The Regular Meeting of the Board ~f Town Trustees was held on March 26, 1987
at the Southold Town Hall, Main Road,/Southold. President Henry P] S--~t~ ~pe--~ed
the meeting at 7:00 P.M.

Trustee Smith advised that the next regular field inspection will be held on
April 23, 1987 to commence at 12:00 P.M., and the date for the next regular
meeting will be held on April 30, 1987 to commence at 7:00 P.M. to be held at
Town Hall, Main Road, Southold.
Moved by Trustee Bredemeyer seconded by Trustee Krupski it was
RESOLVED to approve the minutes of the Special Meeting held on February 24, 1987

Trustee Smith gave the Monthly Report for February 1987 as follows: Application Fees
$160.00, Wetland Application Fees ~1500.00, Wetland Inspection Fees $80.00 and
Mooring Renewal Fees $350.00 for a total amount of $2090.00. This money has been
transmitted to the Supervisor and placed in the General Fun~.
President Smith advised that the Public Notices are published on the Town Clerk's
Bulletin Board if anyone wishes to review them. He proceeded with the communications.

III. COMMUNICATIONS:
1. From Michael A. LoGrande, Suffolk County Executive regarding Women's information
and referral fair to be held on March 24, 1987 at the H. Lee Dennison Bldg.,
Veterans Memorial Highway, Hauppauge, and March 26, 1987 at the County Center,
Riverhead.
2. From the New York State Department of Environmental Conservation regarding
responses to questions that were addressed to that office from the Trustees.
Trustee Bredemeyer advised that he had submitted the questions to the D.E.C.
on behalf of the Trustees. Trustee Bredemeyer advised that the response to
Question No. 3 was almost the same response sent out from the D.E.C. office almost
three years ago, when the project was declared a Significant Project by the Town.
He continued to read Question 3 as follows: "Have all acquisitions under the
Environmental Quality Bond Act of 1972 been made? ..... A project proposed for a
salt marsh island in Hallocks Bay, O~ient (AKA Gids Island) owned by a Dr. Perrone
was reportedly withdrawn whicl negotiations took place with your agency considering
its purchase. What is the status of this? Response: No. The Department will
initiate a major acquisition project in the Long Beach/Hallocks Bay area in 1987.
We are not able to discuss details of what parcels we may and may not include in
such an acquisition, but we feel that the dimensions of the project will be
consistent with our understanding of the Trustees' interest." Trustee Bredemeyer
advised that he thought that this was rather interesting.
3. From Eh-Consultants, Inc. regarding the Elizabeth Yaro application No. 478.
Trustee Smith advised that a survey will be required for this project as previously
requested.
4. From Allan A. Pines, Attorney regarding the Prieto property in Southold. A
letter is to be forwarded to Attorney Pines reiterating that the Board of Trustees
will continue to issue mooring permits at the foot of this R.O.W. until it is
proven that it is not a R.O.W. by the Prieto's.
5. From Christopher F. Smith, Cooperative Extension Agent regarding a Draft
Final Report out he Bay Scallop Nursery Structures. Trustee Smith advised that
this report is on file in the Trustee Office if anyone wishes to review it.
6. From the New York State D.E.C. information regarding the Wickham Creek
Dredging proposal. --
7. From the New York State D.E.C. information regarding the Little Creek
Dredging proposal.
8. From the New York State D.E.C. information regarding the Brushes Creek
dredging proposal,
9. From Councilman Paul Stoutenburgh regarding Crab traps in the creeks. The
Board discussed this matter and the following resolution was declared:
Moved by Trustee Smith seconded by Trustee Bredemeyer it was
RESOLVED that the Trustees would be in favor of limiting crab pots to two (2)
crab pots per individual and that each pot and buoy is to be identified with the
individuals shellfish permit number.

