WORK SESSION: 6:00 P.M.
A Work session of the Board of Town Trustees was held at 6:00 P.M.
on January 26, 1989 at the Town Hall, Main Road, Southold.

REGULAR MEETING (January 26, 1989): Frank Kujawski called the
meeting to order at 7:00.
NEXT REGULAR MEETING: 7:00 P.M., T~esday~ February 28, 1989.

MOVED by Albert Krupski, second by Jay Bredemeyer, it was RESOLVED
to approve above dates and times for February 1989 meeting and
inspections. Vote of Board: Ayes; All - Resolution adopted.
MONTHLY REPORT (December 1988):
Collected $3439.00 in total fees, which we have forwarded on
to the Supervisor's office for the General Fund. Receipts
include mooring renewals, waivers, permit fees and wetland
applications. The greatest amount of fees collected were
from Wetland Applications.
II.
PUBLIC NOTICES:
Public Notices are available in our office for review, and
they are also posted on the Town Clerk's Bulletin Board for
public inspection.
III. COMMUNICATIONS:
1. Merlon Wiggins re: Young's Marina
Frank Kujawski: Correspondence in regards to information that was
wanted on Young's Marina. Letter from Bob Thurber, the DEC
environmental analyst, talking about the method of dredging, and
its affects.
2. Gigi Spates re: Angel Shores - concerning freshwater.
3. N.Y.S.D.E.C. re: Wade application - requirements that
the DEC wanted regarding the Wade application in Cutchogue. This
was received before they were notified of our action at last months
meeting.
4. Paul Clancy, Peconic Bay Estates Homeowners Association,
re: property that has been cleared on Kerwin Blvd, Lot ~10.
FRANK KUJAWSKI: The Bay Constable did check out the operation and
it is not in our jurisdiction, it was more than 75

5. John and Nancy Wissman re: Angel Shores = regarding
freshwater.
6. Charles Mebus re: road runoff into Jockey Creek.
FRANK KUJAWSKI: Problem with road runoff. There's been alot of
silting in. Has this site been identified for a possible reed bed
application?
HENRY SMI~: W~at's the location?
FRANK KUJAWSKI: Route 25 and Jockey Creek, by the Marina.
HENRY SMITH: That's State, the whole state drainage system all the
way up past Town Harbor Road, runs down there into that.
JOH~ HOLZAPFEL: We had sent a letter to Blass listing 5 or 6 State
places that were going into Creeks and Bays. Blass responded With
a fairly forceful letter to the Road Dept. of Suffolk County
saying, '~these places have been identified, I want you to do
something about them, please let me know your schedule and when you
are going to do it." What this means I can't translate, but I just
wanted to let you know.
7. Leonard and Donna Schlegel re: extension of
Permit No. 314, expiration date July 31,1987-
FRANK ~JJ~SKI: request for an extension of a permit that was
issued on July 31, 1986. Since this permit was issued, the period
for requesting extensions was extended for two years to get the
work done. So 'actually under the new rules, which are now little
over a year old~ she would have until this July of 1988.
Apparently there was some problems that they ran into with the DEC
that have just been resolved within the past couple of weeks so
they weren't able to co~ence the work. If the Board agrees that
this could be extended to July of 1989, we could put this on the
agenda later on.
ALBERT KRUPSKI: What's the nature of the work?
HENRY SMITH: I've got no problem with this, its been approved
before.
MR. SCHLEGEL: It was for a residential dwelling on that site, the
only problem was that they didn't plan on building the house till
the following year. I would like to start in the spring of 1990.
ALBERT KRUPSKI: I wonder if the DEC offered any modifications to
our permit that was granted to you.
MR SCHLEGEL: They did not modify anything on your permit, but the
permit I had gotten from them is also expired so I have gone back
to them for another permit.
JOHN BREDEF~iER: If the work isn't planned till 1990, maybe we
should wait and see if DEC reissues. Maybe we should take a copy of
their permit and and our existing file and do another field
inspection of it before we could move on it.
FRANK KUJAWSKI: I donut know how quite to handle it. We haven't
had anything that was planned so far in advance.
HENRY SMITH: When did the permit expire?
MR SCHLEGEL: July 31, 1987.
JOHN BEDNOSKI: Maybe they should resubmit.
FRANK KUJAWSKI: I think we have a problem with that far in
advance. If you had gotten a 2 year permit, if we could have
brought you under the new regulations for a 2 year permit, we could
have given an extensions up to ! year beyond that. Actually all
you have to do is co~encework. You don't have to co~plete the
work, that is, if the board would give you a one year extension
beyond a two year permit.
ALBERT KRUPSKI: Maybe we could see a copy of the DEC permit.
FRANK KUJAWSKI: Did you ever forward a copy of the DEC permit to
us?
MR. SCHLEGEL: No, I don't think I ever did, you never asked.
FRANK KUJAWSKI: We would like a copy for our files. Should we
move this to the rest of the agenda to extend permit to July
31,1989.
JOHN BEDNOSKI: Why didn't they ask for a waiver since the house is
beyond 75 feet?
HENRY SMITH: Because of the dock.
JOHN BREDEMEYER: Is your principal concern the house construction?
MR. SCHLEGEL: Yes.
JOHN BREDE~EYER: The house is beyond our jurisdiction so we're not
even involved with the house if you're abiding by the DEC permit
and the only other question would be the dock.
FRANK KUJAWSKI: You're not going to build a dock before July 31,
19897
MR SCHLEGEL: No.
FRANK KUJAWSKI: If you were-the board would give you an extension
to July 31, 1989 that's really 3 years since the original and we
wouldn't want to set precedent and grant an extension beyond that,
you would have to resubmit an application. So if the dock is a
couple of years off, it would be better to resubmit an application
with just the dock on it. As far of the house it is out of our
jurisdiction.
ALBERT KRUPSKI: Being that its all one application, house and
dock, it seems that if he coJLm~enced work on the entire project, its
one permit. If you started to clear the area, it would start our
process.
MOVED by Henry Smith, second by Albert Krupski, it was RESOLVED to
approve an extension of the permit to July 31~ 1989. Vote of the

