HENRY RAYNOR ON BR~ALF OF THE OYSTER F~3C~ ASSOCIATION: Mr. Raynor explained his proposal, on behalf of the Oyster Farm Association, to the Trustees. He emphasized that this is a very preliminary plan~ and explRined that this is an existing marina. The Trustees advised Mr. Raynor that they would try to set up a meeting with the D.E.Co on the site to review the proposal as part of the pres~bmission conference. MR. GLRNN JUST, J.M.O. CONSULTING AND MR. ROBERT ERMERINSt ROBERT STERN ARCHITECTS appeared before the Board regarding the application for Russell Planitzer. The Trustees will meetwith the Conservation Advisory CoUncil, Mr° John Thatcher, Glenn Just, and Robert Ermerins on the site to discuss the matter further. The Board commenced with the regular meeting at 7:10 P.M. REGULAR MEETING The regular meeting of the Board of Town Trustees was held on March 24, 1988 at the Southold Town Hall, Main Road, Southold. President Bredemeyer introduced the members of the Board and other Town Officials that were present at the meeting as follows: Bay Constable Donald Dzenkowski, Trustee John Bednoski, Vice-President Albert Krupski, Clerk Ilene Pfifferling, Trustee Henry Smith and John Holzapfel, Chairman of the Conservation Advisory Council. President Bredemeyer opened'the meeting with the Pledge to the Flag~ President Bredemeyer advised that the Field Inspections will be held on April 14, 1988 to commence at 9:00 a.m. to depart from Board of Trustees - March 24, 1988 - Page 2. the Town Hall, Main Road, Southold. The Trustees will convene a work session at 2:00 p.m. to be held at Town Hall on the 14th also. The next regular meeting will be held on April 21, 1988 to commence at 7:00 p.m. at the Town Hall, Main Road, Southold. ~roval of the Februar~ 24, 1988 minutes. Moved by Trustee Smith seconded by Trustee Krupski it was RESOLVED to APPROVE the minutes of the February 24, 1988 meeting. -~ Board: Ayes: Trustee Krupski, Trustee Bednoski, Trustee Bredemeyer, Trustee Smith: adopted. Vote This resolution was declared duly Approval of the April 1988 mooring renewals. Moved by Trustee Smith seconded by Trustee Bednoski it was RESOLVED to APPROVE the April mooring renewals. Vote of Board: Ayes: All - This resolution was declared duly adopted. I. REPORT: Trustee Bredemeyer gave the monthly report as follows: Application fees $75.00, Bulkhead fees $482.00, Wetland Inspection fees $80.00, Wetland Application fees $750.00, and Mooring Renewal Fees $250.00 for a total of $1637.00 collected. II. PUBLIC NOTICES: Public Notices are printed on the Town Clerk's Bulletin Board for review. III. COMMUNICATIONS: President Bredemeyer asked Trustee Bednoski to read the correspondence as follows: 1. From J.M.O. Consulting on behalf of Russell Planitzer, information relative to the test borings done on the site. 2. From Rosemary Shea, Fish & Wildlife Technician, N.Y.S.D.E.C. regarding the D.E.C. Tentative Freshwater Wetland Maps. 3. From En-Consultants, Inc. on behalf of John Dwyer a request to amend the approval of said application. Moved by Trustee Smith seconded Bednoski it was RESOLVED to approve the request made by En-Consultants, /nc. on behalf of John Dwyer to amend his permit No.447 as per the revised plan, dated February 17, 1988. Vote of Board: Ayes: Trustee Bredemeyer, Trustee Bednoski, Trustee Smith. Abstained: Trustee Krupski- This resolution was declared duly adopted. Board of Trustees - March 24, 1988 - Page 3, 4. From Town Atorney James A. Schondebare regarding Liability Insurance. 5. From Gerard H. Schultheis a request to amend his permit for the inclusion of cesspools on the site. Moved by Trustee Bednoski seconded by Trustee Krupski it was RESOLVED to amend the permit No. 439 to include (2) 2' deep pools at least 2' above spring high tide to be installed on property located in New Suffolk. An engineer's drawing is to be submitted to the office for the file to show compliance with the Suffolk County Health Dept. in that the 4' deep cesspool rings on the site would not be in conformity with the Health Dept. regulations for a shallow pool system. Vote of Board: Ayes:All - This resolution was declared dulv ~dopted. 6. From Fred W. Howell, Chief, Environmental Quality Review Section, Division of Regulatory Affairs, N.Y.S.D.E.C. regarding Critical Environmental Areas. 