Box 728 Southold, New York 11971 TELEPHONE ~516) 765-1892 JANUARY 21, 1988 ORGANIZATIONAL MEETING - 6:30 p.m. The Organizational Meeting of the Board of Town T~ustees was held on Thursday, January 21, 1988 at the Southold Town Hall, Main Road, Southold. President Henry P. Smith called the meeting to order at 6:30 p.m. with the following present: President Henry P. Smith Vide-President John M. Bredemeyer, III Albert Krupski, Jr. John Bednoski, Jr. Ilene Pfifferling, Clerk President Smith opened the meeting and explained that the purpose of the Organizational Meeting was to elect a President, select ~ Vice-President and appoint a Clerk.to the Board of Trustees. After discussion the following resolution was offered: Moved by Trustee Smith seconded by Trustee Bednoski it was RESOLVED that John M. Bredemeyer, III be and hereby is elected President to the Board of Town Trustees and Albert Krupski, Jr. be and hereby is selected as Vice-President to the Board of Town Trustees until such time as the Trustees have a fifth member then th, ere will be another election. Vote of Board: Ayes: All - This resolution was declared duly adopted. Moved by Trustee Bredemeyer seconded by Trustee Bednoski it was RESOLVED that Ilene Pfifferling be and hereby is appointed ceremonial Clerk to the Board of Town Trustees. Vote of Board: Ayes: All - This resolution was declared duly adopted. President Bredemeyer thanked Trustee Smith for the work done while President of the Board. (See resolution on page. There being no farther business to come before the Board at the Organizational Meeting a motion was made by Trustee Smith seconded by Truste~ Bednoski to adjourn the meeting. Board of Town Trustees Page 2 - January 21, 1988 REGULAR MEETING JANUARY 21, 1988 - 7:15 p.m. A Regular meeting of the Board of Town Trustees was held on Thursday, January 21, 1988 at the Southold Town Hall, Main Road, Southold. President John M. Bredemeyer, III called the meeting to order at 7:15 p.m.--with the following persons present: President John M. Bredemeyer, III Vice-President Albert Krupski, Jr. Trustee Henry P. Smith Trustee John Bednoski, Jr. Clerk Ilene Pfifferling John Holzapfel, Chairman, Conservation Advisory Council In the audience, Kent McCarthy, Bay Constable President Bredemeyer advised that the Field Inspections are scheduled fur' February 17, 1988 to commence at 9:00 a.m. to depart from Town Hall, Main Road, Southold. The Trustees will convene a work session at 3:00 p.m. to be held at Town Hall, Main Road, Southold. The next regular meeting will be held on February 24, 1988 to commence at 7:00 p.m. Moved by Trustee Bednoski seconded by Trustee Bredemeyer it was RESOLVED to APPROVE the minutes of the December 17, 1988 meeting. Vote of Board: Ayes: All - This resolution was declared duly adopted. Moved by Trustee Smith seconded by Trustee Krupski it was RESOLVED to APPROVE the February 1988 mooring renewals. Vote of Board: Ayes: All - This resolution was declared duly adopted. President Bredemeyer gave the monthly report for December 1987 as follows: Application fees, S125.00, Wetland Applications, $450.00, Wetland Inspections, $60.'00, Mooring Renewals, $20.00 for a total of $655.00 ~vhich has been turned over to the Supervisor's office to be placed in the General Fund. President Bredemeyer advised that $32,085.75 was collected in 1987. Trustee Bredemeyer advised that the Public Notices are published on the Town Clerk's Bulletin Board for th'e public to view. The President proceeded with the Communications as follows: From Presiding Officer S. C. Legislature, Gregory Blass regarding proposed maintenance dredging proiects. President Bredemeyer appointed Trustees smith and' Trustee Krupski to the Waterway Committee. From Glenn E. Just regarding a clarification of a pipe on property of John McGillian, Fishers Island. 3. From Francis Weisent requesting a hearing on a wetland violation. 4. From Gordon C. Colvin, Director of Marine Resources, D.E.C. regarding help with monitoring waters for possible conditional permits Board of Trustees Page 3 - January 21, 1988 J From William D. Moore, Attorney, regarding covenants and restrictions Meadow Lane property, Mattituck. A copy of th~ covenants and restrictions is to be forwarded to Attorney Frank Yakaboski who was the Special Town Attorney l~reviously reviewing this matter. The Trustees are requesting his written confirmation regarding same .... From Patricia C~ Moore, Attorney, regarding the Southold Park District Cook/ Wortis matter. Estimates for fencing were submitted to the Trustee office. ~gye~ by~ Trustee Bredemeyer seconded by Trustee Krupski it was RESOLVED that tt{~-C'i~r'k transmit the estimates for the fencing regarding the Southold Park District/Cook/Wortis matter to the Town Board for their selection of the estimates. Vote of Board: Ayes: All - This resolution was declared duly adopted. From Pieter VanVolkenburgh, Chief, Bureau of Shellfisheries, D.E.C. a Conditional Shellfish Program for Mattituck Inlet and creek. President Bredemeyer advised that the Board would commence with agenda item V - Leads until 7:30 p.m. V. LEADS: 1. PECONIC ASSOCIATES ON BEHALF OF JOSEPH F. CITARDI - LEAD DECLARATION Moved by Trustee Krupski seconded by Trustee Bednoski it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Peconic Associates on behalf of Joseptu F. Citardi for a Wetland Permit on certain property located at 56225 County Road, Greenport. Vote of Board: Ayes: All - This resolution was declared duly adopted. 