(631)765-1809• Fax(631)765-9064 N, �} �C•IN FINDINGS, DELIBERATIONS AND DETERMINATIONOuth®ld Town Clerk SPECIAL MEETING HELD NOVEMBER 1, 2007 ZBA File No. 6066 — PETER and SHARON MANGANIELLO Property Location: 58315 County Route 48, Greenport CTM 44-2-12 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further review under SEQRA. TOWN CODE CHAPTER 268:LWRP DETERMINATION: The applicants are requesting relief concerning open deck additions at both sides of the existing building, for the reason that the construction currently does not have a certificate of occupancy or building permit. A Determination of Inconsistency was issued under Chapter 268 (Town Code Waterfront Consistency Review and Local Waterfront Revitalization Program standards). Denial of the easterly deck in this variance application will substantially increase the closest setback measured from the Long Island Sound high water mark to the building and will reduce the building coverage of the lot. The variance determination noted below eliminates the need for a variance on the eastern side, and reasonably brings the building into more conformity with the Town Code provisions. PROPERTY FACTS/DESCRIPTION: A survey prepared June 4, 2004, updated 9/28/07 shows the property boundaries encompassing an area of approximately 4,800 square feet, inclusive of land below the high water mark, and 3,272 square feet of land above the high water line extending to the front (street) lot line adjacent to the North Road (C.R. 48). This lot is improved with a 36.3 ft. by 24.3 ft. dwelling structure. BASIS OF APPLICATION: Building Inspector's April 9, 2007 Notice of Disapproval, amended October 2, 2007, concerning as-built deck additions to the existing single- family dwelling, for the reason that the construction will also be less than 100 feet • • Page 2—November 1, 2007 Appeal No. 6066—P. and S.Manganiello CTM 44-2-12 from the ordinary high water mark of the Long Island Sound (in addition to side setback and lot coverage variances published for a public hearing held September 13, 2007). ZONING CODE PROVISIONS: Section 280-116A.2, stating that buildings located on lots adjacent to sounds shall be set back not less than 100 feet from the ordinary high water amount of the Sound; Section 280-124B, stating that nonconforming lots having an area of less than 20,000 square feet require a minimum side setback of 10 feet, total side yard setbacks at a minimum of 25 feet, and lot coverage maximum at 20% of the land above the high water mark (building lot area). FINDINGS OF FACT The Zoning Board of Appeals held public hearings on this application on September 13, 2007 and October 18, 2007, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Relief from side yard setback requirements and lot coverage code to allow the retention of two as-built side decks each having zero (0.0) side setbacks and a zero setback from the Long Island Sound. AMENDED APPLICATION:ADDITIONAL RELIEF: During the September 13, 2007 hearing, the Board asked the applicant to submit the setback information needed by the Building Department to issue a determination under Section 280- 116A.3 as to whether or not an additional variance is necessary, and for the filing of an amended variance if the building Inspector issued an amended Notice of Disapproval to include this area of the Code. On October 2, 2007 the Building Inspector issued an amended notice of disapproval, stating that the code requires the setback at a minimum of 100 feet from the Long Island Sound or adjacent bank area. ADDITIONAL INFORMATION: The applicant's representative confirmed that the west side deck was constructed in 1977 and has submitted a copy of the 1981 Certificate of Occupancy issued by the Building Inspector. There is also an east side deck which construction date is unknown, but which appears predate the west side deck. • • Page 3—November 1, 2007 Appeal No. 6066—P. and S.Manganiello CTM 44-2-12 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law $267-b(3)(b)(3)(1). Grant of the area variance will not produce a significant change in the character of the neighborhood or a detriment to nearby properties. None of the houses in the immediate area has a conforming lot coverage and location. 2. Town Law $267-b(3)(b)(3)(2) The benefit sought by the applicant, the retention of the existing house and decks cannot be achieved without variances. The total area of the lot is 4,850 square feet, of which 2,336 square feet are landward of a concrete barrier between the house and the Long Island Sound. The entire lot is less than 100 feet in depth and 36.3 feet in width. There is no conforming location on the parcel to construct either deck. 3. Town Law §267-b(3)(b)(3)(3) The variances sought are substantial. Applicant asks for 100% reduction for both side setbacks of the as-built construction. Elimination of the eastern side deck will increase the setback on that side by 6 feet and decrease the total lot coverage from 1,178 square feet (24.28%) to 1,034 square feet (21.3%). 4. Town Law &267-b(3)(b)(3)(5). The alleged difficulty was not created by the present owner, who acquired the property in 2004. 5. Town Law §267-b(3)(b)(3)(4). No evidence has been submitted to suggest that the relief applied for will have an adverse impact on the physical or environmental conditions in the neighborhood. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition for a deck and entry, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Weisman, and duly carried to • • Page 4—November 1, 2007 Appeal No. 6066—P. and S.Manganiello CTM 44-2-12 GRANT the variances with respect to lot coverage, side yard setback and setback from the L.I. Sound concerning the westerly deck addition, as requested, and to DENY the variances with respect to the easterly deck addition, and to GRANT alternative relief to allow a 30 square-foot landing (plus steps per code) on the easterly side of the dwelling at not less than one foot measured from the easterly side property line and with removal of the easterly deck construction. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