7. From Charles Beckert, Henderson and Bodwell, comments on the Angel Shores Project. Trustee Krupski read the letter from Mr. Becker. 8. From Merlon E. Wiggin, President, Peconic Associates regarding the Joseph F. Citardi project. 9. From Freddie Wachsberger, Vice-President, Orient Association regarding Hallock's Bay. 10. From William G. Hastback, Marine Resources Specialist, N.Y.S.D.E.C. advising that he has taken over for James Redman regarding Shellfish Programs. Trustee Bredemeyer advised that Mr. Hastback will be helping out to try to continue the conditional permit. 11. From Roger & Donna McCarvill a request for a "Lite Buoy" outside of Corey Creek, Southold. 12. From Cecila Loucka regarding projects on Main Ba!rview Road, Southold. 13. From Stephen Reale information regarding permit No. 385. Mr. Reale appeared before the Board regarding this matter. Moved by Trustee Bredemeyer seconded by Trustee Bednoski it was RESOLVED to Amend the permit for Stephen Reale to reflect a 8' x 16' float the other float will have to be removed from the site. A new drawing is to be submitted for the file. Vote of Board: Ayes: All - This resolution was declared duly adopted. 14. From Lewis L. Edson a request to review the survey regarding property on Clearwater Ave., Southold. Moved by Trustee Krupski seconded by TruStee Bredemeyer it was RESOLVED to Approve the survey as submitted by Lewis L. Edson for property located on Clearwater Avenue, Southold with the Board of Trustees - March 24, 1988 - Page 4. provision that the berm on the water side of the property is maintained to prevent any run-off from entering the creek. Vote of Board : Ayes: All - This resolution was declared duly adopted. 15. From Councilwoman Larsen a memo regarding the Cedar Beach dredging. President Bredemeyer called for a recess of the regular meeting in order to hold the following Public Hearings on the applications for Wetland Permits. It is noted for the record that all transcripts of the hearings have been prepared verbatim under separate cover and filed simultaneously with the Town Clerk's office with these minutes for reference. PUBLIC HEARINGS: 7:30 P.M.- In the matter of the application of Miriam & Robert Klotz for a wetland permit. 7:32 P.M. - In the matter of the application of Latham Sand and Gravel, Inc. on behalf of Robert Hulsman for a wetland permit. 7:34 P.M. - In the matter of the application of En-Consultants, Inc. on behalf of Lawrence Huke for a wetland permit. 7:36 P.M. -In the matter of the application of William D. Moore, Esq. on behalf of Ernest & June Pappas for a wetland permit. APPROVAL/DENIAL of the Wetland /Trustee Applications. (see page 14,15 & 16 for approvals.) Regular meeting resumed. The Trustees proceeded with the Leads as follows: V. LEADS: The Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the following applications for wetland permits as follows. It is noted for the record that these projects are tentatively unlisted actions. 1. .~arrett A. Strang on behalf of Mr. & Mrs. Bernard Kiernan Moved by TruStee Smith seconded byTrustee Bredemeyer it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Garrett A. Strang on behalf of Mr. & Mrs. Bernard Kiernan to construct a catwalk, dock and floating dock on property located on North Parish Drive, Southold, and Board of Trustees - March 24, 1988 - Page 5. The Town Trustees approve the request made by Garrett A. Strang on behalf of Mr. & Mrs. Bernard Kiernan for a Waiver of the Wetland Ordinance for the deck, gazebo and stairs behind the bulkhead. Property is located on North Parish Drive, Southold. Vote of Board: Ayes: All - This resolution was declared duly adopted. 2. Costello Marine on behalf of John Vassil - Lead Moved by'Trustee Bednoski seconded by Trustee Smith it was RESOLVED that the Southold Town Trustees declare itself Lead Agency in regard to the application of Costello Marine on behalf of John Vassil to reconstruct a bulkhead in kind and in place and to fill on the site. Property is located on Salt Lake Lane, Mattituck. Vote of Board: Aves: All - Resolution adopted.. 