SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated October 10, 2007 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. TOWN CODE CHAPTER 268 EXEMPT: A letter was submitted to the ZBA dated September 27, 2007 confirming this application to be exempt under Chapter 268-3(F). SUFFOLK COUNTY SOIL AND WATER CONSERVATION DISTRICT: A letter was submitted to the ZBA dated October 1, 2007 recommending proper installation of sediment and erosion control at the site. The applicants' architect submitted a landscape grading plan dated 9-11-07 for the purpose of mitigating concerns for erosion control, sedimentation, runoff, and drainage of pool water. The landscape plan shows steps to change the grade for approximately 40 linear feet of landscape in the areas where the grade slopes (between 22 ft. and 17 ft. contours), and additional drywells for pool drainage and to prevent runoff and sedimentation from traveling into the wetland boundaries. �✓ 0 Page 2—November 1, 2007 Appeal No. 6077—M. and B.Neumann CTM 107-1-12 PROPERTY FACTS/DESCRIPTION: The applicants' 77,318 square foot non- conforming parcel is improved with an existing single family dwelling as shown on survey prepared by Joseph A. Ingegno, Land Surveyor dated November 29, 2005. BASIS OF APPLICATION: Request for a Variance under Section 280-15, based on the Building Inspector's June 28, 2007 Notice of Disapproval concerning a proposed in-ground accessory swimming pool, partly in a side yard instead of entirely in a code permitted yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 18, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Requested is a partial side yard location of a proposed 20' by 40' in-ground swimming pool, to be at least 26 feet from the southerly (side) property line and approximately 145 feet from the front lot line which borders a private right-of-way (extending from Grand Avenue). REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. A large portion of the pool will be located in a conforming yard. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicants cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The house is too close to the creek to allow placement of the pool entirely in the rear yard. Placing the pool in the front yard would render it visible to be both neighbors and would have significantly greater impact on the neighborhood. 3. Town Law §267-b(3)(b)(3). Town Law §267-b(3)(b)(5). The difficulty was not self-created. It is a result of its closeness to the creek and wetlands and the Town Trustees' requirement of a 50-foot (minimum) setback for a pool. 5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory swimming pool, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Weisman, and duly carried, to GRANT the variance as applied for, as shown on the October 16, 2007 site Drawing A-1 prepared by Frederick R. Weber, Architect, subject to the following condition: That pool equipment be enclosed within a soundproof structure or building. That the above condition be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Demolition of the older house is complete and construction of the new house is nearly complete. Due to construction activities much of the site is disturbed. However, some sediment and erosion control practices are being utilized,but have been installed improperly. The site is adjacent to Mattituck Creek and a tidal wetland. Landward of the wetland,the lot slopes upward at an approximate slope of 19 percent. The plan map of the project shows that the proposed pool elevation is 19'6". Existing ground at the landward end of the pool is elevation 23' and existing ground at the creek end of the pool is elevation 17'. There are no retaining walls or final grading contours on the plan indicating how the elevation differences will be accommodated. A drywell is proposed to accept pool filter backwash water, which will help protect the slope down to the tidal wetland. Drainage for the house,porch,terrace and garage roof are proposed. However, if the proposed patio around the pool is impervious, runoff water could cause soil erosion on the slope above the wetland. If you have any questions, please contact this office.
