Dear Mr. Pell:
Pursuant to our letter of October 14, 1982 regarding the above referenced
subject, we wish to express, in good faith, additional comments relative to the
landfill.
The proposal of your committees to purchase additional property for the
landfill was confusing to us at first since the State D.E.C. had targeted 1984 as
a deadline for ending open pit dumping. However, we trusted that your good judgement
and concern did motivate that proposal, which prompted us not to oppose or question
the idea. Unfortunately, we should have questioned it in more detail.
When we entered into contracts to purchase property or homes on
Mathews Lane, we certainly knew that the landfill existed; however, we were assured,
advised and made aware of the State and Town efforts to eliminate open dumping, close
landfill areas and protect the environment, thereby protecting us. With this
knowledge, all of us have purchased, made substantial improvements to our homes and
property and are proud of it. Proud because we have taken a sparsely populated
residential area and developed it into a subdivision that rivals many in the Town.
Our hopes of increased development and property values will prove fruitless
because of your proposal that includes a general entrance to the landfill off
Cox Lane. The landfill traffic combined with the normal traffic on Cox Lane will
create a hazzard at the intersection of Route 48.
We've heard "The landfill would be socially unacceptable or unsuitable
in other areas of Southold." If it is unacceptable in other areas, it certainly
is in ours also!
The safety and well-being of all Southold residents including 13 children
in the immediate vicinity should be of the uppermost importance in your decisions
for the present and future planning.
We urge you to reconsider your proposals on behalf of all of us who have
worked so hard to build and maintain our homes and property consistant with the
values and traditions of the Town of Southold.

information related to the expansion of the land fill and
discussed my findings with other neighbors on Mathews Lane,
Cox's Lane in Cutchogue.
On their behalf, I am directing this letter to you, as
Chairman of and the other Planning Board Members for serious
consideration of our following comments and recommendations
during your next and future meetings on the subject.
a)
Of the total area you authorized purchase of
and bond issue fo~ included therein to the south
of proper~y owned by J. Muratore is an area of
wooded land approximately 200 ft. (on Cox Lane)
by 600 ft., currently fully wooded, with a dirt
road for small vehicles.
b)
Our long range belief is that the Planning Board
might consider the area for future use as access
or egree for the land fill site.
We recommend, for public safety, fire protection,
asthetic value and our privacy that this area be
maintained as wooded with the dirt road kept only
for emergency vehicle access and egress to the
land fill site and that the main entrance and
egress be as currently situated from Route 48.
Concerning the entire land fill site, we recommen~
the maximum treed areas be maintained and additional
onsite planting of trees and shrubs be included in
the planning as a buffer, noise abatement, and visual
asthetic improvement and to reduce the paper - plastic
"blowout and scatter" experienced which involves
'considerable time and personnel to clean up.

We also respectfully request that no further land
fill expansion beyond the present boundaries be
made which would affect or cause aquisition of. all
or part of the present and future' properties fronting
on Cox's Lane.
We believe the above recommendatio~ns are basic and can be
readily incorporated in the Land Fill Expansion Program. I