2. FRANCIS WEISENT - LEAD DECLARATIONS Moved by Trustee Bednoski seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Francis Weisent for a Wetland Permit on certain property located at 1925 Naugles Drive, Mattituck. 2. Vote of Board: Ayes: All - This resolution was declared duly adopted. 3. MIRIAM & ROBERT KLOTZ - LEAD DECLARATIONS Moved by Trusiee Smith seconded by Trustee Bednoski it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act ~n the matter of the application of Miriam & Robert Klotz for a Wetland Permit on certain property located at 2010 The Strand, East Marion. 3. Vote of Board: Ayes: All- This resolution was declared duly adopted WILLIAM D. MOORE, ATTORNEY ON BEHALF OF ERNEST & JUNE PAPPAS - LEAD Moved by Trustee Bednoski seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of William D. Moore, Attorney on behalf of Ernest & June Pappas for a Wetland Permit on certain property located at 75 Cedar Point Drive East, Southold. Vote of Board: Ayes: All - This resolution was declared duly adopted. President Bredemeyer called for a recess of the regular meeting ~n order to hold the following Public Hearings on the applications for Wetland Permits. It is noted for the record that all transcripts of the hearings have been prepared verbatim under separate cover and filed simultaneously with the Town Clerk's Office with these minutes for reference. 7:30 - 7:33 p.m. - Public Hearing was held and concluded in the matter of the application of the Cove at Southold submitted by Wilbur Klatsky for a wetland permit. 7:33 - 7:50 p.m. - Public Hearing was held and concluded in the matter of the application of Matt-A-Mar Marina submitted by Donald Cocks for a wetland permit~ 7:50 - 7:51 p.m. -Publ~ic Hearing was held and concluded in the matter of the application of J.M.O. Consulting on behalf of John F. McGillian for a wetland permit. 7:51 - 7:55 p.m. -Public Hearing was held and concluded in the matter of the application of Diane & Frederick Raymes for a wetland permit. 7:55 - 7:55 p.m. - Public Hearing was held and concluded in the matter of the application of J.M.O. President Bredemeyer advised that the Board would proceed with the Approvals/Denials of the applications for wetland/trustee permits as follows: WILBUR KLATSKY ON BEHALF OF THE COVE AT SOUTHOLD - APPROVAL - No. 60] Moved by Trustee Bednoski seconded by Trustee Smith WHEREAS, Wilbur Klatsky on behalf of the Cove at Southold applied to the SoUth6tc~ Town ~Tr~us.tees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated December 4, 1987, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on January 21, 1988 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that Wilbur Klatsky on behalf of the Cove at Southold BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO Construct certain housing units within a 75' buffer. Property is located on Main Bayview Road, Southold. Approval is granted as submitted, the covenants and restrictions will have to be reviewed by the Town Attorney to insure that they are truly acceptable in the form of what the Trustees requested for the Town. These will have to be acceptable to the Town Attorney. This permit will expire on January 21, 1990 if work has not commenced by said date. There are two inspections required and the Trustees are to be notified upon the completion of the work. Prior to the issuance of said permit by the Clerk, the applicant shall file with the Clerk a certificate that he has public liability insurance policies ~nsuring against any liability which may arise in the performance of the operations pursuant to such permit in such amount as shall be fixed by the Trustees, which said policies shall name the Town as a name insured. Please take further notice that this declaration should not be considered a determination made for any other department or agency which may also have an application pending for the same or similar project. Board of Trust~es Page 6 , January 21, 1988 DONALD COCKS ON BEHALF OF THE MATT-A-MAR MARINA - APPROVAL - No. 599 Moved by Trustee Bredemeyer seconded by Trustee Bednoski WHEREAS, Donald Cocks on behalf of Matt-A-Mar Marina applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated December 11, 1987, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on