Larsen Approximately 15 people were in attendance in the audience at the beginning Of the meeting. The Truste~'m~t with the Officers of the Mattituck Estates Property Owners Association to discuss the Findings and Determination rendered regarding the Wetland Application of Cramer/Moore for the construction of a single family dwelling on property located on Meadow Lane, Mattituck. 7:00 P.M. - Regular Meeting The regular meeting of the Board~of Trustees was held-on May 28, 1987 commencing~at 7:00.,P.M. at the Southold Town Hall, Main Road, Southold, New York. President Smith called the meeting to order. Trustee Smith advised that the Field Inspections will be h~ld on June 17, 1987 to commence at t2:00 P.M. and the date for the next regular meeting will be held on June 25, 1987 to commence at 7:00 P.M. and held at the Town Hall, Main Road, Southold. Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was RESOLVED to APPROVE the minutes of the April 29, 1987 meeting. Vote of Board: Ayes: All - This resolution was declared duly adopted. Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was RESOLVED to APPROVE ~he July mooring renewals. Vote of Board: Ayes: Ail - This resolution was declared duly adopted. Board of Trustees - May 28, 1987 - Page 2. Trustee Smith gave the April Trustee Report as follows: Application Fees $355.00, Bulkhead Fees $2057.00, Wetland Application Fees $1650.00, Wetland Inspection Fees $125.00 and Mooring Renewal Fees $385.00 for a total amount of $4572.00 collected and turned over to the Supervisor's office to be placed in the General Fund. Trustee Smith advised that the Public Notices are posted on the Bulletin Board should anyone wish to review them. President Smith commenced with the Communications. COMMUNICATIONS: 1. From the Southold Town Baymen's Association, Inc. a letter of intent regarding the Baymen's position on the Senate/Assembly Bills. 2. 7Fro~m the~Dept, of Health Services advising that the County Executive, Michael A~ LoGrande proclaimed May as High Blood Pressure month in Suffolk County. 3. From Cornell Cooperative Extension of Suffolk County Marine Extension Program advertising an Eelgrass Planting Workshop to be held on June 3, 1987 at 1:00 P.M. ~ntil 4~45 P.M. at the Suffolk County Community College in Riverhead. 4. From the New York State D.E.C. information regarding the application of James E. Fitzgerald, Jr. on behalf~df~the~BrQadwaters~CoveAssociation, 'Cntch~§~e. 5. From Commissioner Henry G. Williams, N.Y.S.D.E.C. revisions to S.E.Q.R.A.. Trustee Bredemeyer advised that this is the last month that the Board will be able to declare Conditional Negative Environmental Assessments without having a long assessment form to review and it will have to be justified substantially before the declaration is declared. 6~ From Gregory Blass, Presiding Officer, Suffolk County Legislature advising that a second meeting will be held on the Algae Bloom to be held on May 21, 1987 at 2:00 P.M. in the Riverhead Town Hall Auditorium on East Main Street, Riverhead. 7. From Hofstra University advising that a conference on Coastal R~source Management and Shellfishing will be held on August 19, 20, & 21, 1987. 8. From James Small, Deep Hole Creek Association, a Thank you. 9. From The New York State D.E.C.~information regarding the Gid's Island project. 10. From Glenn Just, Land Use Company a request for emergency approval to dredge on behalf of the W~st Lake Association. 11. From Colin Van Tuyl descriptions of Quit Claim Deeds for: Ruth Emerson Cook; Quit Claim to Southold Town Trustees; Quit Claim to Southold Park District, and Quit Claim to Southold Park District. Trustee Bredemeyer advised that he reviewed these Quit Claim Deeds and thought that there were some discrepancies. Trustee Smith advised that he also had some problems with th~se ~deeds. 12. Information from Colin Van Tuyl regarding Quit Claim Deeds. Board of Trustees - Mau 28, 1987 - Page 3. 13. From Frank P. Francia a request to amend his permit no. 1780 to include the name "Conte." Moved by Trustee Smith seconded by Trustee Bredemeyer it was RESOLVED to AMEND Permit NO. 1780 issued to Frank P, Francia to include the name "Conte" whereas Mr. Conte will be using the dock along with Mr. Francia. Vote of Board: Ayes: All - This resolution was declared duly adopted. 