3. Eh-COnsultants, Inc. on behalf of Janet Swanson - Tabled Moved by Trustee Smith seconded by Trustee Bednoski it was RESOLVED that the Town Trustees TABLE the application in the matter of Janet Swanson to construct a timber retaining wall with returns and to armor the structure with stone. Property is located on Ryder Farm Lane, Orient. Vote of Board: Aves: Ail - Resolution adopted. 4. Wilhelm Franken - Tabled application Moved by Trustee Bednoski seconded by Trustee Bredemeyer it was RESOLVED that the Town Trustees TABLE the application of Wilhelm Franken to maintenance dredge approximately 300 cu. yds. of material. Property is located at 965 Osprey Nest Road, East Marion. The Trustees requested a new plan for the project. Vote of Board: Ayes: Ail - Resolution adopted. 5. Henry E. Raynor, Jr. on behalf of the Oyster Farm Associates In the matter of Henry E. Raynor, Jr. on behalf of the Oyster Farm Associates by Neted of America, Ltd. to dredge, enlarge and bulkhead the existing marina basin on property located on the east side of Shipyard Lane, East Marion, the Trustees will review this proposal further before they take any action on this project. 6. Roger & Dorothy L~mour - Lead Moved by Trustee Smith seconded by Trustee Bednoskiit was RESOLVED that the Southold Town Trustees declare itselflead agency in the matter of Roger W. & Dorothy Lamour to install a floating dock with a ramp from an existing bulkhead. Property is located at 1690 North Bayview Road, Southold. Vote of Board: Ayes: All - Resolution adopted. Board of Trustees - March 24, 1988 - Page 6. 7. Daniel Steaner - Tabled Moved by Trustee Bredemeyer seconded by Trustee Krupski it was RESOLVED that the Southold Town Trustees TABLE the application in the matter of Daniel Stegner to replace a bulkhead and to fill (to be in line with the neighboring bulkhead) and to construct a house. Property is located on a r.o.w, off Main Bayview Road, Southold. The Trustees want a survey depicting one foot contours and a more legible application for review. Vote of Board: Ayes: All - This resolution was declared duty .adoDted. 8. ~J.M.O. Consultina on behalf of the Cedar Beach Park Association, Inc. - L~ad. Moved by Trustee Krupski seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees declare itself lead agency in the matter of J.M.O. Consulting on behalf of the Cedar Beach Park Association, Inc. to maintenance dredge an existing channel to 4' at mlw. Spoil (1025 cu. yds.) will be trucked to an upland site. Property is located at Stillwater Lake Inlet, Cedar Beach, Southold. Vote of Board: Ayes: All - Resolution adopted. 9. J.M.O. Consultinq on behalf of Will, rd S. Mahood - TABLED Moved by Trustee Bredemeyer seconded by Trustee Krupski it was RESOLVED that the Southold Town Trustees TABLE the application of Willard S. Mahood, Fishers Island, to construct a single family dwelling, sanitary system, decking and lawn. The Trustees will inspect for jurisdiction. Vote of Board: Ayes: All - Resolution adopted. IV. ASSESSMENTS: 1. JAMES F. MURPHY, JR. - NEGATIVE DETERMINATION Moved by Trustee Smith seconded byTrustee Krupski the following determination was declared: NEGATIVE DECLARATION ~OTICE OF NO-SIGNIFICANT EFFECT ON THE ENVIRONMENT Date: March 24, 1988 APPLICATION NO.: 609. NAME: JAMES F. MURPHY, JR. This notice is issued pursuant to the provisions of Article 8 of the Environmental Conservation Law State Board of Trustees - March 24, 1988 - Page 7. Waldron~ Jr. as requested to reconstruct a deck (38' x 12') on property located at 2980 Ole Jule Lane, Mattituck. Vote of Board: Ayes: All - resolution adopted. 2. Moved by Trustee Bednoski seconded by Trustee Bredemeyer it was RESOLVED that the $outhold Town Trustees Approve the request made by .~n-Consultants, Inc. on b~half of Mattituck Inlet Marine Inc~for a waiver to make various modifications to the existing office located on Mill Road, Mattituck as per the plan submitted dated Jan 23, 1987. Moved by Trustee Krupski seconded by Trustee Smith it was RESOLVED that the Southold Town Trustees DENY the request from Murray & Neil ~chlussel for a waiver to construct a single family residence on property located on Stillwater Avenue, Cutchogue, because it is a substantial project within 75' of tidal wetlands. Feiler on behalf of Gannon for a waiver to construct additions to an existing residence un property located on Youngs Drive, Laurel. Vote of Board: Ayes: All - Resolution adopted. 