January 21, 1988 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that Donald Cocks on behalf of Matt-A-Mar Marina BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: Extend existing docks 37'x 6' e/w and 105' x 8' n/s in an effort to avoid shoal that ~s hazardous to approaching deep draft boats. Property is located on Wickham Ave., Mattituck. Approval is granted with the provision that the applicant remove the four finger piers that are attached to the existing dock assembly within 90 days of construction of the gas dock proposed. This permit will expire on January 21, 1990 if work has not commenced by said date. There are two inspections required and the Trustees are to be notified upon the completion of the work. Prior to the issuance of said permit by the Clerk, the applicant shall file with the Clerk a certificate that he has public liability insurance policies insuring against any liability which may arise in the performance of the operations pursuant to such permit in such amount as shall be fixed by the Trustees, which said policies shall name the Town as a name insured. Consulting on behalf of John McGillian applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated October 22, 1987, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on January 21, 1988 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that J.M.O. TOWN OF SOUTHOLD TO Repair a severly damaged bluff by repairing the stone wall located at the bottom of the bank then by filling the eroded area with trucked ~n sand and loam (approximately 750 cu. yds.) and then revegetating the filled area with various species of seaside vegetation. Property is located on a Private Road, Fishers Island. This permit is approved with the provision that the pipe coming out of the base of the cliff is to be plugged with cement during the course of construction. This permit will expire on January 21, 1990 if work has not commenced by said date. There are two inspections required and the Trustees are to be notified upon the completion of the work. Prior to the issuance of said permit by the Clerk, the applicant shall file with tl~e Clerk a certificate that he has public liability insurance policies insuring against any liability which may arise in the performance of the operations pursuant to such permit in such amount as shall be fixed by the Trustees, which said policies shall name the Town as a name insured. DIANE & FREDERICK RAYMES - APPROVAL - NO. 597 Moved by Trustee Bredemeyer seconded by Trustee Bednoski WHEREAS, Frederick Raymes applied to the Southo]d Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated October 15, 1987, and Board of Trustees Page 8 - January 21, 1988 WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on January 21, 1988 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed wilt not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that Frederick Raymes BE AND HEREBY IS GRANTED PERMISSION UNDER TFIEPROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: Construct a one family dwelling with a deck and took storage building. Property is located at 704 Wiggins Lane, Greenport. This permit is approved subject to the prevention of any building debris and/or run off during the construction phase and the installation of dry wells for the finished house. This permit will expire on January 21, 1990 if work has not commenced by said date. There are two inspections required and the Trustees are to be notified upon the completion of the work. Prior to the issuance of said permit by the Clerk, the applicant shall file with the Clerk a certificate that he has public liability insurance policies insuring against any liability which may arise in the performance of the operations pursuant to such permit in such amount as shall be fixed by the Trustees, which said policies shall name the Town as a name insured. Property is located at 6130 Peconic Bay Blvd., Laurel. This permit will expire on January 21, 1990 if work has not commenced by said date. There are two inspections required and the Trustees are to be notified upon the completion of the work. King applied to the Southold Town Trustees for a permit under the provisions of [he Wetland Ordinance of ~he Town of Southold, application dated November 19, 1987, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on January 21, 1988 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that Charles A. Existing ramp on the site since 1973. Property is located at 200 East Mill Road, Mattituck. In the future if this ramp is to be recovered, a permit will be required. A letter is to be forwarded to all Asphalt Companies in $outhold and Riverhead Towns advising that they need permits for any work done within Trustee jurisdiction. DR. STANLEY KEATING - APPROVAL NO. 49] Moved by Trustee Krupski seconded by Trustee Smith WHEREAS, En'-Consultants, Inc. on behalf of Dr. Stanley