The regular meeting of the Board of Town Trustees was held on Thursday,
June 25, 1987 at the Town Hall, Main Road, Southold. President Smith called
the meeting to order at 7:00 P.M.

Trustee Smith advised that the field inspections for July will be held on July 22, 1987
to commence at 12:00 P.M. to depart from the Town Hall, Main Road, Southold, New York.
The date for the next regular meeting of the Board will be held on Monday, July 27, 1987
to commence at 7:00 P.M. to be held at the Town Hall, Main Road, Southold, New York.

Trustee Smith gave the monthly report for May 1987 as follows: Application Fees $445.00,
Bulkhead Fees $1303.00, Wetland Inspection Fees $80.00, Wetland Application Fees $2400.00,
Mooring Renewal Fees $420.00 for a total amount of $4648.00 which was turned over to
the Supervisors office to be placed in the General Fund.

Trustee Smith advised that the Public Notices are published on the Town Clerk's
Bulletin Board if anyone wishes to review them.
Trustee Smith commenced with agenda item number three, Communications as follows:
1. From Thomas J. McMahon, Senior District Technician, Soil & Water Conservation
District regarding the John Bagshaw wetland application.
Trustee Larsen advised that the soils on the site are mapped as Beaches and
Tidal Marsh. The mapping was confirmed during the site inspection by the
Soil and Water Conservation District. The soils are rated as having severe
limitations regarding homes,res and sewage disposal fields due to high water
(groundwater.) Soils adjacent to the property, where the applicant proposes
to improve a road for gaining access to the property, are mapped as Carver and
Plymouth Sands with 15-35 percent slopes. Field inspection confirmed the soil
mapping and determined that the predominant slope is 22 percent. Carver and
Plymouth Sands are very coarse textured and highly erodable soils. Limitations
of this soil for streets and parking lots are rated as severe due to slope.
At the point where the proposed improved road would adjoin the property there is
a low wet area. Vegetation in this area is reedgrass-Phragmites communis, which
is indigenous of poorly drained soils. Such a wet area could cause seasonal
problems regarding access to the property. Along the northeren edge of the
property - Harbor and Lowland Roads, there exists stands of salt meadow cord-
grass - Spartina patens. This grass is typically flooded by salt water during
spring tides or during storms and is also a protected saltmarsh species. The
western side of the property, along Peconic Bay, shows evidence of coastal erosion
as a low embankment above the beach is scoured and partially undermined.
Consequently, this indicates that the beach area is receding. The aforementioned
information was taken from the letter received from Thomas J. McMahon, Senior
District Technician, Soil and Water Conservation District. Trustee Krupski
added that the letter backs up what the Trustees found on the site inspection.
Trustee Smith advised that this letter is placed in the file, and will be taken
up at the Public Hearing on this application.
From James E. Fitzgerald, Jr. on behalf of the Broadwaters Cove Association

requesting a copy of the public hearing minutes. The Clerk advised that these
minutes have been forwarded to Mr. Fitzgerald.
From George A. Burrell for the Lagoon Association regarding dredging of the
Lagoon, Nassau Point, Cutchogue. The Trustees advised that this is private
bottom~land.
From the Southold twon Planning Board a Significant Environmental Assessment
on the application of Charles Bowman.
From Jack & Dorothy Drobet regarding a dock on Lupton's Point, Matt,tuck.
Trustee Smith advised that this matter will be taken up later on during the
meeting.
Fmom Anthony B. Tohill, P.C. for John Bagshaw a Long Environmental Assessment
Form. Trustee Krupski advised that this form was incomplete. Trustee Smith
requested that Trustee Krupski outline the additional information needed for
this application so that the applicant can be advised to furnish same.

From Dr. Martin Garrell regarding the Conservation Advisory Council.
From Bertram W. and Margery M. Walker regarding property of Mr. Zeidler on
Brushe's Creek, Laurel. Trustee Smith advised that the Trustees conducted an
on site inspection of the Zeidler property in response to the Walkers letter.
It was determined that the structure constructed was built larger than the
plan submitted with the request for approval. The Trustees advised Mr. Zeidler
to submit a new application along with a licensed survey depicting all structures
on the subject property and showing all dimensions of same.
From Costello Marine Contracting Corp. a survey indicating the proposed
retaining wall line as per the Boad of Trustees approval. The Trustees
reviewed the survey and advised that the permit can be issued for the project.