IV. PUBLIC HEARINGS:
1. 7:30 P.M. Hearing in the matter of the application of
Proper-T Services on behalf of Paul Ferdenzi.
V. LEAD AGENCY:
1. J.M.O. for Lambert Javelera, Fishers Island, to
reconstruct single family dwelling, garage and foundation.

FRANK KUJAWSKI: Glenn are you going to have any problems? Is it
going to moved back from the original site.
GLENN JUST: I submitted a while back a copy of the DEC permit
where it showed using the same, part of the same foundation.
2. En-Consultants for Robert Keith, Willis Creek Drive,
Mattituck, to construct one family dwelling.
MOTION to take Lead Agency, Albert Krupski, second Frank Kujawski,
Vote of the Board, Ayes; All.
ROY HAJE: If there's any way to speed this up?
ALBERT KRUPSKI: Couldn't they have the house delivered and just
park there outside of our jurisdiction.
FRANK KUJAWSKI: We don't see a problem with that now, with the
adjustments that have been made.
JOHN BREDEMEYER: Remember there was a question about jurisdiction
because there was some high tide bush.
ALBERT KRUPSKI: I don't think its a question if this pez~Ltit is
going to go through, I think that it is just in a state of review.
I don't think its going to be anything extraordinary.
JOHN BREDEHEYER: I don't how quick they could get a restricted
covenant together, we have filed them before. You could waive it
subject to restrictive covenant within the zoning law that would
be stricter than a permit provision.
FRANK KUJAWSKI: Have you seen anyone speed up a permit beyond the
normal sequence? I don't see a problem with this project at this
time so I think they should move ahead with their contracts really
would be the safest thing to do.
ALBERT KRUPSKI: Remember this is a matter of few feet whether it
was our jurisdiction or not.
3. Anthony Leggio, 2300 Glenn Road, Southold, to construct
catwalk, ramp and float (Goose Creek).

