The Regular meeting of the Board of Town Trustees was
held on February 27, 1986 at the Town Hall, Main Road, Southold.
President Smith opened the meeting at 7:30 P.M.
Present were:
President Henry P. Smith

Moved by Trustee Larsen seconded by Trustee Bredemeyer it was
RESOLVED to APPROVE the minutes of the Jahuary 23, 1986 meetinq.
Vote of Board: Ayes: All
This resolution was declared duly adopted.
Trustee Smith advised that the Field inspections will be held on
March 20, 1986 and the next regular meeting will be held on March 27,
1986 at 7:30 P.M.
Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was
RESOLVED to APPROVE the April 1986 Mooring Renewals.
Vote of Board: Ayes: All
This resolution was declared duly adopted.
Trustee Smith gave the Trustees Monthly report as follows: Application
fees $10.00, Dock and Ramp fees $60.00, Wetland Applications $400.00,
Wetland Inspection Fees $45.00, Dredging and Bulkheading $192.00 and
Mooring Renewals $60.00 for a total of $767.00.

Trustee Smith advised that these notices are published on the bulletin

1. Costello Marine Contracting Corp. to amend the Wetland
Application for the Lagoon Association c/o Robert Sturdy.
Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was
RESOLVED to Amend the Wetland Permit No. 256 for the Lagoon Assoc.
c/o Robert Sturdy to reflect 2,000 cu. yds. of sand rather than
the 6,000 requested.
Vote of Board: Ayes: Trustee Smith, Trustee Bredemeyer, Trustee
Krupski and Trustee Goubeaud
Abstained: Trustee Larsen
This resolution was declared duly adopted.
2. Nancy Sawast~,nowicz regarding the Wetland Application for
Richmond Creek Associates development and marina plan. This was
a letter of concern, we will advise her that the letter has been
placed in the file.
3. Legislator Tony Bullock regarding the Algae Bloom Studies.
Trustee Bredemeyer advised that this resolution was approved by
the Suffolk County L~gislature on February 10, 1986.
4. Joseph Fischetti, Jr., P.E. regarding Southport Development
for a determination on jurisdiction. Trustee Smith advised that
the Board has responded to Mr. Fischetti that the Trustees do have
jurisdiction in this matter.
5. Royal R. Reynolds, P.E., Senior Public Health Engineer, D.H.S.
regarding the application for Thomas W. Cramer.
6. Thomas W. Cramer regarding his wetland application no. 312,
advising that his is proceeding with the testin~ on the site as
requested by the Board.
7. Berye Wilcox commenting on the wetland application for
John Xikis, application no. 334.
8. Joseph Citarch commenting on the wetland application for
John Xikis, application no. 334.
9. Janet Thorn Waesche commenting on the wetland application for
John Xikis, application no. 334.
10. Benjamin C. Thorn commenting on the wetland application for
John Xikis, application no. 334.
11. Roy L. Haje, President, En-Consultants, Inc. requesting to
withdraw the groin portion of the wetland application no. 334 for
John Xikis.

RESOLVED that the groin section of Wetland Application No. 334
for John Xikis be and hereby is WITHDRAWN WITHOUT PREJUDICE.

12. Catherine L. Alwan regarding the wetland application no.
334 for John Kikis.
13. Joseph Schoenstein, President, North Fork Welding & Steel
Co., regarding his wetland application no. 337.
14. Abigail A. Wickham requesting to withdraw Wetland Application
No. 358 for John M. Bredemeyer, Jr. and in place thereof request
for a waiver of the Wetland Ordinance. Trustee Smith advised that
he was not favorable to a waiver of this application seeing that
this is the father of one of the Trustees. The Clerk advised the
Board that Ms. Wickham called the office today and advised that
she would not be able to attend the meeting this evening, due to
a prior commitment. She also requested that if the Board was not
favorable to a w~ver -she would like the opportunity to come before
the Board to discuss the application.
15. Stanley A. Pauzer, District Manager, Soil & Water Conservation
District regarding the Wetland Application No. 336 for Glenn
Heidtmann.
16. Stanley A. Pauzer, District Manager, Soil & Water Conservation
District regarding Wetland Application No. 319 for Ted Dowd.
17. Gary Doroski request for a waiver of the Wetland Ordinance
for the Construction of a single family residence on 690 Huntington
Blvd. and 20 Second Ave., Peconic, lot 78 and 79.
18. Gary Dor0ski request for a waiver of the Wetland Ordinance
for the Construction of a single family residence on 100 Second
Ave., Peconic, lot 109-110. It has been determined that the Trustees
do not have jurisdiction in regard to these matters. Trustee Smith
advised the Clerk to send a letter to Mr. Doroski advising him that
the Trustees do not have jurisdiction.
19. Theodore Krukowski requesting an extension on his permits
number 1930 and 199.
Moved by Trustee Smith Seconded by Trustee Bredemeyer it was
RESOLVED to APPROVE the request for an extension on perm±ts number
1930 and 199 for Theodore Krudowski. Said permits will expzre on
August 27, 1986.

