Dear Mr. Scheer:
The Southold Town Planning Board, at a meeting held on Monday, January 14, 2008, adopted
the following resolutions:
WHEREAS, the agent, Charles Scheer, submitted a formal site plan for approval on November
12, 2007; and
WHEREAS, this site plan is for a new 1,560 sq. ft. storage building for agricultural purposes on
11.39 acres in the A-C Zone located at 3450 NYS Route 25, on the south side of Rt. 25, in
Laurel. SCTM#(s)1000-125-3-8 and 1000-125-3-10; and
WHEREAS, Half Hollow Nursery Realty, Inc. is the owner of the property located on the south
side of New York State Road 25, known as 3450 Rt. 25, in Laurel; and
WHEREAS, on November 26, 2007, the Planning Board accepted this application; and
WHEREAS, on November 29, 2007, the Architectural Review Committee (ARC) reviewed the
site plan and proposed building, and provided comments to the Planning Board; and
WHEREAS, the Planning Board reviewed the comments from the ARC and determined the
building type would be allowed as proposed because it is a pre-made building being purchased
used, and, upon submission of a sketch of existing screening by the applicant, the Planning
Board also determined the landscaped screening was adequate; and
WHEREAS, on November 19, 2007, the Southold Town Planning Board, acting under the State
Environmental Quality Review Act (SEQRA) (6 NYCRR, Par[ 617.5 c), made a determination
that the proposed action is a Type II Action and not subject to fur[her review under SEQRA; and
WHEREAS, on December 18, 2007, the Southold Town Building Inspector reviewed the plan
and cer[ified that the proposed agricultural storage building is a permitted use; and

WHEREAS, on January 3, 2008, the applicant submitted a letter from the Natural Resources
Conservation Service outlining suggested measures for run-off management from the buildings
and the Planning Board accepts these as adequate to address drainage for the new building;
and
WHEREAS, the Southold Town Planning Board, pursuant to §280-133 C., has the discretion to
waive any or all of the requirements in §280-133 for those applications involving uses strictly
related to agriculture; and
WHEREAS, the Southold Town Planning Board, pursuant to {}280-131 H., has the discretion to
waive the public hearing requirement for those applications involving uses strictly related to
agriculture; therefore, be it
RESOLVED, the Planning Board has found the proposed 1,560 sq. ft. building is for uses strictly
related to agriculture, and that the site plan application requirements to be waived are not
necessary to further the objectives set forth in §280-129, and has also found that the modified
site plan requirements listed above are sufficient to allow the Board to determine that the public
health, safety, and welfare are maintained at and around this site. The Board was able to waive
some of the site plan requirements for this proposed building due to the small size of the
building, the large size of the parcel, and the fact that the new building will only add one half a
percent of lot coverage to the seven percent of lot coverage currently existing on the site, and
that pursuant to Southold Town Code §280-133 C., the Planning Board hereby waives the Site
Plan Application Requirements in §280-133, except the following:
§280-133 A. 1, 2, 3, 5, B. 1 (a)-(f), B. 3. (a), (d), 4. (a), (g), and part of (i) building elevations; and
be it further
RESOLVED, the Planning Board has found that waiving the public hearing is appropriate for this
proposed building for the following reasons: the building is small in size, adding only one half a
percent of lot coverage to an existing seven percent of lot coverage of buildings on the property;
and it will be situated over fifty feet from neighboring property lines among several other barns
on an 11.39-acre active farm. Further, the building will be used for storage of equipment, and
thus is not expected to generate noise, odor or cause any nuisance to any surrounding
properties, and that pursuant to Southold Town Code §280-131 H., the Planning Board has
determined the proposed 1,560 sq. ft. building is for uses strictly related to agriculture, and
hereby waives the public hearing requirement for this application; and be it further
RESOLVED, that pursuant to Southold Town Code §280-131 Part I, the Planning Board
requires, and the applicant agrees to, the following conditions:
Run-off and drainage from the new building shall be managed as described in the
December 6, 2007 letter from the Natural Resources Conservation Service as follows:
a. Drip trenches constructed along each side of the building.
b. Each trench the width of a backhoe bucket and excavated down to clean sand.
c. Fill trench with bank run sand to a height of one foot below ground surface.
d. Fill remaining depth with 1-inch rock to allow rapid infiltration of the roof run-off;