Guldi, Principal Civil Engineer, Division of Waterways, Dept. of
regarding Gull Pond. Mr. Guldi advised that he would be willing
the residents to review the matter, should there be any further
shoaling in Gull Pond.
From John R. Guldi, Principal Civil Engineer, Division of Waterways, Dept. of
Public Works regarding Wunneweta Pond and West Lake dredging. Mr. Guldi advised
that Wunneweta has just been dredged by private interests and, therefore, should
not require additional dredging until such time as re-shoaling occurs. He requested
drawings indicating the exact areas and depths for each project and the proposed
spoil sites then he will add these creeks to the dredging priority list for
Countydredging.
From the New York State D.E.C. a Load Agency Coordination Response regarding the
Pat Cicorelli Application No. 548. The D.E.C. acknowledged that the Southold
Town Trustees are the Lead Agency regarding this project.
From Mr. Zeidler in response to his Notice of Violation regarding property
on McDonalds Crossing, Laurel. Mr. Zeidler appeared before the Board of Trustees
to explain the reasons for constructing his pool and deck contrary to the
dimensions granted on the waiver approved by the Board.
From Marcelle & Herbert Greenfield and Sim & Dai Moy regarding the application
submitted for the West Lake Association. This letter will be read into the
record of the public hearing regarding this application.

RESOLVED to APPROVE the mequest made by Harry Beaton to place an offshore
mooring in Gosse Creek using public access with the provision that the
boat will not impede navigation or interfere with any other boat.

Moved by Trustee Larsen seconded by Trustee Bredemeyer it was
RESOLVED that the Southold Town Trustees declare itself lead
agency in regard to the State Environmental Quality Review Act
in the matter of the application of Christopher Conners for a
Wetland Permit on certain property located 350 West Drive, Southold.

6A. CHRISTOPHER CONNERS - SIGNIFICANT ENVIRONMENTAL ASSESSMENT
Moved by Trustee Bredemeyer seconded by Trustee Krupski the following Significant
Environmental Assessment was declared based on the on site inspection conducted
by the Board of Trustees whereas wetland indicator plants were found on the
site and the possibility that the property could be contiguous with the Peconic
Dunes or Great Pond.
NOTICE OF SIGNIFICANT EFFECT ON THE ENVIRONMENT
Pursuant to the provisions of Article 8 of the Environmental Conservation Law,
Part 617, of Title 6 of the New York State Codes, Rules and Regulations, and
Chapter 44 of the Southold Town Code, the Southold Town Trustees, as lead agency
does hereby determine that the action described below is a Type 1 Action and is
likely to have a Significant Effect on the Environment.
APPLICANT: Christopher Conners
DESCRIPTION OF ACTION: To construct a single family dwelling.
LOCATION: 350 West Drive, Southold, New York 11971
REASONS SUPPORTING THIS DETERMINATION:
Freshwater vegetation on the site.
Value as a wildlife habitat or productivity.

RESOLVED to APPROVE the request made by John Johnnidis to reinstate on offshore
mooring in Mattituck Creek, using public access with the provision that the boat
will not swing into any other boat or impede navigation.

offshore mooring in Town Creek, using private property as access.

9. MATT-A-MARINA - APPROVAl
Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was
RESOLVED to APPROVE the request made by Donald P. Cocks, on behalf of
Matt-A-Mar Marina to amend permit no. 2263 to include three pilings to be
placed at the seaward end of each dock to secure same.

10. EN-CONSULTANTS, INC. ON BEHALF OF JOHN XIKIS - APPROVAL
Moved by Trustee Goubeaud seconded by Trustee Bredemeyer it was
RESOLVED to APPROVE the request made by En-Consultants, Inc. on behalf of John
Xikis to extend permit no. 279 for a period of one year. Said permit will expire
on April 24, 1988.

11. JOSEPH B. PHELAN - APPROVAL - MOORING

boat will not swinM into any other boat or impede navigation.

38. FERUCIO FRANKOLA - WAIVER REQUEST
Moved by Trustee Bredemeyer seconded by Trustee Krupski it was
RESOLVED that the Town Trustees Approve the Waiver requested by Ferucio Frankola
to construct a 20' x 40' in-ground swimming pool, fence, 8' jacuzzi with a
Gazebo on property located at 269 Glenn Road, Southold in accordance with the plan
provided by the applicant for the waiver.

43. FERUCIO FRA~NKOLA - WAIVER REQUEST

RESOLVED that the Town Trustees Approve the Waiver requested by Ferucio Frankola
to construct a second story addition to an existing residence on property located
at 269 Glenn Road, Southold, with the provision that a restrictive covenant is
placed on this_~property that this house is to remain as a one family dwelling.
This addition is not to exceed the dimensions of the existing structure.

on behalf of ALexander Koke to place 3500 cu. yds. of fill for the construction
of a berm on the property located on Pine Neck Road and NOrth Bayveiw Road,
Southold. The berm is to be constructed with a slight swale to prevent any run off
into the creek and it is to be vegetated before the winter.