4. Thomas A. Palmer, 2050 Deep Hole Drive, Mattituck, to

5. En-Consultants for Kenneth Rathgeber, Nassau Point Road,

FRANK KUJAWSKI: This was above the high tide mark. There were
some co~m~ents from the CAC about the construction of this.
ROY HAJE: Could I get a copy of those comments?
JOHN HOLZAPFEL: We just thought it would be better to match it up
with the two neighbors instead of coming out that 4 foot and then
running it along, to keep it in a straight line, we suggested
terracing.
ROY HAJE: That would be one of the problems making that a very
steep lot, it would also create a problem with that building lot.
I think you would essentially write this lot building off if you
moved it backoff.
ALBERT KRUPSKI: Ail you have to do is go by CAC comments starting
at the neighbors and making an angle out to the building or else
instead of making a sharp angle out to where the original one was
on the neighbors line make that at the building. There are
different ways on doing it.
ROY HAJE: You wouldn't be gaining much by doing it that way. It
was in-kind, in-place and to follow the same line.
HENRY SMITH: In-kind, in-place, we can't deny him that.
JOHN HOLZAPFEL: In-kind, in-place is when the thing is functional.
ALBERT KRUPSKi: In-kind, in-place is meant for a permitted
structure.

6. En-Consultants for Dr. Frank Sciotto, 3350 West Creek
Avenue, Cutchogue, to construct pool, deck and gazebo.

7. En-Consultants for Gerald Wood, Holbrook Lane, Mattituck,
to construct dock and walkway.

8~ Costello Marine Contracting Corp. for Mateo LettuniCh,
porperty located at Bay Home Road, Southold, to reinforce westerly
concrete and rock seawall including returns, and reconstruct
easterly rock revetments with rocks and filter cloth.
FRANK KUJAWSKI: When do you expect a DEC permit?
JOHN COSTELLO: Very shortly, within a week or so, they have
inspected the job and see no problem, I'm going by their verbal say.
FRANK KUJAWSKI: I will suggest that we take lead agency on the
project.
JOHN COSTELLO: Now there will be two agencies taking lead.
FRANK KUJAWSKI: Then there's no sense for us to take lead on it.
So it doesn't do you any good for us to take lead agency on this,
its better for us to sit back and assume that they are taking lead.
JOHN COSTELLO: Yes, if you feel that they are more qualified.
FRA/qK KUJAWSKI: We will still have to go throught a Trustee
hearing at some point. There's nothing wrong with us taking lead
because that way next month it would be up for assessment.

FRANK KUJAWSKI: I believe the DEC has already waived whatever goes
on, on that property when they did the septic system.

FRANK KUJAWSKI: Conversation with Dr. Samuels About in kind/in
place replacement of bulkheads and retaining walls. Dr. Samuels
explain how the DEC does this to the board.
DR. SAMUELS: On in kind/in place replacement of bulkheads the DEC
requires you to remove any material which sloughs in during the
period when you are constructing a bulkhead. You are required by
the DEC and Corps of Engineers to remove that material because its
placing fill on coastal flats and shoals. They are required to
remove it.
FRANK KUJAWSKI: Wording of the DEC on in kind/in place replacement
of bulkheading, we will pass it on to the Code C~u~ittee for the
Town if the board approves. No objections.
7. Geoffrey Penny (a modified project) to construct a
retaining wall and do maintenance dredging in the boat basin at
property located at 570 Mason Drive, Cutchoque.

8. En-Consultants for Marie Nersoyan, property located at
Mesrobian Drive, Laurel, to reconstruct a bulkhead and stairway,

9. J.M.O. Consulting for Frank and Antoinette Notaro,
property located at Calves Neck Road, Southold, to construct 2
additions to a single family dwelling stairway, catwalk, ramp,
float, and dredge.
FRANK KUJAWSKI: I believe this project is down to 70 cu. yds., it
has been altered. It is still the feeling of some members of the
board this project is not located in the right place, or would
accomplish something that alot of the members of the board are not
in favor of in terms of the size of the vessel and the dredging
that would occur there.
HENRY SMITH: Project under 100 cu. yds. of dredging, and I don't
think its up to us to decide what size of a vessel a person can
have. They have a smaller vessel than the vessel across from
them. There is a 56 ft. already there and their's is 44 ft.
Already there are larger boats in the creek. I think it could fit
under a non-significant effect.

