HENRY OMAN Moved by Trustee Smith seconded by Trustee Bredemeyer it was RESOLVEDto APPROVE the mooring application.for Henry Oman to place an offshore stakewith pulley line to onshor'e stake-in Richmond Creek, using public access, with the provision that the stake is placed at the end of the R.O.W. and n~t on ~he private property to the left and right of the R.O.W. 14. Vote of Board: Ayes: All This resolution was declared duly adopted. 15. LOUISE~MOYLE - WETLAND APPLICATION APPROVAL Moved~ ~y Trustee Bednoski seconded by Trustee Bredemeyer WHEREAS, Louise Moyle applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated January 19, 1985, and WHEREAS, said application was referred to the Southold Town Conseruation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees'~with respect to said application on March 27, 1985 at which time all ±nterested persons were given an opportunity to be heard, now, therefore, be it RESOLVED that Louise Moyle be granted permission under the proviSions of the Wetland Ordinance of the Town of Southold, New York, all in accordance with the application. This permit will expire on March 27, 1986 if work has not commenced Dy said date. There shall be two inspections required; and the Trustees shall be notified when the project is complete. 15. Vote of Board: Ayes: All This resolution was declared duly adopted. 16. BAYLES, LEVINSON AND FRANKEN - WETLAND APPROVAL Moved by Trustee Bredemeyer seconded by Trustee Smith WHEREAS, Donald Bayles, Michael Levinson and Wilhelm Franken applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, Application dated January 2, 1985, and Board of Trustees -12- March 27, 1985 WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on March 27, 1985 at which time all interested persons were given an opportunity to be heard, now, therefore, be it RESOLVED that Donald Bayles, Michael Levinson and Wilhelm Franken be granted permission under the provisions of the Wetland Ordinance of the Town of Southold, New York all in accordance with the application. This permit will expire on March 27, 1986 if the work has not commenced by said date. there shall be two inspections ~eguired; and the Trustees shall be notified when the project is complete. 16. LOUIS JAHIER - LEAD AGENCY DECLARATION Moved by Trustee Smith seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees declare itself lead agency in the matter of the application of Louis Jahier submitted by En-Consultants,, Inc. for a wetland permit on certain property located on a right of way on the north side of Main Road, East Marion. 17. Vote of Board: Aves: All This resolution was declared duly adopted. 18. JOHN KALIMNIOS Moved Dy Trustee Smith seconded by Trustee Bredemeyer it was RESOLVED to.DENY without prejudice the mooring application submitted by John Kalimnios to pla~e a mooring in Town Creek, Southold until the location for the mooring is staked, for a more accurate location. 18. Vote of Board: Ayes: All This resolution was declared duly 9dopted. 19. MICHAEL CARLUCCI S.E.Q.R.A. SIGNIFICANT ENVIRONMENTAL DECLARATION Board of Trustees -13- March 27, 1985 19. Moved by Trustee Kujawski seconded by Trustee Bednoski WHEREAS, Michael Carlucci has heretofore applied to the Southold Town Trustees, pursu~n~ to Chapter 44 of the Code of the Town of Southotd for permission to maintenance dredge an area 45' ~ 45~ ~ ~ d~p--~h-6-~-r~-~i~ 1-~Ww---~ ~ire-~y in front of his residence and to backfill on property l~--cated at 8A ~-~-~d View Lane, Greenport, NOW, THEREFORE it is RESOLVED as follows: 1. That pursuant to the provisions of Article 8 of the Environmental Conservation Law; Part 617 of Title 6 of ~he New York State Code, the Southold Town Trustees, as lead agency does hereby determine that the action proposed is a Type I action and is likely to have a significant effect on the environment. 2. That the Secretary to the Trustees shall file and circulate such determination as required by the aforementioned law, rules and code. 3. That the Secretary to the Trustees shall immediately notify the applicant. Michael Carlucci and further request same to attend a meeting on May 1, 1985 to discuss some of the significant'impacts which may have to be addressed in a Draft Environmental Impact Statement, all in accordance with said law, rules and code. 19. The was discussion held regarding the Notice of Complete Application for Rsnate Riedel of 161 Brook Road, Westhampton Beach, New York regarding a proposal to construct a one family dwelling 72' landward of tidal wetland area. Mr~ Bob Costanzo appeared before the board to advise that he is very concerned about this proposal. He stated that this is a wetland area. The Trustees advised that the present wetland ordinance limits the Board to looking at certain species of plants in the area,but further advised that the wetland ordinance is being amended to include an area up to 75' Once this takes effect the trustees will have jurisdiction and will be able to ~equest an application and to hold a public hearing, so ~eryone will be able to make comments on this project.