14. From Martin H. Garrell, Chairman, Southold Town Conservation Advisory Council regarding the Koke property on Narrow River Road, Orient. The following letter was read by the Secretary to the Board as requested by the President: Dear Henry: We do not feel that the survey of wetland species on the Koke property (Application No. 373) falls within the province of any of our C.A.C. members, Heather Cusack included. Consequently, we do not plan to do the survey for you. Clearly, such a task should be undertaken by an independent consultant, who can perform said task for a reasonable consulting f~e. Moreover, in the context of environmental impact statement, the survey should be paid for by the developer not by the town. This was properly done on the Kramer/Moore application, for example. This Board serves in an advisory capacity and will never undertake true consulting jobs free of charge. We cannot afford to do this as volunteers, despite our considerable expertise. Leggio regarding his property located on Glenn Road, Southold. Moved-by TCustee~Bredemeyer seconded by Trustee Krupski it was RESOLVED that the Southold Town Tr. ustees DENY without prejudice the wetland application No. 500 submitted by Anthony Leggio whereas the subj.ect structure appears to be on Town controlled Wetlands and the applicant has not provided the required Environmental Impact Statement or removal of said structure as requested by the Board of Trustees. Vote of Board: Ayes: Trustee Smith, Trustee Goubeaud~ Trustee Krupski, Trustee Bredemeyer: This resolution was adopted by unanimous vote of the Board. 16. From John L~ Braider regarding property on Gull Pond, Greenport. President Smith advised that the Boa=d will commence with the R~solutions~ ~ until 7:.30 P.M. when the Public Hearings are scheduled to be held. RESOLUTIONS: MARK BAXTER - MOORING - APPROVAL Moved by Trustee Smith seconded by Trustee Bredemeyer it was RESOLVED to APPROVE the mooring application as requested by Mark Baxter to place an offshore stake with pulley line to onshore stake in Goose Creek. QUINN - MOORING - DENIAL Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was RESOLVED to DENY WITHOUT PREJUDICE the mooring application submitted by JOHN J. QUINN to place an offshore mooring in Gull Pond, Greenport. 2. Vote of Board: Ayes: Ail - This resolution was declared duly adopted. Trustee Bredemeyer advised that the Gull Pond area is presently considered an area that is filled with moorings. There is presently no room available for additional mooring sites. Trustee Bredemeyer advised that he will try to survey the area this summer. 3. JOSEPH A. ZUHUSKY - MOORING - APPROVAL Moved by Trustee Goubeaud seconded by Trustee Bredemeyer it was RESOLVED to APPROVE the request made by JOSEPH A. ZUHUSKY to place an offshore mooring in Narrow River, Orient using a fore and aft mooring. 3. Vote of Board: Ayes: All - This resolution was declared duly adopted. GEORGE BAMBRICK - MOORING - TABLED Moved by Trustee Krupski seconded by Trustee Goubeaud it was RESOLVED to TABLE the application of George Bambrick to place a mooring in Rich~nd Creek, Southold until the matter of the quit claim deeds in the area are resolved. Vote of Board: Ayes: Ail - This resolution was declared duly adopted. 5A. JOHN H. GEIDRMAN ON BENALF OF GARDIN~Rg BAY PROPERTY OWNERS ASSOCIATION (532) Moved by Trustee Smith seconded by Trustee Krupski it was RESOLVED that theSouthold Town Trustees AMEND the Application No. 532 submitted by John H. Geidemmn on behalf of the Gardiners Bay Property Owners Association as follows: To construct a bulkhead 3~ landward of MHW to tie in to existing bulkhead on the north end and to remove the existing catwalk on the property located at the foot of Orchard Lane, East Marion.. There is to be no dredging associated with this project. and be it further 5B. RESOLVED that the Southold Town Trustees declare itself lead agency in regard.to the State Environmental Quality Review Act in the matter of the application of John H. Geideman on behalf of the Gardiners Bay Property Owners Association for a Wetland Permit on certain property located at the foot of Orchard Lane, East Marion. 5A&B. ON BE~AI.F OF ALE%ANDER KOKE - LEAD AGENCY DECLARATION Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Eh-Consultants, Inc. on behalf of Alexander Koke for a Wetland Permit on certain property located on Pine Neck and North Bayview Road, Board of Trustees - May 28, 1987 - Page 5. 13. The Trustees recessed the regular meeting at 7:45 P.M. to hold the following Public Hearings under the Wetland Ordinance. 