The Board met with Town Attorney Tasker to discuss the proposed Local Law for the regulation of Housebarges in Town Waters. See Communication number 3, page 2. REGULAR MEETING - 7:30 P.M. The regular Meeting of the Board of Town Trustees was held on Wednesday, February 27, 1985 at the Town Hall, Main Road, Southold. The meeting was opened with President Henry P. Smith presiding at 7:45 P.M. Present were: President Henry P. Smith Trustee John Bredemeyer Trustee John Bednoski Trustee Frank Kujawski Secretary Ilene Pfifferling Moved by Trustee Bednoski seconded by Trustee Kujawski it was RESOLVED to APPROVE the minutes of the Regular Meeting of January 30, 1985. Vote of Board: Ayes: All This resolution was declared duly adopted. Moved by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to APPROVE the mooring renewal permits for April, 1985. Vote of Board: Ayes: All This resolution was declared duly adopted. Trustee Smith advised that the date for the inspections will be March 21, 1985 starting at 2:00 P.M. and the date for the next regular meeting will be held on March 27, 1985 at 7:30 P.M. Trustee Smith gave the monthly report for January, 1985 as follows: Application fees $15.00, Dock and Ramp fees $1,139.25, Wetland Inspection fee $35.00, Wetland Applications $200.00, Mooring Renewals $100.00 for a total of $1,489.25.00. Trustee Smith: Next will be our Public Notices. II. PUBLIC NOTICES Board of Trustees -2- February 27, 1985 1. U. S. Army Corps of Engineers notice of application by John G. Scott, Main Road, Cutchogue to install two moored shellfish nurseries in Cutchogue Harbor and North Race, Little Peconic Bay. Comments by: February 20, 1985 Trustee Smith: Are there any comments on this one? (No Comments.) We will move on to our communications. III. COMMUNICATIONS 1. Mr. Ralph Grandinetti has requested to amend his application for a mooring in Gull Pond, Greenport. The Board personally visited the site in question and have reviewed all correspondence in the file, accordingly, On motion made by Trustee Bredemeyer seconded by Trustee Ku]awski it was RESOLVED to APPROVE the mooring application for Ralph Grandinetti to place an offshore mooring~ using private property as access, in Gull Pond, Greenport, as amended with the .provision that the boat will not impede navigation or interfere with any other boat. 1. Vote of Board: Ayes: All This resolution was declared duly adopted. 2. A lead agency request from the D.E.C. regarding Constantine P. Georgiopoulos. Trustee Smith: Are there any comments on this one? Trustee Bednoski: Yes. I received a telephone call on this.one. I believe in home rule. In knowing that area quite well, and knowing the backlog that the D.E,C. has I felt that we should have taken the lead. Trustee Smith: The D.E.C. has taken the lead on this one. 3. From Town Attorney Tasker regarding the Local Law to regulate housebarges. Trustee Smith: We just met with the Town Attorney. There is a problem with the language of the law, which has not been remedied yet. 4. From James Redman, N.Y.S.D.E.C. regarding updated recommendations on Arshamomaque Pond. Trustee Smith: Are there any comments on this one? Trustee Bredemeyer: Mr. Redman has sent some material to us. I think it would be nice.if we responded. He gave us a quote on a cheaper price on,Medium_~that we..could .use for some of the bacteriological testing to be done. Board of Trustees -3- February 27, 1985 Trustee Smith: We will proceed with our resolutions. RESOLUTIONS: 1. John M. May - To place a mooring in Fairhaven Inlet, using two stakes, access from private property, (a letter of permission has accompanied the application), the Board personally visited the site in question and have reviewed all correspondence in the file. No one appeared in behalf of the applicant and no opposition was made during the meeting, accordingly, On Motion made by Trustee Smith seconded by Trustee Bredemeyer it was RESOLVED to APPROVE the Mooring application,~as submitted for John M. May, in Cedar Beach, Southold. 1. Vote of Board: Ayes: All This resolution was declared duly adopted. Trustee Smith: Number two is for Mr. Edward Yanke to place a mooring in James Creek. Frank will you take this one? Trustee Kujawski: Sure. Mr. Yanke owns the property where the boat will be moored, right in front of his house. 2. On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to APPROVE the mooring application for Edward Yanke, for an offshore mooring, mn front of his property located at 2095 Bay Avenue, Mattituck. No one appeared in behalf of the applicant and no opposition was made during the meeting. The Board personally visited the site mn question and reviewed the file, therefore; the Board unanimously voted to approve this application, as submitted. 