20. Thomas W. Cramer regarding his wetland application no.
312.
21. William H. Lieblein, President, Port of Egypt Enterprises,
Inc. requesting a waiver of the Wetland Ordinance for the relocation
of existing fuel tanks on the propertylocated on Main Road, Southold.
Moved by Trustee Larsen seconded by Trustee Bredemeyer it was
RESOLVED'to Waiver the request 0fi, Mr~ Lieblein on behalf of the
Port of Egypt Enterprises, Inc. f6r~the relocation of existing
fuel tanks on the property.
Vote of Board: Ayes: All
This resolution was declared duly adopted.
22. Thomas W. Cramer requesting relief of the Wetland Ordinance
to install test wells to monitor ground water levels on property
located on Meadow Lane, Mattituck.
Moved by Trustee Bredemeyer seconded by Trustee Larsen it was
RESOLVED to waiver the need of a wetland permit to conduct testing
on the site as specified in the letter of request made by Mr. Cramer.

23. Charles T. Hamilton, D.E[C. regarding Lead Agency Coordination
request for Mattituck Dr¥1and Marina.
24. Supervisor Martin Lan~, Town of Southampton regarding the
Algae Bloom Studies.
25. John Bredemeyer, Town Trustee, to Mr.~Gordon Colvin, DEC requesting
that the Board of Trustees De considered a party of interest in any
possible change in the Wetland Boundary on the property of Lewis
Edson, Clearview Avenue, Southold. Trustee Bredemeyer advised that
the Board felt that they should be apprised of what the D.E.C.
decision making is, so that the Board could use it in a future
decision, when or if the Board sees a Wetland Application for this
parcel.
Trustee Smith: We will proceed with our resolutions until 8:00 P.M.
V. RESOLUTIONS:
1. CHARLES BO~4AN - WETLAND APPLICATION NO. 326
Moved by Trustee Smith seconded by Trustee Goubeaud it was
RESOLVED that Wetland Application NO. 326 for Charles W. Bowman
be and hereby is WITHDRA~ WITHOUT PREJUDICE.

2. JOHN J. NEWMAN - WETLAND APPLICATION NO. 335
Moved by Trustee Krupski seconded by Trustee Larsen
W~EREAS? John J. Newman applied to the Southotd Town Trustees
for a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated November 25, 1985, and
;~EREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and
WHEREAS, a public hearing was held by the Town Trustees with respect
to Said application on January 23, 1986 at which time all
interested persons were given an opportunity to be heard,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area; and,
WHEREAS, the B6ard considered all testimony and documentation
submitted concerning this application; and it is-noted for the
record that testimony was taken during the public hearing and is
under separate cover; and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the Town,
NOW, THEREFORE, BE IT
RESOLVED, that John J. Newman be granted permission under the
provisions of the Wetland Ordinance of th~ Town of Southold, New
York for the placement of twelve spiles to be placed landside, nov
in the creek or wetland and in accordance with the application
submitted. This permit will expire on February 27, 1987 if work ha.c
not commenced by said date. There shall be two inspections and the
Trustees are to be notified when the project is complete.

Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was
RESOLVED that the Southoid Town Trustees declare itself lead agency in
regard to the State Environmental Quality Review Act in the matter of
the application of James F. King for a Wetland Permit on certain property located
on East Mill Road, Mattituck.

GERARD GALLIAN - LEAD AGENCY DECLARATION
Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was
RESOLVED that the Southold Town Trustees declare itself lead agency in
regard to the State Environmental Quality Review Act in the matter of
the application of Gerard Gallian for a Wetland Permit on certain property located
on Pine Tree Road, Cutchogue.

GOLDSMITH'S BOAT SHOP, INC. - LEAD AGENCY DECLARATION

RESOLVED that the Southold Town Trustees declare itself lead agency in
regard to the State Environmental Quality Review Act in the matter of
the application of Goldsmith's Boat Shop, Inc. for a Wetland Permit on
property located on Main Road, Southold.

RESOLVED that the Southold Town Trustees declare itself lead agency in
regard to the State Environmental Quality Review Act in the matter of
the application of James Gray for a Wetland Permit on certain property located
on Bridge Lane, Nassau Point, Cutchogue.

7. MATTITUCK INLET DRYLAND MARINA - LEAD AGENCY DECLARATION
Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was
RESOLVED that the Southold Town Trustees declare itself lead agency in
regard to the State Environmental Quality Review Act in the matter of
the application of Mattituck Inlet Dryland Marina for a Wetland Permit on
certain property located on certain property located at Naugles Drive,
M~ttituck.

8. VILLAGE MARINE - LEAD AGENCY DECLARATION

the application of Village Marine for a Wetland Permit on certain property located
on certain property located on Bay Avenue, Mattituck.

