WORK SESSION: 3:00 P.M.
A work session of the Board of Town Trustees was held at 3:10
P.M. on June 23, 1988 at the Town Hall, Main Road, Southold.
Present were:
President Frank A. Kujawski, Jr.
Trustee Henry P. Smith
Trustee Albert J. KrupSki, Jr.
Clerk Ilene Pfifferling
Absent: Trustee Henry Po Smith
Trustee John Bednoski, Jr.
Victor Lessard, Administrator of the Bldg. Dept. appeared before
the Trustees to discuss a proposal for the Anchor Inn project.
Glenn Just J.M.O. Consulting for the Cedar Beach Project. The
Trustees requested that Mr. Just consider reducing the scope of
the dredging for this project. Mr. Just will discuss this matter
with the applicants.
F.I. Affordable Housing Plan review - The Trustees did not
discuss this matter.
Michael Carrig for Mrs. Guiton - Mr. Carrig did not appear before
the Board.
Christopher Connors: Mr. Connors appeared before the Board to
discuss his application. The Trustees advised Mr. Connors that
the D.E.I.S. was still incomplete for review. The Board further
advised that the D.E.C. Violation has to be resolved prior to the
Board completing their review process of his application.
The Trustees completed the assessment form for the Javelera
application.
Mr. & Mrs. Walker appeared before the Trustees to discuss the
Zeidler property. The Board forwarded a letter to Mr. & Mrs.
Walker advising them that there will be an inspection by the

Trustees after the work has been completed on the Zeidler
property.

President Kujawski reported that $2,646.00 was forwarded to the
Supervisor's Office to be placed in the General Fund. He advised
that the report is available should anyone wish to review it.
President Kujawski reported that the P~blic Notices are
published on the Town Clerk's Bulletin Board for review.
III. COMMUNICATIONS:

1. From J.M.O. Consulting on behalf of Willard S. Mahood,
Fishers Island, a revised survey showing the grading plan.
Trustees reviewed the plan submitted.
2. From En-Consultants, Inc. on behalf of Anthony Panzarino, a
Long Environmental Assessment Form.
3. From Eh-COnsultants, Inc. on behalf of Christopher Connors,
information relative to his D.E.I.S. - The Board needs additional
information regarding this matter.
4. From J.M.O. Consulting on behalf of Russell Planitzer a copy
of his D.E.C. permit, along with a Notice of Complete application
for the Willard Mahood project.
5. From Jean Thompson regarding the Cove at Southold.
6. From Dennis Wo Cole, N.Y.S.D.E.C., Lead Agency Coordination
response regarding Joseph Spitaline.
7. From William D. Moore, Esq. on behalf of the Cedar Beach
application advising that authorization for the spoil site has
been rescinded. (Angel Shores property) Revisions will possibly
be made regarding this project.
8. From J.M.O. Consulting for the Cedar Beach Association
Project - spoil will be trucked to town landfill.
IV. PUBLIC HEARINGS:
7:30 P.M. - To resume the hearing in the matter of the
application of J.M.Oo Consulting on behalf of Russell Planitzer
as amended to construct a 10' x 10' Gazebo with three benches and
an earthen walking trail. Property is located on Wilderness
Point, Fishers Island.
7:32 P.M. - In the matter of the application of Gus Mueller on
behalf of the Reydon Shores Property Owners Association, Inc. to
maintenance dredge the entrance channel and to place the spoil
above M~W. Property is located on Reydon Drive, Southold.
7:34 P.M. - In the matter of the application of
En-Consultants, Inc. on behalf of Goldsmith's Boat Shop to remove
and replace in the same location and configuration 779 lin. ft.
of existing timber bulkhead all but an 80' section nearest Hobart
Road. Maintenance dredge the basin and other areas in front of
the bulkhead to grant line to 4' below mlw. Approximately 450
cu. yds. will be removed and placed on upland area of the owner's
second marina in Southold. Property is located on Hobart
Landing, Southold.
7:36 P.M. - In the matter of the application of Clifford
Eginton to construct a 50' retaining wall 13' from the monument

