The regular meeting of the Board of Town Trustees was held on
December 23, 1986 at the Town Hall, Main Road, Southold. The meeting
was called to order by President Henry P. Smith at 7:00 P.M..
Present were:

Trustee Smith advised that the date for th~ January field inspections will be
held on January 22, 1987. Trustees are to depart from Town Hall at 12:00 P.M..
The date for the next regular meeting will be held on January 29, 1987 to
commence at 7:00 P.M..
Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was
RESOLVED to APPROVE the minutes of the November 25, 1986 meeting as
corrected: Communication No. 10 - the word marshes is to read water.

Moved by Trustee Bredemeyer seconded by Trustee Krupski it was
RESOLVED to RESCIND the following resolutions adopted on November 25, 1986 on
page 23 as follows:
D - SAL CAIOLA - WETLAND APPLICATION NO. 450 - TABLED
Moved by Trustee Goubeaud seconded by Trustee Larsen it was
RESOLVED to Deny the wetland application of Sal Caiola whereas there is no
evidence of undermining of the lateral support of land in the vicinity based on
land west of this property there has been no erosion.

RESOLVED to APPROVE the wetland application of Sal Caiola to construct a steel
retaining wall along the tow of bluff. A total of 962± lin. ft. of retaining

wall is proposed. For sections facing Long Island Sound stone armor will be
placed. Approximately 400 cu. yds. of clean sand and loam will be trucked in
for backfill. Wall will be entirely above MHW. Property is located on Sound Drive,
Greenport.

This resolution was declared duly adopted.
Trustee Larsen arrived at 7:10 P.M.
Trustee Smith reported that he received a telephone call from Mr. Herbert L. Ortner,
Attorney who represents Mr. & Mrs. Richard Prieto regarding a question of a right-
of way on Corey Creek, Southold. Trustee Smith reiterated that in his opinion
this property is a R.O.W. unless this can be proven differently and if any of the
mooring renewals come up at that road ending that they-will be approved.
Moved by Trustee Smith seconded by Trustee Larsen it was
RESOLVED to APPROVE the renewal of mooring permits at the end of the R.0.W.
on Corey Creek, Southold.

This resolution was declared duly adopted.
Moved by Trustee Smith seconded by Trustee Larsen it was
RESOLVED to APPROVE the FEBRUARY 1987 Mooring renewals.

This resolution was declared duly adopted.
Trustee Smith gave the Trustees report for November 1986 as follows:
Application Fees $75.00, Wetland Applications $700.00, Wetland Inspections $40.00,
Docks and Bulkhead Fees $130.50 and Mooring Renewal Fees $45.00 for a total
of $990.50. This has been turned over to the Supervisor to be placed in the
General Fund.
II. Public Notices: Trustee Smith advised that these notices are put on
the Town Clerk's bulletin board if anyone wishes to review them.
The President proceeded with agenda item number III. Communications.
III. Communications:

Mr. John Wickham appeared before the Board to discuss repair work needed
on his dike. The Board determined that an application is necessary for this
work and requested Mr. Wickham to submit same to the Trustee office.
Moved by Trustee Smith seconded by Trustee Bredemeyer it was
RESOLVED that Mr. John Wickham is to submit an application to the Board of
Trustees for work to be done on the dike located on Grathwohl Road, New

This resolution was declared duly adopted.
Ralph Levy regarding a Notice of Violation for the placement of stones
within 75 ft. of the water. Property is located at 885 Arshamomaque Ave.,
Southold. Mr. John Harrison appeared before the Board on behalf of Mr. Levy
to explain the activity that has taken place on the property. The Board
advised Mr. Harrison to submit a Wetland Application for the Board to review
regarding this work.
From Roy L. Haje, President, En-Consuttants, Inc. advising that no jetty
work is contemplated for the Sal Caiola project. Property is located on
the North Road, Greenport.
From Marjorie L. Rosenthal, Ferrari, Rosenthal & McGann a request for an
adjournment on the Wetland Application of Frank Frankola.
Moved by Trustee Bredemeyer seconded by Trustee Larsen it was
RESOLVED to RESCIND the Environmental Declaration declared on November 25, 1986
on the Wetland Application of Ferucio Frankola until such time as additional
plans are submitted to the Trustee office for review. (Conditional Negative
Declaration - resolution no. 23. page 15 of November 25, 1986 minutes.)

