MATALENE, both residing at 326 Harden Street, Columbia, SC 29205 party of the first part, WINDY HILL ASSOCIATES, LLC, a limited liability corporation doing business at 326 Harden Street, Columbia, SC 29205 party of the second part, WITNESSETH, that the party of the first part, in consideration ofTEN ($10.00) dollars, lawful money of the United States paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the SEE SCHEDULE "A" ANNEXED HERETO TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof. TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premIses. TO HAVE AND TO HOLD the premises herein granted unto the pm1y of the second part, the heirs or successors and assigns of the party of the second pm1 forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires. Duryee Estate, said point being about 3,500 feet easterly along said nOJiherly line from Reeve Road, and running thence along said northerly line of Soundview Avenue two courses as follows: I. SUBJECT TO a foot passage 30 feet wide over so much of the westerly part of said premises as lies between the northerly line of the land (now or formerly) of McGreevy and the high water mark of Long Island sound, the westerly line of which foot passage is the westerly boundary of such much of the premises as lies north of said McGreevy's land as aforesaid and the easterly line of which is parallel with and 30 feet easterly therefrom measured at right angles thereto. RESERVING the right to pass and repass along a foot passage thirty (30) feet wide extending along so much of the westerly boundary of the above-described premises as lies north of the land now or formerly of John L. TOGETHER with all right, title and interest of the party of the first part in Soundview Avenue lying in front of and adjoining said premises to the center line thereof and to lands under the water of Long Island Sound adjoining said premises. PARCEL 2 ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being, in the Town of Southold, County of Suffolk and State of New York, north of Mattituck, bounded and described as follows: COMMENCING at a pipe at the point of intersection of the easterly lands now or formerly of Henry W. Matalene, Jr. and Jane R. Matalene, the westerly line of lands now or formerly of the Estate of William V. Duryee as the same is described by deed dated October 4, 1957 recorded in Liber 440 I cp 406, which point is also 3391 feet, more or less, easterly from the intersection of the easterly line of Reeve Road and the northerly line of Sound view Avenue and from said point of beginning running North 57 degrees 30 minutes 00 seconds east 50.00 feet to a point; thence North 23 degrees 47 minutes 30 seconds west along other lands (now or formerly) of the Estate of William V. Duryee 725 feet, more or less, to the ordinary high water mark of Long Island Sound; thence westerly along said high water mark (as indicated by a tie line South 65 degrees 41 minutes 20 seconds west) 50 feet, more or less, to lands of the party of the first part; and thence South 23 degrees 47 minutes 30 seconds East 725.0 feet to the pipe at the point or place of BEGINNING.
