Pledge of Allegiance
Next Trustee Board meeting: Thursday, October 3, I991 at 7P.M.
Worksession: 6:00 P.M.
Next Field inspection: Thursday, September 26, 1991 at 8:00A.M.
Approve Minutes: Board to approve minutes of the special
meeting of February 8t 1991. A motion was made by TRUSTEE SMITH
and seconded by TRUSTEE TUTHILL to approve the minutes. ALL
AYES.
I. MONTHLY REPORT:
Trustee monthly report for July 1991: A check for $3,713.50 was
forwarded to the Supervisor's Office for the General Fund.
II. PUBLIC NOTICES:
Public notices are posted on the Town Clerk's Bulletin Board for
review.
III. AMENDMENTS/WAIVERS/CHANGES:
1. Gerald & Linda Weir request waiver to clear area as
outlined on survey. Located at ROW off Indian Neck Lane.
This request is out of Trustee jurisdiction as applied for.

2. Edward Maidel request waiver to construct a split rail
fence along the west and southerly property lines leading to and
within 10' of Great Pond. Kenny's Road, Southold.
A motion was made by TRUSTEE B~DEMEYER and seconded by TRUSTEE
KRUPSKI to grant a waiver to build a fence as applied for~ ALL
AYES.
3. Henry Smith request amendment to move two spiles ten feet
to the South. A motion was made by TRUSTEE TUTHILL and seconded
by TRUSTEE KRUPSKI to approve amendment. TRUSTEE SMITH
ABSTAINS. AYES: Tuthill, Krupski, Bednoski, Bredemeyer.
4. Land Use on behalf of Mark and Lisa Davis'request waiver to
build a one family dwelling located off Peconic Bay Bl~d.,
Mattituck. Applicant has Planning Board approval subject to DEC
approval. They have verbal O.K. from DEC with conditions of
drywells and buffer as shown on map.
A motion was made by TRUSTEE SMITH and seconded by TRUSTEE
TUTHILL to deny waiver and request a full permit. Board has
full permit and will put on Assessments. ALL AYES.
5. Peconic Associates on behalf of Brick Cove Marina request
a waiver of the Town Wetlands ordinance 97-21-J empowering the
Town Trustees to grant waivers under section 97-221
A motion was made by TRUSTEE KRUPSKI and seconded by TRUSTEE
SMITH to grant waiver. ALL AYES.
6. Thomas Gralton request to table his application for a
dock until November 14th regular meeting.
A motion was made by TRUSTEE BEDNOSKI and seconded by TRUSTEE
SMITH to grant request. Abstain: Trustee Krupski, Ayes:
Bredemeyer, Bednoski, Smith, Tuthill.
IV. PUBLIC HEARINGS:
THIS IS PUBLIC HEARING IN THE MATTER OF THE FOLLOWING
APPLICATIONS FOR PERMITS UNDER THE WETLANDS ORDINANCE OF THE
TOWN OF SOUTHOLD. I HAVE AN AFFIDAVIT OF PUBLICATION FROM THE
SUFFOLK TIMES AND AN AFFIDAVIT' OF PUBLICATION FROM THE LONG
ISLAND TRAVELER-WATCHMAN. PERTINENT CORRESPONDENCE MAY BE READ
PRIOR TO ASKING FOR COMMENTS FROM THE PUBLIC.
7:15 P.M. - In the matter of John Geideman on behalf of Ail
Cardinale to construct 95' catwalk (3.5' above grade) 3' X 12'
ramp, 6' X 20' float on James Creek. Lot #2 of subdivision.
The CAC has voted to approve this with suggestions. CAC
suggest on Lot 92 that the applicant extend the walk and send
the ramp from the catwalk to the float and eliminate the
stairs. Is there anyone here who wishes to speak for this
application? At this time I will take a motion to close the
hearing in this matter.
A motion was made by TRUSTEE BEDNOSKI and seconded by TRUSTEE
KRUPSKI to close the public hearing. ALL AYES.

