part of the consideration for the issuance of the Permit does understand and Fr-'~cn'be to the fol-
lowing:
1. That the said Board of Trustees and the Town of Southold are released from any and
all dam~e~ or C]~imq fO~ dnmnges, of suits arising dh~tly or indir_,~__ly as · result of any oper-
atlon performed pursuant to this permit, and the said Permittee will, at his ne her own expense,
defend any and all such suits i,;tinted by third.parties, and the said Permittee a~a,mes full liabiHty
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of ,~mthold
2. That thi~ Permit is valid for a period of 3_2 mos. which is consldexed to be the
estimated time required to complete the work involved, but should ciro,m,a~nces warfare, request
for an extettsion may be mnde to the Board at a later date.
3. That this Permit should be rernined indefinitely, or as long as the said Permictee wi~hes
to maintnin the structure or project involved, to provide evidence co anyone concerned that auth-
orization was originally obtained.
4. That the work involved will be subject to the /nspertion and approval of the Boa~cl ot
its agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the sa[el Board.
5. That there will be no unreasonahle interference with navigation as · resuit of the work
herein authorized.
6. That there shah be no interference with the right of the public to pass and ~epass along
the beach between high and low water ma~ks.
7. That if furze operations of the Town of Southold reqtztre the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Boaed of Trustees, the
wo£k _~hall cause unreasun~ble obstruction to f~ee navigation, the said Permktee will be £equlted,
upon due notice, to remove or alter this work o£ project herein stated Without expenses to the Town
~ Southold.
8. That the said Board will be notified by .the Permittee ox the completion of the work auth-
orized.
9. That the permittee will obtain all other permits and consents that may be ~ sup-
plemental to d~s permit which may be subject to revoke upon failure to ot~;- same.

to the order of the Board of Southold Town Trustees. This fee is computed below according
the Schedule of Rates as set forth in the Instruction Sheet (Form I/1).
If the Permit Fee is paid in person to the Secretary of the Board, The Permit will be obtainabJ¢

Gentlemen;
We have an application from Dawid Ackerman, part
of lot 23, Lidia Bartley subdivision, ~+9~ Rochelle Plase, Mattituck
N.Y. to build a "patio-deck" in connection with a dock,~James Creek,
Mattituck)
It appears that this structure will overhan{ high water
mark as well as "stradle" the existing bulkhead.
If you will approve the part overhanging the bulkhead and
highwater line, we can approve the balance of the structure on the
upland; otherwise we will have to require a minim, m 3 ft setback
from the bulkhead.

Secure the correct Area Map from the Secretary of this Board, and by using an X WITHIN
A CIRCLE indicate as closely as possible the location of this dock. On the reverse side of this
map, provide a SCALE DRAWING which will show Ordinary High Water Mark, the shape
and size of the dock and any supplemental pilings which ore needed to hold a floating dock
or tie-up a boat. Give all dimensions necessary to determine the area of the dock surface
which extends offshore from the O. H. W. hA.
6. Will any portion of this construction extend offshore i.nto Town Waters beyond an imaginary
ne or boundary formed by other similar structures along the areo's shoreline? ~ or NO.

read or am familiar with the provisions of any Southold Town Ordinance pertinent to the work