TYPE OF ACTION: UNLISTED
DESCRIPTION OF ACTION: To construct a house, pool, sanitary system, blue stone drive
way, extension of berm parallel to bulkhead and approximately 40' from it. To fill
with 3500 cu. yds. of fill. To construct a timber dock off the bulkhead consisting
of a 4' x 4' fixed platform, 3' x 16' hinged ramp, (3) 6' x 20' floats secured by
(4) 8" pilings on the inside.
LOCATION: Pine Neck and North Bayview Road, Southold.
REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment form has been submitted which
indicated that there would be no adverse effect to the
environment should the project be implemented as planned.
2. Because there has been no response in the allotted time from
the Southold Town Building Dept. and the New York State D.E.C.
it is assumed that there are no objections nor comments from
those agencies.

WHEREAS, Alexander Koke/Jon Kerbs applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated March 1, 1986, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on August 28, 1986 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE, BE IT
RESOLVED that ALEXANDER KOKE/JON KERBS BE AND HEREBY IS GRANTED PERMISSION UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: Construct a one family
house, driveway, sanitary system and well and to fill with approximately 100 cu. yds.
of fill to raise the grade. Property is located on Narrow River Road, Orient. Approval
is subject to the following: Ail construction being kept within-the building envelope
of the survey provided. The house is to be constructed on open pilings as discussed
on field survey with the applicant, and subject to the approval of the Suffolk County
Department of Health Services. A communication is to be forwarded to the Health Dept.
requesting that they give due consideration to the coliform generation toward Hallocks
Bay with any technically advanced or new sanitary system be constructed if it is deemed
necessary. The following general conditions are to he met also: 1. Ail necessary
precautions shall be taken to preclude contamination of any wetlands or waterway by
suspended solids, sediment, fuels, solvents, lubricants, epoxy coating, paints, concrete,
leachate or any othe environmentally deleterious materials associated with the project
work. 2. Ail fill and spoil material shall be suitably contained at the owrk site so as
to prevent its eroding, leaching or otherwise entering into the adjacent wetlands and/or
waterway. This permit will expire on June 25, 1989 if work has not commenced by said

In the matter of the application of the Land Use Company on behalf of the West
Lake Association to maintenance dredge a 85T x 60' area to a depth of 4' at
LMW. Resultant spoil (approximately 600 Ch. yds. of sand) will be trucked to
an upland disposal site. Property is located on Lake Drive at West Lake,

Clerk: Dear Mr. Smith: Please be advised that opposition to the proposed
dredging of West Lake exists and that on behalf of the property owner residents
Mr. & Mrs. Dai Moy and ourselves we request that your table any decision at this
time pending further investigation and study of community objections and concersn.
Basically, some of our concerns are: 1. How will this dredging impact on the
environment? How realistic is the request for 4 ft. at MLW in such a small pond, and
is it highly excessive? What of the effect on the existing shellfish, and birdlife
that survive on that area of the lake? Will the increased volume and tidal force
effect the surrounding wetlands? 2. The damage to our bulkheading and properties,
how extensive and detrimental will it be? And are you prepared to assume responsibility
if it occurs? How much impact will there be on surrounding properties and adjoining
bulkheading caused by the depth and extend of the proposed dredging, directly or
indirectly? We, the Moys and ourselves, each own properties that abut each side of the
canal leading in to adjoining West Lake, and we maintain our bulkheading at great
cost. This past year, we ourselves replaced approximately 200 ft. of new bulkheading
lining the canal and bay front on our own property. What can we expect will be
the extent of undermining of this bulkheading if the dredging is approved? Row much
damage will occur as a result of the increased water volume/activity? We are prepared to
hold all those responsible if any undermining or damage does occur directly or indirectly.

