PROPERTY LOCATION: 6429 Indian Neck Lane, Peconic CTM 86-6-23 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 31, 2007 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: A Letter confirming inconsistency was submitted to the Board of Appeals under Chapter 95, Waterfront Consistency Review of the Town of Southold Code and Local Waterfront Revitalization Program (LWRP) standards. A report from the Suffolk County Soil and Water District Technician Polly Weigand dated November 14, 2007 noted that the bulkhead is in structurally sound condition, but regular inspections and repairs should be made to maintain stability. The LWRP Report dated November 1, 2007 notes the house as being located in Flood Zone AE8. Grant of relief as applied for in this variance application can be mitigated by following the recommendations of the Suffolk County Soil and Water Conservation District and the Town LWRP Coordinator which include: the installation of drywells at the terminus of the gutters and leaders on the dwelling, the installation of hay bales/silt fencing during construction to prevent sediment loading into Richmond Creek, and the planting of a non-turf, native vegetation buffer landward of the bulkhead to protect Richmond Creek or as an alternative, maintaining turf grass but limiting the use of irrigation and fertilizer to prevent damage to the bulkhead and pollution of the creek. PROPERTY FACTS/DESCRIPTION: The applicant's 12 June 2006 survey prepared by Stanley J. Isaksen Jr. shows 6,615 square feet of land area, 50 feet wide by 136.64 feet deep along the westerly lot line, and an existing single-story residence with attached garage situated 30.6 feet from the bulkhead adjacent to Richmond Creek, 5.6 feet from the easterly property line, and 6.3 feet from the westerly lot, at its closest points. The applicant also owns County Tax Map (CTM) Lot 23 in Block 6, upon which exists an accessory building, also shown on the applicant's 12 June 2006 survey. Page 2—December 6, 2007 ZBA File#6086—Roy W. Argent CTM 86-6-23 BASIS OF APPLICATION: Request for Variances under Sections 280-122 and 280-116B, based on the Building Inspector's September 10, 2007 Notice of Disapproval concerning a proposed new dwelling, after substantial demolition of the existing building. In the event the applicant further deterioration of the portion of the foundation that he plans to retain, the applicant also requests demolition of this remaining portion, for total reconstruction of the dwelling in kind, in place, proposed by applicant without a reduction of the same nonconforming setbacks that exists for the current dwelling footprint. AREA VARIANCE RELIEF REQUESTED: The applicant is requesting relief concerning new construction which will be within the same nonconforming footprint and less than the code-required minimum of 35 feet from the rear lot line, less than 75 feet from the bulkhead, less than 10 feet on a single side yard, and less than 25 feet total side yard setbacks. ADDITIONAL INFORMATION: The applicant's 6,615 square foot non-conforming lot in the R40 District is very narrow and deep at 50' x 136.64' which is typical of lots in this area that were improved in the 1940's with summer cottages. The applicant's waterfront lot is reached from Indian Neck Road though an earth-base driveway adjacent to the westerly property line that passes two other lots, all previously owned by the applicant. The street-side property (CTM lot 23) contains an accessory garage that is used by the applicant (granted with conditions under ZBA#4987). The middle parcel (CTM 22) was sold and is improved with a single-family dwelling. The applicant has an existing asphalt driveway on his property with an existing cesspool to the west. The existing dwelling is 30.6 feet for a rear yard setback where the code requires a minimum rear yard of 35 feet, a single side yard setback of 5.6' where the code requires 10', and a total side yard setback of 12' where the code requires 25'. The setback from the bulkhead also is 30.6' at the closest point where the code requires 75 feet. The applicant proposes to demolish the existing dwelling on the subject premises which is structurally unsound, in general disrepair and contaminated with excessive mold, and replace it in kind with a new dwelling, with modifications to roof pitches at a proposed 27' 0" height. The current attached garage will be converted to living space in the new dwelling. The applicant states that he wishes to maintain the footprint of the existing foundation, which is currently a partial full basement and partly a crawl space. To bring the foundation to code, repairs will be made to the existing block foundation of the old cellar as needed, and the crawlspace portion will be excavated an additional 3' deeper to create basement storage at full height. The entire foundation will be raised an additional 8" above grade from 10.9' to 11' which will place the new first floor at or above the minimum FEMA requirements for a flood plain. A new covered open porch entrance with railing is proposed on the front elevation, in line with the existing elevation, in the location of the setback of the existing attached garage. These details are shown on an undated set of plans drawn and submitted by the applicant Roy Argent (formerly owner-contractor of Argent Homes and now retired). It is further noted, however, that in the event replacement of the only remaining portion of the foundation that applicant is trying to maintain is necessary, that in-place reconstruction is authorized using the same building footprint which now exists. Argent CTM 86-6-23 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law §267-b(3)(b)(3)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The current modest one-story dwelling has been on the property since the 1940's and is in disrepair. It will be replaced with a new single-family home on the same footprint, with only minor modifications that will improve the property and the neighborhood. There were no objections from neighbors received in writing or expressed at the public hearing. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance, since all current setbacks are pre- existing non-conforming, and the lot is too narrow to permit the construction of a modest home without non-conforming side yard setbacks being maintained. The current house and foundation were sited (prior to 1957) at an angle to the side yard property lines and parallel to the creek. The neighbor to the west is located at considerable distance from the shared property line, and there are no obstructions to accessing the Creek. Removing the existing foundation and building a new one that is parallel to the property line could increase the applicant's westerly side yard setback to 8' which would permit access by emergency equipment on the applicant's property. However, the house would then be at an unnatural angle to the Creek, and filling in and excavating a new foundation would cause substantially greater land disturbance near the bulkhead and disrupt the existing sewer line to the dwelling, both at considerably greater expense to the applicant. Moving the proposed new dwelling landward of its current footprint to create a more conforming setback to the bulkhead would require building over the existing cesspool and the neighbor's well. 3. Town Law §267-b(3)(b)(3). The variances granted herein are substantial but reasonable given all the other circumstances described herein. 4. Town Law §267-b(3)(b)(5). The difficulty has not been self-created, but it the result of the original location of the house, wells and cesspool as described herein. 5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Should the applicant's bulkhead require maintenance and repairs, Roy Argent, the representative for the applicant, testified at public hearing that equipment could be brought in by barge on Richmond Creek, thus providing access without adverse impact on the land between the house and bulkhead, or the westerly neighbor's property. 6. Grant of the relief as applied for is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new replacement dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. • Page 4—December 6, 2007 ZBA File#6086—Roy W. Argent CTM 86-6-23 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for and shown on the set of plans and elevations drawn and submitted by Roy Argent, contractor (retired) of Argent Homes, undated, and the site survey by Stanley J. Isaksen Jr., Licensed Land Surveyor, dated 12 June 2006, updated 04 Sept 2007, and notes by the applicant clarifying possible rebuild/demolish areas, subject to the following Conditions: 1. Gutters and leaders must be installed on the dwelling. 2. Drywells must be installed to contain roof and groundwater runoff away the bulkhead. 3. Hay bales/silt fencing must be installed during construction to prevent sediment loading into Richmond Creek. 4. A non-turf, native vegetation buffer landward of the bulkhead must be planted to protect Richmond Creek, or as an alternative, turf grass is acceptable if the use of irrigation and fertilizer is limited to prevent damage to the bulkhead and pollution of the creek. 5. Applicant agrees to inspect and repair the bulkhead as necessary according to the recommendations outlined in the Report from Soil Technician Polly Weigand dated November 14, 2007. The above conditions shall be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The following are the observations and recommendations reflective of the site visit. Observations: The house is sited 30 feet from Richmond Creek(Photol). The immediate house lot gently slopes towards the creek and the house is not entirely fitted with gutters, downspouts or drywells(Photo 1, 2, 12&13). A fully grassed lawn exists between the rear of the house and the Creek(Photo 1 &2). A bulkhead and stairway have been installed on the shoreline and appear to be in stable condition(Photo 1- 11). Repairs to the top of the bulkhead appear to have been recently made and can been seen in Photo 3. A small sinkhole exists on the western side of the bulkhead and the tie backs are exposed at this location(Photo 11). The top and face boards(stayers and stringers)of the bulkhead appear tight and from the front of the bulkhead do not appear to be losing sediment through the boards(Photo 4). On the eastern edge of the property, near the stairway, a small sandy beach vegetated with Spartina exists. This area is currently in stabile condition and little shoreline erosion is occurring(Photo 5-7). On the western edge of the property, sand has been scoured away from in front of the bulkhead and water is in contact with the bulkhead. The corner of the bulkhead (on the western side) cuts perpendicularly into the shoreline. At this location,the bulkhead is abutted by what appears to be a dilapidated concrete boat launch/access point (Photo 8-11). 423 GRIFFING AVENUE SUITE 110 RIVERHEAD, NY 11901 • • Recommendations: The bulkhead on this property is protecting the shoreline from erosion and in turn, protecting the structures located behind it. Therefore, the bulkhead should be kept in good functioning condition in order to maintain best protection for the structures behind the bulkhead. As noted in the observations, the bulkhead is in structurally sound condition, however to maintain such stability the following inspections and repairs should be made. First, the cause of the small sink hole found on the backside of the bulkhead should be investigated. This hole can indicate that sediment is escaping from behind the bulkhead either from undermining of the toe or that the face boards are decaying. Both cases cause sediment to be pulled from behind the bulkhead and are the primary causes of bulkhead failure. Inspection of the base of the bulkhead and face boards should be conducted at low tide to determine