10. From Supervisor Francis J. Murphy regarding S.E.Q.R. fees. This is a matter
that should be discussed with the Town Code Committee for a possible change.
11. From the Southold Town Planning Board a Significant Environmental Assessment
on Wolf Pit Associates subdivision. The Trustees request that the Planning Board
transmit a copy of the subdivision sketch plan for the Trustees to review.
12. From the State of New York Dept.of Transportation regarding Route 25 over
Dam Pond channel. Trustee Bredemeyer advised that this proposal is not going to
impinge on wetlands. He advised that the proposed bridge addition is going to
expand beyond, essentially 10 ft. to the north and south of the existing with a
new abutment and new road surface put in. He advised that the DOT is willing to
work with the Board regarding this project.
13. From the North Fork Environmental Council, Inc. regarding Francis S. Perrone,
M.D., Gids Island.
14. From Freddie Wachsberger, Orient Association regarding Gids Island.
15. From the Office of the County Legislature regarding Algae Bloom.
16. From Frand Wibben, Regional Design Engineer, Dept. of Transportation regarding
road run off. Trustee Smith advised that the DOT is saying that they will not
be willing to do anything about these run off problems.
17. From Jeffrey Kassner, Bay Management Specialist, Brookhaven Town regarding
the State Shellfish Management Grant meeting, to be held on March 26th at the
Dennison Bldg. in Hauppauge.
18. From Christopher F. Smith, Cooperative Extension Agent, Marine Extension
Program regarding Fish Trap Mussel Culture feasibility demonstration.
19. From Joseph Hall, New York State D.E.C. regarding the subdivision of Harold
Reese. Trustee Larsen advised that they are recommending a D.E.I.S. on the project
and he asks what the current Zoning is on the project?
20. From Monroe R. Sonnenborn regarding a request for an emergency permit for
work to be done at 305 North Sea Drive, Southold. Trustees advised that a
Wetland Permit will be required for this work.
21. From Robert J. Miller regarding the construction of a single family dwelling on
Fishers Island. Trustee Smith advised that this matter is to be referred to
Steve Malinowski, Bay Constable on Fishers Island requesting an on site inspection
-for a determination on the need of a Wetland Permit on this project.
22. From Twomey, Latham, Shea & Kelley requesting an extension on a permit for
James N. Bailey. The following resolution was adopted by the Board:

RESOLVED to Approve the request made by John F. Shea, III, Attorney on behalf
of James N. Bailey for an extension of six months on permit No. 233. Said
permit will expire on September 25, 1987.

IV. PUBLIC HEARINGS:
7:30 P.M. - In the matter of the application of The Land Use Company on behalf
of Nunzio & Steohanie Rea]~ to construct a 4' x 32' fixed dock leading
to a 3' x 10' ramp leading to a 6' x 20' float dock to be a~ttached to two
6' x 20' float docks. Property is located on Fleetwood Road,
Cutchogue.
7:32 P.M. - In the matter of the application of Patricia'C. Moore on behalf
of Peter & Barbara Herz to construct a single family dwelling
on property located at 170 Cedar Point Drive East, Southold
7:34 P.M. - In the matter of the application of Ernest Tarm~n to construct
stairs from the bluff to the beach; install a gazebo with a deck
at the top of bluff. Property is located on Main Road, Orient. -
7:36 P.M. - In the matter of the application of Eh-Consultants, Inc. on behalf
of Olof Nelson to construcn a timber dock consisting of a 4'x5'
ramp extending from lawn onto a 10' x 10' deck landward of marsh
-fringe; a 4' x 60' fixed, elevated (4' above grade of marsh) walkway
a 4' x 16' hinged ramp; (2) 8' x-16' floats secured by (5) 12"
pilings. Property is located on F~shers Island.
7:38 P.M. - In the matter of the application of Peconic Associates, Inc. o~
behalf of Sal Prato to construct a 30' x 40 building and a 30'
x 50' fenced in storage area. ~roperty is located on Kerwin Blvd.,
Greenport.
In the matter of the application of Robert E. Johnson to register
an existing bulkhead which replaced an 82' bulkhead destroyed
by hurricane Gloria. Property is located at 430 Koke Dr. & Corey
Creek Road, Southold. '
7:42 P.M. - In the matter of the application of Ralmh Levy to place 3/4 gravel
at the area next to creek at a depth of 2" - 3" in an area 6'