From Supervisor Francis J. Murphy regarding information from the State of
New York, Dept. of State in regard to a Grant under its local Waterfront
Revitalization Program.
5. From Frank Heroy, Secretary, Lake¥iew Terrace Road Association regarding
the Bay Avenue project in East Marion.
6. From Charles deQuillfeldt, Marine Resources Specialist, II regarding
Mattituck Inlet.
7. From William H. Gill, United States Dept. of Interior, Fish & Wildlife
Service an amended list of endangered and threatened wildlife and plants.
8. From the New York State D.E.C. a request for information at the January 29th.
meeting to be held at 7:30 P.M. at the Town Hall, Main Road, Southold.
Trustee Bredemeyer suggested that they may be interested in the Stripe Bass
Ban and Shellfish Sanitation. He further suggested that if any of the
Trustees had any information they want to be submitted that they should
give it to the Secretary to forward to the D.E.C. office. Trustee Smith
further advised that the Secretary forward a letter to the D.E.C. office
advising them that there is a conflict with the date as the Trustees meeting
is scheduled for the same evening.

From Roy L. Haje, President, En-Consultants, Inc. regarding the status of the
Harold Wilsberg application no. 398. Trustee Bredemeyer advised that the
Significant Declaration was declared on the application for the construction
of the bulkhead and to dredge. Trustee Bredemeyer continued that the
application to clear the land of small brusb is on the agenda for
an Environmental Assessment.

regarding the Suffolk County Dredging of James Creek spoil sites.
Trustee Larsen advised that the D.P.W. Spoil sites are not acceptable.
Trustee Smith reported that he spoke with someone regarding Deep Hole
Creek, Mattituck. Trustee Smith advised that the possibility of having
Deep Hole Creek dredged privately is being considered.
From Walter G. Lindley, Environmental Planner, Bureau of Wastewater
Management, Dept. of Health Services regarding comments and concerns
regarding an application for Anthony Gambino on Deep Hole Creek, Mattituck
for a house proposal. ~ application was transmitted to Mr. Gambino
for this construction.
From John J. Clavin, Harbormaster on Fishers Island regarding the Olaf Nelson
wetland application.
16. From Richard C. Corwith, President, Board of Trustees, Town of Southampton
a thank you for the special Proclamation presented at their Dongan Patent
celebration and for the gift of clams which were greatly enjoyed by those
present. Trustee Smith commented that the L. I. Traveler-Watchman did
a nice job on the coverage of that celebration.
The Trustees~recessed the regular meeting at 7:55 P.M. to hold the following
Public Hearings on the Wetland Applications as follows:
7:30 P.M. - In the matter of the application of Paul Galgan to construct a
new dock and catwalk to replace an existing old wood boat ramp.
Dock to be 10' 20' with 4 pilings, catwalk to be 6' x 50' with
steps to a 10' x 10' landing with a ramp 3' x 20' to connect
to catwalk, East Creek, Cutchogue.

a timber dock consisting of a 4' x 16' hinged ramp and a 6' x 20'
float secured by (2) 8" pilings, James Creek, Mattituck.

In the matter of the application of Wilhelm H. Frank to replace
a timber bulkhead, 88 lin. ft. and fill with approximately 50 cu.
yds. of fill to be trucked in from upland source. Bulkhead to
be replaced in kind and in place, Pett~s Pond, Southold.
7:36 P.M.-
In the matter of the application of Vincent R. Pisano to construct
a 4' x 50' catwalk to a 3' x 16' ramp leading to a 4' x 40' float
dock to be attached to a 8' x 20' float dock, Mattituck Creek, Mattituck.