2. Vote of Board: Ayes: All This resolution was declared duly adopted. Trustee Smith: Next is a Wetland Application for Jon C. Kerbs to Declare Lead Agency. 3. Moved by Trustee Kujawski seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees declare itself lead agency in reqard to the State Environmental Quality Review Act in the matter of the Application of Jon C. Kerbs for a Wetland Permit on certain property located on the South Side of Riley Avenue in Mattituck. 3. Vote of Board: Ayes: All This resolution was declared duly adopted. Trustee Smith: Next item is an Environmental Assessment on the Wetland Application of Bayles, Levinson and Franken submitted by the Land Use Company. t wish tO offer the following: Board of Trustees -4- February 27, 1985 4. Moved by Trustee Smith seconded by Trustee Bredemeyer it was RESOLVED that pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that the Southold Town Trustees as lead agency for the action described below, has determined that the project, which is unlisted, will not have a s~gnificant effect on the environment. DESCRIPTION OF ACTION: The application submitted by the Land Use Company, on behalf of Bayles, Levinson and Franken, for a Wetland Permit to dredge 375' area of a private canal, South of Tarpon Drive, to 6' below MLW, by large crane with spoil (300 yds.) to be placed upland of bulkhead at the south west corner of the canal. The project is located at Tarpon Drive and Albacore Drive, Southold. The project has been determined not to have a siqnificant effect on the environment for the following reasons: An environmental assessment has been~submitted which ~ ~r~.~- indicated that no significant adverse effect to the environment are likely to occur should the project be implemented as planned. Because there has been a response from the Southold Town Conservation Advisory Council recommending that the application be approved, and indicating that this project would not have a significant effect on the environment. Because there has been no response in the allotted time from the New York State Department of Environmental Conservation and the Southold Town Building Department, it is assumed that there are no objections nor comments from those agencies. 4. Vote of Board: Ayes: Ail This resolution was declared duly adopted. Trustee Smith: Number 5 is another Environmental Assessment for the Wetland Application submitted by J. Louise Moyle. 5. Moved by Trustee Bednoski seconded by Trustee Kujawski it was RESOLVED that pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that the Southold Town Trustees as lead agency for the action described below, has determined that the pro]ect, which is a Type II Action will not have a siqnificant effect on the environment. DESCRIPTION OF ACTION: The application submitted by J. Louise Moyle for a Wetland Permit to .~e~t~ce-exist.in~eroded cinder block bulk- head with treated wood materials on property located at 1920 Minnehaha Blvd. Southold. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effect to the environment are likely to occur should the project be implemented as planned. Vote of Board: Ayes: All This resolution was declared duly adopted. In the matter of the application of E.N. Richards submitted by En-Consultants, Inc. to construct a dock consisting of a ramp and float secured by pilings and to place a mooring piling off of the Southeast corner of the float on property located at Salt Lake Village, Mattituck. The minutes of this public hearingwere prepared under separate cover. On motion made by Trustee Kujawski seconded by Trustee Bednoski it~was~_~ RESOLVED that this public hearing be and hereby was clo~ed Dy unanimous vote of the board. In the matter of the application of Martin and Florence Gellman to repair and extend an existing dock and to place removeable ramp and floats with pilings on property located at Meday Ave., Mattituck. The minutes of this public hearing were prepared under separate cover. On motion made by Trustee Kujawski seconded by Trustee B~dnoski it was RESOLVED that this public hearing be and hereby was closed by unanimous vote of the Board. In the matter of the application of Theodore Krukowski to construct a catwalk and floating dock to moor a boat, on property located at 15 Stillwater Avenue, Cutchogue. The minutes of this public hearing were prepared under separate cover. On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED that this public hearing be and hereby