be affected as a result of the proposed dredging? How much will the proposed extensive
dredging and resulting increased water volume make our area accessible for many more
and increasingly bigger boats that are motor run? Small sailboats have no difficulty

and adjoining our bayfront beach areas seriously threaten the safety of near by
beach activities? Please note all the individual familys swim beaches lining our
bay front shores on either side of the canal. We, and the Moys, directly adjacent
to either side of the canal enjoy the swimming and have grave concerns for our
safety and for our children's safety. One adult member of our immediate family
sustained serious bodily injuries just within the past few years, being over run
by a neighboring mororboat in the very vicinity of the canal and bayfront in waist
high watrer. To summarize: We in the West Lake Community who have grave
concerns about the proposed dredging trust that each of you, as Town Trustees, will

carefully scrutinize and weigh the consequences of any approval you might
consider for dealing with the proposal before you now. We have every confidence
that yon will proceed with caution and please, if you so choose, provide us the

community, work to keep our area in its present natural, tranquil condition. For
those who have lived here for many years, having purchased our properties in full
knowledge of the limitations of little West Lake not a viable big motor boating area
such as Gull Pond, etc. we appreciate the support of the authorities in keeping us on
the right "keel", protecting us from encroachment and endangerment of our safety and
property and rspecting our rights to affording a good life on our North Fork. Thank you

TRUSTEE SMITH: Thank you. Does any one have any comments to make on this application?
RICHARD HUMPHREY: My name is Richard Humphrey and I have two parcels on West Lake.
This problem was presented to me by Mr. Procoff. I don't know if he is here tonight.
It was my understanding that we were restoring the lake to its natural state. In
the year and one-half that I owned the property, which it was explained to me that
as a result of the Greenfields dredging, who's letter I just sat here and listened to.
that we've had about 19 years of deterioration in the natural depth of West Lake.
Which I am very interested that they have pontificated so in this letter.
Is it not so that they have a permit to dredge for their own personal use to bring
a larger boat in? Part of this bulkhead included dredging? When I called I understood
that they dredged, is that true?
TRUSTEE BREDEMEYER: We would have to check the file.
RICHARD HUMPHREY: When I called, and did some investigation I understood that the
Greenfield's had dredged so that it was fine for them to bring their motor boat in,
but it was not fine for everyone else. I can attest that in my area at low tide
we might have 3 ft. of ware there. That was not the way that it was suppose to be.
If they are so concerned with ecology, they should be concerned with restoring the
ecology so that the animals can live there and have life as they know it.
TRUSTEE SMITH: From my personal knowledge of this area, it has been dredge before.
but without any real success.
TRUSTEE LARSEN: How long then, with your familiarity with the area, would it take
for that area to fill up again.
GLENN JUST, LAND USE COMPANY: It would probably take less than 18 months to shoal up.
It was originaly dredged three quarters of the way down to a depth of 5' below mlw.
where the bulkhead is in place now. That is what the permit says. I examined the

permit this morning in the D.E.C. office in Stony Brook. We are asking for 4 ft.
at mlw. It shoaled up a tot. You can walk across and barely get your pants wet.
TRUSTEE LARSEN: In your opinion what is the reason for the shoaling up?
GLENN JUST: I think that if the groins that exist on the outside were prefilled
before they were constructed it would cut down a~lot of the sand drifting in the
mouth. Because it is tough getting in and out there the homeowners are basically
landlocked. They are paying a good amount of taxes on the property and it is
almost impossible to use the basing.
TRUSTEE BREDEM~YER: Mr. Chairman, for the record, I don't believe that the
gentleman got a chance to identify himself.
GLENN.JUST: I'm Glenn Just from the Land Use Company thank you.
TRUSTEE SMITE: Thank you. Any one else have anything to say for or against this
project?
ED BRENNAN: My name is Ed Brennan I own property on West Lake. We have lived
there for 13 or 14 years. We always had a certain amount of difficulty getting
in and out into Little Peconic Bay. Mr. Greenfield replaced his bulkhead. In
the process of doing that there was a certain amount of soil that sifted into the
channel. Of course when they put in the new bulkhead, they had to jet the new
poles down. This disturbed also a certain amount sand. As part of the deal he
dredged the channel to get it back to where it was before. This all disturbed
the sand. On an incoming tide alot of~the sand washed in~ Where we want to
dredge is not in the channel at all. It is inside of the bay, inside the lake,
where all of this sand washed. We had a certain amount of sand in there before.
Now, there is a bar built up and you can just about walk across from one side to
the other. As a result you can only get out with an outboard motor at half tide on
the way up and the way down. Other than that you have to leave the boat on the out-
side because you will never get in.
TRUSTEE SMITH: It is my impression that you don't want to dredge in between the
two bulkheads?
ED BRENNAN: No. Ail we want to do is remove the sand bar which has formed as a
result of sand washing in and as a result of the work that was done.
TRUSTEE SMITH: I think there was a gentleman ....
TRUSTEE BREDEMEYER: Mr. Brennan, when was the last time that the inlet was dredged
before? To the best of your memory?
MR. BRENNAN: I do not remember it being dredged before.
TRUSTEE SMITE: I remember it being dredged before.
MR. GREENFIELD: It is our understanding that if they dredged the canal that they
would still have problems getting out there. We dredged, but we didn't dredge to
5 ft. below mlw. We dredge just enough to put behind our bulkhead. It would be
counter productive if they were to just dredge the mouth of the lake. I understand