In the matter of the application of Costello Marine Contracting
Corp. 'on behalf of Nick Tsour~s to armor 125' of eroded bluff
with 3-4 ton rock @ 3 ton/lineal ft.; to install core stone and
filter cloth base 1' betow MLW and 5' seaward of 3 ton toe stone.
Install (2) 24' returns at each end of propert~ located off of

In the matter of the application of En-Consultants, Inc. on behalf
of Bernhard Peper to rebuild existing damaged dock consisting

cu. yds. of spoil will be removed by dragline crane and deposited

Moved by Trustee Larsen seconded by Trustee Bredemeyer it was
RESOLVED that the Town Trustees APPROVE the request made by Henry
Stasiukiewicz to move his house out of the Trustee jurisdiction
[as stated in his letter of March 3, 1987 .... 90 ft. west of original
site] and to continue the review process on the application for the fill.

located on the South side of the eastern end of Mason Drive, Cutchogue.

LAND USE COMPANY ON BEHALF OF MR. O'BRIEN - DETERMINATION ON THE NEED OF A PERMIT
After an on site inspection of this property by Trustee Larsen it was
determined that the project as proposed is 78' from the H.W.M. to the building
envelope, therefore, the Trustees have no jurisdiction in regard to this
matter.

CONDITIONS: Subject to the Trustees restaking the location for the fill.

DESCRIPTION OF ACTION: Total lineal footage of retaining wall will be 1314',
to be installed approximately 5' landward of meadow fringe; to backfill the 1314'
of retaining wall with 4000 cu. yds. of clean trucked in sand; to construct 1314'
of catwalk to run the length of the retaining wall on the landward side. To be
1314' x 12'; An existing 29' catwalk, 14' ramp, and 6' x 40 float on the west
side of the property will be expanded to a float 110' x 6'. The configuration
will remain the same, that is the existing "T". Regarding the basin section,
there will be a 16' ramp extending landward from the retaining wall, attached to a
40' x 6' float.

DESCRIPTION OF ACTION: To construct a 30' x 50' single family dwelling plus

system a minimum of 100' landward of high marsh and install a well. There is
to be no distrubance to the vegetation or topography within 50' of the high marsh/
intertidal marsh area.
LOCATION: Lupton Point road, off of Marratooka Road, Mattituck.
REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment form has been submitted which
indicated that there would be no adverse effect to the
environment should the project be implemented as planned.

Trustee Bredemeyer advised that this amendment was a result of the Building
Dept. issuing a Building Permit prior to the issuance of the Trustee Permit
for this project. He felt that the Building Dept. should forward a written
explanation as to what happened in regard to this matter and that Mrs. Gledich
also deserves an explanation.also. Trustee Goubeaud suggested that the Trustees
hold a work session with the Building Dept. to discuss this and other items of
concern.
Mr. Glenn Just appeared before the Trustees on behalf of Mr. & Mrs. DeGaudenzi
regarding a Town Violation on property located at 3520 Ole Jule Lane, Mattituck.
Mr. Just advised that Mr~ Charles Hamilton of the D.E.C. would be making an on-
site inspection of this property on 3/27/87 and that he would,advise the
Trustees of his findings after that date.

after another on-site inspection~that as long as all of the work is kept behind the
existing flagged stakes on the property the*~Trustees will have no jurisdiction in
this matter. ~
Mr~G~nn~,Just addressed the Board on behalf of Mr. Charles Bowman regarding
his project on Bayview Road, Southold for the construction of two houses with
sanitary systems on each lot and to fill. The Trustees advised that this project
would be Significant because of the following: 1. Previous inspection and
determination that this would remain as one lot, with one~house proposed on the
North lot. 2. That the Salt Marsh is accreting, and 3. That the site has been
hydraulicly filled. The Bdard TABLED this application and will forward their
comments to the Planning Board for their considerat£on. (see resolution no.14, p~.9.)
The Trustees will meet.with the Code Committee on April 1, 1987 at 7:00 P.M. to
discuss Trustee jurisdiction on the Sound.