was closed by unanimous vote of the Board. In the matter of the application of the application of John Newman to construct rip-rap, remove solid fill walk, construct walk and docks, remove and replace bulkheads, dredge and fill on property located at the end of Sailor's Needle, Mattituck. The minutes of this public hearing.were prepared under separate cover. On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED that this public hearing be and hereby was closed by unanimous vote of the Board. In the matter of the application of Albert Roke submitted by ~ John Geideman to dredge in Schoolhouse Creek algng property of Katherine TuthiI1, and fill to be placed on Hartung property. Project location is at the eDd of Old Harbor Road, New Suffolk. On motion made by Trustee Kqjawski seconded by Trustee Bednoski it was Resolved that this p~lic hearing be and hereby was closed by unanimous vote of the Board. In the matter of the application of Gus Klavas submitted by En-Consultants, Inc. to replace (within 18") a timber bulkhead plus two returns and backfill on property located at Arshamomaque Road, Southold. Minutes of this public hearing were prepared under separate cover. On motion Wade by Trustee Kujawski seconded by Trustee Bednoski it was Resolved that this public hearing be and hereby was closed by unanimous vote of the Board. In the matter of the application of the Winds Way Building Corporation to construct a fixed dock to a ramp ~nd" float secured by spiles at Cedar Beach Drive East, In Pleasant Inlet, Cedar Beach. The minutes of this public hearing were prepared under separate cover. On motion made by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED that this public hearing be and hereby was closed by unanimous vote of the Board. The meeting reconvened at 8:19 P.M. Richards applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of SoUthold, application dated October 19, 1985 and WHEREAS, Said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on Feb. 27, 1985 at which time all interested persons were given an opportunity to be heard, now, therefore, be it 'RESOLVED that E.N. Richards be granted permission under the provisions of the Wetland Ordinance of the Town of Southold, New York, all in accordance with the application. This permit will expire on February 27, 1986 if work has not commenced by said date. There shall be two inspections required; and the Trustees shall be notified when the project is complete. Board of Trustees -7- February 27, 1985 MARTIN AND FLORENCE GELLMAN Moved by Trustee Kujawski seconded by Trustee Bednoski WHEREAS,Martin & Florence Gellman applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated Nov. 22, 1984 and Trustee Application, and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on Feb. 27, 1985 at which time all interested persons were given an opportunity to be heard, now, therefore, be it RESOLVED that Martin & Florence Gellman be granted permission under the provisions of the Wetland Ordinance of the Town of Southold, New York, all in accordance with the application. Lead Agency Declaration Moved by Trustee Bednoski seconded by Trustee Kujawski it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act~ in the matter of the application of Kearnsport, Ltd. submitted by En-Consultants, Inc. for a Wetland Permit on certain property located at Atlantic Avenue and Monsell Place, Greenport, New York. 7. Moved by Trus~e~ Smith seconded by Tru~te~ Bredemeyer NOTICE IS HEREBY GIVEN that public hearings will be held by the Board of Town Trustees of the Town of Southold, at the Southold Town Hall, Main Road, Sohthold, New York, on WEDNESDAY, March 27, 1985 on the following applications for permits under the provisions of the Wetland Ordinance of the Town of Sou%hold, to commence at 8:00 P.M. In the matter of the application of Donald Bayles, Michael Levinson and Wilhelm Franken submitted by the Land Use Company to dredge an area of a Private Canal south of Tarpon Drive by barge crane with resultant spoil to be placed upland of the bulk- head at southwest corner of the canal, project located at Tarpon Drive/Albacore Drive, Southold. In the matter of the application of J. Louise Moyle to replace existing eroded cinder block bulkhead with treated wood materials on property located at 1920 Minnehaha Blvd., Southold. Ail persons interested mn said matters should appear at the time and place above specified and will be given an opportunity to be heard. Trustee Smith: Number ten we are going to hold, that's the environmental assessment on Mattituck Inlet Marina. We are waiting for the recommendations from