on the property with a return on the north side 12'; return on
the south side 8', to grade with approximately 30 cu. yds. of
backfill to be trucked in to the site. Property is located at
780 Deep Hole Drive, Mattituck.
7:38 P.M. In the matter of the application of J.M.O.
Consulting on behalf of Dr. Edouard P. Beaugard to remove
approximately 160' of timber bulkhead, reconstruct in kind/in
place and to backfill with 100 cu. yds. of clean sand to be
trucked in from an upland source. Property is located at 830
Tarpon Drive, Southold.
Approval/Denial of the Wetland/Trustee Applications.

V. LEADS:
1. DAVID MERZ - LEAD AGENCY DECLARATION
Moved by Trustee Krupski seconded by Trustee Kujawski it was
RESOLVED that the Southold Town Trustees declare itself lead
agency in regard to the State Environmental Quality Review Act in
the matter of the application of En-Consultants, Inc. on behalf
of David Merz for a Wetland Permit on certain property located on
Robinson Road, Greenport.

2. EN-CONSULTANTS, INC. ON BEHALF OF JOF~N GUTLEBER - LEAD
Moved by Trustee Smith seconded by Trustee Krupski it was
RESOLVED that the Southold Town Trustees declare itself lead
agency in regard to the State Environmental Quality Review Act in
the matter of the application of En-Consultants, Inc. on behalf
of John Gutleber for a Wetland permit on certain property located
on Lupton Point Road, Mattituck.

3. J.M.O. CONSULTING FOR LAMBERT JAVELERA - LEAD

agency in regard to the State Environmental Quality Review Act in
the matter of the application of J.M.O. Consulting on behalf of
Mr. & Mrs. Lambert Javelera for a Wetland Permit on certain
property located on Equestrian Avenue, Fishers Island.

4. ANDREW & BERNICE LETTIERI - LEAD
Moved by Trustee Bredemeyer seconded by Trustee Kujawski it was
RESOLVED that the Southold Town Trustees declare itself lead
agency in regard to the State Environmental Quality Review Act in
the matter of the application of Andrew and Bernice Lettieri
(amended application as requested) to construct a ramp and

Pleasant Inlet, Southold.

VI. ASSESSMENTS:
1. Eh-COnsultants, Inc. on behalf of Linda Wilton.
Moved by Trustee Krupski seconded by Trustee Smith it was
Resolved that the application submitted by En-Consultants, Inc.
for Linda Wilton is a significant declaration of Environmental
Significance.
Mrs. Wilton: My name is Linda Wilton. A violation was received
from the Town, nothing has been issued by the DoE.C.. We have a
Building Dept. Vacant Land C.O., this has been inspected by the
Building Dept. several times. It is a recent sub-division. The
Town has approved it, the Z.B.A. has accepted it, and so did the
Planning Board. As far as we knew, there was no reason to obtain
any other permits. Then we got the violation. Right now we are
working on clearing that up. Right now I would like to wait
until my Attorney can be present before you make any decision.
Trustee Kujawski: Can you furnish this office with copies of the
material from the Z.B.A., Planning Board, etc. that would give us
a better picture of what is going on?Mrs. Wilton: Then you will
hold that off?
Trustee Kujawski: I have no problem with that.
John Holzapfel, C.A.C.: All you are doing tonight is giving it
an assessment, it then goes to a Public Hearing a month later.
Do you know what I~m saying? You might be pushing yourself back
a month one way or the other.
Mrs. Wilton: Do you require an impact statement?
Trustee Smith: Right now, I think it would be calling it "In the
person's best interest" it is best if it were put off until next
month.
Trustee Kujawski: It would take some time to prepare a D.E.I.S.
Vote of Board: Nay: All Resolution lost.
Moved by Trustee Smith seconded by Trustee Krupski it was
RESOLVRD to table the application submitted by En-Consultants,
Inc. on behalf of Linda Wilton for one month.
Vote of Board: Ayes: All Resolution adopted.