In the matter of the application of En-Consultants, Inc. on behalf of
Nell Simon to construct a 4' x 16' walkway to a 4' x 14' ramp and
a 6' x 16' float secured by two spiles on a dredged canal, prQperty is
located at Harbor Lights Drive, Southold.
7:40 p.M.~ In the matter of the application,of Frederic Endemann to replace 5
old docks with new floats and ramps to be constructed as follows:
(3 floats - 30' x 5' and 2 floats - 20' x 4') in Schoolhouse Creek,
New Suffolk.

In the matter of the application of Rita F. Gledich to construct an open
deck and dwelling additions to an existing residence, Property is
located on Oak Street, Cutchogue.
7:44 P.M.-
In the matter of the application of Walter H. Burden, III to
construct a 4' wide catwalk to be 40' long. Property is located
of a R.O.W. off of 6th Street, Greenport.
7:46 P.M.-
In the matter of the application of the Land Use Company on behalf
of Ruth Engel to construct a 12' x 40' deck 8' x 20' float dock and
a 3' x 6' ramp on a dredged canal off of East Creek, Cutchogue.
7:48 P.M.-
In the matter of the application of En-Consultants, Inc. on behalf
of Friedrich Krug to replace (within 18") 74 lin. ft. of existing
timber bulkhead; Dredge an area within cut-out (8' x 58') to 4'
below MLW. Place resultant 65± cu. yds. of spoil behind the bulk-
head on owners lot. Install a dock within cut-out consisting of:
4~' x 4' fixed platform off of bulkhead: 3' x 16' hinged ramp; (2)
6' x 24' floats secured by (3) 8" spiles. Property is located on
Budd's Pond Road, Southold.

Dr. Martin Garrell requested that the Secretary strike the comments previously
submitted to the Trustees regarding this application. Dr. Garrell stated that
the Conservation Advisory Council will have to reinspect this proposal and

President Smith advised that he received a telephone call from a Mr. Anderson
who was quite upset. Mr. Anderson purchased a mooring in West Harbor on Fishers
Island and was advised by the Harbormaster, Mr. John Clavin, that he only
purchased the instrument and not the permit. Trustee Smith advised Mr. Anderson
that he would have to go to Judge Raymond Edwards or the Southold Town Board if
he has a problem with this matter.

provision that the intertidal marsh fringe is revegetated.
This permit will expire on December 23, 1987 if work has not commenced by said date.

The Board discussed the following agenda items:
John Wickham was previously discussed (see page 2, communication item IA).
Julius Juttner - The Board reinspected the property of Julius Juttner
located on Westview Drive, Mattituck. The Board determined that mean high
water is just about at the bulkhead line. The Board instructed the Secretary
to forward a letter to Mr. Richard J. Cron, Attorney on behalf of Mr. Juttner
advising that a survey is to be drawn up reflecting the HWM at the bulkhead
so that a Quit Claim Deed can be prepared as requested.
Carlo DeGaudenzi - Trustee Bredemeyer advised that a return was added
to the structure on property located at 3520 Ole Jule Lane, Mattituck.
Mr. DeGaudenzi was issued a permit for a bulkhead under permit no. 189.
Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was
RESOLVED that the Secretary forward a letter to the Mr. DeGaudenzi advising
that he is to appear at the next Trustee meeting to be held on Jan. 29th
to discuss possible irregularities in the construction from the permit issued,
forthwith of a Notice of Violation for irregularities noted in their structure.

Anthony Leggio - The Bay Constable is to issue the Notice of Violation
regarding his property located on Glenn Road, Southold.
Trustee Smith advised the Board the Mr. Leggio wanted a waiver of the Ordinance
for this construction. Trustee Smith advised Mr. Leggio that the Board of
Trustees are firm in their determination that a full application is required
for the work completed on his property. The Trustees are awaiting the application
fee for same at this time. A letter was forwarded to Mr. Leggio advising him
that the fees are to be submitted so that the application can be reviewed.
A request by Martin H. Garrell, Chairman, Conservation Advisory Council
regarding the consideration of the statement to be added to the wetland application
as follows: "I/we certify that I/we have notified all property owners within
100 ft. of this project, Signed, ". The Trustees felt that
whereas, the Army Corps of Engineers requires notification to adjacent property
owners, they do not feel that this is necessary at this time.

