Smith DISCUSSION: Orient Wetlands - Trustee Bredemeyer discussed this matter with the Trustees. It was decided that a letter will be forwarded to the D.E.C. requesting a joint meeting to discuss this matter further. Review of Assessment Forms - The Trustees are going to wait for the Town Attorney's input regarding this matter. Donald Cox - Matt-A-Mar Marina - The Trustees requested that Mr. Cox submit a notarized statement that the South side of the marina will not be expanded further and the number of boats is to be limited to 91. Daniel Stegner Application No. 619 - The Trustees discussed this application with Mr. & Mrs. Stegner. A letter was submitted, as part of the file, stating that hay bales will be placed on the property first, then they will replace the bul~head in kind/in place and fill on the site prior to the houSe construction. Mrs. Wetzel appeared before the Trustees to discuss her application. The Trustees suggested changes to the application and requested that a new plan be submitted for the file. Moved by Trustee Bednoski seconded by Trustee Krupski it was RESOLVED to Approve the minutes of the March 24, 1988 meeting, April 14, 1988 work session, April 21, 1988 Organizational and Regular minutes. Moved by Trustee Krupski seconded by Trustee Bednoski it was RESOLVED to Approve the June 1988 mooring renewals. President Kujawski gave the report as follows: Application and Waiver Fees $325.00, Dock Fees, $656.00, Wetland Inspection Fees, $10.00, Wetland Application Fees, $1050.00, Mooring Renewals, $645.00 for a total of $2686.00 collected and turned over to the Supervisor's Office to be placed in the General Fund. JOAN & JOHN WETZEL - LEAD DECLARATION Moved by Trustee Krupski seconded by Trustee Kujawski it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Joan & John Wetzel for a Wetland Permit on certain property located at 4635 Pequash Ave., Cutchogue. It is noted for the record that the application will be modified considerably in length and in the type of project submitted over the course of the next month. JOSEPH POLICANO In the matter of Joseph Policano a letter will be forwarded to Mr. Policano advising him that if he wants to revegetate the property and take care of the house and worrt about clearing the last 75' of the property he would not need a permit, but if he chooses to clear out down to the wetlands before it is revegetated then the application will be necessary. The applicant will have to ask for a waiver when he wishes to clear on the property. 7. J.M.O. It is noted for the record that the concerns are with the spoil site and slumping in addition to the magnitude of the dredging proposed. 6A. J.M.O. SIGNIFICANT ENVIRONMENTAL DECLARATION Date: May 25, 1988 Pursuant to the provisions of Article 8 of the Environmental Conservation Law, Part 617 of Title 6 of the New York State Codes, Rules and Regulations, and Chapter 44 of the Southold Town Code, the Southold Town Trustees, as Lead Agency does hereby determine that the action described below is a Type 1 Action and may have a Significant Effect on the Environment. Application No. 588 B~ard of~Trustees - 6/25/88 - Page 1O. Name: J.M.O. Consulting for Ellen Guiton Address: Grand Ave., Mattituck, New York 11952 Description of Action: to construct 310' of timber retaining wall with a 20' return at either end and to backfill structure with approximately 350 cu. yds. of clean sand to be trucked in from an upland source. Vote of Board: Ayes: Ail - Resolution adopted. It is noted for the record that the Trustees requested a long assessment form.in addition to a work plan of how the proposed activity will take place and how the wetlands in front will be protected during the construction. It is also noted for the record that President Kujawski asked if Mr. Guiton wished to amend his application as per discussion while on field inspections? Mr. Guiton advised that it was not his intention now. He advised that he was advised that this was a sound application. If he wished to amend the application, he would have to reapply all the plans and submit again to the D.E.C. for approval. President Kujawski advised that the from the consensus of the Board, this is a project that could be mitigated. A project with less impact would probably not be a problem. We mentioned a 2' or 3' and we also spoke about a 4' wall. The Trustees left it up to you to discuss with your agent. VII. WAIVERS: 1. Waiver request by Claire L. Woolley, r.o.w, off Main Bayview Road, Southold. To add an 11' extension onto the back of her residence. Moved by Trustee Kujawski seconded by Trustee Krupski it was RESOLVED that the Town Trustees approve the request made by Claire L. Woolley for a waiver of the Wetland Ordinance to add 11' on to the rear of an existing residence on property located on a r.o.w, off Main Bayview Road, Seuthold. Vote of Board: Ayes: All - Resolution adopted. 