the Conservation Advisory Council. We will move on to number 11. Jay will you take this one? 11. PETER NEYLAND - LEAD AGENCY DECLARATION Moved~by Trustee Bredemeyer seconded by Trustee Bednoski it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of~,-Peter Neyland for a wetland permit on certain property located at Cedar Lane, Gardiners Bay Estates, East Marion, on Spring Pond. 11. Vote of Board: Ayes: All This resolution was declared duly adopted. Trustee Smith: Jay will you take number 12 also, that's in your area also. 12. WES BEDNOSKI - To place an offshore stake in Narrow River, Orient, using public access to the water. Trustee Bredemeyer: I have personally visited the site in question, and reviewed the f~le. Although there is an increasing number of boats in this area, I feel that there iS room there to accommodate an 18~ boat. Trustee Smith: That's to the north? Trustee Bredemeyer: Yes, that's essentially to the north of the ramp in the open waters. Accordingly, 12. On motion made by Trustee Bredemeyer seconded by Trustee Kujawski it was RESOLVED to APPROVE the mooring application for Wes Bednoski as submitted. 12. Vote of Board: Ayes: All This resolution Was declared duly adopted. 13. Trustee Smith: I would like to hold the moorinq application for Henry Oman, until we can determine how many stakes are there now. Mr. Oman has applied for an offshore stake in Richmond Creek. 13. Moved by Trustee Smith seconded by Trustee Bednoski it was RESOLVED to Table the mooring application of Henry Oman for one month until an inspection can be made to determine the number' of moorings in that location. 13. Moved by Trustee Smith seconded by Trustee Kujawski it was RESOLVED to APPROVE the mooring application for Ilse Scheible, to place an offshore stake with pulley line to onshore stake in Corey Creek, using public access. lA. Vote of Board: Ayes: All This resolution was declared duly adopted. Trustee Smith: Next is our Grandfather Application for Raymond Pluschau. Trustee Bredemeyer: The configuration that shows on the application is not the same as what is in the water. Trustee Smith: We will schedule this for our inspections on March 21, 1985. Trustee Bredemeyer: I'll move to table this for one month. GF 1. Mr. Haje: I think it is more for ease of moving the boat in and out than anything else. I think this way it will be easier to get the boat in, when he is coming in from East. Outside of that I don't know of any Other reason. Trustee Ku]awski: There is a sandbar that is washed up against the bulkhead. I just think austically, it would look much nicer if it was perpendicular with the bulkhead. Also, the ramp does it have e~ough torque on it? Mr. Haje: That's the way he wants it. I took over the property in May of 1984, and the dock was existing, at the end of it there was no ramp. When the dock existed there were a number of floats on the beach. When I spoke to'M~s. Pfifferling~ upon getting the application, she said they were classed the year before ~oard of Trustees Public Hearing - F~b. 27, 1985 Page 2. - Martin & Florence Gellman There was a survey done,~ of all docks by some students who were hired by the Town, and the dock was not registered as existing. It has been there about 20 years. I hava no proof that it was there, except that seeing it is%here. I now have some navigation charts, by Nohah dated 1981, although the detail was small, it shows an existing dock. I lust want to establish that it was there. I made an application to extend it, in floats, I wanted .to apply properly. There were docks, and pil~s in the creek,as far back as 81. Trustee Smith: You said you bought the place in 19847 Mr. Gellman: Yes. Trustee Smith: Do you think that when this place was up for sale these docks were taken out for the winter and never put back in? Mr. Gellman: There is a ramp on the beach, no piles or existing docks in the water, but there are 2-16'floats, plus a 8' x 16' float. I don't know the configuration, but my application indicates, what I imagine exactalty how these floats may have existed. I spoken to some neighbors and they said maybe 15 years ago someone had the dock out and this was the configuration. As I said they did exist. Trustee Kujawski: I think we met. l~r. Gellman~: You were out, and you saw the ramp~ Trustee Kujawski: We talked a little about it. I explained that one of the problems, at that time, the property line, it's right on the property line with your neighbor. We would propose to put in as close in front as possible, but within 18" and add returns on both sides to the adjacent bulkheads, which are also deteriorated.