ALBERT KRUPSKI: Matter of making the creek fit the boat or the
boat fit the creek, and we have heard comments from the Baymen that
dredging in the creek, Town Bottom, is one of the reasons for the
deterioration of the quality of the creeks.
HENRY SMITH: The town uses that end of the creek for road runoff
so I don't think its a viable shellfish area.
JOHN BREDEMEYER: I'm not happy with the dredging, but the
applicant certainly made every effort to scale down the scope of it
but I would like to condition off the performance basis of it, the
boat doesn't seem to be out of what's up there. I would prefer to
see the structure or the boat be out alittle bit closer to the
channel, if we could avoid further dredging, but I don't if its
realistic at this point.
STEVE LATSON: Good habitat for seed clams. I feel we shouldn't
give away anymore of our bottom.
JOHN HOLZAPFEL: The depth was what we were concerned with (6 ft.).
ALBERT KRUPSKI: It's a matter of the board developing a policy on
how many of these little basins you want to dredge into the creek
bottom.
10. J.M.O. Consulting for J. Trataros, property located on
Main Road, East Marion, to construct a catwalk, ramp, float, and 2
poles for mooring.

JOHN BREDEMEYER: Do we have a copy of the CAC comments in the
file, so maybe there would be no prohibition on doing an Assessment
tonight, as Mr. Haje had requested. We already have in our file
comments from the DEC.
FRANK KUJAWSKI: We have them.
JOHN BREDEMEYER: Why don't we just move for an assessment tonight
and then it could go on fora public hearing next month, that is,
if there seems to be no problem with it.
FRANK KUJAWSKI: My only comment would be that now we have declared
lead agency we are going to be notifing other agencies within the
town and the DEC, that we are the lead agency and if they have any
comments. Although,the Dec permit has been issued so now its a
matter of the public and neighbors and so on if they want to submit
comments to us for assessment.
MRS. RATHGEBER: We have been trying to buy this house since last
August, we had everything ready by October, we thought the first
meeting in November, second December, and at this meeting it would
be decided. Our mortgage is about to expire as is our contract if
we don't get a permit. If there's going to be 2 more months before
a decision is made then this house deal we're not having for us
because it expires. Could it be possible that 2 steps could be
done tonight at the same time?
FRANK KUJAWSKI: The paperwork does seem to be in order.

Mattituck, to construct a one family dwelling.
JOHN BREDEMEYER: We normally assess prior to public hearing
anyway. It just seems unusual that we are a small board if we have
a request like this that we can meet the needs of the poor home
owner.
FRANK KUJAWSKI: Are you talking about the Keith Application ?
JOHN BREDEMEYER: Yes.
JOHN HOLZAPFEL: We don't have any problem with it at all.
FRANK KUJAWSKI: I'll go along with it also only because I think
probably now it is out of our jurisdiction with the adjustments
that ha~e been made to it. Unusual but I'll go along with
it.
ALBERT KRUPSKI: What were the DEC's comments?
FRANK KUJAWSKI: DEC suggested to protect the value of the tidal
wetland a permanent vegetated buffer zone shall be established.
There shall he no disturbance to the natural vegetation or
topography within an area extending 65 linear ft. landward of the
tidal wetland boundary which is located at the 3.5 ft. counteur
level. A snow fence shall be staked in place at the landward edge
of the buffer area before co~Lu~encement of regulated activites and
remain in place until the project is completed and all disturbed
areas are stabilized with vegetation. Driveway and parking areas
shall be constructed of pervious material. Roof runoff shall be
directed to drywells a minimum of 100 ft. landward of the tidal
wetland boundary for immediate on site recharge. No accessory
structures or additions will be permitted without further approval
of the Department. Project must comply with all local and federal
floodplain regulations. All fill shall consist of "clean" gravel
and soil (not asphalt, sleg, flyash, broken concrete or demolition
debris). The storage of construction equipment and materials shall
be confined to within the project work site and/or upland areas
greater than 65 linear ft. distant from the tidal wetland
boundary. Prior to the ultimate expiration of this permit the
permittee will cause all fill and exposed faces to be vegetated to
prevent erosion. Also, supplementary special conditions that are
attached which are more preclusive than the above.