7:30 P.M. - 7:32 P.M. - 7:34 P.M. - 7:36 P.M. - 7:38 P.M. - 7:40 P.M. - 7:42 P.M. - In the matter of the application of Eh-Consultants, Inc. on behalf of Philip Salice to construct a timber dock consisting of a 4' x 40' (with additional 4' x 4' off set at outer end) fixed elevated walk extending from existing bulkhead; 4' x t6' hinged ramp; 6' x 50' float oriented N-S and (2) 6' x 30' floats oriented E-W to form "V". Dock over area behind existing bulkhead (30' x 99.5') and construct a 12' x 15' Gazebo. Property is located on Bayview Ave., Mattituck. In the matter of the application of David Rosenberg/Old Mill Inn to construct 1200 sq. ft. of decking with (4) pilings. Property is located at the end of West Mill Road, Mattituck. In the matter of the application of Michael M. & Jane B. Sueiro to maintenance dredge 40 cu. yds. of spoil and to install two 20' x 5' floating piers. Property is located on the eastern end of Mason Drive, Cutchogue. In the matter of the application of En-Consultants, Inc. on behalf of Joseph Lestingi to construct a stairway down the face of bluff for access from the yard to beach. A 10' x 10' storage room will be attached at lower end of stairs. Property is located at 1150 Sound Drive, Greenport. In the matter of the application of Christian B. Salminen to construct a 16' x 20' deck with steps to the water. Property is located at 240 Lakeview Terrace, East Marion. In the matter of the application of John H. Geideman on behalf of Alan Cardinale to expand an existing catwalk by the addition of two new floats, 10' x 20' and 10' x 16'. There is to be no dredging associated with ths project. Property is located at the foot of Bridge Lane, Cutchogue. The regular meeting resumed at 8:15 P.M. and the Trustees commenced with the remainder of the resolutions. In keeping the pilings in a uniform manner it was decided to drive them in at 40 ft. 2. Seven middle pilings were added dure to the extension of the outer piling. Having a middle piling will keep boats from banging into each other. 3. A ten foot extension was installed to oblige the addition of a 40 ft. floating dock, which will be attached to the float with a ramp. The floating dock is to protect the boats from a North East wind and to be used as a break water. 4. To replace a dolphin piling with a single piling. DREDGING REQUESTS: The Trustees directed that the Secretary forward a letter to Mrs. John Guldi, Principal Civil Engineer, Dept. of Public Works, Waterway Div±sion, requesting that West Lake in Southold and Wunneweta Pond in Cutehogue be put on the County Priority list for 1987 for dredging, in the mouth of these creeks. The Trustees advised that they will waiver the need of all town permits for this dredging in the mouth of these creeks. A copy of this letter is to be sent to Mr.. Frederic Bruce, Dr. gohn~Hansen~and-th~ Land,Use.Company. These creeks are to be put on the number one priority list for dredging. ANTHONY B. TOHILL, P.C. PERFORMANGE HEARING HELD BY ASSEMBLYMAN JOSEPH SAWICKI AND ASSEMBLYMAN JOHN BEttAbI. Trustee Brede~yer gave a report on this meeting held. He advised that he felt that maybe Assemblyman Sawicki and Behan would try to develop some legislation regarding the~aoncerns raised during this meeting. GODE COMMITTEE REPORT: Trustee Smith advised that it was his feeling that the Trustees do have the jurisdiction they want now. In the future the Trustees may expand their jurisdiction~to the crest of the bluff. IN KIND-IN PLACE REPLACEMENT: Trustee Bredemeyer advised that an in-kind, in-place replacement for a permitted structure, would not require the review process as long as the structure has a permit on file. This would be considered a repair. Trustee Smith advised that to date no wetland application has been received by the Trustee office on behalf of Mr. Caravanos=regarding his wetland violation. The Bay Constable reported that he is to appear in court on May 29, 1987. COUNCILMAN PENNY APPEARED before the Trustees regarding project that require D.E.C. Pez~it~s~ as'~ell ~as Town Trustee permits. Councilman Penny advised that alot of the applications that are required by the D.E.C. could be expedited by the Town Trustees if the D.E.C. would agree to give thejurisdiction to the Trustees. James Fitzgerald: My name is James Fitzgerald and I will be happy to answer any questions. I would like to know why you are going to table this. Trustee Smith: The Conservation Advisory Council is required to give us an opinion on the application. We can't vote on this until they give us their recommendation. James Fitzgerald: Oh yes, I received a letter from them two days ago. The letter indicated that I would have to wait until their June meeting to present the informatio~ they need. Is that correct? Secretary: Submit the information that they requested. I would contact the secretary to the C.A.C. to ask her if she knows what information they need. Trustee Bredemeeyr: That' right. James Fitzgerald: I contacted her yesterday, and she didn't know. Trustee Bredemeyer: Then you may want to talk to the Chairman and see what they