6. Moved by Trustee Bredemeyer seconded by Trustee Krupski it was RESOLVED that John A. Bertani on behalf of Joseph J. & Marianne Macy are granted a waiver to construct a deck addition to a residence located on Inlet Lane, Greenport. Vote of Board: Ayes: Trustees Bredemeyer, Krupski, Bednoski - Abstained: Trustee Smith - Resolution Adopted. 7. Moved by Trustee Smith seconded by Trustee Bredemeyer it was RESOLVED to DENY the request from Robert G. Egan for a waiver to construct a timber retaining wall in front o~ a concrete wall on property located on Knoll Circle, East Marion. Vote of Board: Ayes: All - resolution adopted. The Trustees will forward a letter to Mr. Egan advising him that the Trustees consider an in-kind, in-place replacement of the structure as a repair, whereas it is a substantially existing structure. Moved by Trustee Smith Smith seconded by Trustee Krupski it was RESOLVED that the Southold Town Trustees Approve a Waiver for all Suffolk County Dredain~ Proiects for maintenance dredging projects as reviewed by the Southold Town Dredge Committee. Moved by Trustee Smith seconded by Trustee Krupski it was RESOLVED that the Southold Town Trustees Approve the request made by ~rank Galalis to place an offshore mooring in Goose Creek, Southold using private property as access. ~Vote of Board: Ayes: All - This resolution was declared duly dopted. 2. Moved by Trustee Krupski seconded by Trustee Smith it was RESOLVED to Approve the request made by David J. Zazeski to place an offshore stake with a pulley line to onshore stake in Mattituck Creek using public property as access. Vote of Board: Ayes: Ail - Resolution adopted. 3. Moved by Trustee Krupski seconded by Trustee Bredemeyer it was RESOLVED that the Town Trustees Approve the request made by Douqlas Ian Shaw. to place an offshore mooring in Howard's Branch of Mattituck Creek using a private (deeded) r.o.w, as access. Approval is subject to the applicant submitting a copy of his deed and placement of the mooring to be made by the Special Bay Constable. Vote of Board: Ayes: All - resolution adopted. IX. Vote of Board: Ayes: All - Resolution adopted. 5. From Patricia C. Moore, Esq. a request for an extension on ..a permit for Barbara & Peter Herz, 170 Cedar Point Drive East, f. Southold. Said permit will expire on February 26, 1989. ~ote of Board: Ayes: All - Resolution adopted. DETERMINATIONS AS REQUESTED FOR: GeorGe H. Starkie, Jr., 630 Tarpon Drive, Greenport, house construction. The Trustees inspected the site and it was determined that the Board has no jurisdiction in this matter. Board of Trustees - March 24, 1988 - Page 12. ~ARS TORERLSEN - WAIVER Moved by Trustee Krupski seconded by Trustee Bednoski it was RESOLVED the Southold Town Trustees Approve the request made by Lars Torkelsen for a Waiver of the Wetland Ordinance to construct a 12' x 40' deck on his residence located at 1130 Glenn Road, Southold. Vote of Board: Ayes: All - Resolution adopted. Francis O'Malley/Bayberry Estates - A reco,~,,endation to the Planning Board. The Trustees forwarded the following comments regarding this matter: 1. No drainage discharge into the wetlands. Discharge is to be made to man made drainage areas and should have pretreatment if possible. 2. The Wetland Line does not appear identified as to agency? The Trustees would like a Trustee/NYSDEC approved line with a 100' buffer minimum around same. 3. John Ho]zapfel, Chairman of the Conservation Advisory Council: I would like to point out that the Conservation Advisory Council is against putting the bulkhead up there. They felt that it was not an absolute necessity. Trustee Bredemeyer: Okay, is there any other discussion on this application? Trustee Krupski: Yes, I would like to comment. The D.E.C.'s position of establishing a solid line there seems like an excuse to extend the property out further there. The further you extend the property out into the bay the more problems you-will have in the future. Trustee Bredemeyer: It wasn't actually extended into the bay, it was landward of high water. Trustee Krupski: To bad there wasn't someone