keep us advised and perhaps call on us for questions and

Dear Mr. Raynor:
Pursuant to my conversation with you the other day, I reviewed
the file, and I now realize the survey of Young & Young Land Sur-
veyors dated July 15, 1982 submitted to the Planning Board (Item
3 of my letter of October 6, 1982) might be confusing since the
surveyor shows a course line of "North 28° 39' 55" East 424.17"
indicating a delineation of the 7.510 acre parcel from the 11.383
acre parcel. This course and distance should not have been placed
on the survey in that the parcel of land being sold to the Town of
Southold is 18.893 acres (the total of 11.383 and 7.510 acres). I
have reviewed the file and find the legal description (Schedule A)
submitted in the Application (Item 1 of my letter of October 6,
1982) encompasses the entire parcel for which the set-off is being
requested. Therefore, kindly ignore the line drawn on the survey
of "North 28° 39' 55" East 424.17" as it is meaningless.
You should also realize the 18.893 acre parcel for which the
set-off is being requested is being sold to the Town of Southold.
This is the precise parcel of land the Town wanted to purchase.
Mr. Glover is aware this leaves him an undersized 2.417 acre parcel
on the south for which he will have to make an application to the
Board of Appeals for an area variance. As I understand it the
Town did not want to purchase the 2.417 acreage because all they
wanted was access to Cox's Lane. If the Planning Board members
have any questions on this matter, they should discuss them directly
with the Town Board.
The survey by Young & Young (Item 3 of my letter of October 6,
1982) was prepared for the Town of Southold. Mr. Glover does not
have a survey of his entire parcel other than what is being used as
a sand pit since it is in agricultural use and had no need for such
a survey. In order to help clarify the situation, I am enclosing
a Suffolk County Tax Map of the area. As you can see by reviewing

the tax map, Mr. Glover is assessed for 41.4 acres of which he
is selling 18.893 acres to the Town, and he will have to obtain
a variance for the 2.417 acres. The remaining parcel of 20.2
acres will remain in agriculture. I have outlined in red on the
tax map the parcel being sold to the Town and outlined in blue
the parcels being retained by Mr. Glover.
I have discussed this matter at length with Robert W. Tasker,
the Town Attorney, and it is his opinion it would serve no purpose
to have a survey of the 20.2 acre parcel in that it was the Town
which, through negotiation, has cut out the 18.893 acre parcel
from the entire 41.4 acre parcel of land and had Young & Young
prepare a survey of this parcel which should be sufficient for the
Planning Board to act on it.
As I understand it, it is Mr. Tasker's opinion, considering
the nature of the transaction this application is proper for a
"set-off" as what is being requested is approval of this parcel to
be sold to the Town of Southold. Further, it will be in conformance
with the criteria as set forth in Section A106-13 of the Subdivi-
sion Regulations.
I would appreciate the Planning Board acting on Mr. Glover's
application at its earliest convenience as there are certain time
constraints in this matter due to the nature of the HUD funds and
tax considerations of Mr. Glover. The closing of title is presently
scheduled for November 15, 1982.
If the Board has any further questions, I will be happy to dis-
cuss them at its meeting on October 18, 1982, as I understand I have
an appointment on this date to discuss this matter. I believe Mr.
Tasker will also be available if the Board has any further questions.

Dear Henry:
As you are no doubt aware, the Town of Southold has entered into a contract
with Leander B. Glover to purchase a parcel of land comprising 18. 893 acres
adjacent to the Town landfill site at Cutchogue.
The contract is contingent upon the seller obtaining the required Planning
Board approval and a variance from the Board of Appeals. Richard Lark
represents the seller and I understand that he has discussed this matter with
you. Mr. Lark talked to me about this matter and indicated that you had
some questions concerning the matter. He indicated that you expressed a
concern for the remaining land area retained by Glover.
I have made an exerpt from the tax map showing the area in question and a
copy is enclosed herewith. The area in yellow is the land presently owned by
Glover and contains 41.4 acres. Since the Town is only acquiring 18. 893
acres, Mr. Glover will have in excess of 22 acres of land remaining after
the Town acquires the parcel under contract. On the enclosed sketch, cross-
hatched in red is the area to be acquired by the Town. The area in red is the
present landfill site owned by the Town. The southeasterly corner of the
Glover property has a frontage of 225 ft. on Cox Lane. Of this amount, the
Town is acquiring a 75 ft. strip extending from the westerly side of Cox Lane
westerly to the Town property. Glover will retain 150 ft. frontage on Cox
Lane and the parcel retained will comprise 2.417 acres. Since this property

is in the C-1 Industrial Zone, it will be less than the required area and width.
Accordingly, the seller will have to apply to the Zoning Board of Appeals for
a variance.
Mr. Lark indicated that you had some questions with respect to this matter

with me the questions which are of concern to the Planning Board.