A motion was made by TRUSTEE SMITH and seconded by TRUSTEE
KRUPSKI to approve this application as per the CAC's
recommendations ~bove. ALL AYES.
7:16 P.M. - In the matter of Costello Marine on behalf of J.E.
Valk request permit to replace within 18" 16' existing
bulkhead & return. Fill with approx. 60 yds. Clean fill
from upland source. Deck & boardwalk to be removed and replaced
after bulkhead is constructed. No expansion to existing
structures. Located at 9680 Nassau Point Road, Cutchogue. Is
there anyone here who wishes to speak on behalf of this
application? There being none, I will take a motion to close
the hearing.
A motion was made by TRUSTEE SMITH and seconded by TRUSTEE
KRUPSKI to close the public hearing. Abstain: Trustee
Bredemeyer; Ayes:Smith, Krupski, Bednoski, Tuthitl.
A motion was made by TRUSTEE BEDNOSKI and seconded by TRUSTEE
KRUPSKI to approve application. Abstain: Bredemeyer; Ayes:
Smith, Krupski, Bednoski, Tuthill.
7:17 P.M. - In the matter of Eh-COnsultants on behalf of Larry
Blessinger request permit to construct a 4' X 4' platform
immediately landward of crest of bluff; 4' X 24' stairway; 4' X
16' hinged ramp; 6' X 10' inner float and 6' X 60' outer"T"
floats. Floats will be secured by a total of 7 pilings. Located
ROW off Westphalia, Mattituck. The CAC voted to approve
this matter. Is there anyone here who wishes to speak on behalf
of this application? Anyone wish to speak against this
application? There being none do the Trustees have comment on
this application?
TRUSTEE SMITH: I make a motion we close the hearing in this
matter.
TRUSTEE TUTHILL: Second. ALL AYES.
TRUSTEE SMITH: I make a motion that we grant this permit.
TRUSTEE TUTHILL: Second. ALL AYES.
7:18 P.M. - In the matter of Eh-Consultants on behalf of Gerald
Yellen permit to construct a timber dock consisting of a 4' X
105' '(including 15' inclined section on south side) fixed
elevated walkway (4' above grade~of marsh); 3' X 16' hinged
ramp; 6' X 10' float and 6' X 30' float in "L" configuration.
Floats will be secured by (3) sets of 2 pile dolphins. Located
at 935 Meday. Ave., Mattituck. We do not have c~Lu.~nts from
the CAC in this matter. Is there anyone here who wishes to
speak on behalf of this application? Anyone here who wishes to
speak against this application?
TRUSTEE KRUPSKI: We would like to request of the applicant that
the area being mowed for recreation purposes, not to be mowed
any more.
TRUSTEE BREDEMEYER: O.K. Any additional coLL~,ents from the Board

V. LEAD AGENCY:

improve, modernize, and enlarge existing marina (138 slips).
Improvement ot include a more efficient slip layout a~d the
addition of environmental improvements that include pump-out
station, interception of stormwater runoff, landscaping,
dredging of approximately 2900 cubic yards of material from the
shoal areas and the relocation of an existing septic system 100
feet landward of mean high~water. Located Sage Boulevard,
Southold.
After t~e following (attached) letters where read for the record
a motion was made by TRUSTEE KRUPSKI and seconded by TRUSTEE
TUTHILL to send the letters to the appropriate agencies; Dept.
of Health, DEC-Stony Brook, DEC-Albany, Army Corp. ALL AYES.
After coordinating with all agency a motion was made by TRUSTEE
BREDEMEYER and seconded by TRUSTEE KRUPSKI to assume Lead
Agency. (see attached resolution) ALL AYES.

Resolution - Special Meeting
Southold Board of Trustees
Whereas, the Southold Board of Trustees accepted lead
agency status for the action known as Brick Cove Marina on
September 5, 1991, and
Whereas the State Environmental Quality Revi&w Act
(SEQRA) provides that the lead agency shall determine the
significance of the action within 20 calender days of its
establishment as lead agency, or within 20 calender days of
its receipt of all information it may reasonably need to
make a determination, and
Whereas, other involved agencies have not submitted
information reasonably needed to determine the significance
of the proposed action, and
Whereas, the Trustees are able to convene on September
26, 19.91 to determine the significance of the action; now be
it
Resolved, that the Southold Board of Trustees shall
convene in a special meeting on September 26, 1991 at 7:00
pm in Town Hall to determine the significance of the action
known as Brick Cove Marina in the absence of additional
information it may reasonably need to make such
determination; and be it further
Resolved, that notification of the special meeting be
published in the Town designated local papers, and be it
further
Resolved~that this resolution take effect immediately.