2. Any outdoor lighting associated with the new building shall be shielded so the light
source is not visible from adjacent properties and roadways. Lighting fixtures shall focus
and direct the light in such a manner as to contain the light and glare within property
boundaries. The lighting must meet Town Code requirements; and be it further
RESOLVED, that the Southold Town Planning Board has reviewed the proposed action under
the policies of the Town of Southold Local Waterfront Revitalization Program and has
determined that the action is consistent as outlined in the January 14, 2008 memo prepared by
the LWRP Coordinator; and be it further
RESOLVED, that the Southold Town Planning Board grant approval on the site plan sketch
shown as "proposed building" on the survey prepared by Young and Young, "Survey for Half
Hollow Nursery, Inc., Building Permit Agricultural Structure", dated October 9, 2007, and
stamped as "Received" by the Planning Board on November 5, 2007, and authorize the
Chairperson to endorse the site plan with the following conditions:
1. The site plan approval requires that ail work proposed on the site plan shall be
completed within three (3) years from the date of this resolution.
Prior to the request for the Certificate of Occupancy, the owner or authorized agent must
request, in writing, the Building Inspector and the Planning Board to perform an on-site
inspection to find that the site improvements are in conformity with the approved site
plan.
If the as-built site improvements vary from the approved site plan, the Planning Board
reserves the right to request a certified as-built site plan detailing all the changes.
Any changes from the approved site plan shall require Planning Board approval and any
such changes without Planning Board approval will be subject to referral to the Town
Attorney's Office for possible legal action.
The Planning Board will issue a final site approval in the form of a letter following a site
inspection and at the time the site improvements are found to be in conformance with
the approved site plan.
Copies of the approved site plan are enclosed for your records. As per the Town Code, one
copy each will be distributed to the Building Department and Town Engineer/Highway
Department.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, the proposed action is CONSISTENT with the LWRP, provided
that the below recommendations are required in the site plan approval.
This proposal is to construct a 30' x 50' storage building for agricultural purposes in an
Agricultural Zone located at 3450 Main Road, in Laurel. SCTM# 1000-125-3-8, 10. The
property is located south of State Route 25, a designated New York Scenic Byway. To further
policy 3.1 Enhance visual quality and protect scenic resources throughout the Town of Southold,
it is recommended that the Board apply the following standards to the greatest extent practicable:
Minimize introduction of structural design components (including utility lines,
lighting, signage and fencing) which would be discordant with existing natural
scenic components and character.
C. Screen components of development which detract from visual quality.
Use appropriate siting, scales, forms, and materials to ensure that structures
are compatible with and add interest to existing scenic components.
Preserve existing vegetation and establish new indigenous vegetation to enhance
scenic quality:
1. Preserve existing vegetation which contributes to the scenic quality of the
landscape.
2. Allow for selective clearing of vegetation to provide public views
without impairing values associated with the affected vegetation.
Protect visual quality associated with public lands, including public
transportation routes, public parks and public trust lands and waters.
Protect visual quality associated with agricultural land, open space and natural
resources.
1. Maintain or restore original landforms except where altered landforms
provide useful screening or contribute to scenic quality.
2. Group or orient structures during site design to preserve open space and
provide visual organization.
3. Avoid structures or activities which introduce visual interruptions to
natural landscapes including:
a. introduction of intrusive artificial light sources
b. fragmentation of and structural intrusion into open space areas
c. changes to the continuity and configuration of natural shorelines
and associated vegetation.
In addition, to further Policy 5, "Protect and improve water quality and supply in the Town of
Southold" and protect and improve the water quality and supply in the area, it is recommended
that the following best management practice be required:
Require the use of drip trenches to retain surface runoff as is appropriate to the
proposed building as specified in the United States Department of Agriculture
Natural Resources Conservation Service letter dated December 6, 2007.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help appricants and agencies determine, in an orderly manner, whether s project or action may
be significant. The question of whether an action may be significant ia not always easy to answer. Frequently, there are aspects of

I have inspected the site for the new building to determine the need for runoff management. The building
site location is within the farmstead area and the increase in runoff does not pose a threat to adjacent
properties or surface waters nor will it come in contact with any agricultural land. However it is
recommended ~.at the runoff be controlled as it comes off the roof as clean runoff and thus eliminate any
potential for any negative impacts to ground water.
Since the building is a Quonset hut type structure, gutters and downspouts are not appropriate. Therefore
I would recommend that drip trenches be constructed along each side of the building. Each trench should
be the width of a backhoe bucket and should be excavated until you reach clean sand. The trench should
then be filled with bank mn sand to a height 1 ft. below the ground surface. The remaining depth should
be filled with 1 inch rock to allow rapid infiltration of the roof runoff.

be used on the building. The comrmttee would prefer to see a more traditional style lighting
fixture used. Subnfission of the proposed style of the street sign with proposed lighting cut.
Submission of the proposed grill styles on the front door and windows. The committee
would prefer to see a more residential style double hung window used. Submission of
materials/color samples or a letter indicating specific materials/colors being used on the
structure. Fencing cuts and dimensions if a new fence is proposed in the front of the
property.
