SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 20,000 sq. ft. parcel has 100 feet along Wickham Avenue, and is improved with a two-story frame dwelling and accessory structures as shown on the February 2, 2005 survey prepared by Peconic Surveyors, P.C. BASIS OF APPLICATION: Building Department's January 18, 2005 Notice of Disapproval, amended April 14, 2005, citing Section 100-244. In its denial of the applicant's request for a building permit to construct a proposed addition with alterations to the existing dwelling. The reason stated for disapproving the application is that following the proposed construction, the front yard setback will be 38+/- feet, instead of the code required 40 ft. minimum. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 2, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to place a 6 ft. extension to their home along the northerly front and side yards. The home has a conforming front yard at 43 feet from Wickham Avenue, and the applicant is proposed to extend 6 ft. closer to the front lot line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. After visits in the area of this home, it was noted that the neighborhood is well developed with single-family homes, at variable setbacks consistent and similar to this request. The applicants are proposing a new front entryway, and their home as constructed originally, has not followed lines parallel to the front line adjacent to the street. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing front setback measures 39+- feet to the existing front stoop and 43.6 feet from the southwest corner of the home. A 6 ft. x 39.2 ft. addition at the front of the home would not be possible without a variance, in relation to the street location and siting of the home on this 100 ft. by 200 ft. lot. The remainder of the proposed new construction shown on the plans prepared by Nigel Robert Williamson, Architect do not require setback relief from the code and extend along the side of the home. 3. The front setback variance granted is not substantial. The code requires a minimum 40 ft. front setback, and the applicant is requesting relief resulting in a two ft. reduction from this requirement. 4. The difficulty has not been self-created. The home is conforming and no construction has been commenced. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Orlando, and duly carried, to GRANT the variance as applied for, as shown on the diagrams date-stamped by ZBA April 13, 2005, prepared by Nigel Robert Williamson, Architect, and survey updated April 13, 2005 by Peconic Surveyors, P.C. There is no value available from the manufacturer on this product used in this manner. The post/header could be held down with a HRS12- 12ga.
