SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 31, 2007 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. PROPERTY FACTS/DESCRIPTION: A survey prepared March 15, 2007 shows the applicant's 102,174 square foot parcel to be improved with a one-story dwelling an accessory shed, and accessory concrete structure. The property is shown with 154.29 feet along Woodcliff Drive, depth of 481.20 feet along the northerly line, and 92.63 feet along the shoreline of Mattituck Creek. BASIS OF APPLICATION: This is a request for a Variance under Sections 280-14 and 280-122, based on the Building Inspector's October 11, 2007 Amended Notice of Disapproval and Zoning Interpretation ZBA #5039 (Walz) concerning proposed additions and alterations to the existing single-family dwelling. A front porch is proposed at less than 50 feet from the front lot line, and the second-story addition will be an increase in the degree of nonconformance when located less than 50 feet from the front lot line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law 5267-b(3)(b)(3)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's survey shows a parcel size of 2.346 acres with frontage along the shoreline of Mattituck Creek. It is improved with a one-story high level ranch type home in a R-40 Residential Zone District. The existing dwelling has a non-conforming front yard setback and the proposed porch will be an increase in the degree of non-conformity. The applicant is requesting a complete second-story on and over the existing first-floor footprint, with some additional decking and covered front porch. These proposed additions and alterations will not impact the existing footprint of this one-story home as evidenced after inspecting the immediate homes to the north of the subject property, and noting the variable setbacks which are closer to the front property line than the proposed additions to this home. 2. Town Law 5267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Although the applicant's property is very large in area and length, it is non-conforming with a 42.7 ft. setback from the front lot line to the dwelling, the primary building. The applicant has no other alternative, but to request a variance for the alterations to the dwelling. 3. Town Law 5267-b(3)(b)(3). The variance requested herein is substantial. The dwelling fronts on a curved street, and the closest setback is measured from the arc on the curve at 42.7 feet to the front property line. The proposed front porch makes the setback 36.83 feet to the steps. This is the maximum setback reduction that the Board would grant. 4. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. Since the setback of the home is already non-conforming, the difficulty has been self-created. 5. Town Law 5267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Page 3—December 6, 2007 • • ZB File No.6096—Perri Hoffer Hinden CTM No. 107-6-18 The setbacks of the homes in the immediate areas, including those on the curves of the road, appear closer than that proposed in this application. Granting of these alterations as requested will not impact the physical or environmental characteristics in this neighborhood. Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of his property, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Oliva, and duly carried, to GRANT the variance as applied, as shown on March 15, 2007 survey updated July 24, 2007 by Nathan Taft Corwin III, Land Surveyor, and the Site Plan prepared July 16, 2007 by Young and Young. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The covered porch provides a nice design element without much bulk. This 7'x 15'covered porch does not provide more room than for decorative elements(rocking chairs)and adds proportion to the rest of the house. (5) Has the alleged difficulty been self-created?