Resolution - Lead Agency Designation_
Whereas, an application for wetlands permit was
submitted by Peconic Associates, Inc. on behalf of SOuthold
Bay Associates for an action known as Brick Cove Marina on
July 29, 1991; and
Whereas, the application was deemed complete by the
Southold Board of Trustees on August 1, 1991; and
Whereas, the application was coordinated by the
Southold Board of Trustees to all involved agencies on
August 6, 1991; and
Whereas, none of the involved agencies have expressed
interest in assuming lead agency for the action known as
Brick Cove Marina; and
Whereas, there is familiarity with the site and
application among the Southold Board of Trustees; no~ be it
Resolved, that the Southold Board of Trustees hereby
assume lead agency status for the action known as Brick Cove
Marina, and be it further
Resolved, that this resolution tare effect immediately.

On September 5, 1991 the Southold Town Trustees declared Lead
Agency in the matter of:
Peconic Associates on behalf of Brick Cove Marina to improve,
modernize, and enlarge existing marina (138 slips). Improvement
to include a more efficient slip layout and the addition of
environmental improvements that include pump-out station,
interception of stormwater runoff, landscaping, dredging of
approximately 2900 cubic yards of material from the shoal areas
and the relocation of an existing septic system 100 feet
landward of mean high water.
The Southold Town Trustees in continuing our review under
S.E.Q.R.A. will be taking comments on this proposal until
September 26, 1991.

contacted you by letter on August 6, 1991 stating the
Board's interest in assuming lead agency pursuant to SEQRA
in the matter of Brick Cove Marina.
Description of Action: Improve, modernize, and enlarge
existing marina (138 slips). Improvement to include a more
efficient slip layout and the addition of environmental
improvements that include pump-out station, interception of
stormwater runoff, landscaping, dredging of approximately
2900 cubic yards of material from the shoal areas and the
relocation of an existing septic system 100 feet landward of
mean high water.
We are aware that the Army Corps of Engineers has
already granted a permit for this project (Permit # 15516,
November 1, 1989). In the absence of comments received from
your agency regarding lead agency designation we can only
conclude that your agency has no objection to the Southold
Board of Trustees assuming lead agency in the above
described project. However, you may submit any comments or
concerns you may have in writing up to September 2~, 1991.
Any comments received from you agency will be considered and
incorporated into our environmental assessment of the
proposed project.

Whereas on September 5, 1991 Peconic Associates, Inc. on behalf
of Southold Associates for the action known as Brick Cove Marina
has requested a waiver of the Town Wetlands Ordinance 97-21-J
empowering the Town Trustees to grant waivers; and
Whereas the applicant has received prior site plan approval for
a project similar to this proposal from the Planning Board; and
Whereas the applicant has indicated in writing their intention
to re-submit to the Planning Board for site plan approval.
Therefore be it Resolved that the Southold Town Board of
Trustees approve a waiver under Chapter 97-21-J pursuant to
Chapter 97-22 of the Town Code.

SUBJECT: Request for Waiver - Chapter 97 21J
Dear Members of the Board:
Re: Application Brick Cove Marina Dated July 29, 1991.
Request a waiver of the above referenced paragraph of the
Southold Town Code because of its conflict with 6 NYCRR,
Part 617, State Environmental Quality Review Act
specificalIy regarding the required Site Plan approval of
the Southold Town Planning Board.
It is the Applicant's intent, in accordance with the Supreme
Court of Suffolk County's decision that after the
coordinated Environmental Assessment is complete, that there
will be a Site Plan submitted to the Planning Board that
will be substantially similar to the Site Plan now being
reviewed by your Board.