here to discuss this application-. Mr. H~nds: I'm an adjoining property owner there. In fact, there are a few of us that are awaiting this because we Would like to put in bulkhead also. There is any existing bulkhead there by the Sagalister's which is about I would say, 4 or 5ft. above the high water mark. Even when the hurricane came, a few years ago the tide hit it and it sprayed but it did not come over the bulkhead. A~-~an adjoining property owner we are loosing that bank. ' Trustee Bredemeyer: It is a toe failure situation. Mr. Hands: We are loosing property every year. Trustee Krupski: That is apparent. In my mind about the need. The D.E.C. did not find any need for erosion. John Holzapfel: Again, we were not in favor of bulkheading. Rip-rap would have been our choice again. Just to break the wave action. It was not that we were against the bulkhead. It is erosion, there is not doubt about that. Trustee Bredemeyer: We voted for a rock revetment for one of the neighbors. Then we heard that there may be C & R's in that subdivision against using anything but bulkheading. I don't know if it is true, it wasn't verified? We did call the D.E.C. to ask their position and they indicated that they would perfer to have a unit structure because of reflected waive energy. The Trustees inclination was to try to have a bulkhead as close to the toe of the bluff as possible. John Holzapfel: Now did they tell you to make it one solid line, or to indent it? I haven't heard this? John Bredemeyer: I have the name, it was Suzanne Rohl, Coastal Erosion Section, she advised us to determine its compliance with flood plain regulations and they wanted permit consistency with the existing permits that were let for the neighboring lots. They were concerned that a failure would lead to a failure of all the neighboring lots particularly if they were bulkheads. That is why they wanted a stable line. This is border line on a fairly high wave energy area. They felt that it was a substantial enough structure was there, 'like the Sagalister's, and they felt this kind of construction was good, but if it was not placed in line it would not be good. Mr. Hands: There are five of us that are interested in the bulkhead. It is my understanding that the bulkheads have D.E.C. approval and with their approval the rest of us can kind of.. Trustee Krupski: How long ago did the Sagalister's have that bulkhead. Mr. Hands: Somewhere between 15 and 20 years. Trustee Bredemeyer: I don't believe it was quite that long. I think it was 10 or 127 Mr. Hands: No, it was longer than that. The house was built and then the bulkhead was subsequently built. Trustee Bredemeyer: Maybe 15 years? Mr. Hands: I would say 15 easy, and that can be proven. Trustee Bredemeyer: Sure. Mr. Hands: What you have is Bob Douglas who has the big stone wall, rock and everything else that swings back in. We are not asking to go partyout into. the water. I am not representing the Hulsman~s, I'm just an interested Trustee Bredemeyer: Maybe the interests of the D.E.C. could be met by attaching to the Sagalister's and then bringing back at the easter end as close to the toe of the bluff so that we don't continue the line that much more seaward from what the toe is presently. Trustee Krupski: I'm not comfortable with a solid structure. I would rather see the rock revetment. I would rather see that continued. It doesn't matter if one area is out a little more tl~an the other, that wave energy instea8 of being reflected the wave energy is absorbed by the surface of the rock. I don't know if you are familiar with the rock revetment? Mr. Hands: I'm not. My question is what is wrong with the structure that is there? Trustee Krupski: The bulkhead represents a very solid structure. When the wave energy hits it, it is deflected down and it scours out the beach in front of it. Mr. Hands: I have lived there for a long time. Trustee Bredemeyer: In any case why don't we close the discussion and recess this hearing. The hope is to build this 18' high storage building 18' x 25' footprint and if you have any questions, I will be happy to answer them. I don't think that we will affect the wetlands there. We are no closer to the wetlands than the existing building there.