VII. MOORINGS.
1. RICHARD PEDDLE - APPROVAL
Moved by Trustee Smith seconded by Trustee Krupski it was
RESOLVED to approve the mooring request for Richard Peddle to
place an offshore mooring in Jockey Creek, Southold, using a
deeded r.o.w, as access.

2. PATRICK MARKHAM - APPROVAL
Moved by Trustee Smith seconded by Trustee Krupski it was
RESOLVED to approve the application submitted by Patrick Markham
to place an offshore mooring in Corey Creek, Southold, using
public property as access.
Vote of Board: Ayes: All - Resolution adopted.
3. WILLIAM HINDERLITER - APPROVAL
Moved by Trustee Kujawski seconded by Trustee Smith it was
RESOLVED to Approve the mooring application for William
Hinderliter to place an offshore mooring in Mattituck Creek,
Mattituck using public property as access. The Bay Constable is
to assist in the placement of the mooring.

4. RICHARD GWYDIR - APPROVAL
Moved by Trustee Krupski seconded by Trustee Kujawski it was
RESOLVED to approve the mooring application for Richard Gwydir to
place an offshore mooring in Broadwaters Cove using public
property as access.
Vote of Board: Ayes: All - Resolution adopted.
5. MARK BAXTER - APPROVAL
Moved by Trustee Smith seconded by Trustee Kujawski it was
RESOLVED to approve the mooring application for Mark Baxter to
place an offshore stake with pulley line to onshore stake in
Goose Creek, Southold.
Vote of Board: Ayes: All - Resolution Adopted.
6. JOE MARQUARDT - APPROVAL
Moved by Trustee Krupski seconded by Trustee Kujawski it was
RESOLVED to approve the request made by Joe Marquardt to place an
offshore stake with pulley line to onshore stake in East Creek,
Cutchoque.
Vote of Board: Ayes: All - Resolution adopted.
7. JOHN A CARDONA APPROVAL
Moved by Trustee SmiTh seconded by Trustee Krupski it was
RESOLVED to approve the request made by John A. Cardona to place
an offshore stake with pulley line to onshore stake in Goose
Creek, Southold.
Vote of Board: Ayes: All Resolution adopted.
8. BENNETT ORLOWSKI, JR. - APPROVAL
Moved by Trustee Krupski seconded by Trustee Kujawski it was
RESOLVED to approve the application for Bennett Orlowski, Jr. to
place an offshore mooring in East Creek as amended to use Oak
Street as access.
Vote of Board: Ayes: All Resolution adopted.
9. GEORGE BAMBRICK - APPROVAL
Moved by Trustee Kujawski seconded by Trustee Bredemeyer it was
Board of Trustees - June 23, 1988 - Page 7.
RESOLVED to approve the application for George Bambrick to place
a mooring in Richmond Creek, Southold using public access.

IX. AMENDMENTS:
1. FRANCIS WEISENT - APPROVAL
Moved by Trustee Kujawski seconded by Trustee Bredemeyer it was
RESOLVED TO Approve the request made by Francis Weisent to
register an existing dock, ramp, ramp and float, property located
at 1925 Naugles Drive, Mattituck.
Vote of Board: Ayes: Trustees Krupski, Kujawski, Bredemeyer, Smith
Resolution Adopted. Vote of Board: Ayes: All - Resolution adopted.
2. JAMES REIDY - APPROVAL
Moved by Trustee Smith seconded by Trustee Krupski it was
RESOLVED to approve the request made by James Reidy to register
an existing dock and boat slip, 2910 Deep Hole Drive, Mattituck.

Smith - Resolution adopted.
3. JAMES REIDY - APPROVAL
Moved by Trustee Smith seconded by Trustee Krupski it was
RESOLVED approve the request made by James F. Reidy to register a
dock and boat slip, property is located at 3000 Deep Hole Drive,
Mattituck.

