Down's Farm Preserve
A meeting of the Southold Town Conservation Advisory Council was held Wed.,
December 5, 2007 at Down's Farm Preserve.

CALL TO ORDER
Acting-Chairman Jack McGreevy called the meeting to order at 4:30 PM.
CHAIRMAN'S ANNOUNCEMENTS
Chairman Don Wilder was unable to attend the meeting because of Jury Duty.
Acting-Chairman Jack McGreevy suggested the CAC send a memo to the Town Board
requesting permission for the council members to receive proper training with regards to
the LWRP, and other Town Codes. Jack also suggested the memo that he drafted last
month regarding the shoaling of Down's Creek, be forwarded to the Town Board, and a
memo be sent requesting re-imbursement of mileage to and from all committee meetings.

He further suggested a memo be sent to the Town Board offering the services of the CAC
to participate in other groups such as the Peconic Land Trust, and possibility act as a
liason. Jack volunteered to draft the memos for comments at the next meeting.
REPORTS
Member Peter Young will invite Merlon Wiggins to the meeting next month to discuss
lighthouses.
The members agreed that deciding who was going to attend the monthly meeting of the
Board of Trustees would be addressed at the beginning of the meeting, so that person
can take detailed notes in preparation for the meeting. Member James Eckert and Student
Member Jacob Smith volunteered to attend the next Trustee meeting on Wed., December
12,2007.

DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL
EROSION PERMIT APPLICATIONS
Moved by James Eckert, seconded by Chris Kempner, it
RESOLVED to SUPPORT the Wetland Permit application of ROBERT & DIANNE
CASTALDI to demolish the existing dwelling and construct a new dwelling and new
sanitary system.
Located: 8525 Nassau Point Rd., Cutchogue. SCTM#118-4-12

The proposed project wasn't staked, however, the CAC Supports the application with the
Condition the dwelling is moved to at least 100' from the wetland boundary, a 20' non-turf
buffer is installed, the driveway remains pervious, and every effort is made to save the
trees measuring 8" DBH and larger.

RESOLVED to SUPPORT the Wetland Permit application of BIRCH HILLS PROPERTY
OWNERS ASSOCIATION, INC. to repair the existing beach stairs, deck, and safety fence
along the top of the bluff.

The CAC Supports the application with the Condition best engineering practices are used
at the base of the stairs for erosion control because of the steep bluff, a 5' non-turf buffer
is installed along the top of the bluff, and non-treated lumber is used, as per the Wetland
Code.

RESOLVED to SUPPORT the Wetland Permit application of LAURIE MANDELBAUM to
construct a first-floor addition to the existing dwelling, new flush patio areas and a new
partial second-floor, new sanitary system, and a new detached garage.

RESOLVED to SUPPORT the Wetland Permit application of JOAN SHANNON to remove
the existing roof and expand second floor within the existing footprint; construct a new
covered porch on the landward side of the existing dwelling; and install drywells to contain
a 2" rainfall for the proposed dwelling and existing detached garage.

construct an in-ground swimming pool and patio; construct 12'X 16' screened porch
addition partially in-place of existing deck, steps, and walk to be removed, and construct
new steps; establish a non-turf buffer; and install a pool drywelllandward of Chapter 275
jurisdiction.

to construct +/-145 linear ft. of vinyl bulkhead in place of existing timber bulkhead;
construct +/-172 linear ft. of timber retaining wall in place of existing timber retaining wall;
and backfill with approx. 20 cy. clean sand to be trucked in from an upland source.

RESOLVED to SUPPORT the Wetland Permit application of LINDA & MICHAEL
GAMBARDELLA to install a 16'X 36' in-ground swimming pool and masonry pool patio;
install a pool-enclosing fence; and establish a variable width (21 '-28') non-turf buffer to be
planted with native vegetation between the existing bulkhead and 14' elevation contour;
construct a two-story addition to the existing two-story, one-family dwelling; install a hot-
tub; replace the roof on the existing garage; and install a drainage system of drywells and
upgrade sanitary system.

RESOLVED to SUPPORT the Wetland Permit application of KEVIN GALLAGHER to
construct two (2) stone revetments at the subject parcel to curb areas of substantial
erosion. Both revetments will consist of cap stone and toe stone in the 50-100 lb. range
and will be backfilled with clean upland sand and vegetated with Cape American
Beachgrass.

RESOLVED to SUPPORT the Wetland Permit application of JAMES WILLIAMS to
construct a new bulkhead 102'+/- with vinyl sheathing in a location landward of the
existing bulkhead and as close as is practical to the existing bulkhead; construct new
return 15'+/- with vinyl sheathing at east end of new bulkhead in the same location as the
existing return. Excavate area behind existing bulkhead as necessary to place new piles,
sheathing, and anchoring components. Place an estimated 20 cy. of clean soil/sand
behind new bulkhead and new return to replace material previously lost to wash-out.

LISA GILLOOLY to construct a bulkhead along 103' of shoreline using vinyl sheathing, a
12'X 24' platform and 4'X 10' catwalk.

Comments on Lisa Gillooly Application for Bulkhead Construction.
This is a high energy shoreline evident by a steep beach profile and the
sediment is composed of coarse gravel. Active sediment transport is evident, driven
south by north-west winter winds. To the north of the Gillooly property are a series of
groins, revetments and bulkheads installed by private property owners who cheerfully
have passed their erosion problem to their southerly neighbor. This entire shoreline is
starved for sediment because of this hardened shoreline to the north which has
captured sand available for transport. The Gillooly property is last in line and is now
enjoying accelerated erosion of their beach bank face. All these properties will be
vulnerable to storm surges.
Of more serious concern is the erosion of the undeveloped and unprotected
shoreline immediately south consisting of the end of King St, a parking lot, and a long
stretch of a berm fronting tidal wetlands. The asphalted end of King St and that of the
parking lot is currently under erosion with asphalt on the beach and evidence of erosion
continues south. Storm surges are apt to break thru the protective berm flooding not
only the wetlands but overtopping King St and possibly flowing into Harbor Rd.
This shore to the south will undergo accelerated erosion and environmental
damage in the near future The Trustees should seek professional counsel for long
range management of this area.

RESOLVED to SUPPORT the Wetland Permit application of MURRAY GAYLORD to
construct a second-story addition to the existing single-family dwelling, containing 2,290
sq.ft..

RESOLVED to SUPPORT the Wetland Permit application of DENNIS HICKEY to remove
existing non-native species, build terraces above the 10' elevation and pitch grade
landward from water. Install drywells upland to capture downspouts and surface waters
from terracing. Replant entire area affected by terracing with native grasses and shrubs
18-36" on center depending on species. Install gravel and stones throughout plantings for
maintenance of planting areas.

the s/e corner of the property. The CAC obseNed a floating device stored on the wetlands
and questions the legality of the existing fence. The CAC and also questions whether the
shed is on private or public property.

DISCUSSION AND RECOMMENDATIONS OF APPLICATIONS TO AMEND PERMITS
Moved by Glen McNab, seconded by Jack McGreevy, it was
RESOLVED to NOT SUPPORT the Amendment application of EDWARD FERGUS to
Amend Permit #6302 to revise the footprint and location of the proposed dwelling, which

dwelling will be located 80' from the situate wetland boundary; reconfigure the proposed
sanitary system; and relocate the proposed shed 82' from the wetland boundary.