Trustee Larsen: The only thing that I would like to say is that where it says
"88 lin. ft. and fill with approximately" I would like it to say "Backfill
bulkhead with approximately 50 cu. yds. of trucked in fill" on the permit.
Trustee Bredemeyer: I wenn down and taped this job off. The 88 ft. is not
a straight distance. I don't know if the drawing does it justice? Apparently
there is a cut out, it looks like it could have been a cut for a boat ramp there?
This area will be filled in with this. There was some concern on inspections
about it, then it got to dark to go out. I went down and taped it today, if
you want to look at the diagram I prepared?
Trustee Krupski: I thought the 88 ft. didn't include the cut?
Trustee Bredemeyer: No it's only 63 ft. without the cut. I wrote the
measurements down. It's 88 ft. including the cut. That would be a straight
line across. There would appear to be pilings or supports there, apparently
washed out. Maybe an old bulkhead washed out, something was there.
Trustee Goubeaud: He told me that there was a boat ramp there.
Trustee Smith: There used to be a boat ramp there.
Trustee Larsen: There is also an unbulkheaded portion of that, as well adjacent
there. There was a question as to whether that portion ......
Trustee Bredemeyer: That is unbulkheaded, he wants to go all the way across. I
just want to bring it to your attention. I don't see a problem.

Martin Garrell, C.A.C.: It is just our general feeling that they restore
the shoreline when ever possible to make up the damage when you bring in
the equipment.
Secretary: The C.A.C. recommended "Approval is with the stipulation that the
applicant properly contain the spoil and cover with appropriate marsh plants."
Are you putting the fill behind the bulkhead?
Roy Haje: You can't plant with marsh grasses. It has been bulkheaded for years.
Martin Garrell: I'm sorry for that comment. Strike that.
Trustee Smith: Yeah.
Martin Garrell: Some of the stuff, it's not clear.
Trustee Larsen: I have a question. You are requesting to dredge an 8' x 58'
area within the cut out. But at the same time you are putting a dock
in the cut out with a platform, a 15' ramp and then 2-24' floats that will
take you out of the cut out area into deeper water. So why do you want to
dredge in the cut out area when you are putting a dock out of the cut out
aea.
Trustee Smith: Because the width of the float will not go past the shoaling
that occured there. This person on this side (indicating on map) he bulkheaded
this piece of property over here. Mr. Witney bulkheaded his the same, and the
people who owned this property prior didn't bulkhead because of the expense
what ever. Ail of this fluffed in. They put a temporary rinky dink bulkhead
up there to hold any further erosion, now what they want to do is to tie this
bulkhead into this bulkhead (showing on map) But the Army Corps would not
let him do this. Now he wants to replace in kind and in place and take out some
of the stuff that fluffed in put this floating dock in so he can keep his boat
there. Which to me, is a sensible way to do it. For one thing he will not
have to put in such a deep bulkhead. He will have nothing more, in fact he
will have less than his neighbors with an 8' set back.
Trustee Larsen: Right.
Trustee Smith: Are there any other comments on this application. No comments.

Trustee Smith: The Conservation Advisory Council has approved the previous
application. Are there any comments?
Roy L. Haje, En-Consultants, Inci: Roy Haje for the applicant, ~Neil Simon.
This represents a slight modification from a prior application in that we
have pulled the entire structure in so that it lies totally within the
property line. The land underwater is owned by the applicant, as this is
a man made canal. We have received Army Corps of Engineers approval as well
as D.E.C. for this project. We urge your approval.
Trustee Krupski: Roy, how far did you pull it in? We felt there may be
a problem with navigation.
Secretary: The prior.application was before you were on the Board Al, the new
application that is before you now has not been amended. The old application
had a different p~an.
Trustee Bredemeyer: It was a different plan.
Roy Haje: It came out from the house more. We moved it further South, away
from the bay.
Trustee Goubeaud:
Along the adjacent property line.
So we are working on an amended application.
Trustee Krupski:
Secretary: No, the application before you now, is what he is asking for.
T~ere was a previous application, before you were on the Board, for a different
structure.
Trustee Bredemeyer: It is a new application. In his mind he amended what he had