that they have an application into the County to continue the dredging. Then
they would dredge out our canal. It would not help them if they could not get
through the canal. At low tide the canal is pretty bad.
TRUSTEE BREDEMEYER: Is your principal concern the fact that your concerned that
your bulkhead may be undermined?
Mit. GREENFIELD: Yes, that is one of our concerns.
TRUSTEE BREDEMEYER: Is that a p~incipal concern? This is shoaling at such a rapid
rate that we may be presented with a creek that is entirely closed.
Mil. GREENFIELD: I appreciate your concern. But it is also our understanding that
it will not close because of the bulkhead that ~was put in on both sides. The build-
up has increased hut not to that extent.
TRUSTEE SMITH: Mr. Greenfield how long have you lived there.
MR. GREENFIELD: Thirteen years. When I came there we had the same problem and I came
with the idea that I would bring a sail boat and nothing more. I know what the lake
was like and we want to keep it that way.
TRUSTEE BREDEMEYER: Do any of the owners allege to have rights to the bottom land there.
Or deeds?
MR. GREENFIELD: Not that I know.
TRUSTEE GOUBEAUD: How deep is your staving there,below ground?
MR. GREENFIELD: i believe 6 ft. If they dredged 4 ft. below ....
TRUSTEE LARSEN: Did you dredge after your bulkhead was installed?
MR. GREENFIELD: Yes.
TRUSTEE LARSEN: Which under mines it.
MR. GREENFIELD: No we didn't dredge that much. We dredged 6 ft. below the bottom of
the canal.
MIKE MOONEY: I'm Mike Mooney of North Fork MaKine Construction who was contracted to
do this job. Like Glenn said all we wish to do~Sremove the bar,~ any dredging in the
canal is limited to behind the property owners on either side,to a point where it
is going to dig in the center of the channel no digging on either side in a dish slope~
As for big boats going in and out there there is still no way to get clearance for
a big boat. It is just to get the property owners to get their motor boats in and out.

MIKE MOONEY: We will truck it out to an upland site. Some will be used for the roads.

there and you can walk across. I am not touching any wetlands, just basically
removing the bar that is there. I plan on starting to dredge from the old wall
and dredging from that point and at that part of the channel pull out the sand
bar. I see no problem with undermineing at all. Thank you.
RUTH OLIVA: My name is Ruth Oliva. I would like to clarify this in my own mind.
The dredging that is going to be done, is going to be done exclusively in the pond
and not in the canal coming in between the two bulkheads? Am I correct? They
are only taking out the build up of the bar?
TRUSTEE GOUBEAUD: Ruth, come up and see the map.
TRUSTEE LARSEN: They are only going to dig a small area in the middle.
TRUSTEE BREDEMEYER: Mr. Mooney, do you mind if I ask you a question?
TRUSTEE SMITH: Mr. Mooney, Trustee Bredemeyer has a question for you.
TRUSTEE BREDEMEYER: The Trustees are currently having the insurance provision
of the ordinance reviewed by the Town Attorney. Would you have any objection
if we developed the requirement that you provide insurance holding the Town
harmless and possibly permitting the reconstruction of the neighboring bulkhead
should there be a problem during the dredging? You have no problem with the
amount that we would determine through the Town Attorney as being the appropriate
amount on this project.
MR. MOONEY: No I have no problem.

Trustees). Mrs. Yaro what we are saying is that the phragmites are too tall. You
can get rid of them and replant with something in the natural setting like bunch grass
or something like that.
TRUSTEE KRUPSKI: What we are trying to prevent is run off from lawn chemicals or
fertilizer.
MRS. YARO: I don't intend to use any chemicals or fertilizers.
TRUSTEE SMITH: We don't want a lawn.where chemicals or irrigation is used.
TRUSTEE LARSEN: It's called no managed turf areas, that's how it would be worded.
TRUSTEE KRUPSKI: Beach plums or something like that.
MRS. YARO: That's fine, I used to live on Cape Cod.
TRUSTEE SMITH: Something that would grow naturally that would not need maintenance.
TRUSTEE LARSEN: Is this your family?
FROM THE AUDIENCE: No, we are the opposition at this point.
MRS. YARO: I don't know why?