want, try to meet with them on field inspections to answer any questions prior to their meeting. The New York State D.E.C. has raised some questions. Have they advised you of their concerns? James Fitzgerald: Yes they have. I met with them and I think we arrived to an amicable decision. The two major concerns were the increase in the boat population in that area. Toward the end I suggested that instead of having 4 fingers extending from the new dock that we intended to provide space for 8 boats. We reduce that to 3 fingers which would be for only 4 additional boats. The other concerns were how we would contain the spoil from the dredging so that it would not flow towards the south into the wetland area. We indicated that if it were appropriate, we would Page 2. If necessary put in temporary barricades during the dredging operation. As I said both of those things, in our conversation, seemed adequate. After the conversation I submitted it in writing and I haven't heard from them yet. Trustee Krupski: What about the Army Corp of Engineers? James Fitzgerald: Steve Mars was suppose to be out two weeks ago, tomorrow, and he was not able to make it. He will be out tomorrow. The only problem with the Corp of Engineers at this point is, or administrative detail, was that I didn't put in an arrow on the locus map and things of that nature. I think that was all of his concerns in regard to the application or things that I could do at hand that it didn't have any impact on the actual application. Secretary: Will you forward a copy of your letter that you sent to the D.E.C so that we know what agreement was made? For our file. James Fitzgerald: I understand that they haven't said that it was okay as yet. It was just a suggestion in response to their comments. Trustee Smith: Thank you. Steve Latson: Mr. Fitzgerald why is it you want to dredge? I looked over there and I found that there is 3 ft. of water at the end of the little docks at low tide? Mr. Fitzgerald: At low tide there is no water against the bulkhead. Because of ~he prevailing~wi~ds i~ ~he area~ the people who h~ve po~er~oats dock them with the b acing east. we nave naa situations in the past where the z~oaters were in the sand. I have a little sail boat that is in a more southerly position. Where the catwalk goes east and the sand has built up in that corner to the extent that even though the boat is a 14' Boston Whaler Harpoon, and even though it only draws 4" it is on the sand at low tide. Steve Latson: I was curious to know why they dock that way. Trustee Smith: Thank you. Do any of the Trustees have anything they want to say. No comment. From the audience: I have something to say. Trustee Smith: Will you please state your name. Jeffrey Levitt: Jeffrey Levitt, I am an Attorney at 119 West Oak Street, Amityville. I represent Mr. Norman Boos who owns the Broadwaters Cove Marina which is about 500 ft. north of the subject property. The issues that I really want to raise with you tonight involve the standards that the Board is going to apply to this particular application. In the latter part of 1983, Mr. Boos made an application to this Board to add dock space to his marina. Trustee Smith: I think that you are getting off of the track here. This is a Public Hearing for the Broadwaters Cove Marina. M~. Levitt: Yes, I understand, may I make a point here. Believe me I did not spend two hours to come out here to waste your time. Or to waste my time. Both of these properties are zoned the same. Both of these properties are non-conforming uses. Page 3. James E. Fitzgerald, Jr., Pres., Broadwaters Cove Association, Inc. Public Hearing - May 28, 1987 In 1983 Mr. Fitzgerald wrote to this Board, and I have a copy of this letter, strongly protesting on behalf of the property owners. I have a co~y for each one of you. Strongly protesting any change in the area by which there would be any increase in the marina facility. As a result of that objection, there was a subsequent letter from the Association in 1984 making complaints. That applicant was forced, I'll take back the word forced, he was requested to prepare an Environmental Impact Statement. Now, what I'm leading up to is this -- we feel that the standards that should be applied to this application should be consistant standards. For example, Mr. Boos had to get an Environmental Impact Statement, why doesn't the Association have to get an Environmental Impact Statement? Now I have read the application and I don't know if there has been a change in the application in the last three days? But there were pages and pages that deal with environmental matters that were totally left blank. There was nothing