VII. ASSESSMENTS:
CONDITIONAL NEGATIVE DECLARATION
1. En-Consultants for Kenneth Rock, property located at
1200 Broadwaters, Cutchogue, to replace existing bulkhead and
maintenance dredge.
FRANK KUJAWSKI: (To Roy Haje) The DEC has made several
modifications on it. This board has been wondering if you would be
willing to make any other modifications.
ROY HAJE: I don't know what more we could do, we cut the dredging
down and it is now totally restricted to within the basin area, not
allowed into the ~creek at all, It would only leave a spot for the
boat to remain afloat during all tidal changes. He would have an
impossible time getting out at low water. So if he were not to
dredge in the slip it would be essentially useless.
FRANK KUJAWSKI: Has the applicant considered the idea of actually
removing the slip and moving to a catwalk and a ramp arrangement.
ROY HAJE: We haven't considered that because of the presence of
the slip now; if it had been a new application he might very well
have considered that, but to abandon the slip.
FRANK KUJAWSKI: If you look at the neiqhborhood, everybody else
has gone to docks, ramps, floats. Certainly a structure that's not
going to require over the long run the type of maintenance and
upkeep that a boat slip is going to require, or the expense of
retaining walls and I realize there would be some destruction and
possibly some damage that occurred to the creek that if this was
attempted to restore it back to a healthy environmental shoreline.
Would the applicant consider that.
ROYE HAJE: Are you saying just leave the bulkhead to deteriorate
further?
FRANK KUJAWSKI: Remove it.
HENRY SMITH: You can't deny a man what he has already.
ROY HAJE: I really think we have comprised and have met everyone
more than half way om it, with the other modifications that the DEC
has demanded and we have ceded to, I really don't think there will
be any environmental damage.
ALBERT KRUPSKI: That whole area behind that is high marsh,
spartina patens.
ROY HAJE: Have you seen the restrictions the DEC has imposed on
us, as far minimizing backfill, we have to leave one section alone
so that there will be virtually no destruction of that marsh behind.
FRANK KUJAWSKI: In other words, you don't know if those five
restrictions asked for by the DEC (Katy Murphy, environmental
analyst) are actually going to be incorporated into the DEC permit.
ROY HAJE: I'm 99% certain that they will be.
FRANK KUJAWSKI: Would you be willing to incorporate those
conditions this evening as part of a conditional negative
declaration on this Project?
ROYE HAJE: kbsolutely, we would have to adhere to them anyway, to
be consistent, sure.
FRANK KUJAWSKI: The conditions are: The 37 Ft. section on the
west side should be replaced landward of existing bulkhead with no
removal of existing bulkhead, with any backfill to be limited to
area between west section wall and the slip, the 7 ft. section on
the east side should not be replaced, the 52 ft. section can be
replaced within 18 in. but no backfill can be used behind old
bulkhead at deadmen, the remaining section can be replaced within
18 in., no machinery can operate on landward side due to tidal
wetland vegetation.
FRANK KUJAWSKI: Did you calculate how many cu. yards of dredging
are now involved inside of the boat slip?
ROY HAJE: It would be about 50 cu. yds.
FRANK KUJAWSKI: Some backfilling allowed on west side, but there
will be some excess spoil that will have to be carted away.
ROY HAJE: It could probably be able to be used right on site.
MOTION to assess as a conditional negative declaration with the
five restrictions listed above, Frank Kujawski, second, John
Bredemeyer, Vote of the Board: Ayes, All.
2. Robert Simon, R.O.W. off Indian Neck Lane, Peconic, to
construct a single family dwelling.
FRANK KUJAWSKI: I sent a letter to Mr. Lindtey, Suffolk County
Dept. of Health, but there has been no response. I would give this
a conditional negative declaration if there were no lateral
transport from the septic system to the wetlands, and the way I
would propose that, if the applicant agreed, an impermiable wall
constructed between the septic system and the wetlands.
JOHN HOLZAPFEL: I think the health dept. would have the best ideas
on on what to do on that.
JOHN BREDEMEYER: If you CND it subject to no lateral transport of
material then you're incorporating thats positive, withOUt planning
the engineering aspects.
FRANK KUJAWSKI: I envisioned a semi-circular wall basically
between the septic system and the wetlands at all points on the
property.
JOHN BREDEMEYER: I don't see why we can't request a such retaining
structure as to prevent lateral escapement.
FRANK KUJAWSKI: Don't you think the Health Dept. will jump in and
come up with those specifications, once we suggest the idea. The
DEC didn't have any problem with this one because of the
elevations. The structure I drew in would be about 50 ft. and
basically it would be in-between the house and the border of the
property. I would like to offer it as a motion to give it a
conditional negative declaration, they would have to agree to the
structure based on Suffolk County Health Dept. approving the
structure.
MOTION to assess as a conditional negative declaration with
stipulations that the applicant agrees to the stated structure, and
Suffolk County Health Dept. approval, Frank Kujawski, second John