ROY L. HAJE: Very briefly, Mrs. Yaro has owned the property since about 1960. It is
in single and separate ownership. She wishes to construct a home for her own use. A
small home. We have relocated the home to the now placed 20 ft. from the road as you
have the survey before you. That is the oneyou're ~onsidering.We just now had a
discussion regarding the possibility of creating a buffer. The removal of the
phragmites and the planting of more natural type of shrubbery and things rather than
a lawn and Mrs. Yaro has indicated her consent to do that. We will also maximize
the distance to the cesspools subject to the Health Dept. approval which is reviewing
the matter also. Given those safe guards and the fact that the property is a
legal building lot and in single ~n~ separate ownership we feel that there would be
very little e~vironmental impact of the projeDt upon the waters of Corey Creek. We
request your favorable review of the project. Thank you.

We now have grades there between three and four feet. That would be
then about twenty-five feet.
TRUSTEE BREDEMEYER: About twenty-five feet in front of the house. That makes sense.
TRUSTEE SMITH: You will still maintain a 50' buffer zone.'~lThank you. Will you please
state your name?
PAT LOHM: I live in Laughing Waters. We have many, many objections to this proposed
project. You should be in receipt of a letter that we sent you several months ago
when we learned this was the plan. We object to it on ~many, many reasons, primarily
of health and also in regard to protection of surrounding properties. In the letter
that we sent you, we have told you that several times each year this lot as you
intend to fill is completely under water. I don't mean soggy, I mean under one to
two feet of water. The front of that property on Minnehaha Blvd. the entire area
of that road in any rain storm is completely inundated. What you are proposing to
do is to raise this lot which is basically a swamp and let all of the water, if it
doesn't pass over it, run around it and settle right in front of it again. Additionally,
you are talking about driving a well on this property. If I'm not mistaken a few years
ago a permit was applied for to drive a well and it was found that the water was not fit
for human consumption. You also want to put cesspools in. Now directly adjacent to
this property is the Laughing Water Property Owners Association Bathing Beach. It is
a community of eighty families. Many with small children. There is no argument that
you can present, or any one else can, that will convince us that there will not be
septic run off that will be hazardous to our health. I want to show you some pictures
during a storm you can not tell what it is except that it is under water. This is
taken from the deck of my sisters house which is directly across the street.
TRUSTEE LARSEN: This is the road then...right here. (pointing to the picture.)
TRUSTEE BREDEMEYER: What storm was this taken in?
PAT LOHM: Let me show you. This is the property over here (indicating to Trustees
with the picture) it is completely under water.
TRUSTEE BREDEMEYER: I see water on the road, I see water on the main property, I see
marsh vegetation.
PAT LOHM: You see marsh vegetation, but you also see water coming all the way
through there, if you walked there...
TRUSTEE BREDEM~YER: Are these pictures identified with a particular date and event?
In other words, as in a hurricane?
PAT LOAM: Yes, in a winter storm of March 1984. Now, my point is the property is
under water. It happened once, it would Rappen again. If we had taken pictures
during "Gloria" you would have seen the same thing except there would have been
leaves on the trees. If you build this up and fill in this area, where is the
water going to go? Is it going to go in a southerly direction, southwesterly