4. Michael P..Harben - Approval
Moved byTrustee Krupski seconded by Trustee Kujawski it was
RESOLVED to approve the request made by Michael P. Harben a to
transfer his mooring from a pulley type to a mushroom mooring,
East Creek, Cutchog~e.
Vote of Board: Ayes: Trustees Krupski, Kujawski, Bredemeyer,
Smith - Resolution adopted.
5. From John T. Wetzel a request to amend their application to
reflect a 3' x 12' float. The Trustees did not act on this
matter as the Trustees accepted the application the way it is now.
6. WILLIAM BEAL - APPROVAL
Moved by Trustee Smith seconded by Trustee Bredemeyer it was
RESOLVED that the Trustees approve the request made by William
Beal to amend his permit to fill on his property to raise the
grade with the provision that he maintain the grade away from the
creek. Property is located on New Suffolk Ave., New Suffolk.
Vote of Board: Ayes: Trustees Krupski, Kujawski, Bredemeyer,
Smith - Resolution adopted.
7. JEANNE FENKL DENIAL
Moved by Trustee Bredemeyer seconded by Trustee Krupski it was
Board of Trustees - June 23, 1988 - Page 8.
RESOLVED that the Trustees DENY the request made by Jeanne Fenkl
to amend a dock permit to reflect a 6'x 145' dock, 3' x 15'6"
ramp and a 6' x 20' float in Mattituck Creek, Mattituck. Vote of
Board: Ayes: All - Resolution adopted.
President Kujawski advised that a letter will be forwarded to
Mrs. Fenkl advising that the structure does not agree, with the
permit that was issued, therefore the permit is revoked until the
structure is built in accordance with the application that was
submitted.
8. En-Consultants, Inco for Philip Salice - Disapproval
Moved by Trustee Kujawski seconded by Trustee Krupski it was
RESOLVED TO Disapprove the request made by En-Consultants, Inc.
for Philip Salice requesting an amendment to allow a different
configuration of the dock than what was approved previously. This
determination was made based on a personal inspection by the
Board and also a report by the Bay Constable that there is 3 to
5~ of water on an incoming tide.
Vote of Board: Ayes: Trustees Krupski, Kujawski, Bredemeyer,
Smith - Resolution adopted.
9. WINIFRED SAYI{E - AMENDMENT
Moved by Trustee Krupski seconded by Trustee Smith it was
RESOLVED to approve the deed submitted reflecting the new owners
and to amend permit no. 2090 of Winifred Sayre to reflect the
names Charles W. & Geraldine Riesterer, Calves Neck Road,
Southold.
Vote of Board: Ayes: Trustees Krupski, Kujawski, Bredemeyer,
Smith - Resolution adopted.
WAIVERS:
1. VENITIA MCKEIGHAN - APPROVAL
Moved by Trustee Smith seconded by Trustee Bredemeyer it was
RESOLVED that the Trustees approve the request made by McKeighan
to construct a 9' x 6' deck on the second floor of her residence
located at 495 Bay View Ave., Southold.
Vote of Board: Ayes: Trustees Krupski, Kujawski', Bredemeyer,
Smith - Resolution adopted.
2. G.W. Bornschein - Approval
Moved by Trustee Kujawski seconded by Trustee Bredemeyer it was
RESOLVED that the Trustees approve the request made by G. W.
Bornschein for a waiver to construct an extension on the rear of
his residence located at 560 Oak Street, Cutchogue.
Vote of Board: Ayes: Trustees Krupski, Kujawski, Bredemeyer,
Smith- Resolution adopted.
3. PETER R. STOUTENBURGH - APPROVAL
Moved by Trustee Krupski seconded by Trustee Smith it was
RESOLVED that the Peter R. Stoutenburgh on behalf of John
Mulholland requesting a waiver to construct an addition to an
existing residence on property located at 725 Island View Lane,
Greenport with the provision that they discontinue the mowing of