Trustee Goubeaud: We took a look at that property Roy. We thought that if the
dock was put further North on the property line, adjacent to the neighbor that
it may have a problem with navigation?
Trustee Larsen: Were in a catch 22 situation. We thought that there would be
a problem with navigation there.
Trustee Goubeaud: Across the creek, there is a dock and float.
have his boat out there it will restrict navigation through the channel.
Roy Haje: There is a bulkhead across most of the opposite shoreline. There is
an indentation there. Plus there is also the remains of an old groin there.
Trustee Krupski: Your application was to go out further?
Roy Haje: I'm not sure? I don't know exactaly how much further?
Trustee Krupski: We measured it.
Roy Haje: D~ you feel that the canal was wider there on the North end?
Trustee Krupski: No, we just felt that they should be staggered more, rather
than have them meet at the same place.
Roy Haje: May I speak to my client, may I discuss this with him. The thing
that pops out in my mind is that we will have to amend our other permits?
Trustee Smith: We could make it a stipulation?
Trustee Goubeaud: We could put him on notice that there may be a change down
the line if people complain in the neighborhood because of the restrictiveness
of the structure.
Trustee Krupski: It was hard to tell what the neighbor had, how much room?
Trustee Smith: Can you hold it back any more?
Roy Haje: No.
Trustee Krupski: Then we will put the provision in the permit that it will
not impede navigation.

Trustee Henry P. Smith: Our comments from the Conservation Advisory Council
were to approve the application. Are there any other comments on this
application? Yes, please come up and state your name.
Paul Galgan: My name is Paul Galgan. I am the applicant. Since receiving
your letter in Novenmber after the Board was present at the site it was
explained to me that the dock should be placed on the South side of the
property; after conversation with Mrs. Pfifferling and Trustee Krupski,
Since those conversations I have examined the South site again. I have
a series of photographs for you, (Given to the Clerk) to show where the
property lines comes in regarding that South side.
Trustee Goubeaud: Your property line cuts right through that walk there.
Mr. Gaigan: Yes that is right.
Trustee Larsen: It was brought to my attention also.
Trustee Goubeaud: That was brought to my attention after the fact.
Mr. Gaigan: In Photograph number l, it's taken looking East.
Trustee Smith: That is your property marker there?
Mr. Galgan: Yes that is my property marker that concrete monument.
I estimate that that's where that green pole, at the waters edge, is placed.
According to the property survey. On a windy day I drew a piece of rope, ½ inch
nylon and photograph 1 shows the approximate property line from the green stake

to the concrete monument. In photograph 2, it is the same photograph but
looking West in the same direction. It gives a little better view. I have
another set of photographs if everyone would like to see them?
Trustee Smith: I think that everyone has been down to the property.
Trustees: Yes we have.
Mr. Galgan: Photo 2, indicating a portionof steps are already encroaching
the adjoining property. I took possission on August 28th of this year. With
all of the monuments there, it came to my attention now that that portion of
the steps, where the Board suggest that the dock be placed on the South side
you can see that I would be dealing with quite a problem there.
Trustee Smith: Yeh, it would not be on your property.
Mr. Galgan: Photo 3 looking East and taken at a different angle. Shows
the relationship of the property line (water rope) to existing bulkhead and
steps. Photo 4, I took the liberty of placing a yellow yard stick and you can
see that it comes within 3 ft. somewhere between 30 and 33 inches the property
line comes in. It doesn't allow me much room to work with. Whereas, photo's 5,
6 and 7 are on the North side and if I may read my narrative "It's taken looking
East, the o~er all photo showing the property line on the North side (white
rope and dark green stake at water line) proposed catwalk, which happens to be
reduced, or made an application to have it reduced as conversation with Mrs.
Pfifferling on the 15th. That catwalk will be reduced to a 4' width as per D.E.C.
regulations. It shows the two white stakes at the water line. Also shown is
relationship of existing bulkhead (right side of photo) to property line
approximately 11 feet. Old wood boat ramp shown in photo will be removed and
replaced with new catwalk and dock if original application is approved.
(Note: the same appplication for dock was submitted to the D.E.C. and I hope
it will be approved.) with the one modification from the 6' catwalk to a 4'
catwalk. After living there, after we have had a few of these high tides, what
is it, with the earth, the moon and the sun I think it will be enlightening.
Photo 6 shows looking Southeast, shows the applied work area indicating
existing locations of water, grass and bare sand areas on the North side of
the property. After talking to Mr. Stepnowski from the Greenport Dock we
concluded that if we had to go with the south side, 3 of those pilings for
the catwalk would be placed in the grass area. Whereas on the North side a
total of 4 would be in the grass area. I want that grass to hold the pilings.
No way do I want to disturb that any more than necessary. In addition to
the explanation of the newly submitted photograph's as the applicant
I request the Town Trustees consideer the following reasons for granting
a permit as originally requested. Depth of water. There is an approximate
6" to 8" difference in the depth of the water. The North side (original
application site) being the deeper.
Trustee Larsen: You are only going to have 2 ft.of water at the end of your
float at iow tide?
Mr. Galgan: It looks like that. You don't plan to take a decent size boat
out at low tide.

