Dear Mr. Pappas:
This letter is in response to your pre-submission letter dated October 1, 2007 for a
proposed in-ground swimming pool located on the seaward side of your dwelling. The
Board of Trustees went out onto the site on October 10, 2007 to review your request and
determined that an in-ground swimming pool in this proposed locations would not be
approved, and as in accordance with the Town Code-Wetlands and Shoreline, Chapter
275.3, D - Setbacks: The minimum setbacks apply to any and all operations proposed on
residential property within the jurisdiction of the Board of Trustees: swimming pool and
related structures, 100 feet.
Any other activity within 100 feet of the wetland boundary requires a permit from this
office.
This is not a determination from any other agency.

our backyard.
Our home is at 1205 N. Parish Drive and overlooks the bay opposite Port of Egypt.
For your information, enclosed is a letter of Non-Jurisdiction-Tidal Wetlands Act that we received In 2002
and a new survey which approximates the location of a pool. .

Letter of Non-Jurisdiction - Tidal Wetlands Act

Based on the information you have submitted, the New York State Department of
Environmental Conservation has determined that:
The property that is landward of the bulkhead, which is more than 100 feet in length, and
existed on or before August 20,1977, as shown on the aerial photograph supplied by Aero-
Graphics and dated 4/6/76, is beyond the jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6 NYCRR
Part 661), no permit is required under the Tidal Wetlands Act. Pi ease be advised, however,
that no construction, sedimentation, or disturbance of any kind may take place seaward of the
tidal wetlands jurisdictional boundary, as indicated above, without a permit.
It is your responsibility to ensure that all necessary precautions are taken to prevent any
sedimentation or other alteration or disturbance to the ground surface or vegetation within
tidal wet!ands jurisdiction which may resuit from your project. Such precautions may include
maintaining an adequate work area between the tidal wetland jurisdictional bOundary and your
project (i.e., a 15 to 20 feet wide construction area) or erecting a temporary fence, barrier, or
hay bale berm.