Keating applied to the Southo]d Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated October 30, 1987, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on January 21, 1988 at whick time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and - ~ WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that Eh-Consultants, Inc. on behalf of Dr. Stanley Ketating BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: Construct a timber dock consisting of a 4' x 32' fixed elevated (3.5' above grade of marsh) walk; 4' x 12' hinged ramp; 8' x 20' float secured by (2) 8" diameter pilings. Dock replaces previous structure destroyed by storms, deterioration, etc., property is located on Haywaters cove, Cutchogue, This permit is approved with the provision that the dock does not conflict with the moorings located at the end of the road. This permit will expire on January 21, 1990 if work has not commenced by said date. There are two inspections required and the Trustees are. to be notified upon the completion of the work. It was determined after the on-site inspection conducted on January 20, 1988 that the Trustees do not have jurisdiction in this matter. The Trustees recommend that the building envelope be altered to remove the possibility that the Natural Ravine just North of the existing house (which is on tt~e South end of the envelope) be filled in or altered. Richard Mohring: The Trustees inspected the property of Richard Mohring located at the foot of Bay Avenue, Cutchogue on January 20, 1988. It was determined that the Trustees have no jurisdiction in this matter. However, the existing natural vegetation on the seaward side of the project within t~he Trustees 75' jurisdiction is to be left undisturbed. Anthony and Sally Pirrera: The Trustees inspected the property on North Road, Southold as referre:d, by the Planning Board. It was determined that the project is out of ihe Trustee jurisdiction. The Trustees suggest protection of the slopes to the bluff. Dorman, Townsend, MacKay and Mills: The Trustees inspected the property on January 20, 1988. It was determined that the project is out of Trustee jurisdiction. The kettle holes on the site are not wetlands. Nevertheless,, every effort should be made to save them as contiguous open space for the following reasons: 1. Site is a Significant wintering area for White Tailed Deer which migrate to the North side of Orient when food and cover in the lower areas deteriorates. 2. The Cedars on the site near the kettle holes are important cover for Song Birds as well~as the deer. 3. Woods on this parcel are very typically occupied by Red Fox and the larger owls (Great Horned, etc.) because of the diversity and high quality of cover and food available. Fol-lowing up on our meeting of the 17th with the Board of Trustees when a negative declaration was declared on the subject parcel, we also did make application to prevent the following on the property. As part of commitment and as per our conversation with the Board of Trustees we have prepared a vegetation map, which is also part of the file document approved by the Board of Trustees. The map that you have in front of you, represents a combination of maps in some respects, the..wetlands line that was established by the Trugtees in October also it established a 75! buffer, line~ As part of our position it also relocated three buildings to hold all construction activities out of the wetlands area, which we agreed and which was part of the C & R's that we described. It established that there would be no fertilization shall take place at any time Within areas shown as Zone ] and Zone 2. We have also withdrawn the application, and also withdrawn from this map, the location of the pool which was previously right adjacent to the existing boat ramp on the east side of .the program. Also for the record, 'I would like to note that we are showing the future location of the pool and tennis court in the northeast quadrate of the program which is beyond the jurisdiction of the Trustees'. We are making application to the Planning Board for that. I think my letter outlined the primary issues that the Trustees wished to address, that was to remove all construction activities from~ycithin the w~tlands line. Eliminating all fertilization in Zones 1 and 2. We outlined all fertilizers and plant material in" the other parts of the program. We also have-~a pooper scooper language in the C & R's. I think that-we basically addressed all the issues the Trustees had. Are there any questions ? Trustee Krupski: We were on field in~pections-yester-day, and.we saw an old pipe on the property. ~. .... Trustee Bredemeyer: It looked 'like an old 4" cast iron pipe that apparently was draining _.