Trustee Larsen: I have one comment. There are three docks proposed for
private use. It seems excessive for a private piece of property.
Trustee Kru~ski: With no access from the road.
Trustee Larsen: Access is from a R.O.W. and we never really determined if
it was a public or private R.O.W.?
Trustee Bredemeyer: There are two floats. A ramp .... ...
Trustee Krupski: Did we make a condition on the assessment?
Trustee Larsen: Yes, that the R.O.W. is used for access and that he has to
revegetate the high marsh where it was devegetated there. John, I'm not up on
the dock code, where are the limitations there?
Trustee Bredemeyer: They can have two boats other than his own.
I think that we can put a restriction on the permit that the Town Code would
~ohibit more than two boats other than his own in the family. If there is a
~estion on that
Trustee Larsen:. It's just that we are seeing alot of larger docks.
Trustee Smith: Attach a copy of the Town Code regarding this section with the
approval.
Glenn Just: He has four sons.
Trustee Smith: Four sons?
Trustee Krupski: Is there any way we can put this on for an inspection in July
just to see what is going on. It seems to be a viable high marsh area, and I
would not like to see that become a high.traffic area.
Trustee Bredemeyer: Put that as a conditon of the permit. A single path, no mowing,
no vehicles with four wheels on it, a foot path ......

forward application. If you have any questions on it I will be glad to answer
them.
Trustee K~hpski: Ellen and I were out there earlier in the year, we met with
some people that were concerned with possible navigational problems. It is a
busy area. They were concerned with the length of the dock.
Roy Haje: It is a busy area but it does not extend out into the navigable channel
way. We have taken that into account because we know that there was a problem
with a fellow down the way, 500 or 600 ft. or so away. That was a considerably
a longer dock. This area is not part of the channel way.

We saw moorings that were about 100 ft. off shore~
They would have to stay away from the channel also.
Trustee Larsen: I don't have a problem with the length of the dock, other than
it interfering with the moorings that had been previously secured immediately

construction of a vehicle and general storage area for Sal Prato, Electricial
Contractor. The building is being constructed on a prefilled site approved by
the Trustees and the D.E.C. and since your application was submitted the Bldg.
Dept. and the Planning Board suggested that they increase the sq. ft. of the
building b~ 10 ft. and delete the fenced in storage area and add the slope of
the crushed stone paved area to include inlet grills to collect surface water
on the site so that it does not go into the wetlands.
Trustee Smith: He is changing the application?
Secretary: He is no closer to the wetlands than first proposed is it Mr. Wiggin?
Merlon Wiggin: There is no change in dimensions, just to the building. He
deleted the storage area that was fenced.
Trustee Larsen: Why did he delete the fenced in area?
Merlon Wiggin: So he would not have to go to the ZBA.

Trustee Krupski: He 'has a big berm around the east and south side of the
property, what about the west side of the property. Is he going to build that
up.

John Harrison: I have nothing to add except what I said two months ago when I
came before the Trustees.
Trustee Bredemeyer: I have a question? How will the applicant keep emergent
weeds and vegetation from coming through. It would seem that that type of
landscaping technique is used as a cover for aesthetic purposes. Here you
have wetland grasses that will want to come through. Is he going to use
pesticides or use his home concoction on it when no one is looking?
Mr. Harrison: I don't think that that'will be a possibility. Before the stone
was placed there was no vegetation in that area. Nor any growth, except on the
extreme edge which is still maintained. I don't for see any problem or the need
for that. The stone was there to cover the mud. I don't see any need to control
it, I don't think that there will be any .growth except what is on the edge~
We would 10ok for any vegetation, as I said at that time we installed rose plantings
on the creek area. There was nothing holding the bank. We were concerned that
the bank would further erode. The stone was placed there for aesthetic reasons.
Just to add to the area until the rose plantings established. We all k~ow that
once the rose plantings are established there will be no growth there.

structure. It is deteriorated.
Trustee Kr3pski: Didn't we have a recommendation on this to increase the length
of the catwalk so that it could meet with the stone wall?
Trustee Bredemeyer: Or to provide enough elevation over the marsh so that
the catwalk could meet wit'h the stone retaining wall that is there. We want
steps to provide movement along the beach on town property. We felt that the
hight (3.5') would protect the marsh grass and be good planning for the owner.
Roy Haje: We did leave a gap for access-to and from? You want steps on either
side? Rather than up and over?