3. En-Consultants for Nicholas Theorides, property located
at 800 MaPle Avenue, Southold, to construct dock, platform, steps,
ramp, float, and to dredge.
FRANK KUJAWSKI: Does the applicant agree to the DEC requested
modifications of this project?
ROY HAJE: Can't get in touch with them. At first glance it
appeared to be workable. In fact it might save them some money.
FRANK KUJAWSKI: The modifications were moving the structure to the
corner of the property and basically reducing the dredging to just
a scoop around the float, no channel dredging.

5. Thomas D. Prokop, property located at Little Peconic
Bay Lane, Southold (West Lake), to repair exiSting dock and

FRANK KUJAWSKI: This was a violation that this board discovered
and upon inspection we found more problems with a road leading into
West Lake for launching boats and most of the work already being
done, and th~ pipe leading into West Lake.
ALBERT: Should we notify the DEC of the violations?
FRANK KUJAWSKI: Sent it on to theDEC as an incomplete application
with a copy of the violations attached to it. The major concerns
of the Trustees are: the launching ramp or road that has been
constructed to the lake, and the drainage pipe that's taking all
the roof runoff directly to the pond. Also our reco~,,endations:
remove the corrigated PVC, take all runoff to a dry well placed in
driveway, removal of gravel on roadway to creek and replant with
native shrubbery.

FRANK KUJAWSKI: When you do the dredging I'm sure it would be
better to do it at the same time. Is there a way we could
coordinate this so when the approval comes in to maintenance dredge
that this one could be done also.
MIKE MOONEY: The disturbance to the bottom would be at one time.
It's only going to be 10 ft. from the bulkhead.
FRANK KUJAWSKI: Did you get a chance to look at this?
JOHN HOLZAPFEL: Not this one, but the others there's no problem,
this is just a continuation.
ALBERT KRUPSKI: The dredging won't be done until the bulkheading
is conpleted.
FRANK KUJAWSKI: We will be up for a hearing on the others in
February and approval. This one would be only up for lead in
February unless we did~an assessment tonight.
JOHN HOLZAPFEL: Environmentally do it all at once. It's alot more
sense, but I don't know how you could do it legally.
FRANK KUJAWSKI: We have moved to assess the project Monica Kenny
and Associates as a negative declaration if we retract that motion,
or emend that motion to be Monica Kenny and all Associates and
adjacent properties.
JOHN BRED~MEYER: I'm not an attorne~ but its sounds good to a
Trustee that sits here.

