MEETING OF DECEMBER 6, 2007 Southold Town Jeri ZBA FILE # 6094 - BRIAN and MERRY RETUS PROPERTY LOCATION: 235 Soundview Road, Orient CTM 15-3-4 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicant's parcel is a 22,684 square foot parcel (nonconforming in this R-40 Low-Density Residential Zone District), with 100 feet along Soundview Road, 224.23 feet in depth along the easterly side property line, and 96.59 feet along a tie line adjacent to the Long Island Sound. The premises is improved with an existing 11/2 story single- family dwelling as shown on survey prepared by John Metzger, L. S. dated August 2, 2006 updated June 28, 2007. BASIS OF APPLICATION: Request for Variances under Sections 280- 116A(1), based on the Building Inspector's September 28, 2007 Notice of Disapproval concerning a proposed second-story deck addition to the dwelling, which new construction will be less than 100 feet from the top of the bluff or bank of the Long Island Sound LWRP DETERMINATION: A Letter confirming consistency dated June 25, 2007 was submitted to the Board of Appeals under Chapter 95, Waterfront Consistency Review of the Town of Southold Code and Local Waterfront Revitalization Program (LWRP) standards. Grant of the relief in this variance application as applied for will not adversely impact the bluff along Long Island Sound provided best management practices are adhered to as follows: use hay bales or silt fencing during construction, install gutters, downspouts and sub- surface drywells to contain roof and deck runoff on site, and maintain a non- disturbance buffer zone to protect the bank. A letter dated June 19, 2007 from Suffolk County Soil and Water signed by Thomas J. McMahon, the District Manager, confirms the LWRP report and recommendations, indicating that Page 2—December 6, 2007 • • ZBA File#6094—Brian and Merry Retus CTM 15-3-4 the bluff is well vegetated with herbaceous and woody plant materials, numerous boulders at the toe and is in stable condition. AREA VARIANCE RELIEF REQUESTED: The applicant proposes to build a 8 ft. by 26 ft. second-story, exterior deck, open to the sky, with a 4 ft. roof overhang directly above a first-floor deck measuring 12 ft. by 40 ft. as noted on two elevation drawings and one floor plan drawn by Michael Macrina, Architect dated 10/1/07. This requested relief is located within the existing footprint of the dwelling, but is less than 100 feet from the top of the bluff adjacent to the Long Island Sound. ADDITIONAL INFORMATION: In July 2007, ZBA variance #6049 granted relief concerning conversion of an existing 11/2 story dwelling to a two-story dwelling, and to rebuild the ground floor deck with the same non-conforming 36 ft. setback from the bluff as the existing deck. A proposal for a second-floor deck above was denied as increasing the setback non-conformity of the code and creating additional strain on the bluff as well as visual impacts. At the public hearing on November 15, 2007 for the current variance, the applicant's attorney stated that the current application is for a smaller second-story deck rather than the one originally applied for and that no discussion at the previous hearing about potential impacts on the bluff of a second-story deck had taken place. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law 6267-b(3)(b)(3)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The new dwelling is almost complete and adding a second floor deck will not be visible to neighbors or the street. It is in keeping with the new architectural design and will enhance the applicant/owner's enjoyment of views to Long Island Sound 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance since the proposed second floor deck will add greater non- conformity to the existing non-conforming setback from the bluff. 3. Town Law 267-b(3)(b)(3). The variance granted herein is not substantial. The proposed deck is modest in size at 208 S.F. 4. Town Law 267-b(3)(b)(5). The difficulty has been self-created since a second floor deck is not a necessity. . Page 3—December 6, 2007 • • ZBA File#6094—Brian and Merry Retus CTM 15-3-4 5. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. A structural analysis dated October 2, 2007 by Ralph Pacifico, P.E. with the firm of Joseph Schmitt Consulting Engineers, concluded, based on site conditions and the proposed second-floor deck design, that the pier locations and loads are adequate to support a second-floor deck and will not affect the stability of the bluff. This conclusion was supported by site inspection from ZBA members. The survey prepared June 28, 2007 by John T. Metzger notes two drywells on site that will contain all roof runoff, as requested by the LWRP and Suffolk County Soil and Water District Reports 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second-floor deck, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Oliva, and duly carried, to GRANT the variance as applied for, as shown on the two elevation drawings and one 10/1/2007 floor plan drawn by Michael Macrina, Architect subject to the Condition that the second-story deck remain open to the sky. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. During the Zoning Board Hearing of Appeal#6049 the Board made no comment or asked any questions regarding the open second floor deck balcony. The applicant had no opportunity to discuss this issue and consider alternative designs. At the hearing of appeal No 6049 there was no objection or comment from the public or the board members regarding denial of the second floor balcony. The owner and the architect were present and they would have addressed any concerns by the Board regarding the weight of the roof and balcony on the bluff. The denial of a second floor balcony significantly changes the design of the proposed second floor and the use and enjoyment of the property. A Professional Engineer Ralph Pacifico PE has evaluated the existing structural supports as weight bearing supports for first floor and second floor balcony, contrary to the Board's conclusions,the weight of the second floor deck/balcony does not impact the bluff. The toe of the bluff is protected by not only boulders, but dense natural vegetation and three retaining walls. The retaining walls are covered over with vegetation and can not be seen(enclosed are photographs of the retaining walls under the dense vegetation). The retaining walls add to the stability of the bluff previously noted by The County of Suffolk Division of Soil&Water in their letter dated June 19,2007. The angle of repose is stable and there is no evidence of erosion. In fact,in 1986 the ZBA granted a first floor deck 40 foot setback from the top of the bluff(on the east side)which continues to measure 40 feet on the east side today. The variance of 1987 prohibited enclosing or converting the deck to living space. The owner does not propose to enclose the first floor deck or convert it to living space. The request is a roof over the first floor deck to construct a second floor deck. The owners submitted a reasonable application,neighboring homes have similar second floor decks which are documented in the enclosed photographs. The applicants had no expectation that the Board would deny,without discussion, a second floor deck over an existing deck which was previously issued a variance. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance,because: The views of the Long Island Sound are magnificent and a second floor deck is a significant aspect of the design of the second floor. The owner has reduced the size of the second floor deck however, removal of S access to the outside from the second floor would be a significant change to the house plans and the enjoyment of the property. The second floor deck creates a roof over the first deck which provides needed shade and also enables all rain water to be collected into dry wells and captured before it runs onto the bluff. The roof(floor of the second floor deck)over the first floor eliminates any rain runoff. The rain runoff from first and second floor deck is captured by gutters and drains. (3) The amount of relief requested is not substantial because: The setback from the bluff is established by the first floor deck and steps off the first floor deck, the roof and second floor deck do not encroach any further onto the bluff. The revised design reduces the size of the second floor deck. The constructed footings for both decks are the first floor concrete piers and poured foundation walls. These footings and walls require no modifications in order to accommodate the roof deck. These piers and foundation walls are more than adequate to support the roof deck over the approved first floor deck and do not increase the degree of nonconformity because the foundation for the structure is the same. According to our professional engineer the weight of the roof over the existing deck and the second floor deck will have no impact on the bluff. It is in the owner's best interest to be assured that the house and deck will have no affect on the bluff. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The bluff is absolutely stable,protected by boulders and retaining walls. The existing dwelling,foundation and piers are constructed,the weight of a roof with a second floor deck has no weight impact on the bluff. To the east,a house was renovated,second floor with a first floor enclosed porch and second floor patio as well as an in-ground swimming pool was approved. (Photograph of house enclosed). This house is twice the size of the applicant's. Mr.And Mrs.Retus admire the neighbor's beautiful home and they wished to enjoy a smaller house but with a similar style. They were extremely disappointed and surprised that the ZBA,without discussion or comment at the public hearing,denied a significant aspect of their design. The deck loads were assumed at 45 psf live and 15 psf dead load. The greatest load on a poured concrete (PC) pier is 6100 Ib, combined live load and dead load. The PC pier has an area of 4 sq ft, which will result in a soil bearing pressure of 1525 psf. The soil is assumed to be well graded sand, which has a soil bearing capacity of 2000 psf, leaving a safety factor of 2000/1525=1.3. The closest pier is 36 ft from the top of the bluff, and 78 ft horizontally from the bottom of the bluff, which is 19 ft below the bottom of the pier. This is adequate clearance from the bluff to allow full load spread from the piers, allowing for a 1 on 2 slope from the bottom of the footing. Based on the site conditions, and the proposed deck design, the pier locations and loads are adequate to support the deck, and will not affect the stability of the bluff. RETUS: Brian Retus, 1250 Northsea Drive. 