2. Waiver request by Henry P. Smith to place an accessory storage shed on property located on Hobart Road, Southold. Moved By Trustee Krupski seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees approve the request made by Henry P. Smith for a Waiver of the Wetland Ordinance to place an 8' x 12' tool storage shed on property located on Hobart Road Southold. Vote of Board: Ayes: All - Resolution Adopted. 3. J.M.O. Consulting on behalf of H. Daniel Jones, Home Pike Road, Mattituck - house construction. The Trustees determined, after an on site inspection, that this project was out of Trustee jurisdiction. 4. DANIEL & PATRICIA STEGNER - 1000-78-6-10.3 Waiver , Board of Trustees - 6/25/88 - Page 11. Moved by Trustee Kujawski seconded byTrustee Bednoski it was RESOLVED that the Southold To~.~ Trustees Waiver the need of a wetland permit as requested by Rudolph H. Bruer on behalf of Daniel & Patricia Stegner to construct a single family dwelling and to replace in kind and in place a timber bulkhead and to fill on the property located on a r.o.w, off Main Bayview Road, Southold. The Trustees have as part of the file, a letter from Mr. & Mrs. Stegner stating that they will place the timber bulkhead and fill on the site, prior to the house construction in addition to placing hay bales on the property prior to construction. Vote of Board: Ayes: All - Resolution adopted. VIII: MOORINGS: 1. John Hoins to place an offshore mooring in Narrow River, Orient using public access. Moved by Trustee Bredemeyer seconded by Trustee Kujawski it was RESOLVED to Approve the request by John Hoins to place an offshore mooring in Narrow River, Orient. Vote of Board: Ayes: All Resolution adopted. 2. Paul Galgan to place an offshore mooring in East Creek, Cutchogue using private access. Moved by Trustee Krupski seconded by Trustee Bednoski it was RESOLVED to approve the mooring request for Paul Galgan to place an offshore mooring in East Creek, using private property as access. Vote of Board: Ayes: All - Resolution Adopted. 3. R. Friedland to place an offshore mooring in East Creek, CutchoQ~e using private (deeded r.o.w.) as access. Moved ~y Trustee Krupski seconded by Trustee Bredemeyer it was RESOLVED to approve the request made by R. Friedland to place an offshore mooring in East Creek, with the provision that fore and aft moorings are used. Vote of Board: Ayes: A~i - Resolution Adopted. 4. Thomas C. Buckley to place an offshore mooring in Gull Pond, Greenport, using public access. Moved by Trustee Bredemeyer seconded by Trustee Kujawski it was RESOLVED to TABLE the application of Thomas C. Buckley pending a further review of the moorings in that creek. Vote of Board: Ayes: All - Resolution adopted. 5. Charles V. Danilczyk to place an offshore mooring in Pleasant Inlet using private property as access. Moved by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to Approve the application of Charles V. Danilczyk to place an offshore mooring in Pleasant Inlet using private · Bgard of Trustees - 6/25/88 - Page 12. property as access with the provision that the Bay Constable review the location. Vote of Board: Ayes: All - Resolution adopted. 6. John J. Jernick to place an offshore stake with pulley line to onshore stake using public property as access. Moved by Trustee Kujawski seconded by Trustee Bednoski it was RESOLVED to approve the mooring for John J. Jernick to place an offshore stake with pulley line to onshore stake subject to the review by the Bay Constable. Vote of Board: Ayes: All - Resolution Adopted. IX. AMENDMENTS: 1. J.M.O. Consulting for Joseph Henderson to place two pilings in West Harbor, F.I. - request to amend permit No. 435. Moved by Trustee Bredemeyer seconded by Trustee Kujawski it was RESOLVED to approve the request by J.M.O. Consulting for Joseph Henderson to place two pilings in West Harbor, F.I.and to amend the permit accordingly. Vote of Board: Ayes: All Resolution Adopted. 2. Salt Lake Association requesting an extension on permit No. 388, Old Salt Road, Mattituck. DETERMINATIONS: In reference to D.B.M. and the Gazza matter: President Kujawski spoke to Mr. John Holzapfel, President, Southold Town Conservation Advisory Council in reference to the Conservation Advisory Council staking out the Wetlands. Mr. Holzapfel advised Mr. Kujawski that he felt that this job was not a job for the C.A.C. that they felt this job was the Trustees job. Mr. Kujawski advised that it was his feeling that the Trustees should not be staking areas of jurisdiction, and then acting on those applications in that jurisdiction. It is sort of a conflict of interest. You know if you stake it one way, the project doesn't fall in our jurisdiction, if you stake it the other way .... Mr. Holzapfel said he understood. P~esident Kujawski said that, perhaps this could be taken back to the C.A.C., that it was the job of the C.A.C. to advise all Town Agencies. He said that he could remember back in the 70's that most of the C.A.C.'s time was taken up with the Planning Board. Trustee Bredemeyer advised that the we have tried to get together with the C.A.C. on a few inspections.