The project as proposed is quite necessary, as the inlet is closing down
very drastically with very little water at tidal stages to get through
at all. The project is a small segment of the County project, which has been
done in the past. Hopefully it will be done in the future. We just don't know
that right now. We can't count on that now. So we are proposing to do it
privately at the cost of the Association. The material will be placed along
the beach as stated in the application above the high water line. It is all
sand and similar with the material on the receiving area. We don't for see
any adverse effect there. Any questions, I will be happy to answer them.
Trustee Krupski: You didn't receive our comments. Henry and I went to the D.E.C.
meeting. We thought that maybe a better spoil site would be on the east side
of the creek, like to build a dune above MHW.
Trustee Larsen: With all of those groin fields?
.~r. Samuels: The County in the past has attempted to get permission to put
~3s'~nd on the east side and to get the construction easements that you need and
'~m were unsuccessful. The County permit which is still in force, which the D.E.C.
will not allow the Deep Hole Creek Association use, still has the spoil site on
the west side. It appears to me that thee is no way out. It would be nice to
put it on the down drift side. You have to have permission. It would be nice
Koppelmant° put it to on do the it east this side. year. Hopefully the County will get permission from
Trustee Smith: If you get permission and you do do it, and you put the spoil
to the west, can it g.o above the HWM?
Mr. Samuels: It will go above the HWM. It will go in the groin compartments.
It will fill those compartments.
Trusem Krupski: Will this be adequate to provide na~igation~
Mr. Samuels: After this summer.

Mr. Samuels: Last year people could not get in or out.
Trustee Larsen: It has really filled in.
Mr. Samuels: Five years ago we did it for the County and it cost $55,000.
on a contract basis. If it is done this year, hopefully, we're low bidder
again on the contract, we'll be able to do it. It is going to cost more.
Deep Hole Creek Association is up against the wall if they don't get County
approval. They have to follow through with the permits in case. They can't
make it through another summer like last year.
Trustee Larsen: Why don't you dig as deep in that ares. Take the point off.
Mr. Samuels: If you can get Charles Hamilton to ~gree to it we will be very
happy to do a deposition basin there. The problem is that from your lips
and the D.E.C.'s decision is a long step. We haven't been able to make that.
A letter came from the D.E.C. to dig to 4' instead of 6' If it were to 4'
I know it would not last the summer. You know the conditions there. We'd
appreciate it greatly, and I know Mr. Small would, any imput the Trustees could
give. We have a classical situation where we have an elected Board of Trustees
who have a knowledge of the area and situation then the D.E.C. who does not
have the time to make an inspection generally speaking. You have a copy of the
Tidal Wetlands Advisory Report. Thac spells it ouc very nicely. We would like
to get some imput on any projects like this. I assure you that the DPW will.
Trustee Larsen: I think we would like you to expedite the dredging. We wouldn't
like to see the dredging in the summer months.
Mr. Samuels: I agree, we would like to get the permits before the environmental
Laborwindows Day. that Mr. Hamilton might create which would put the project off until
Trustee Smith: You have the blessing of this Board to do this proj.ect.
Mr. Samuels: A letter from this Board stating that a minium of 6'should be
dredged to would be appreciated. Otherwise it will not hold this summer.
Trustee Smith: The reason we were concerned with the spoil area, we were trying to
have+ the spoil placed some place where the problem would not reoccur so quickly.
Mr. Samuels: Absolutely. It is a question of funding. The word I have been
getting is that the County Executive has placed sufficient funds in the County
Budget for this project. So I hope that it will go forward. I hope that
Broadwaters Creek will go forward also. It is a very complex problem. I don't
think that the D.E.C. is being realistic with the depths. The shallow depths
that the D.E.C. approves precludes that you will be back again to dredge.

bigger,matter. A 5' x 40' float per 36' boat is not extravagent. Boats are getting

Glenn Just: From high water about 32' out for the fixed dock. Then you have
the ramp going on to the float ifself. If you have the plan it's 30 ft. back to
the bank which is all marsh. '