VI. ASSESSMENTS/ENVIRONMENTAL DECLARATIONS:
1. John Geideman on behalf of Pauline Israel to construct a
4' X 12' catwalk, 3' X 10' ramp, 6' X 20' float. Located at
Osprey Nest Road, Greenport.
A motion was made by TRUSTEE BREDEMEYER and seconded by TRUSTEE
KRUPSKI to grant a negative declaration. ALL AYES.
2. En-Consultants on behalf of George Koch to repair an
existing timber bulkhead return and extend landward to overall
length of 30'. A 4' - wide walk landward of bulkhead will also
be repaired/replaced and extended. Approx. 100 c.y. of clean
sand will be trucked in for backfilling bulkhead. Located at
530 Schooner Drive, Southold. ~
A motion was made by TRUSTEE BEDNOSKI and seconded by TRUSTEE
SMITH to table this application until CAC comments are
received. ALL AYES.
3. En-Consultants on behalf of Pat Calagiuri to install from
an existing bulkhead, a 3' X 12' hinged ramp leading to a 6' X
30' float. Float will be secured by (.2) sets of 2 pile
dolphins. Located at Bungalow Lane, MattituCk.
A motion was made by TRUSTEE SMITH and seconded by TRUSTEE
KRUPSKI to grant a negative declaration. ALL AYES.
4. Costello Marine on behalf of Dorothy Northridge to
replace e deteriorated bulkhead, in-kind/in-place, (62'),
construct new bulkhead 58' and 10' return attaching to existing
bulkhead. Install 3 support batter piles to existing bulkhead.
30 c.y. of clean backfill.. Located at 625 South Drive,
Mattituck.
Bulkhead will hug toe of bluff. In line with existing bulkhead.
A motion was made by TRUSTEE KRUPSKI and seconded by TRUSTEE
BEDNOSKI to grant a negative declaration with the stipulation
that revised survey showing bulkhead hugging toe of bluff prior
to the public hearing. Abstain: Trustee Bredemeyer; AYES:
Krupski, Bednoski, Smith, Tuthill.
5. Mark & Lisa Davis to construct one family dwelling. See #4
on Waivers.
A motion was made by TRUSTEE SMITH and seconded by TRUSTEE
TUTHILL to grant a negative declaration. ALL AYES.
VII. RESOLUTIONS:
1. Board to set public hearing for the October 3rd'regular
meeting forJthose items that received negative declaration at
this meeting.
A motion was made by TRUSTEE SMITH and seconded by TRUSTEE
KRUPSKI to set public hearings.
2. Board to review the revised ma dated August 2, 1991 in the
matter of Land Use Co. on behalf of Corey Creek Association.

1991.
After discussion a motion was made by TRUSTEE BEDNOSKI and and
seconded by TRUSTEE KRUPSKI to accept revised map dated August
2, 1991. ALL AYES.
A motion was made by TRUSTEE KRUPSKI and seconded by TRUSTEE
BREDEMEYER to set a public hearing in this matter on October 3,
1991. (Note: This public hearing will be held prior to
concluding SEQRA). ALL AYES.
3. Board to set September 26, 1991 at 7:00 P.M., worksession
at 6:00 P.M. for a Special Meeting.
A motion was made by TRUSTEE KRUPSKI and seconded by TRUSTEE
BREDEMEYER to set this meeting. ALL AYES. ~-
4. Argenteri/Egan located off Mattituck Creek. (Added on

made by TRUSTEE BREDEMEYER and seconded byTRUSTEE KRUPSKI to
suspend permit 01602 and all prior amendment to this permit
until the September 26, regular meeting so the all parties can
work this out. ALL AYES.
5. Panagoitis Gazouleas Board to approve amendment to
the application by accepting the planting survey.
A motion was made by TRUSTEE BREDEMEYER and seconded by TRUSTEE
BEDNOSKI. ALL AYES.
6. Brick Cove Marina - A motion was made by TRUSTEE BREDEMEYER
and seconded by TRUSTEE KRUPSKI to set a special meeting for
9-26-91, 7 P.M. (see attached resolution) ALL AYES.
VII. MOORINGS:
1. Anthony Pagoto request mooring for a 17' Boston Whaler
with 150 lb. mushroom in Wunneweta Pond. Access: ROW off
Wunneweta Road, Nassau Point.
A motion was made by TRUSTEE B~EMEYER and seconded by TRUSTEE
SMITH to approve mooring. Abstain:-Trustee Krupski; Ayes:
Bredemeyer, Bednoski, Smith, Tuthill.
2. Nancy & Steve Romeo request mooring for a 22' Pursuit with
a 100lb mushroom in Mattituck Creek. Access: Browers Woods
Association Property.
A motion was made by TRUSTEE SMITH and seconded by TRUSTEE
KRUPSKI to approve this mooring. ALL AYES.
3. William & Helen Childs request 2 sets of Onshore/offshore
stakes in Brushes Creek.
A motion was made by TRUSTEE BREDEMEYER and seconded by TRUSTEE
KRUPSKI to approve one (I) onshore/offshore stake. At the time
of resolving the neighboring fashion of the stakes, ~Childs
will be granted a second stake. ALL AYES.
4. John Cushman request permit for Duck Blind in West Creek.
Board of Trustees 7 September 5, 1991
A motion was made by TRUSTEE SMITH and seconded by TRUSTEE
BREDEMEYER to table this application until Mr. Cushman can get
a letter of approval of the Mr. Wickham the adjacent property
owner. ALL AYES.
5. Jim McMahon request permit for Duck Blind in Down's Creek.
A motion was made by TRUSTEE KRUPSKI and seconded by TRUSTEE
SMITH to grant approval for the duck blind. ALL AYES.
