The regular meeting of the Board of Town Trustees was held on Thursday, December 17, 1987, at the Southold Town Hall, Main Road, Southold. Vice- President John Bredemeyer called the meeting to order at 7:10 p.m. with the following Trustees present: Vice-President John Bredemeyer Trustee Philip J. Goubeaud Trustee Albert Krupski, Jr. Trustee Ellen M. Larsen John Holzapfel, Chairman, Conservation Advisory Council Ilene Pfifferling, Clerk President Henry P. Smith (arrived at 7:18 p,m.) Trustee Bredemeyer advised that he would proceed with the Communications and Notices on the agenda. The approvals of the minutes and future meeting dates will be held until the President is present. Trustee Bredemeyer advised that the Public Notices are published on the Town Clerk's Bulletin Board if anyone wishes to review them. III. COMMUNICATIONS: A letter from Howard H. & Dorothy J. Zehner regarding Young's Boatyard and marina. From Joseph Hall., ~D.E.C., Stony Brook regarding the Orient Wharf Company applicatio~. From Joseph Hataier regarding a sign in Orient, requesting clarification. Trustee Bredemeyer advised that he has spoken to Mr. Hataier regarding this matter. From John H. Thatcher, Jr., President, Fishers Island Conservancy, Inc. regarding a tower on North Dumpling Island. Trustee Krupski will compose a letter to be forwarded to Mr. Thatcher. 5. Trustee Smith advised that the next field inspection will be held on January 21, 1988 to commence at 11;00 A.M., the next regular meeting will be held on January 28, 1988 at 7:00 P.M. to be held at the Town Hall, Main Road, Southold. Trustee Smith advised that the Organizational Meeting will be held on January 21, 1988 at 6:00 P.M.. Trustee Smith gave the Trustees monthly report as follows: Application fees, $75.00, Piling fees, $25.00, Wetland Inspection fees, $30.00, Wetland Applications, $750.00, Mooring fees, $160.00 for a total of $1040.00. This amount was iurned over to the Supervisor's office to be placed in the General Fund. ON BEHALF OF THE COVE AT SOUTHOLD - LEAD AGENCY DECLARATION Moved by Trustee Larsen seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State EnvironmentM Quality Review Act in the matter of the application of Wilbur Klatsky on behalf of the Cove at Southold for a Wetland Permit on certain property located on Main Bayview Road, Southold.. Vote of Board: Ayes: All - This resolution was declared duly adopted. Mr. John Holzapfel, Chairman of the Southold Town Conservation Advisory Council advised the Trustees that the Conservation Advisory Council would like to see a vegetation plan for the site regarding the Cove at Southold by Wilbur Klatsky. He also advised that there was concern regarding lawns within 100 ft. of wetlands, and the idea that if there were animals on the site that the feces would be picked up on the site. These were the recommendations of the Conservation Advisory Council. VI. ASSESSMENTS: 1. J~.M.O. Consulting on behalf of Ellen Guiton, application no. 588, until the property is properly staked and a work plan reflecting profiles of the project is submitted for review. Property is located ~off of Grand Avenue, Mattituck. 1. Vote of Board: Ayes: All - This resolution was declared duly adopted. 2. J,M.O. CONSULTING FOR DR. VELJKO J. KRSTULOVIC - TABLED o Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was RESOLVED that the Southold Town Trustees TABLE the application for J.M.O. Consulting on behalf of Dr. Veljko J. Krstulovic as the Trustees suggest that the structure be constructed in kind and in place. A plan of 'construction is also requested. Property is located on South Drive, Mattituck. The Trustees have determined that they have no jurisdiction in regard to this proposal. J. PETER FINIGAN: In the matter of the request made by J. Peter Finigan for an on site inspection for a determination of jurisdiction on property located on Main Bayview Road, Southold, the Trustees determined that a wetland permit will be required. It was determined that the proposed house is 50 ft. to wetlands. JOHN WlCKHAM: Trustee Bredemeyer advised, ~during~conversation with Mr. Wickham in Town Hall, he advised that he will put into cultivation, in the near future, his property to the dike. Trustee Bredemeyer is concerned, whereas Mr. Wickham will be working ~n Town Wetlands and very possibly on Town Trustee land. It doesn't seem like this is going to stop, at least from what Mr. Wickham indicated. Trustee Bredemeyer advised that he has called Legislator Gregory Blass in an attempt to have the "Ag" district reviewed. Truste~e Bredemeyer advised that he has requested that Mr. Wickham contact the Trustee office to review this matter with him further. I have been on the Board for eight years, and when we have two year terms, you never know if all of us are coming back, or none of us are coming back. As you know, we have several factors~that you have to consider. Before I begin, I would like to introduce Mrs. Kuerner and her daughters. First item is whether this project will adversely affect any of the wetlands of the Town. This property, if you havre gone and looked at it, has absolutely no wetlands. It is a small house, it has a patio in the rear. It has a retaining wall, so the entire property is as non-wetlands as you can get. However, we are here for a wetland permit. The big issue is whether it will cause damage from erosion, turbidity or siltation. So, again we have the bulkheading or retaining wall, to be more specific. It is not going to have any affect on the wetlands. Again, we are not going to have any affect on the wetlands. Will there be a cause of saltwater intrusion onto the fresh water resources of the town. Again, no. Will it adversely addect fish, shellfish or other beneficial marine organisams, aquatic wildlife and vegetation or the natural habitat thereof. No. Will it increase the danger of flood or storm tide. No. Will it change the course of any channel' or the natural movement or flow of any waters. Again no. Will it weaken or undermine the lateral support of other lands in the vicinity. Again no. Will it otherwise adversely affect the health, safety and general welfare of the people of the town. Again no. I have some exhibits for you for the record. I have the original photo's which I am going to submit to the Zoning Board, so I made copies for you. I would like to preserve the photo's for the Zoning Board. Trustee Smith: The Board doesn!t' have any problem with this, Pat. There is no environmental impact. The only thing is that a.'~dry will will have to be installed to contain roof run off. Trustee Goubeaud: We taped it off, and on the west wall, where it is parallel with the inlet it seems to' be about 8 ft. longer than the intent of the application. It Trustee Bredemeyer: It is 8 ftt longer/than the intent of the application is. To have the wall on the north side intersect the west wall. We are talking about a straight line starting at the old bridge abutment-and went north. Jeff hung out with the tape there. Roy Haje: I :estimated it as closely as I could. I could not get out there. Trustee Bredemeyer: With two people out there, we just managed to get it. Roy Hale: It will be easy to verify. Trustee Goubeaud: Keep everything in line wifih':the northerly bulkhead and the westerly bulkhead. The most northern spile of ~he deck that is there. Trustee Bredemeyer: I think we are going to need a new drawing for the file and new measurements so that we don't end up with a situation where the D.E.C. is doing additional field inspections. It can be called a bulkhead, but in essance it is a groin. It is built up so much on the souih side that we are required to put in tie rods.
