THIS INDENTURE, made the 19th day of April, two thousand two,

party of the first part, and
Leonel Palencia and Elena B. Palencia, his wife, residing at 38400 County Road 48,
Southold, New York 11971
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other
good and valuable consideration paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Peconic, Town of Southold, County of Suffolk and
State of New York, known and designated as Lot 14 on Subdivision known as "Ismar
Acres" which subdivision map was filed in the Suffolk County Clerk's Office on
3/13/73 as Map No. 58n,. which said lot is bounded and described according to said
map as follows:
BEGINNING at a point on the North side of Bridge Lane where the division line between
Lots 13 and 14 as shown on said map intersects the North side of Bridge Lane;
RUNNING THENCE North 55 degrees 18 minutes 40 seconds West along the North side
of Bridge Lane 135.69 feet to the East line of land of the L.I.R.R.;
RUNNING THENCE North 46 degrees 58 minutes 00 seconds East along the easterly
side of the L.I.R.R. 344.22 feet to land now or formerly of Foster formerly Carroll;
RUNNING THENCE South 54 degrees 14 minutes 00 seconds East along said land
122.60 feet to the division line between Lots 13 and 14 as shown on said map;
RUNNING THENCE South 44 degrees 53 minutes 10 seconds West along said division
Line 339.39 feet to the point or place of BEGINNING.
THE GRANTOR herein being the same party as the grantee and the premises same as
described in deed recorded in the Office of the Clerk of the County of Suffolk in Liber
11619 CP 708.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever,
except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of
paying the cost of the improvement and will apply the same first to the payment of the cost
of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.