the wetland grasses thirty feet from the flagged stake landward
on the property.
Vote of Board: Ayes: Trustees Krupski, Kujawski, Bredemeyer,
Smith - Resolution adopted.
DETERMINATIONS:
Daniel Kelly requested a determination on the need of a permit
for work to be done. The Trustees met with Mr. Kelley and it was
determined that a wetland permit will be necessary for work to be
done on his property.
Richard Mohring - Determination of jurisdiction for house
construction - It was determined after an on-site inspection that
this project is out of the Trustees jurisdiction.
K & K Lawn Care on behalf of Patricia A. Castoldi requesting a
determination of jurisdiction for work on property located on
Ford Road, Southotd. The Trustees inspected the site and
determined that they have no jurisdiction in this matter.
Edward Bebany to construct an enclosed deck on property located
at 1370 Lighthouse Road, Southold. - determination of
jurisdiction. The Trustees inspected the property and it was
dete£1~ined that the work is out of Trustees jurisdiction.
Trustee Bredemeyer discussed the DeGaudenzi and Leggio matters.
These matters will have to be investigated further.

not looked at the plans for the gazebo°
Trustee Bredemeyer: Mr. Just do you think that the applicant
will come in for the pond improvements in the future?
Mr. Glenn Just, J.M.O. Consulting: To be honest with you, it will
never happen. As you know, there has been a lot of public
comment regarding that application. Mr. Planitzer backed down on
that applicationbecause of my suggestion to him.
Trustee Bredemeyer: It just seems like a shame to me. I thought
that this Board was possibly in a position to use the matter as
an improvement for h~hitat diversification. I think of all the
groups out there that would support such a move, Ducks Unlimited,
etc. I'm surprised that we did not hear anything positive from
the D.E.C.. I would think that it would provide more fringe.
Provide the possibilities for endangered species. I just think
that we lost an opportunity here. I felt very bad about this
application.
Mr. Glenn Just, J.M.Oo Consulting: We did a lot for him. We
hired someone who worked for the Dept. of Agriculture for 15
years for the soil.
Trustee Bredemeyer: Maybe over time the people will see that he
is a good neighbor to the Wetland system and he will have another
opportunity for it.

NOTICE IS HEREBY GIVEN THAT A PUBLIC HEARING WILL BE HELD BY THE
TOWN TRUSTEES OF THE TOWN OF SOUTHOLD, AT THE SOUTHOLD TOWN HALL,
MAIN ROAD, SOUTHOLD, NEW YORK ON THURSDAY, JUNE 23, 1988 ON THE
FOLLOWING APPLICATION FOR A PERMIT UNDER THE PROVISIONS OF THE
WETLAND ORDINANCE OF THE TOWN.
IN THE MATTER OF THE APPLICATION OF CLIFFORD EG1NTON TO CONSTRUCT
A 50' RETAINING WALL 13' FROM THE MONUMENT ON THE PROPERTY WITH A
RETURN ON THE NORTH SIDE 12"; RETURN ON THE SOUTH SIDE 8; TO
GRADE WITH APPROXIMATELY 30 CU. YDS. OF BACKFILL TO BE TRUCKED IN
TO THE SITE. PROPERTY IS LOCATED AT 780 DEEP HOLE DRIVE,
MATTITUCK.
Trustee Kujawski: Is there anyone here to speak on behalf of
this application? Mr. Eginton do you wish to speak?
Clifford Eginton: I just want to see this approved.
Trustee Kujawski: Are there any comments, C.A.C.?
John Holzapfel, C.A.C.: We were torn about this, we did not see
a real need for this. The consensus was that we did not see
areal need for this. Revegetation either at the foot of this or
on it itself would accomplish the same purpose.
Trustee Kujawski: We had talked about that at the site. It gets
a rapid flow through there. The whole basin empties out of that
20 ft. area on an outgoing tide and incoming tide. We felt that
it would be tough to revegetate it there because the basin
narrows down. Mr. Eginton did move this back quite a bit on his
own property. Some of our worries were mitigated, I guess that
is the proper word. Do any of the Trustees have anything to add?
No comment. I think this will also be low profile to be kept in
line with the lawn.
Mr. Eginton: Right.
Trustee Kujawski: Hearing no other comments, I will close this
hearing.