the condition of the bulkhead. On the day of the site visit, the tide prevented such inspection. If any boards are found to be decaying, allowing sediment to escape between the boards, or if the bulkhead is being under cut at the toe, repairs should be made as soon as possible to prevent further damage. The decaying boards should be replaced and any holes behind the bulkhead should be filled will soil. If the toe of the bulkhead and face are found in good condition, then it is recommended that the small sink hole be filled with soil, vegetated with grass seed, and monitored. In addition to the toe and the face of the bulkhead, the corners of the bulkhead are also easily compromised as water can wash behind these areas pulling sediment with it at it recedes. The northwest corner should especially be inspected regularly for structurally stability. The concrete foundation which it abuts is very degraded and unstable and poises a potential to cause instability at this corner. Regular inspections and maintenance are critical to prolonging the life of the bulkhead, protecting the house behind it and reducing the costs involved in repair/replacement. This has already been instigated with the replacement to the top board of the bulkhead. Such activities are further encouraged in order to continue to maintain a structurally sound bulkhead. 1. All wooden boards and supports should be free of decay. Any decayed boards should be replaced. 2. No sediment should be eroding from the base of the bulkhead or through the face. All boards should be tightly fitted together without gaps. i , . • III 3. Holes behind the bulkhead should be filled and revegetated. 4. A buffer of vegetation (ideally beach grass, Spartina patens, Coastal Panic grass) should be maintained on top of the bulkhead. However at this location maintaining turf grass is acceptable, however irrigation and fertilizer use should be limited to prevent damage to bulkhead and pollution of Richmond Creek. 5. Geotextile should be maintained between the bulkhead and soil on the backside of the structure. The lack of geotextile in combination with wave action will pull sediment through the structure and eventually cause collapse and failure. It is unknown if geotextile has been installed at this location. It should not be retroactively installed on the bulkhead unless major repairs or reconstruction are necessary. The ground disturbance activity involved in installing geotextile would exceed all the benefits of installing retroactively. 6. Prevent surface water from flowing over the top of the bulkhead. Such activity threatens to erode sediment from behind the bulkhead compromising the structure and causing nutrient and sediment pollution in the associated water body. Water can be diverted by implementing diversions, buffers, reducing irrigation, or installing gutters, downspouts and drywells on the building. At this site efforts to protect the bulkhead from erosion should include installing complete gutters, downspouts and drywells on the house. Such installation is important at this location as the lawn slopes towards the bulkhead. Therefore, runoff has the potential to travel to the bulkhead and cause erosion behind it. Discharging roof runoff into the ground compensates for the impermeable surfaces of the roof and prevents runoff from impacting the bulkhead. Lastly, the installation of silt fencing should be installed at this site as ground disturbing activities are slated within with in reach of surface waters. Such fencing will help prevent sediment loading into Richmond Creek during construction. Enclosed is a diagram documenting the appropriate installation of silt fencing. It is encouraged that inspection of this silt fencing after installation is encouraged to ensure correct installation. More times than not, silt fencing is installed incorrectly and therefore fails to protect the water body from sediment pollution. Location of Property: 6425 Indian Neck Lane, Peconic 1000-86-6-21 Date of Public Hearing: September 20, 2001 FINDINGS OF FACT- .PROPERTY FACTS: The subject property (hereinafter called Lot 21) is an unimproved lot in Peconic, 50 feet wide and with average depth of 224 feet, for a total area of 11,214.24 sq. ft. There are two metal sheds and a frame shed at the north end of the lot. A dirt lane crosses-Lot 21 giving access to two interior lots: SCTM 1000-86-6-22, immediately to the north (Lot 22) and SCTM 1000-85-6-23, further north (Lot 23). BASIS OF APPEAL: Building Department Notice of Disapproval, dated October 31, 2000, denying a permit to build a garage/storage building on Lot 21 because such a structure is not a permitted primary use under Code section 100-31A. RELIEF REQUESTED: Applicant requests Board action regarding a new garage/storage building on Lot 21 accessory and incidental to the applicant's residence on Lot 23, Block 6. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. Applicant also owns Lot 23, which is separated from his Lot 21, by Lot 22. His house is on Lot 23, but applicant states that there is insufficient room there for a needed garage/storage building. Therefore, he wishes to erect the building on Lot 21. 2. If applicant were to build a dwelling on Lot 21, the garage/storage building would be a permitted accessory use. However, applicant has no need for such a dwelling and no desire to build one. Applicant wants to treat Lot 21 effectively as part of Lot 23 and build on it a structure accessory to his dwelling on Lot 23. 3. A dirt lane from Indian Neck Lane runs across Lot 21 to give access to Lots 22 and 23. Although this lane connects Lots 21 and 23, they are not contiguous. 4. Applicant's situation is very unusual. Without relief, he will have a vacant parcel (Lot 21) serving no purpose, and he will remain without a garage. The Board desires to enable him to construct the garage/storage building as, in effect, an accessory to his dwelling on Lot 23.
