SEQRA DETERMINATION: The Zoning Board of Appeals has visiteu the property under
consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required
under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County
Department of Planning issued its reply dated December 3, 2007 stating that this application is
considered a matter for local determination as there appears to be no significant county-wide or
inter-community impact.
PROPERTY FACTS: The applicant's 205,690 sq. ft. conforming parcel in the R-80 District with
525 ft. along South Harbor Road and 316.97 ft. along Hog Neck Bay is improved with an
existing structure as shown on survey prepared by Nathan Taft Corwin III, Land Surveyor
dated June 19, 2007.
BASIS OF APPLICATION Request for a Variance under Section 280-14 based on the Building
Inspector's November 9, 2007 amended Notice of Disapproval concerning proposed additions
and alterations to an existing building at less than the code-required minimum of 60 feet from
the front lot line.
ZONING CHAPTER 280 OF TOWN CODE (formerly Chapter 100): Zoning Code Section 280-
14 states that no building or premises shall be used & no building or part thereof shall be
erected or altered in the AC, R80 . . . Districts unless the same Bulk Schedule incorporated into
this chapter with the same force and effect as such regulations were set forth, to wit, that the
required front yard setback for such a lot is 60 feet.

FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on December 20, 2007, at
which time written and oral evidence were presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning Board finds
the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicant proposes construction of a 296 square
foot storage addition, in line with the western side of, and attached to, the existing bathroom
facility building, leaving a front yard setback of 33.4 feet from the westerly lot line, where 60
feet is required.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted
and personal inspections, the Board makes the following findings:
1. Town Law §267-b(3)(b)(3)(1). Grant of the variance will not produce an undesirable change
in the character of the neighborhood or a detriment to nearby properties. The construction will
not affect the use of park district as a picnic/party area or contribute significantly to whatever
effects the existing park has on the neighborhood.
2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some
method, feasible for the applicant to pursue, other than an area variance. Keeping the new
construction in line with the existing building, which nonconforming setback is 34.8 feet, will
allow construction of room for storage while rendering the bathroom handicap accessible with
minimal effect on the subject property.
3. Town Law §267-b(3)(b)(3). The variance requested herein is not substantial. The proposed
addition will require an area of 296 square feet on a lot measuring 205,690 square feet. The
addition will extend 20 feet along a property line measuring 525 feet in length. The reduction of
setback imposed by extending the building along its western side will be a maximum of 17
inches.
4. Town Law $267-b(3)(b)(5). The difficulty has not been self-created only so far as it is
determined by the placement of an existing non-conforming structure.
5. Town Law §267-b(3)(b)(4). No evidence has been submitted concerning possible adverse
impact on the physical or environmental conditions in the neighborhood arising from granting
the specific variance sought by the applicant.
6. Grant of the relief requested is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of his property, while preserving and protecting the character of
the neighborhood and the health, safety and welfare of the community.

RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member Simon,
seconded by Member Weisman, and duly carried, to
GRANT the variance as applied for, as shown on the June 19, 2007survey prepared by
Nathan Taft Corwin III, and 02-09-2007 Elevation (flat roof on pergola) Sheet A101,
prepared by James Deerkoski, P.E. marked "Final Map Reviewed by ZBA"
Any deviation from the variance given such as extensions, or demolitions which are not shown
on the applicant's diagrams or survey site maps, are not authorized under this application when
involving nonconformities under the zoning code. This action does not authorize or condone any
current or future use, setback or other feature of the subject property that may violate the
Zoning Code, other than such uses, setbacks and other features as are expressly addressed in
this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an
alteration that does not increase the degree of nonconformity.

Weisman. This Resolution was duly adopted(5-0).

1. An undesirable change will not be produced in the CHARACTER of the
neighborhood or a detriment to nearby properties, if granted,because:
The use of the proposed renovations to the existing bathroom to make them
handicap accessible,the addition to the existing storage room and the construction
of a covered open-air pergola area with uncovered brick patio area will not alter
the use of the park district whose grounds are open from May 31st to October 15th
as a picnic/party area. As swimming is prohibited at this park, the construction
will not affect the use of the beach. The covered open air pergola with uncovered
brick patio area will only be used during normal hours of park operation which
are 9AM until dusk. In this regard the CHARACTER of the adjoining
properties/neighborhood will remain unchanged.
2. The benefit sought by the applicant CANNOT be achieved by some method
feasible for the applicant to pursue,other than an area variance,because:
If the sixty foot setback required in an R80 zone is maintained from South Harbor
Road, the neighboring properties to the north/east will have the proposed storage
room addition and open air pergola area impact their open space view.
3. The amount of relief requested is not substantial because:
The proposed storage room addition will be 296 square feet which will be in line
to the north of the existing bathroom building and open air pergola with brick
patio area will have no walls.
4. The variance will NOT have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district because:
The use of the park district will not be changed by the construction and this
location was also chosen due to the level area of the park, the distance from the
existing neighboring homes and the fact that no trees that will have to be taken
down to accommodate the storage room and the covered open air pergola area

Dear Mr. Dinizio,
Re: South Harbor Park(Emerson Park), Southold
This letter is written on behalf of the Commissioners of the Southold Park District regarding the
variance request to construct a 20' x 14.8' storage area attached to an existing one story rest room
building and construct a 20' x 20' covered open air pergola with a 24.1' x 20' brick patio area, and
also replace the concrete slab at the entrance to the restrooms with a brick patio 4' x 14.8' at our
South Harbor Park, South Harbor Road, Southold, NY, at 33.4' from the front property line.
Because of the location of the existing rest room building which is 34.8' from South Harbor Road,
keeping the new construction in line with the building would bring the new construction to 33.4' from
South Harbor Road. Since this does not conform to the R-80 front yard 60' zoning requirement we are
requesting a variance.
The Commissioners will be updating the bathrooms to handicap accessible and enlarging the storage
room, which is also our mechanical room, for picnic table storage and for storage of a handicap beach
wheel chair that we will be purchasing in the future.
We are enclosing a reprint of a letter from Haven and Grace Emerson who gave the land for the park to
the district in December 1921 which was written to the Commissioners of the Southold Park District
with a reply from the Commissioners. This letter and reply were published in the Mattituck
Watchman/Long Island Traveler. Please take special note of the portion of Mr. and Mrs. Emerson's
request to have built a "shelter under which tables and benches would serve the convenience of those
who wish to picnic at the shore". It has been a long time in coming but the Commissioners hope to
make the Emerson's wish become reality. p

The Southold Town Board of Trustees reviewed the survey prepared by Nathan Taft
Corwin Ill dated June 19, 2007 and determined the proposed additions to the existing
building to be out of the Wetland jurisdiction under Chapter 275 of the Town Wetland
Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

has determined that:
The portion of the park that is landward of South Harbor Road,a pre-existing(prior to 8/20/77),paved roadway
which is more than 100 feet in length,as seen on Tidal Wetlands aerial photo map#714-544, is beyond the
jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations(6NYCRR Part 661)no permit
is required under the Tidal Wetlands Act. Please be advised,however,that no construction,sedimentation,or
disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary,as indicated above,
without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any
sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction which may result from your project. Such precautions may include maintaining adequate work area

INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
