ZONING BOARD OF APPEALS
After investigation and inspection, the Board finds that
applicant is requesting approval of a deck which has been
constructed with an insufficient frontyard setback of approxi-
mately four feet and insufficient sideyard setback of approxi-
mately eight feet at 75 Second Street, New Suffolk, Cutchogue,
New York. The Board has found upon inspection that the
20% maximum permitted lot coverage has been exceeded, and
the deck as is constructed is not within the character of
the neighborhood. The Board does not agree with the reason-
ing of the applicant, and there appears to be sufficient
area in the rearyard for same.
The Board finds that the circumstances present in this
case are not unique, and that strict application of the ordi-
nance would not produce practical difficulties or unnecessary
hardship. The Board believes that the granting of a variance
in this case will change the character of the neighborhood
and will not observe the spirit of the ordinance.
On motion by Mr. Grigonis, seconded by Mr. Doyen, it was
RESOLVED, that FRANK E. BROPHY, 75 Second Street, New
Suffolk, New York, be DENIED a variance to the zoning ordinance,
Article III, Section 100-31, in Appeal No. 2693 as applied for,
and
BE IT FURTHER RESOLVED, that the subject deck addition
be removed within 60 days of the date of this decision.

This letter will confirm that it is the opinion of the board
members at a Regular Meeting held last evening that any change
of the construction of the deck addition granted under Appeal
No. 2922 will require an application for a variance to the
Board of Appeals.
The basis for this determination is new con. struction is being
proposed and the deck addition granted under Appeal No. 2922
is still in effect, which may or may not affect the lot
coverage limitations for this zoning district.

on Appeal No. 1597 On which a Public Hearing was held at 8:30 P.M.

New York, upon application of Florence P. Grathwohl and James W.
Pugsley, Fanning Road and Jackson Street, New Suffolk, New¥ork,
for a variance in accordance with the Zoning Ordinance, Article
IIX, ~ection 301, for permission to use existing dwelling units
as single and separate lots and dwellings. Location of property:
south side of Jackson Street, New Suffolk, New York, bounded north
by Jackson Street; east by Second Street; south by Bay and Robbins;
and west by Third Street.

For the Record: Prior to stating the decision of the Board,
the Chairman asked for Mr. Saland,s agreement to the numbering
of the lots. Mr. Joseph Saland (representing Florence Grathwohl
and James W. Pugsley) agreed to the numbering of the lots, as
follows: Lot No, l- large house on northwest corner (Jackson
and Third); ~ot No. l~-cottage set off from Third Street, part
of Lot No. 1, Lots No. 2, 3, 4, 5 on Second Street; Lot No. 6-
with access to private beach.
After investigation and inspection the Board finds that appli-
cant requests permission to use existing ~welling units.as single
and separate lots and dwellings on proper~y located o~ t~e south ·

the Board are that applicant has owned this property for a number
of years prior to the Zoning Ordinance of 19%7; that construction
was made prior to that time. The property consists of a large.
house on the northwest corner, with a garage which is located
partly on Third Street; summer cottage which is on a plot 50t x
100t and which is set off from Third as part of Lot No. l; Lot
No. 2 has 100t on Jackson Street x 72t; Lot No. 3- 100, x 70~.
The 70' is on Second Street; Lot No. 4 is directly south of Lot
No. 3 and has 67~ on the easterly boundary which is Second Street,
78t on the westerly boundary, 100' on the northerly boundary and
101t on the southerly boundary; Lot No. 5 is directly south of
Lot No. 4 and is 100~ x 55~. The 100 t is on Second Street; Lot .
No. 6, 60t x 100~, facing south from the beach, and connected to
Second Street by a l0t right-of-way across the northerly end of
Lot No. 5. The Board recognizes an existing situation and agrees
with the reasoning of the applicant that this proposal will be
an improvement rather than a deteriorating factor to the area.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not change the
character of the neighborhood, and will observe the spirit of
the Ordinance.
On motion by Mr. Gillispie, seconded by Mr. Bergen,'it was
RESOLVED Florence P. Grathwohl and James W. Pugsley, Fanning
Road and Jackson Street, New Suffolk, New York, be GRANTED per-
mission to use existing dwelling units as single and separate
lots and dwellings on property located on the south side of
Jackson Street, New Suffolk, subject to the following conditions:
~. That the~.shall be seasonal occupancy on_~ in cottages on
Lots ~IA, #5 and ~8, the season to run from March 15th through
November l%th (8 months).
2. No improvements can be made without approval of the Board
of Appeals by the provisions of the Ordinance relating to lot
coverage.
3. Any prospective purchaser of any of these six parcels shall
be shown the decision of the Board of Appeals And shall acknowledge
recognition to the Board of Appeals.
4. The garage presently located partially on Third Street shall
be abolished or removed to the rear yard area of Lot No. 1.
5. None of these parcels may be used for m~ltiple occupancy,
including Parcel 1. This ruling does not exclude the rental of the
cottage presently on the Third ~treet line, Parcel lA.

2. The hardship created is UNIQUE and is not shared by all prope~ies alike in the immediate
vicinity of this property and in this use district because ~ had originally ;considered
building the DECK in ~ rear yard rather than the present front
yard location. - However, this tocation would have obstructed the
rear porch view of Peconic Bay and surrounding area to the adjoin-
ing property (Charles Eo Pugsley Estate) on the ~ortho
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because my home and all those located in tbe

a. This application must be completely filled in by typewriter or in ink and submitted in triplicate to the Building
Inspector, with 3 sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets
or areas, and giving a detailed description of layout of property must be drawn on the diagram which is part of this appli-.

c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.