direction and flood out Mrs. Moyle? Is is going to go to an easterly direction
and remove our bathing beach?
TRUSTEE BREDEMEYER: We're talking about displacing Peconic Bay? Ipresume
that if you are talking about the area of the .house as being about 1500 sq. ft.
at ~the height of flood plain and~the amount of soil around it you might displace
Peconic Bay is something about a million of an inch?
PAT LOHM: Nolwhat I'm saying is that we have homes and property and an area that
we dearly love. No one at this point has been able to tell us, that anything that
yon do will protect it fully, no one. It is all hypothetical, it is all very formal,
it is all very, very nicely done~with maps and charts, etc., etc.. When you
look at it and you~consider the impact that it is going to have on all of these
families, it is a terrible thing to allow to happen. It-is a terrible thing to
happen. It is not the first time that these people have tried to build on this
property, and it was stopped once before. I ask you to please, do what is right.
TRUSTEE GOUBEAUD: Is the Association ready and willing to purchase the property?
PAT LOHM: I don't know. No one has ever approached us to do anything.
TRUSTEE GOUBEAUD: What it comes down to is condemnation of property if ~Mrs. Yaro is
not allowed to build. That means that the Town of Southold has to be willing to buy
the property or the Association will,have to be ready to buy the property.
PAT LOHM: Well, if something can be worked out other than to build a house there?
TRUSTEE BREDEMEYER: This can't be the only house subject to flooding down there?
The reason for the Flood Plain Ordinance is to protect houses during storm events.
Some tof the other aspects such~as~watersupply and sewerage are taken up by the
Health Dept. by the technical staff. We have to protect the Wetlands and we have
to protect the Shellfisheries of the Town, that is our job. We have to protect all
of the Wetland values. It would seem that ifyou'r~ concerned with the sanitary waste of
the area that is largely developed would have probably reached or be near impact now.
You should have access to some testing or something that would let you. know.
PAT LOHM: Ar~e you saying that we should take this to the Health Dept.?
TRUSTEE BREDEMEYER: Certainly you have a right to take_to any permitting
agency that has jurisdiction, you have rights to bring those concerns.
PAT LOItM: You say your concern is the wetlands. That is your function. Is the
area in question, in your opinion, because I'm not knowledgeable in what the law
defines "Wetlands" is this area wetlands? Is it part of the wetlands of Corey Creek?
Have you made that determination.
TRUSTEE LARSEN: It is part of the wetland system, the fringe of it. Whether there is
enough it is called "complete wetlands".
PAT LOHM: Is there anything besides plants or plant life that determines whether it is
wetlands? Does elevations determine wetlands?
TRUSTEE BREDEMEYER: No, elevations per se does not. Soil types do.

PAT LOHM: If you think about it, I think that you have to agree with us that there
are more people here involved, that just one family against another, we're talking
a sizeable community. Please, on my behalf, when you go over this in your minds
and together consider every possible aspect because I think that you will agree with
me. That isall I have to say. Thank you for your time. I hope that I did not
disrupt anything by asking these questions.
TRUSTEE SMITH: I have a question for Mrs. Yaro? Mrs. Yaro how long have you owned
this property?
MRS. YARO: I think since 1958 or 1959.
TRUSTEE SMITH: Have you ever been refused a Building Permit before?
MRS. YARO: No. We were refused to put a well on the property.
TRUSTEE SMITH: You were never refused to build on this property prior?
MRS. YARO: No.
TRUSTEE BREDEM~YER: Would Mr. Haje or yourself be able to speak to the issue of
the possibility of the house going on an open piling system so that the concerns
about the fill displacing large amounts of water or creating run off problems onto
the community streets? Is that a possibility?
MRS. YARO: Water rushes down Owassa and it floods the houses there. The highway dept.
came down and built that up. Mr. Vanderbeck has a problem. I have seen a problem with
flooding twice, once in a hurricane and once in storm "Nelson". I don't care about'any
photographs, I have only seen it flooded twice.
ROY HAJE: You asked about the construction on pilings. I think that that would be
an undue hardship. I think that the addition of the fill would not be excessive
we have agreed to limit it substantially. As you have pointed out the displacement
of the water for the Peconic Bay system would be minute.
TRUSTEE SMITH: I think a house on pilings, if this permit was approved, would not
be conducive to the area.
TRUSTEE BREDEMEYER: I just thought that if it was an open option? We still can
require that containment of run off be a provision, if a permit is approved. That
would be something to be discussed.
TRUSTEE KRUPSKI: Can we kick this back to the Dept. of Health for the sanitary system
and the well for their approval before we issue any determination? That is one of
the other concerns of the project?
TRUSTEE LARSEN:

TRUSTEE BREDEMEYER: We will have to communicate with them our specific interests
and questions. If we advise them to the contrary that we would perfer that they
issue a permit and discuss the issues first I imagine they would. They d&fer
to the Towns that have Trustee jurisdiction because Trustees have a.~l~t to say
about all development aspects. I would assume if we told them to deal with the
issues of the water supply and the waste on this, we could hold the permit until
it cleared County approval. If we don't tell them it will get lost out there.
PAT LOHM: One clarification, up until recently, Mrs. Yaro has not spent the entire
winter in her home. I can assure you, the bulk of any flooding that you see the
winter.tides in that area are very, very severe. I can assure you that there have
been more than two times that the property has flooded.
TRUSTEE SMITH: Do any of the Trustees have any other comments. No comments.
MR. GIFFORD: My name is Mr. Gifford of Laughing Waters. I would like to address the
sanitary problem. First of all,.we here~who object~donot have plot plans, elevations,
drawings in front of them~ Only what we hear. .What I gather is that the existing
grade will be raised an additional six or eigh~feet~to a total of ten feet above
mean low water. If this is so, I would assume that the cesspools would be placed in
this fill? If this is so, then I would assume that the cesspools would be above the
elevations of the surrounding untouched land. If this is so, the surrounding un-
touched land is a public bathing beach for the Laughing Water Association. The tidal
waters would flow right in front of it. A septic system is not a containment system.
We all know that we put something in and something must come out. If you are
discussing the ramifications of what is protocol on getting a permit approved and
discussing whether or not the Health Dept. should or should not be asked before or
after, I would think that the Health concerned of many people that use this beach
should come forward. I think that is the way this should proceed. Thank you.
TRUSTEE SMITH: These permit applications are available in the Trustee office. They
are public record and you can obtain a copy of it at any time. They are public record.
It is not private.
MR. POLICASSINO: I have a letter dated June 1 that was dictated over the phone from
a D. J. Larken from Stony Brook, Suffolk County Dept'. of Health Services, County Center,
Riverhead. This is a letter addressed to Mrs. Yaro. We have,inspected your property
on the south side of Minnehaha Blvd. in Southold on Corey Creek. The westerly parcel
is cleared and contains an irregular shaped bulkhead and dock. The marsh grass is
located on the periphery of the land. The easterly lot is covered with phragmites
and the high reed is an unprotected species. The periphery of the lot along t'he
water contains a viable marsh 5 ft. to 15 ft. fringe of alterniflora a protected
species with no bulkhead. This area appears stable, we would not like to see bulkheading
in this area. Under the present moratorium regulations we do not require permits for
subdivisions unless the property would not meet the minimum size of 40 thousand sq. ft.
These are not in effect yet and we can not oppose subdivision at this time.
This was dictacted to me on the telephone by T. J. Larkin in 1977.
TRUSTEE BREDEMEYER: Oh, in 1977.
MR. POLICASSINO: I bring this up only for the fact that this is wetlands.
TRUSTEE BREDEM~YER: This is exactally what we said, the fringe is the wetland.

Roy L. Haje, En-consultants, Inc.: My name is Roy L. Haje, Pres., Eh-consultants,
Inc. on behalf of Herbert Mandel. I have read the Environmental Assessment you sent.
I would just like to make a comment or two. The conditionswhi~h you placed on it
was that the dock, I assume that you mean the float?
TRUSTEE BREDEMEYER: We mean the float, it has been corrected in the minutes.
Roy L. Haje: That is to be shortened to 30' and there is to be no dredging. Mr.
Mandel has a 40' boat. We had proposed 60' of floats to accomodate that plus an
outboard. That is the reason for the float length~ The~dredging that we propose
is in order to allow the boat to float in all tidal stages~ It is too shallow to
allow it to float at low tide. That entire arm of Mattituck Creek had been previously
dredged by the County, I had spoken~to John Guldi, (Dept. of Public Works, S.C.)
regarding that. It had been dredged to 6' or more than 6'
TruSCee Krupski: Realistically he could buy a 200 ft. boat and request to really
dredge that out. That would not be our responsibility.
Tr.ustee Goubeaud: A 30 ft. dock is more than adequate for a 41 ft. boat.
Roy L.,Haje: What is the effect of a floating dock?
Trustee Bredemeyer: Coverage, additional preservatives in the water. It is a creek
end and it seems out of keeping with the area. It would seem more appropriate to
have a 20 ft. boat in that creek end rather than a 40 ft. boat. It is already
dredge heavily. We did not see the need for it. There is 4 to 6' depth at low
tide. We did not see the need for dredging.
Trustee Larsen: We were there ~t'.low tide for every inspection.
Trustee Bredemeyer: Are you saying that Mr. MAndel will be living in this house?
Roy L. Haje: This is where the boat will be docked.
Trustee Smith: Is there a problem with him shortening up the 60' float.

Roy L. Haje: Could it be a some what more than a 30 ft. float? Could it be
40 ft.?
Trustee Bredemeyer: Everyone could come in for the same size float?
Trustee Smith: That is a substantial structure.
Trustee Bredemeyer: I'm sure that the Board ....
Roy L. Haje: As far as coverage, I mean, a float doesn't block light out of the
bottom.
Trustee Bredemeyer: The float would be in sections anyway, I don't believe that
you would have a "60 ft. float" without sections. The applicant could come in
and ask for a Trustee permit because the float is probably beyond the wetland
jurisdiction as far as water depth. It would be a simple one meeting process to
get an addition based on need in the future, when he has his boat there.
Roy L. Haje: Since the floats are 16' long, how about 32' so its a standard size.
Trustee Smith: I have no objections. Does anyone else have any comments. No
comments. Then I will close this public hearing.