RESOLVED that the Southold Town Trustees declare itself lead agency in
regard to the State Environmental Quality Review Act in the matter of
the application of Tovey C. Lesnikowski for a Wetland Permit on certain property
located on Mattituck Inlet, North Drive, Mattituck.

10. PORT OF EGYPT ENTERPRISES, INC. - WAIVER
Moved by Trustee Larsen seconded by trustee Bredemeyer it was
RESOLVED that the Port of Egypt Enterprises, Inc. be and hereby
are granted a Waiver of the Wetland Ordinance for the relocation and
reinstallation of three existing fuel tanks in accordance with Article 12
of the Suffolk County Sanitary Code. Project is located on the Main Road
in Southold, New York.

the application of Peconic Associates on behalf of Budd's Pond Marine
for a Wetland Permit on certain property located
on Route 25, Southold.

wetland permit on certain property located on the W/S of Bay Avenue, Orient.

13. MARY HALLOCK SMITH - MOORING APPROVAL
Moved by Trustee Krupski seconded by Trustee Larsen it was
RESOLVED to Approve the mooring application for Mary Hallock Smith to place
an offshore mooring , using a 150 lb. mushroom anchor in James Creek, with
the provision that the boat will not swing into any other boat or impede
navigation.

with new bulkhead and to place within 18" of existing. Dredge an
area of 126' x 15' on inlet side and place material behind bulkhead
with no return to waterway. (approximately 120 cu. yds.)
LOCATION OF PROJECT: West Lake Road, Southold, New York 11971
REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment form in the

D.EoC. it is assumed that there are no objections nor comments

1. An environmental assessment form'in the short form has been
submitted which indicated that there would be no adverse
effect to the environment should the project be implemented
as planned.
2. Because there has been no response in the allotted time from
the Southold Town Building Department and the New York State
D.E.C. it is assumed that there are no objections nor comments
from those agencies.
3. Because there has been a response from the Southold Town
Conservation Advisory Council recommending approval of the
project.
4. The project as proposed will not affect the health, safety and
general welfare of the people of the Town.

20. FRANK LICARI - REQUEST FOR A WAIVER - DOCK
Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was
RESOLVED to DENY the request made by Frank Licari for a Waiver of the
Wetland Ordinance for the replacement and repair of a catwalk and dock
on property located on Stillwater Avenue, Cutchogue. Mr. Licari will
have to submit an application for this project to be reviewed by the Board.

The Board discussed the following:
Trustee Smith reported that Reverend Tann advised that they were considering
an addition to the back of the Church on the North Road, Southold. The Board
inspected the site and advised Reverend Tann to submit an application to the
Trustees to be reviewed, regarding this proposal.
A request was made by William D. Moore on behalf of Mr. & Mrs. Vrankovic
for a determination on the need of a wetland permit for deck and second
story addition to an existing residence on Sandy Beach Road, Greenport.
An on site inspection was conducted by the Bay Constable who determined that
the Trustees have no jurisdiction in regard to this matter.
Mr. Roy Haje, President, En-Consultants, Inc. has requested a determination
on behalf of Roma Baran, King St. & Orchard St., Orient for the construction
of a single family residence, sanitary system and well. Upon making an on
site inspection the Board determined that as proposed the Trustees do not have
any jurisdiction in regard to this matter.
A request was made by Anthony B. Tohilt, P.C. on behalf of John Bagshaw,
Harbor Road, Cutchogue (Suffolk County Tax Map No. 1000-111-10-11) for the
construction of a single family dwelling, associated sanitary system and well.
Upon conduction an on site inspection of the property it was determined that
a wetland application will be needed in regard to this matter.
Richard Mohring, Jr. on behalf of Long Pond Estates requested a determination
on the need of a wetland permit for the construction of a single family residence
on property located a on Lot No. 7, Long Creek Drive, Southold. (Suffolk County
Tax Map No. 1000-55-11-07.04.). The Bay Constable conducted an on site
inspection and determined, as proposed, the Trustees wo~ld not have jurisdiction
in regard to this matter.
A request was made by Roy L. Haje, President, En-Consultants, Inc. on behalf
of Victor Cavelli, Willow Point Road, Southold for the construction of a single
family residence, sanitary system and well. An on site inspection was conducted
by the Trustees and it was determined that as proposed the work is not within
the Trustees jurisdiction.
The Trustees will forward a letter to all contractors together with a copy of
the amendment to the Wetland Ordinance in an effort to educate the public and to
help prevent problems with violations of the Wetland Ordinance.
Ruth Oliva, N.F.E.C. invited the Trustees to a meeting of the~ League of,~Wsmem
Voters to be held on April 2, 1986 at 7:30 P.M. in the~ Cutchogue~Presb~terian~ ,,, ~ ....