written on them. Now, does that mean that if Mr. Boos comes before the Board with an application that there would be no necessity for an Environmental Impact Statement. That he would not have to fill out any of the environmental information in an application? The application of the Association where there is a question "Is there a permit necessary from the Army Corp of Engineers?" It says no. Now would that mean that the Board would pass on it without the Corp of Engineers? Now there was a Zoning issue. This is a change of a non-conforming use. This was the position that the Association took a few years ago. That someone just a few hundred feet~away with the same property could not add just one more boat without going to the Planning Board, without going to the Zoning Board of Appeals. As far as I know, there is no application by this applicant before the Planning Board, before the Zoning Board of Appeals? So, what is being done here is to by pass all of the normal governmental controls that were requested by this very applicant just a few years ago with regard to one of it's neighbors insisting, and it is my understanding that the Board took the position that before it was going to give any approval that all of those conditions of Environmental Impact Statement, of Planning Board Approval, Site Plan, it was a very expensive proposal and going to the Zoning Board of Appeals which the applicant did. Then because there was objection from the neighbors, very heated objections, this application was withdrawn. By the way, what about parking, there has to be off street parking requirements. There were requests by the Association against it's neighbor a few years ago. Did Mr. Boos have enough parking if he wanted to change the non- conforming use status? The Trustees I understand, made him go to the other governmental agencies to make sure that that was done. I don't understand that there is any such application pending anywhere with regard to parking issues? Issues were raised at that time that Mr. Boos was a profit making organization and this is not a profit making organization. I suggest that the birds and the bees and the fish don't know the difference as to what is going into the water whether the person who is driving the boat docks his boat with someone who is making a profit, or is docking his boat with someone who is non making a profit. By the way, I heard it said that there will be three finger docks for four boats. I think three finger docks will be six boats. If my arithmetic is correct. The physical attributes of the dock, I also find very interesting. It shows a 50 ft. width being proposed here. Unless the boats are going to be 12 ft. boats, they are going to be facing each other on a 50 ft. width, the likely hood is that this is going to have to go out much further into town waters than it is being proposed. If you have two 25 ft. boats facing each other on 50 ft. t don't understand how they will both turn or anyone would turn or exit any area to be able to leave. Now Page 4. James E. Fitzgerald, Jr., Pres., Broadwaters Cove Association, Inc. Public Hearing - May 28, 1987 that doesn't mean necessarily what I'm saying is opposing the application or I!m infavor of the application. I~m raising an issue that the Trustees act in a continual, that's the right word. The persons may change but the concepts are suppose to remain the same. The rules are suppose to remain the same. It seems to me to be very unfair to be bought at that time, to have indicated that those are the rules. Apparently, I'm assuming that if the gentleman came in again, that those are still the rules, but there is a different set of rules. I'm here tonight, to make sure that if that application the Association ~s granted that there are no mistakes that are made. That in the future Mr. Boos should come in, and he is told that he needs an environmental impact statement, ~and he says "What about the Association?" There is no one that says that was a mistake we forgot. Or if he asks about parking, no one says it was a mistake, we forgot. Or if he asks about Zoning? Theoretically from what is being proposed here if he didn't ask for 8 boats and he asked for 80 boats the implication is that you could give approval and he wouldn't have to go to any one to change his non-conforming use. I just want to make sure that these things are brought up in a public session so that we understand and the Board understands, I hope, what the guidelines are suppose to be. Now, they have changed. Now, if none of that is true any longer, we assume that you will apply those standards to this application and to any other application that comes