completed June 14.1960 and filed in Suffolk County Clerk's Office on August 30,1960 as Map No. 3230.
BEING AND INTENDED TO BE TIlE SAME PREMISES CONVEYED TO THE PARTY OF TIll: FIRST
PART BY DEED dated April 16. 1987 and recorded in the Suffolk County Clerlt'sofficc on May 8. 1987 in
Liller 10314 page 23.
The party of the second part. John A. Levien, agrees that the party of the first part, Charles S. Levien, reserves and
has a hright of first refusal" when, as, and if, John A. Levien or his estate determines to sell the premises, and that
John Le\ien or his legul representative will only entertain written offers to purchase. and will send a copy thereof
to Charlca Levien who shall within 30 days by a writing delivered to John A. Levien or his legal reprcscntative
agree to buy the premises on the same terms and conditions as the written offer or waive his right to purchase. If
Charles S. Levien is not livinll when John A. Levien or his estate entertains an olTer to purehase, this aright of
first refusal" can be exercised by his wife, Alice Levien, or ~is children, Thomas Levien or Jane Levien O'Brien,
ifony of them are then residing in the home on lot 26 of Map 3230. 1be method ofexcrcisins the "risht of
refusal" shall be the same as stated above for Chlll'les Levien. This "risht of refusal" shall be extinguished upon
the deaths of Alice. Thomas and Jane or when none of them reside on lot 26, or ifany of them who owns or
resides on lot 26 waives, in writing. this "risht of first refusal",
TOGETHER with all risht, title and interCBt, if any of the party of the first ~ in and to any streets and road
abultinll the above dcacribed premises to the center lines thereof: TOGETHER with the appurtenances and all the
estate and rillhlS of the party of the first part in and to said premises; TO IIA VE AND TO IIOLD the premises
herein JJBIlted unto the party of the second part, the heirs or successors and assigns forever. And the party of the
first pan covenanlS that he has not done or suffered anything whereby the said premises have been eneumbered in
any way whatever.
AND the party of the first par1!srantor, in compliance with Section 13 of the l.ien Law. covenants that the pany of
the first par1!srantor will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any pan of the tolal of the same
for any other purpose. The word "party" or "grantor" shall be construed as if it IUd "parties" or "grantors"
whenever the sense of this document so requires.
