The meeting began at 4:20 p.m. with four LPC members present. Adoption of Meeting Minutes: ?? Acceptance of meeting minutes from 11/27/07 MOTION made by John Sepenoski, seconded by Lillian Ball, to approve the Land Preservation Committee meeting minutes from 11/27/07. Motion carried: 4/0 (Monica Harbes & Chris Baiz absent from vote) Applications and Inquiries: EXECUTIVE SESSION. The members entered into ?? FICNER PROPERTY SCTM #: 1000-95-4-6.1 Zoned: A-C Location: 7990 Oregon Rd, Cutchogue CPF: No Total Acreage: 8.0 acres Subdividable: Yes Update re: status of PDR purchase offer [executive session]. Discussed CPF and Agricultural Structure Area. Melissa Spiro and John Sepenoski met with Town Attorney to discuss landowner’s concerns in regard to non-buildable subdivision open space created when 1-acre Reserve instead of 2-acre Reserve created. Landowners amended purchase offer letter for seller to offer a 6 acre development rights easement and a two acre reserved area that would include the existing residential structures instead of a 7-acre Development Rights Easement and a 1-acre Reserve Area. MOTION made by Lillian Ball, seconded by Eric Keil, to agree to decreasing the easement area to six acres and increasing the reserved area to two acres. All other purchase offer conditions, including 4- acre area within easement within which Ag Structures prohibited, to remain the same. Motion carried 5/0. (Chris Baiz absent from vote) Melissa told LPC that this project would need to be added to the current CPPP list and Town Board will need to be advised that an amendment to the Community Preservation Project Plan is necessary. ?? MOTION made by Eric Keil, seconded by Lillian Ball, to authorize Melissa Spiro to present a purchase offer per buildable acre to Zip Peconic Wells LLC for a development rights easement on the acreage remaining after subtracting the landowner’s requested two to three acres. The offer is based upon the concept plan as sketched on an aerial view presented to LPC with the 2 to 3 acre Reserve Area to be located on the southerly end of the parcel and a development rights easement area on approximately 30 acres. For scenic purposes, the easement is to allow a maximum lot coverage of 2% for future agricultural structures and all agricultural structures are to be located within a designated one acre area along the northwesterly corner near other existing ag structures on adjacent property. The purpose of this acquisition is for farmland protection and scenic protection. The parcel is located within the R-80 Zoning District and septic credits are not available for transfer as this is designated farmland. Motion carried: 6/0 ??