before you. Trustee Smith: Thank you. Roy Haje, En-Consultants, Inc. on behalf of the applicant Philip Salice: I have nothing to say except to answer any questions that you may have. Trustee Krupski: It seems to be a pretty substantial dock. It seems to be~ quite a bit larger than the neighbors have there, almost out of proportion for the area. Roy L. Haje, En-Consultants, Inc.: They have some big boats that have to ge~ to deep water. Since there is no dredging proposed they will tie the bows into the face of the bulkhead so that the stern is in deep enough, water. That is the reason for the size of the dock. Trustee Krupski: How many boats does he intend to dock there. Roy Haje: Two I believe. Trustee Krupski: tt seems like a large structure? Do any of the Trustees have any feelings on this? There is a possibility of having 6 boats there. Trustee Smith: He is allowed to put two boats other than his own there. The Town fathers in their wisdom years ago they felt that marina space was going to be scarce. They put it in the Town Code that if a person has a dock and they wanted to rent space to someone on their private property that they could for two boats other than their own. Trustee Krupski: It just seems that this is a big dock for the area. It provides space for a least six boats. Trustee Bredemeyer: Condition the permit for four boats then. Two other than the owners then. Roy Haje: You would have an occasional guest there. Trustee Krupski: It seems like we have run into problems with these before. Trustee Bredemeyer: No more than 4 boats, no more than 2 of which may be of the owner. Page 2 - Philip Salice We haven't gotten into putting boat limits on docks before. Trustee Krupski: I think it is a good idea. Trustee Bredemeyer: We can discuss this wheB it comes up for the approval on the permit. Trustee Smith: Are there any other comments? Steve Latsen: One question that we have on this dock is that it is at least a 90 ft. dock, plus the bulkhead is pushing the mlw mark out, probably t0 ft. out past the creek. The map submitted shows 1500 ft... Mr. Haje: That has been amended~to 400 ft. Steve Latson: I doubt that it is even that wide. I would like to know what the width of that creek is there. I do know that there is a channel marker there that juts quite a ways out into the creek there which pushes the channel~ over to his side of the creek. I really think, considering the Town Board last week rejected a boat ramp because they felt that creek was to narrow, I think that this is a pretty narrow spot there. There is a lot of traffic there. I would like to rather see the man do a little dredging possibly. I don't think that the real width of the creek has been addressed. Trustee Smith: Mr. Haje do you think your applicant would be willing to shorten the fixed walk by 10 ft. making it 30 ft? Roy Haje: AsSuming that he would be left with adequate water for his boat~. Trustee Bredemeyer: The Trustees looked at it in the field, the neighboring docks go out tha-t far to get to depth? Steve Latson: Fmybe you should you do some soundings? Trustee Bredemeyer: Why don't we discuss that later on. If we cut him back and if the applicant has a problem, he can come in later on for dredging. Trustee Smith: Okay. I believe that the application is incorrect as far as I can calculate the deck that we wish to construct is no more than 600 sq. ft.. Last time that I appeared here we submitted surveys. I don't know if you still have them handy, but I would be glad to pass out new surveys. You can see where it says wood dock. It is sort of an "L" shape. We want to square that off and make that a rectangular - deck. It is-really a deck although there are floating docks around it. Trustee Krupski: That looks identical to what you previously submitted to us. Ted Rosenberg: That is right, it's the square footage that is off. Secretary: He has 1200 sq. ft. of decking requested on the application. So are you saying now that you want to amend it to less? Ted Rosenberg: I'm saying is that the total decking may well be 1200 sq. ft. at least 600 sq. ft. already exists. We only seek to add 600 sq. ft. Like I said it is in an "L" shape now. The area that will have the deck constructed over it is pretty much useless area. It is to shallow to use as a mooring area. Also, my client actually owns that area. We are not seeking to do that on town property. The restaurant has recently gone under a major renovation and the deck looks pretty shabby. We would like to fix up the exterior by improving the existing deck and expanding a little bit so'that it would be suitable for out door dining. As of now, the surveyor's haven't located