~he yard ~¥ gutter from the old building. ~Board of Trustees - Page 2. The Cove at Southold - Public Hearing Trustee Krupski: What it does though, is connect, there is ,a little swale between the wetland line and the creek itself, and that prevents a lot of the run off from the property from running into the creek. Now connecting those two low spots is a 4" pipe. Mr. Joseph Fischetti: Al, there were many of those pipes around. Some of them were drainage pipes from the old hotel. There is nothing in there now that we designed. Trustee Krupski: No, we are aware of that, we just wanted to bring it to your attention. Trustee Bredemeyer: We know that you are aware of it, but it would be nice to have it removed. The one we saw would be on the line :from about unit 11 towards your map notation "Corey Creek" it is almost on the direct line. There is a small pile of rubble th ere. Trustee Bednoski: It is right by the second flag. Trustee Krupski: It was only because I saw water moving around it otherwise I would not have noticed it. Trustee Smith: I think that you are going to make a special exception for them to go into this wetland area to remove this pipe. Trustee Bredemeyer: To remove the pipe and possibly seed, right. Mr. Donald Cox,-.Manager, Matt-A-Mar Marina: On the north .:side of our gas dock the shoal goes out in a westerly direction about 35 ft. from our gas dock. This is preventing deep draft boats from coming into our gas dock. I have pictures showing boats that have gotten stuck. I ha~e police reports of boats stuck. I have about 200 signatures of boaters who are aware of the problem. At this time we are not in a position to spend the money to have the dredging needed. We have an emtimate for $20,000. from one contractor and I have a verbal estimate f~r $25,000. from another contractor. At this time it is not feasible for us to spend that kind of money. It would be feasible for us to extend the dock beyond the shoal. That would at least give us free exit for the gas dock~for the deep draft sail boats., . I have more information. I don't know if everyone saw the pictures and 'police ' reports that were submitted. Trustee Krupski: Yes. Trustee Bredemeyer: Advisory Council? I~]d we get a final recommendation from the Conservation John Holzapfel: We just met today. Once of the questions we had, we tabled it to be honest. We wanted to see what the boitom looked like. You said that you had contours, but we nev~er saw them. We were concerned that what was being.. Mr. Cox: Ei.E.C. has cop~es, .the Army Corps ~has copies. Matt-A-Mar Marina - January 21, 1988 What we would like to do is get the approvals as soon as possible from all the agencies involved. In fact there are six people who would like to do the work. It is a very good time of the year to do this work. We are not working on our boats now. It is kind of a hardship at this point, we would like to get the approvals so that we could work during February and March. Trustee Krupski: On inspections we stoped there-yesterday. I was somewhat troubled because I have had some feed back from people in the area that the Marina keeps expanding and expanding. The Trustees have, since I have ~een on the Board, and historically, tried to work with the Marinas because they are an asset to the community in most cases. It seems that you have documented your problem. We have tried to come up with a solution that would satisfy both sides. By giving you a 35' extension on the gas dock you would also... Mr. Cox: That is 45'. Trustee Krupski: Okay it's 457 total, plus there would be boats presumably on either side of this dock going out the extra 35'. Mr. Cocks: Generally not on the outside of the dock, on ttze~inside 4t would locked be. erage of rk out Trustee Krupski: Right, okay, so what concerned us was the additional coy the shading of the bottom here. As a solution, we thought that we could wc some sort of a compromise with the marina with you. If you would eliminate some of your finger slips along ~he gas dock going out, we would be able to proceed to grant you the extension to proizide better navigation. Trustee Bredemeyer: The intent, I think the Board felt that we would maintain ~he same degree of bottom coverage. The issue here really, as presented, is anissue of safety and the needs of protecting the boating public. Prior applications yo~ have made with respect to dinghy access and all had a lot of merit. ~This is in th~ same line. We feel that if we grant ~his going out so much further anx~i--we have all that additional bottom coverage and it is very substantial and not in keeping with what the request is for. Mr. Cocks: As far as the expansion, the last expansion for the marina was done, I believe, 6 or 7 years ago. Trustee Bredemeyer: We are talking about the finger pier extensions that we .granted. Mr. Cocks: We eliminated two smaller docks there. Trustee Bredemeyer: Right, but the net change has been to increase the coverage over town bottom, that is what the concern of the Board is. Trustee Krupski: What we