7 I currently reside at 1250 Northsea Drive, a block away. 8 BOARD MEMBER SIMON: Would you like to -- MR. RETUS : Sure, basically, we ' re trying to 9 -- we bought this home from a neighbor approximately a year ago, Merry and I . This is my 10 wife, Merry Retus right here. When we bought the home, it ' s a cape cod that was originally built in 11 1966. We sat down with Mike Macrina, our architect who' s here in case there are any 12 architectural or engineering questions . When we met with him, Merry had a folder of different 13 ideas that she had put in the folder for years and we told him to build us a house, to design a house 14 with two criteria. Number one, to stay within the footprint and number two to stay within the 15 character of the neighborhood. Having said that I ' d like to present to the board, I took some 16 pictures of some homes on the block. I also need to turn this in. 17 BOARD ASSISTANT KOWALSKI : Thank you very much. 18 MR. RETUS: I also have a letter from one of my neighbors that we didn ' t request but they felt 19 they wanted to do for us since they wouldn' t be here, they ' re on vacation. I 'd like to , present 20 that to the Board also. The letter, by the way, is from our neighbor directly to the east of us 21 and they are the only full time people that we were required to notify. 22 BOARD ASSISTANT KOWALSKI : The letter is from Rob Shore (phonetic) for the record dated June 23 20th. CHAIRMAN DINIZIO: Basically, it states that 24 these are some upstanding people and they have no objection to the application . 25 MR. RETUS : Thank you. I know you have the plans but Mike drew this , up for us to take a 136 1 ZONING BOARD OF APPEALS - JUNE 28, 2007 2 gander at . Basically, what we ' re asking for a variance would be to convert a one and a half 3 story cape to a two-story home. We ' re essentially converting existing attic space to usable living 4 space. Also in the variance there was a question about the deck. What we ' re proposing to do is 5 there' s a deck there right now, we ' re proposing to stay within the same footprint of the deck. 6 We ' ll replace the deck with a new deck but the dimensions are not going to be changed. 7 BOARD MEMBER SIMON: Is it going to be covered? 8 MR. RETUS : Yes . BOARD MEMBER SIMON: It ' ll be covered from 9 the deck to the porch essentially? MR. RETUS : Yes without changing the 10 dimensions of the footprint of the deck. CHAIRMAN DINIZIO: You ' re not going to be 11 closed. MR. RETUS : There are five columns . What 12 we ' re asking the Board to grant is a variance to build this home. We ' re going to make it our 13 permanent home. Like I said, we live a block away. We feel it ' s of modest size and fits in perfectly 14 to the character of the neighborhood. I also believe with us taking the house and adding the 15 extra drainage to it, if you were to stand at the house now when it rains, Merry calls it the splash 16 house. There ' s water that splashes all over. With the proper drainage, I think we ' ll be well in the 17 scope of being good stewards for the land and taking the water where it should be. We've also 18 agreed, of course, to the ten foot no mow zone. Basically, I think the result would be a win/win 19 situation. We' d have a beautiful home to live in. I think Mike did a great job designing it . The 20 protection will be as good or better for the environment than it is now under the current 21 conditions of the property. Repairing or replacing of the existing one-story deck is not likely to increase the threat to the bluff. In addition the applicant requests an additional second-story deck. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance, The existing first floor deck will be replaced in the same setback that exists, currently 36 feet from the edge of the bluff. 3. The variances granted herein are substantial. The relief sought to permit an outdoor shower, extending the house 4.5 feet from the existing 10 ft. setback, is not substantial. The variance sought to construct a roof deck above the existing deck is substantial and increases the degree of code nonconformity, thus creating additional strain on the bluff as well as,visual effects. New construction for an additional deck above the new replacement deck, at 36 feet from the bluff, where the code requires a minimum of 100 feet, is excessive, more nonconforming and imposes unnecessary risks with the increase. 4. The difficulty has been self-created. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions In the neighborhood. 6.