those stakes. We are going to supply the Trustees with a drawing, with the location of those stakes. Trustee Larsen: Did you move the stakes back past the patens on that corner by the barge? Mr. Costello: Yes we didO- We. removed the ones we had up front. Trustee Larsen: And put them back by... Mr. Costello: They are right where we left them there. We removed a few up front. Trustee Larsen: Did you put them behind the patens? We identified the spartina - patens species. Did you put the stakes behind that? Mr. Costello: We went about half way back at that location, i recall .... Trustee Bredemeyer: That is where' we left them. About half way... Cp~ Mr. : I recall, probably 50', and took that line instead of where it waS~6=iginally out in front. Trustee Larsen: Okay, because I wasn't sure where the stakes were left. I wasn't sure if they were left inside of the spartina patens or landward? Mr. i~bstelto: We moved tham back 40 or 50' landward at that location. Public Hearing - Helen Reiter Page 2. Trustee Smith: This is the East side of the restaurant. Mr. Costello: Right. That one location. We are still going to have to supply you with a map locating those stakes. There is no question about where they go. I just hope that we can get some type of approval subject to some of these conditions. One, the drawing. Of course, DEC approval. Trustee Larsen: We received a letter from the DEC stating that they did not take any action on the application. They ask for plans for the project. Mr. Costello: We will have to resubmit to the DEC. We will resubmit a plan showing the stakes, and showing how far landward we moved the stakes. ~We will have to supply the DEC with one also. Some of the subject to conditions I would like to see is, if the availability of fill does come up in the mean time that we can stock pile some fill keeping it 75' away from the fringe or the stakes. Trustee Bredemeyer: That would be out of our jurisdiction any way? Mr. Costello: The determination of exactally where those stakes will be, we could be in to an argument over 4'. Where we staked it the other day, I would like to stay 75' from that location. Trustee Larsen: Our jurisdiction goes from 75' landward of the MHW or the last wetland indicator plant. Mr. Costetlo: That is what I'm trying to avoid. Where we staked it out, I'm sure there is a couple feet of wetlands on some sides of the stakes, not on others, and I've been in arguments with agencies that it was 72' from the wetlands. What I want to say is that where those existing stakes are we will keep everything 75' from there. Trustee Bredemeyer: Does. anyone have a problem with 75'? Trustee Krupski: I think I know what Mr. Costello is trying to avoid here. I think that it is good that you bring this up. Trustee Larsen: I have no problem with that. We know that you don't want to put it there and then have to move it. Mr. Costello: Or a violation. Some of the other conditions I would like to see in the permit are: the application was for 1314' of retaining wall. What we will do is measure off that farthest East section of retaining wall. I believe it was the opinion of Ch'e Trustees that we continue, I don't know how many more feet of retaining wall, to keep the fill from encroaching on the wetland area. We will have the surveyor measure that and locate it on the map. There will be a slight difference in the footage. Possibly I would like some of the debree, in some of the locations that are landward of the stakes, to relovate it and put it behind the retaining wall. Trustee Bredemeyer: The debree is seaward of the retaining wall. Mr. Costell0: Right. Trustee Larsen: The C.A.C. has some interesting comments. I don't know if they were talking about the same project. They said that they recommend approval with the stipulation that their be no dredging. Also the C.A.C. suggests the Trustees withhold the permit because of the work conducted with out a permit. There was no work conducted with out a permit? Trustee Smith: No, that was something that he had that he replaced. Trustee Krupski: It has-not been our policy to approve dredging in the creeks. Trustee Bredemeyer: Single boat slips and maintenance we approved. Trustee Krupski: Is this maintenance dredging, the application doesn't say that it is. Trustee Smith: Yes it does. Will you please stand up and use the michrophone? Steve Latson: I think that it would be a good time to do a predredging survey of this area. Then do an after dredging survey. Make sure that they do not exceed the application. We want a before and after survey with soundings made of the area to be sure what-was taken in the area. Trustees: Good point.