are proposing would provide you with What you want, but it would also giwre the town a little better environment there on the bottom of the creek. Trustee Bredemeyer: It would not preclude you from using the dock, yon would still be able to tie up along it. The existing one is 85' plus the 3?' so it would provide for a number of docks to be tied up along side of it. Public Hearing - Page 3. Matt-A-Mar Marina - January 21, 1988 Trustee Smith: It is a small expansion but whenever~-:-we can get ~any space into a marina without doing any damage to the environment I don't think that that is a working part of the creek, I think that we should take advantage of it. That is my personal feeling on it. Mr. Cocks: I can not speak for the owner, I will have to go back and check with him on this. Trustee Smith: My recommendation to you is, take what they are giving you. can come back with an application to put your finger piers back If that is satisfactory to you. ' You Trustee Krupski: I understand why you can't make a decision on that now. We can grant a conditional permit on that bases whether or not you want it like Henry said. Our concern is the coverage of the bottom. His coverage is getting more and more extensive. As Henry mentioned it is not a working area of the creek, and as there are more boats in the creek that is of course the reason that it is not a working area in the creek. Trustee Smith: It is an eslablished marina. Trustee Krupski: I know, I know, but it is over town bottom though. Trustee Smith: Every marina is over:town bottom, just about, there are a few where they ~own the bottom. Mr. Cocks: My feelings are thai the expansion it would allow us to have two more boats on the property. What we are doing is to try to prevent any dangerous situation from happening. The boats get hung up on this shoal. The Bay Constable has seen some of the things done to try to get these boats off of the shoal, Trustee Smith: What the Board is doing, is giving you the extra 45' so you don't have that problem. Now the stumbling block is the extra finger piers. I don't think that you can use the safety factor as a lever for those finger piers right now. You have to go about that at a different approach. Mr. Cocks: At one time Mr. Goubeaud brought up an idea of our creek on the south side, a letter, something along the line that we would not be building or doing any kind of dock work there as a trade off. Trustee Bredemeyer: Formalizing what was a prior agreement? Trustee Krupski: I thought that was already formalized? Trustee Bredemeyer: We have never found a written document regarding that, we searched the files. Trustee Smith: I think that was a verbal agreement. Trustee Krupski: I don't know, I think that would have to considered. Trustee Bredemeyer: I agree, Al, we would have to Consider it. ~ublic Hearing - Page 4. Matt-A-Mar Marina - January 21, 1988 Trustee 13redemeyer: Do you have any other comments with respect to the proposal you have now, there may be others who wish to speak-regarding this matter as well? Mr. Cocks: No, just the fact that I feel that this idea of putting the dock out is not to .make a lot of money, we will be spending money to put it out. Eventually we will have to dredge the area, but that will not be for at least five years until the business is making enough money to do that. By putting the docks out we will be saving a lot of money in the dredging. The safety factor will be a big thing also. We are trying to watch out for Southold Town in a way by preventing any injuries or deaths on the shoal. We are gaining two boats by putting out the docks. Trustee Krupski: You~. are missing what we are saying. What we are saying is that you can stay statusquo while doing what-you have hoped to do, to provide for better safety and access to your fuel dock. By making that dock so much longer the access dock to that fuel dock, that much longer; the Board did not feel on inspections that you would be loosing any boat slips-by taking those finger piers out. Our concern is the coverage of the bottom. If you keep the same amount of boats there along side of that. instead: of having finger piers, you are still going to have the slips. Trustee Bredemeyer: I believe, Mr. Raymes, what you are saying is that it is a permitting jurisdiction from this Board it is not a set-back. We review it for possible impacts. The set-back ordinance might properly be for the Z.B.A. you have an application [or them as well? Mr. Raymes: Yes, we had that hearing. Trustee Bredemeyer: That is the set back, we have,the jurisdiction where we issue permits it is not strictly that the structure has to be beyond that line. Are there any other comments? Trustee Krupski: I think that the Board's only concern, is preventing any sort of run off into the creek. I don't think that we are overly cpncerned with the exact location of the house.