B. the eyesore - The original application site (North side) would call for
the removal of the existing old wood boat ramp there by up grading the
visual aspects of the area for the good of the Town of Southold as a whole.
C. Neighborhood agreement - the proposed original application is in full
verbal agreement with both adjourning neighbors as well as most other
neighbors in the area. D. New York State D.E.C. approval as previously
mentionde the applicant has received a permit (#10-86-1321) from the
New York State D.E.C. dated 12/10/86 with only the 4' catwalk modification
on the original requested site. E. Property lines - as previously indicated,
by photo's and their explanations the North side allows for 11 feet as a
work area for catwalk while the South side only allows for less than 3 feet for a
catwalk directly on the property line. F. Sandy area - as the photo's show
there is ample bare sandy area on both the North and South side of applicant's
property to install a new catwalk and dock. It is extimated that 4 pilings would
be placed in grass area on North side and 3 pilings would be required on the
South side in the grass area. G. Grade-observation of applicants property
indicates that the grade on the NOrth side is less than that on the South side.
The design of the original application took this in mind calling for a
10' x 10' landing and approximately 5 steps to the catwalk. The top of the
grade on the North side allows for a more gental approach to the landing area
compared to that approach on the South side. A design of a catwalk for the
South side would call for approximately 11 steps. The above mentioned grade
is very important due to the fact that the applicants wife has been stricken with
Multiple Sclerosis (M.S.) since July 1979 and she requires a quad cane in her walking
mobility. I want to make things as pleasant as possible. I went into an early
retirement because of her physical condition. We want to make the best out of
life.
Trustee Smith: Did you mention this to the D.E.C.?
Mr. Galgan: Yes, I did and they said I would have to go through a full out-
and out hearing. I asked for a modification of 5 ft. I asked if we could
split the difference? They said no, unless a full hearing was held.
Trustee Smith: I know this Board, on occasion, with someone who has a physical
handicap or a hardship, that we would extend the width of the walk.
Mr. Galgan: As long as I can maintain the full 4 ft. catwalk, the walkway
itself. Keep the pilings on the outside. I hope I presented myself in a
professional fashion.
Trustee Smith: I think you did a very good job. Is there any further discussion
from anyone in the audience? Any one of the Trustees?
Trustee Krupski: I would like to say to Mr. Galgan that there is no problem
with the neighbor on the North. They have a new dock and it is quite a distance
from where yours is proposed.
Trustee Smith: It couldn't go on the South side anyway.
Trustee Krupski: With no activity on the South side the grasses should come back.

a group inspection. There was a question regarding the neighbors, that they

Dempsey. The project is rather small in scale. It will be for private use
for the landowner. It will not extend very far out into the waterway. We have
kept it in as close as possible and still make it useable. There is not much

neighbors. If their are some I would like to know what they are?