WHEREAS, William Connors and Christopher Connors have
submitted an application pursuant to the Wetlands Ordinance of the
Town of Southold, Chapter 97, to construct a one family dwelling
with on site sanitary system as shown on the survey by Roderick Van
Tuyl, P.C., dated February 22, 1988, on West Drive, Southold; more
specifically designated as Tax Map No. 1000-59-5-29.3, and
WHEREAS, the Board of Trustees reviewed said application and,
pursuant to the State Environmental Quality Review Act, 6NYCRR 617,
requested and received an environmental assessment for with rider,
prepared by En-Consultants on behalf of the applicant and dated
July 23, 1987, and,
WHEREAS, The Board of Trustees made a positive determination
that the proposed project may have a significant effect on the
environment, and did declare itself Lead Agency under SEQRA~ and
revised environmental impact statement, and
WHEREAS, the Board of Trustees did review said DEIS and
supplemental information requested and received, as well as
reviewing public comments pertaining to same and held a public
hearing on the DEIS on the 17th day of November, 1988,
NOW, THEREFORE BE IT RESOLVED, that the Board of Town Trustees make
the following findings and conclusions:
1. That the subject parcel lies within flood, zone A-7 as
shown on the survey of Roderick Van TuyI, P.C., dated July 6,
1987, and amended February 22, 1988.
2. That the subject parcel contains an area of 20,000 square
feet with a front and rear width of 133.33 feet and a depth on
both sides of 150.79 feet.
3. That the applicant seeks to construct a single family
dwelling of 1,584 square feet with on site sanitary system,
driveway, and waterproof retaining walls, and grading all as
shown on the above mentioned survey dated February 22, 1988.
4. That the environmental assessment form submitted by the
applicant states the depth to the water table as 1.1 foot.
5. That the above mentioned survey shows the sanitary system
2 feet above ground water.
6. That En-Consultants, in the supplemental report to the
DEIS, admitted that 66% of the parcel is freshwater wetland
and that the remainder of the parcel contains a mix of wetland
and upland vegetation. From a personal inspection of the
parcel by the Board, it is the finding and conclusion of the
Board that greater that 66% of the parcel is freshwater
wetland.
7. That, while the applicant submitted some mitigating
measures in the DEIS, for example, pilings as a foundation and
pumpout sanitary system, these measures were rejected by the
applicant based on aesthetics and economics.
8. That the small size of the parcel, 20,000 square feet,
whichis substantially freshwater wetlands, cannot support the
proposed project with destruction of half of the wetland
area. The applicant concede the destruction of 3,000 square
feet. It is this Board's finding and conclusion that a
greater area will be destroyed, and the remaining wetlands and
groundwater will be cleared and unequivocally endangered by
the proposed sanitary system and altered rainfall run-off from
the project.
9. The Board of Town Trustees has compared and weighed the
adverse environmental impact with the social and economic
impact of the project, and finds and concludes that the
preservation of the wetland area greatly outweighs any social
and economic gains of the project, or to be gained from the
project.
NOW, THEREFORE BE IT FURTHER RESOLVED, that the Board of Town
Trustees hereby determines , pursuant to SEQRA, that the
alternative of no action be declared and the project disapproved.
In addition, the Board is mindful t~at it could request a final
environmental impact statement; however, it is the Board's
determination that to so request would be of no value to the
applicant nor to this Board considering the project, the DEIS, and

CONDITIONED NEGATIVE DECLARATION
The following action was taken by the Board of Trustees at
their regular meeting held on January 26, 1989 regarding the
following application:
Description of Action: Application of En-Consultants for Kenneth
Rock, location of property Broadwaters Road, Cutchogue, N.Y., for a
wetland permit to remove and replace 37' by 7' bulkhead section on
extreme east and west sides. Maintenance dredge basin and channel,
dimension of 170' by 25', maximum depth 4' below mean low water.
Remove approximately 300 cubic yards of spoil.
RESOLVED that pursuant to Article 8 of the Environmental
Conservation Law, State Environmental Quality Review Act and 6NYCRR
Part 617t Section 617.10 and Chapter 44 of the Code of the Town of
Southold,
notice is hereby given that the Southold Town Trustees~ as Lead
Agency, have issued a Conditioned Negative Declaration based on the
following:
Due to the projects location in a Critical Environment Area, and
impacts to a potential scallop area, dredging should be limited to
within the slip area. The location of vegetated wetlands around
the slip area mandate the following modifications:
1. The 37' section on the west side should be replaced
landward of existing bulkhead with no removal of existing
bulkhead., with any backfill to be limite~to area between west
section and the slip.
2. The 7' section on the east side should not be replaced.
3. The 52' section can be replaced within 18'' but no backfill
can be used behind old bulkhead at deadmen.
4. The remaining section can be replaced within 18''
5. No machinery can operate on landward side due to the
vegetation.
